Leanne, let's talk about Chief Justice Roberts, his rebuke of Donald Trump. How rare is it to hear something like that? Yeah, it's absolutely rare. Chief Justice Roberts has issued warnings before, not so directly, but just saying that the independence of the courts should be upheld and should be, you know, not admired. But, yeah, should be upheld. Forgot my word there. But this is a moment that the Trump administration and Republicans and MAGA world did not like, the fact that Chief Justice John Roberts inserted himself into this conversation. You have people who are piling on, including Elon Musk, saying, you know, sending threatening, like, messages to John Roberts and these, this is where the Trump administration thinks that so many of these cases are going to end up. And you have Stephen Miller and other Trump administration officials who are confident, who were confident that the Supreme Court is going to uphold the Trump administration in a lot of these cases once it gets there. And so part of the playbook is not only to intimidate these justices, but really make their case in the court of public opinion and get the rallying Republicans behind them in order to put pressure on these justices and these judges along the way so that they think that they can win these cases.

So this is, this is a concerted effort, is it not, to push the.

Boundaries and see what sticks and see what doesn't stick? Well, it sure is. And I look at this, Joe, on sort of two tracks. One is the political, you could call it the conventional, which is Trump is trying to sort of do government cutting. He's got somebody out there at Elon Musk who's catching a lot of flack for it. You and I know that Trump doesn't like folks who are diverting attention from him, and he certainly doesn't like them when they're not popular. And I think that will eventually seal Elon's fate. That's one track, and that's kind of the political track, which is, you know, backlash from voters leading up to a midterm. The other track, which is more sobering, is what I call the constitutional track, and that's what you're alluding to just now, and that is people around Trump, not really Trump himself, because Trump's not super sophisticated about some of these challenges. But it's the folks around Trump who, yes, want to exert Executive power to the point in which they get some kind of a blessing from the Supreme Court of the United States that they can do this, carry this out. Joe, what I find alarming is the rise in volume on the attacks on federal judges and where that could lead us. We know in this country, we have a history in this country of threats against federal judges. This is really dangerous stuff. And I think some of these comments about these federal judges being impeached or confronted is leading us to a really dark place.

Chief Justice Roberts stepped into the middle of this yesterday with I think, completely inappropriate pronouncement that essentially is giving sustenance and moral backing to these radical neo Marxist judges at the front line. Federal judges. This is the world's an efficient market, as they teach at Harvard Business School and all those years of Obama appointees and Biden appointees and quite frankly, Bush feckless Bush Appointees are coming home to recent and in the fact in San Francisco with that field stripping of the Justice Department and President Trump's actual power to riff people and to take care, you know, get rid of these probationary employees, the judges, I think from the Clinton era. But you see these neo Marxist radical judges appointed by Democrats or feckless neoliberal neoconservative Republicans are. That's the only thing they got going for them. They haven't been able to generate their color revolution, although they try every day to the fact now they're doxing Tesla people. And remember this, they're burning, they're going to dealerships, they're burning dealerships, they're burning cars. These were all the people that Elon Musk was a God for when he came with the electric vehicle. Just remember, in the first administration, Elon, I think was in my office, I don't know, every day or every other day for the first couple of months about tax breaks for electric vehicles. And President Trump was absolutely adamant. We just said no. We tossed him out every couple of days, said, hey, I hear your pitch. It's not going to happen. The little guy in this country is not going to underwrite venture capitalists, the Chinese Communist Party and you and all those people that bought it in those era, right, who are all progressives now, they're being doxed. This is what savages they are on the left. They've totally turned on each other because there's. I don't care if you roll it out in the White House every day of the week. Maga's not going to be buying the electric vehicle and certainly not going to be buying Tesla. It's just not going to happen. But you see, they can't get. They're so desperate now, they're taking Bernie and AOC on a college tour essentially to try to gin up and they're using this faux populism. They're coming after the billionaires after they had four years to do anything about it and did nothing. Did nothing. The billionaires all flipped at 11pm Eastern Standard Time on 5 November, when it became obvious that MAGA had won and President Trump had had the greatest comeback in American history. All of a sudden they got old time religion. That old time religion. You scratch it, it's 1/8 of an inch deep. These are pure opportunists. And what has happened now is the one line of defense and they're turning it to offense is the courts, of which you've labored so hard to make sure we have politicians in there that we can get the Supreme Court and the federal court and the appellate court and all of it turned around. This is one of the reasons at the state court level, the situation with this vacancy in Wisconsin so huge. We're gonna get to all that. Also, two other pieces I'm gonna get into today. One Axios lead story about all the strategies that have been worked on legally to make sure that we could do mass deportations. It's quite frankly a brilliant piece. We will get to that. Todd Bensman or someone from CIS will be on later to walk through that. Also, the New York Times has a full scale kind of, I don't know if it's an expose, but talking about every organized effort of the Trump administration, the outside groups, et cetera, to take on the dark money and the network, the rat's nest and back of the Democratic Party. It's quite revealing. Natalie's going to address that this afternoon. I'm trying to get. Brian Glenn is at the White House this morning to jump in. Hogan, D.C. drano joins us right now. DC, your tweet got my interest and we're supposed to try to get Eric Teetzel, who you kind of reposted, but kind of laid it out in layman's terms. First off, DC Drano, a lot of people don't know that you actually went to one of the finest law schools in the country. What is your bona fides as a lawyer? Before we get into this, your feelings and issues and observations about where we stand with federal courts, sir?

