Yesterday was another major day for the US Supreme Court as they released a series of major headline decisions at the end of this Supreme Court term. First off, on a very closely watched case about trans athletes breaking a 6:3 Supreme Court upholds bans on transgender athletes participating in women's and girls sports in West Virginia and Idaho, saying the laws don't violate the 14th Amendment or Title 9 SCOTUS. Liberals dissent. Now, this is just the latest in a number of challenges that have made it to the Supreme Court about the issue of biological males being allowed to compete in women's sports. And one key part of this discussion was the fact that 27 states have passed laws protecting women's sports. And that's a key factor that played into the Supreme Court's decision in this ruling. But I want to read a couple highlights. First from Justice Thomas. Men and boys with gender dysphoria are not women or girls, even if they believe they are. Sex is an immutable biological characteristic. It is binary. And man and woman, boy and girl are the terms that correspond to adults and children of each sex. And as Justice Kavanaugh noted in the opinion, whether biological males may participate on women's and girls sports teams may be a debated policy question. But the legal question for Title IX purposes is whether West Virginia may limit women's and girls sports teams to biological females. As a matter of text and history, West Virginia may do so. And as Kerry Severino noted, as both a girl dad and a girls basketball coach, it's fitting that Coach Kavanaugh writes the majority opinion protecting girls sports. And here's a picture of Senator Hatch, who I worked for at the time, meeting Justice Kavanaugh's basketball team then. And here's a picture of me taking that picture from C Span. Another major decision had to do with spending and campaigns. This from Americans for Public trust breaking. In a 6, 3 decision, the U.S. supreme Court struck down federal limits on coordinated campaign spending between political parties and candidates, holding the restrictions violate the First Amendment in NRSC versus fec. Now, this had been a complaint from largely left wing activists like Mark Elias, who had wanted to pass limits on how much parties could spend in elections so that they could empower the left wing dark money constellation that funded a lot of the Democrat campaigns. This is a major win for free speech. But as Justice Kavanaugh noted, this doesn't just apply to Republicans or Democrats. The Court's decision today treats all political parties equally. It will allow all political parties, including the DNC and RNC in the respective Senate and House campaign committees, as well as other parties and party committees, to participate more freely and compete more closely with their candidates. The banner decision of the day was on President Trump's executive order banning birthright citizenship, in which the Supreme Court cited 6 to 3 against President Trump's order. And what was notable about this is the justices went far enough to answer the constitutional question about whether birthright citizenship is constitutional.

Almost exactly what Justice Kavanaugh himself wrote in his partial concurrence, partial dissent. He said the 14th Amendment actually doesn't get there, but the statute does. I think that would have been a better route if the court was going to go there to say, hey, the statute says this, that means Congress would have been able to change it. Unfortunately, with this decision, we have the bare majority, five justices, saying that the 14th Amendment codifies this expansive notion of citizenship.