Well, I went to University of Chicago Law, and we called feelings the F word. And the F word was not allowed in classroom discussions, only facts.

So, Rogan, why did Teachel put this analysis up? We're gonna have try to get Eric in a second from cra, the kind of anchorman after the great Russ vote went into the administration. Why did you find it compelling? And why are you one of the people on the front line of this, pushing what we're being bombarded, you know, overnight? I was on Chris Cuomo last night and absolutely bombarded with how we're so outside the mainstream, how this is so radical that we're trying to impeach federal judges? Sir, your thoughts?

No. They're the ones that are outside the mainstream in defying historic precedent. What we are experiencing right now, everyone feels it in their gut that this frustration. We just had a duly elected president, popular vote, every swing state, and now we are experiencing what is called a judicial coup. Okay? The decades of infiltration in higher education by these Marxists has led to this moment, right? All those years of training and woke. And it's basically the anti Federalist Society, right? So the Federalist Society teaches judicial restraint. The anti Federalists want judicial overreach. And that's why we're seeing these Marxist activists in black robes effectively deeming themselves president on a specific matter. And the numbers back this up. There was a Harvard Law Review study that Eric Teetzel posted about and it was actually from last year in 24. So the numbers are a little bit old. But basically in George Bush's eight years, he had less than one national injunction per year. In Obama's he had a little bit more than one per year on average. Biden in his four years had about two or three per year. Trump in his first term had over 15 on average per year. And if you throw in the other 15 that have come out in the first couple months, he's at over 80 national injunctions by these district judges, that averages out to over 20 per year. And this is. He has more than half of all national injunctions ever issued in the history of the United States of America. It's completely unprecedented. And when there is unprecedented overreach, it requires unprecedented counterpunches. And that's why we are discussing impeachments and judicial reform.

By the way, real quickly, we're trying to. Our guest, our next guest is trying to get to you, sir, my producer, my crack producer here. We're trying to line up our next guest. Why is this such a big deal? Why are we making the case that these radical justices, these judges, right, doing these national. Because the reason we had Carrie Lake on at the beginning of the week, they came after Kerry Lake yesterday with suits. They're gonna try to shut her down, not just on, nationwide, on a global basis. So why is this such a big deal, Rogan?

Because a single federal district judge should not have the ability to dictate what happens nationwide. And what's making it worse is that Democrats, these NGOs, these Democrat affiliated law firms, they're forum shopping. They are finding a judge they know is going to give them a favorable ruling. And then that judge shuts down nationwide, the entire apparatus of the executive branch. It's, it's, they're completely usurping the authority. There needs to be reform. Now, one of the proposed reforms is Darrell Issa filed a bill and it would require at least a three judge panel to rule on these potential injunctions. And it would require two or more states to be in conflict with this. So that would slow these down precipitously. But at the very least, we do have to start pushing back. There's, there's Chip Roy discussed potentially defunding certain district courts because we're not going to get 67 votes to actually impeach some of these guys in the Senate. Right. Democrats, these are their new best friends. But we do need actual long lasting reform because a judge gives a nationwide injunction and then Trump has to fight for the next three to six months to take this all the way up to the Supreme Court. So at the very least we should be able to move forward while it's in litigation.

I want to make sure that we're fighting smart here, D.C. drano. I understand and I love the fact that the MAGA base, the MAGA warriors of War Room Posse, are up on the ramparts in this and are furious about what is happening with the federal judges. But one of the issues has come up is a lot of our MAGA warriors want is just saying, hey, don't comply. Just do what you got to do. All gas, no break. Walk me through your logic of why you think we should be as we go after strong after impeachments, that we're restrained right now, at least somewhat in that direction.

Sir, I will tell you, there is no issue that people are more fired up about right now than judicial impeachments. And the only course of action that I'm seeing most people rally behind is just disregarding these injunctions and having Trump move forward. We are the party of law and order. We have a 6, 3 on a good day, 5, 4 on a bad day. Supreme Court will 4, 5 on a bad day on the Supreme Court. People are furious. The base is furious. I sympathize with that. I wanna bring up something. When Trump was indicted multiple times, okay, we were furious. We wanted Governor DeSantis to shut down law enforcement from even arresting him. We were just like, disregard this. We know this is political persecution, but what did Trump do? He fought it the right way and he merged victorious. Okay, I just wanna say we gotta play a little bit of a long game here and figure out constitutional legal ways to get around this. And if that means nitpicking, oh, it was over in international waters. We couldn't return the flight. It wasn't usa. That's what we gotta do. But let's play smash mouth here and let's do everything we can within the Constitution to defeat this judicial couple.

I do disagree with you one thing, Rogan. I think in this regard, and I hate to give it to people, but I've warned about this from the beginning, months ago about empowerment and all of it. I ain't so sure it's a 5, 4, the other way court. I don't think we can depend. And I think people are making a big mistake of recalculating that. Coney, Barrett and Roberts are going to be with us on some of these, or whether they're even going to allow it to come on the docket. So I just. It's all.

Having gone through the situation on the contempt, I see them laying the trap right now for some contempt proceedings against certain people in the Trump administration. I can see what this judge is doing. So, anyway, dc, you're at the tip of the spirit of the fight. The base should know that this is getting a lot of attention and it may be number one priority of everybody right now. Dc, where do people go to keep up with you? Because you're on top of this, as.

Everything Trump's doing right now is historic. The rapprochement with the Russians, the hemispheric defense redoing geopolitics, from Mackinder's heartland strategy to this naval strategy around the United States, economically on finance and every cultural issues, everything. You're seeing history live every day on this show as we just turn the cameras on and have Brian Glenn tee it up at the White House and Natalie want to tee up at the White House. But this is now bringing in every branch of government. So Tetzel at Bomber Command, walk us through what this fight is about, how we have to be smart about this and directionally, where are we headed?

Sir, I think it's clear if you look at the data that's been discussed here this morning that this is the new front lines for the left. It's their most reliable weapon in the toolkit. As the author of this piece, our friend Ben Weingarten from over at the Federalist pointed out to me this morning, you can make an argument that an individual federal district court judge, one of 700 of them, is more powerful than John Roberts at this point, single handedly stopping the President of the United States from executing his job. It's unbelievable. And what we're seeing is this explosion in the use of these tools to stop the president's agenda because clearly Chuck Schumer can't do it. Congressional Democrats can't do it. They don't have the numbers. We've got the majorities, we've got a team that's finally seemingly united and rowing in the same direction. But already we have seen 15 national injunctions from district court judges against President Trump this year, 15 in February. That's more than Joe Biden had in his entire presidency. And something's got to be done to constrain it. And thankfully, there are plenty of tools in the toolkit to do that.

Okay, I want to make sure. And this goes back to the unitary theory of the executive. Whether it's President Trump's actions as chief executive about personnel or about money, and later about empowerment, but his ability as chief executive in that unitary theory, the office of the President, number two, as commander in chief, what's happening with the Venezuelan terrorists going to Central America, El Salvador, and third, him as chief magistrate and chief law enforcement officer. They're attacking. They're very strategic. They're going after. Exactly. I mean, they're challenging us. They're saying, hey, we hear the theory. That's interesting on every aspect of it. They're Judge Shopping. They're going to a specific location on a specific initiative of President Trump's and his team and trying to thwart that and trying to drag it out, to delay us, to deny and try to drag this out for years. Is that essentially what's happening, sir?

100%. And it's even worse than that because you can judge shop in multiple jurisdictions simultaneously. So you might get a judge who views the law rightly and rules in President Trump's favor. And it's like, okay, lost that one, move on to the next one. And then you'll get a judge who may view the law wrongly and rule against President Trump, but constrain their ruling to the parties sitting before them and saying, this doesn't have a national application. It's constrained just to the case before me and the person before me. And they'll say, okay, onto the next one until they find a judge who's willing to dictate law for the entire country. It's unbelievable. And you're right. I'm glad you brought up presidential authority, Steve. This is critically important. Cuz presidential authority stems from multiple sources. Obviously, when Congress passes a law specifically giving the President of the United States powers to do something, his authority is clear. And that's exactly what's happened here with getting rid of these criminal gang bangers and sending them back home. Congress gave the President the authority to do that. I don't know who some federal judge thinks they are to step in and say that's no longer valid because the law is old. That's not how the law works. But then even more fundamentally than that is the Constitution of the United States, which specifically gives the President of the United States explicit powers, just as you said, especially when it comes to his role as Commander in chief.