So as Kerry Severino just highlighted, that majority on the constitutional question means this isn't an issue that Congress itself can fix. This can only be adjusted through a constitutional amendment, which is a much more complicated process. And this court had a lot of disagreement on the issue. There was a lot of sort of historical discussion about what the founders intended when they wrote the constitution. What the 14th amendment was really was put in place to do things like that. I wanna read just a point from Justice Thomas dissent today. The Court does so again by recognizing a constitutional right to citizenship for the children of all foreign birth, tourists and illegal aliens. I'm not sure that today's opinion will stand the test of time. The citizenship clause added greatly to the dignity and glory of American citizenship. Today's opinion devalues that citizenship. I respectfully dissent. Now, Justice Alito asked a lot of questions during the oral arguments about birth tourism and this idea that has been out for the last several years of China having nationals come to United States and be born so they could automatically be citizens. And he raised questions about what it means that adversaries to the United States are able to essentially build up armies of American citizens that are also Chinese nationals that have Chinese parentage and are likely loyal to China. President Trump has said he does not believe a constitutional amendment is required. And some senators have also talked about a potential pathway to adjust this. A key part of this going forward will be immigration and of adults before they can come in and have children here, things like the border wall, deportations, there's gonna be a lot more conversation about that to avoid this larger problem. But it's also important to note, Pew found that in 2023, 9% of all new births were two non citizens. That is a crazy statistic. And it is one of the reasons President Trump and others have pointed out no other countries around the world recognize this right to birthright citizenship that the Supreme Court has codified today. For today's Waste Wednesday segment, we are going back to the runaway tax exempt hospital system. You know, this is something I have been very passionate about because it drives me crazy that we're spending billions of dollars to make healthcare cheaper for poor people. And Democrats always say we don't spend enough on health care. And yet we find these tax exempt hospitals are spending so much of that money on everything but health care. Save Our States has a new campaign highlighting that America's tax exempt hospitals have blitz glam and exorbitant executive salaries subsidized by you, the taxpayer. So this is just the latest in a series of campaigns from Save Our States calling out the waste, fraud and abuse in the tax exempt hospital system. They also released with this TV ad, a 14 hospital report outlining some of the glitz and glam of tax exempt hospital taxpayers. And policymakers need to know where the money goes, especially when dollars meant for health care wind up paying for overseas investments, elite club memberships, art collections, or sexual harassment lawsuit settlements. In this report, you'll find things like Rush University Medical center, who paid a CEO an exorbitant salary, but also paid for things like his expensive social club memberships around Chicago. With our tax dollars, you'll hear about tons of things like hospitals paying for super bowl ads, major rebrand campaigns. And as we read there from that outline, sexual harassment settlements, things like that, all covered with our tax dollars. So again, if you're looking for waste, fraud and abuse that is making the system work worse for people, this report has a lot of good nuggets to dig into and Save Our States also sent a letter to Vice President J.D. vance, who is operating the administration's fraud squad, as we call them, trying to root this out around the federal government. We highlighted one person from France who talked about how amazing air conditioning is. Well, fast forward one week and that issue is the subject of a major debate going on right now. Europe finds itself in a very high temperature heat wave and because of their regulations against air conditioning and the general stigma they've created politically around air conditioning, more than 1400 people have died due to heat exhaustion across Europe. Now this has led to a really interesting conversation about air conditioning. The deputy mayor of Paris said this Dear American journalists and social media influencers, for days some of you have been criticizing and making fun of Paris because the city does not have AC in every room. Omg this is so rich. As the second largest emitter of greenhouse gas emissions in the world, you bear a significant amount of responsibility for global global warming and the consequences we in France are experiencing. Your cities, which are 90% air conditioned, are not unrelated to this man alive. First off, in that same article, it quotes World Weather Attribution. Now this is an organization that is cited in just about every media report in the world, every time there's any kind of weather event to say this was caused by climate change. And as we have talked about before, World Weather Attribution has been widely debunked because they've acknowledged their work is not peer reviewed, they don't go through a normal research process, and as they say on their own FAQ on their website, they rush their research to get it into media while they're still talking about a storm. If there's a tornado, they don't want their research to come months after the normal scientific process would require. They want it in there so that when people are talking about this tornado, they can say climate change did this, whether or not they can prove it with any kind of science. And this is now what Paris and France have built their entire sentiment around air conditioning. The life saving technology that could have prevented over a thousand deaths just in France in these last few weeks from happening. And this tweet from France really I think seals it. This is from French Response, the official response account of the French Ministry of Foreign Affairs. They say we're not banning ac, we're making sure future summers need it less. Making sure future summers need it less is a fascinating thing to say. France has documented heat waves for hundreds and hundreds of years. Going back. I don't know what France has in mind to change their trajectory of heat ever happening there. Maybe they're going to blow up some giant croissants to block out the sun to keep temperatures down. But it's not real. But it is real if you happen to believe all of the non scientific world weather attribution nonsense that they're talking about. But in the rest of Europe it's similar. Similarly, a weird sort of high class problem. For example, the European Commission literally shut off air conditioning, but only for floors one through seven where people of lower rank work. The European Commission's headquarters was forced to shut down its air conditioning system on Friday due to the heat wave due to extreme weather conditions, forced shutdown of air cooling system from floor one to seven for the rest of the day. The 13 story building is home to Commission President Ursula von Der Leyden, her 26 commissioners and about 3,000 staff. Von der Leyden works on the 13th floor and most of her commissioner's offices are housed on floors 8 or above. So consider again, the President of the EU Commission, Ursula von der Leyden is sitting in air conditioning on the top of her tall building. Her own staff on the lower levels have no access to air conditioning and more than 1,400 people have died across Europe while she's up there writing more regulations to make it more difficult for them to get access to these simple life saving things like air conditioning. And it's shocking to me that European leaders would see these 1400 plus deaths as an acceptable loss or a sacrifice they're willing to make to fight climate change while being completely silent on the greatest emitter in the world, China. Speaking of Europe, we've talked a lot about the anti competitive rules and regulations Europe has tried to put on American companies to level the playing field with their own complete lack of tech presence, innovation, successful companies and things like that. Well, that took another turn last week from the Wall Street Journal, Amazon Microsoft's cloud services should fall under dma. European Union says Now the European Union has constantly been trying to find ways to take American companies down a notch, as I said, to help their own companies. And this with cloud providers is just the latest from Public policy solutions. The EU's designation of Amazon and Microsoft as gatekeepers under its discriminatory DMA is another blatant assault on American innovation. Brussels thinks it can target US Trade without any consequences. America should retaliate accordingly against European companies. While the EU rakes in billions in punitive fines from our tech groups, EU service providers like Accenture, dhl, Spotify and others have long enjoyed prolific market access in the US amid the EU's attack on our tech it's time we hold European companies to the same standard. President Trump has been vocal about this imbalance, particularly as they continue trade talks with the eu. Numerous European countries have been discussing the imminent implementation of a digital services tax on American companies. Some of these countries are close to actually doing this. Please let this statement serve to represent that any country that imposes such a tax will immediately be met with a 100% tariff on any and all goods sent to the United States of America. Now in that post, President Trump's talking about digital services taxes, but he's also been very vocal about all of the broad range of protectionist policies in Europe has tried to use against America and how those moves could jeopardize these ongoing trade conversations. Perhaps Europe should spend a little bit more time on things like cracking the code to air conditioning and a little bit less trying to bilk American companies. We have talked a lot about how the Democrat Party is discussing the Democrat Socialist takeover, the Democrat Socialist coup, if you will, and the fact that many Democrat Socialists have admitted the fact that they see the Democrat Party as essentially a vehicle that to take over to use for things like ballot access and essentially wear as a skin suit. We've also talked about how a number of Democrats are having a lot of trouble navigating how they want to talk about it. Some are saying, I am uncomfortable with the antisemitism from the dsa. Some are saying, hey, we're a big tent party, even if we're focusing on one single issue, which is hating Israel. One person who had a very interesting discussion on this was former New York Mayor Bill de Blasio on Fox News earlier this week.

You'll remember when Bill de Blasio ran for President in 2020, very desperately he clung to every far left position he could find for relevance and that appears to be what's happening again. I don't know if Bill is planning on running for president again. I hope so because I thought the memes were fantastic. Come clean my roof, you monster. Your giant body will never fit in Washington D.C. but the other part that I thought was interesting was Bill de Blasio kept coming back to this idea that Zoran and other Democrat socialists are talking a lot and focusing on the issue that working families actually care about.

This has been a sort of constant point of conversation from Democrat socialist supporters. This idea that they're speaking to working class America. But that just doesn't hold up. Zoron lost working class voters and won upper class, wealthy, college educated women. We're seeing the exact same thing going on with Graham Platner in Maine. Susan Collins has a 21 point lead among non college voters, even as Graham Platner has tried to position himself throughout this entire theatrical performance as a working class hero. But the last point I want to talk about with Bill de Blasio is Dana asked him specifically what he thought about the anti Semitism issue and she asked him what he thought about Dan Goldman being chased out of a coffee shop in the same neighborhood where Bill de Blasio lives.