Let's talk about Roberts. We got about. I want to hold you through this because we got a toolbox. We have a toolbox. We're going after the law firms. You've got legislation, maybe like the 1801 that you reorganize. You've got Chip Roy saying, hey, not just do we cut the budget for the federal courts as 10 billion, but maybe we target it for districts. There's so many things we can do. One of those is impeachment. Judge Roberts, Chief Justice Roberts jumping in here. Your observations before we go to break, sir.

Well, John Roberts thinks that history is gonna judge him and not the people who are living today. We'll see what history thinks of John Roberts. I was reminded last night that the Supreme Court is filled with turtles. There Are tortoises everywhere? I had never heard this before but the theory is that the justices are supposed to think of themselves as tortoises, slow and are protected. Well, I don't know about being a tortoise. You know, we've got a lot of cars moving pretty quick on the highway these days and that doesn't tend to end well for, for tortoises. The. The reality is that Congress has the power to pass laws to constrain an out of control judiciary. They don't have to rely on impeachment alone. Although impeachment may be warranted in certain cases. Thankfully, members of Congress have stepped up and proposed other ideas to get around this. Like for example prohibiting forum shopping where you just go to the judge that you think is most likely to rule in your favor. That seems like an easy fix. Another idea that Mike Lee has been on is a three judge panel.

That's other than the impeachment weapon. Can you walk through a couple of these?

Right. Impeachment's an important tool, but it's not the only one. Congress has the power to shape the courts by passing laws. And several really good ideas have been proposed to get at this problem. Of course, Senator Mike Lee, who's the best of the best when it comes to a lot of things, including this, he has an idea that would say instead of a single solitary judge having the power to stop the President of the United States, there should be a three judge panel required to consider these cases. That would make it a lot harder for one activist judge to thwart the President's agenda. Darrell Issa has some ideas that he's proposed. He's been like a dog on a bone on this, including outright just banning national injunctions. Why in the world would we ever allow this to happen? Seems like a good idea to me. And then a third idea that's been proposed is to ban this practice of shopping for a district and a judge where you think you're gonna get the best result. You could simply say, you don't get to do that. You have to have a person who has experienced a harm in a specific place, and that's the district where it happens. Or I've heard the other idea of having a lottery to just say, hey, if you want to sue the President of the United States, you don't know which judge you're gonna get or where it's gonna land, and let the fates decide it. One last one that recently was actually part of an executive order that the President put forward is this idea of an injunction bond that would say, okay, you wanna sue, but you need to put some skin in the game. And if at the end of this, big, at the end of this, you were wrong, you forfeit the bond that you put forward. So if you want to put $1 million on the line and in the end forfeit that, if you're wrong, go ahead and do it, and we'll see what that does to the number of these lawsuits that occur.

We are. But, Steve, you and I have known about this for several years. I'll give a lot of credit to the New York Times for reporting on this. And of course, the Democrats right now, as you know, are losing on the messaging. They're behind things that just Americans can't get behind. So they're losing. But now it's time for us to fight back on the other side of this. And I think the New York Times is spot on. When you look at ActBlue and you look at some of the money, where it goes, where it supports, even the building on the other side of the White House here, Steve, the Department of Treasury, I remember reporting about the SARS, reports about all the LLCs that were formed in the Biden crime family and all the different avenues that were funneling money. But finally, finally, it looks like fighting back, not on the legal side, the legislative side, but we're also winning on the cultural side. And to point out the last time we left the White House to drive to the Capitol a few weeks ago, in that presidential motorcade, they cleared the streets, people on either side of it, People got their phones out. I didn't see one person that was given a derogatory hand signal towards the presidential motorcade. So we have won on the cultural side. We have the people. Now it's time to stop all of this illegal money funneling that the Democrats are so good at doing.

They're using government funding, too, to destroy this country, destroy the republic. That's one of the great things about the Doge guys. Or Kerry Lake just shows up the other day at, at, at Voice of America in the whole broadcast industry that the US Government has, has financed that's turned against the American people. But this is the dark money. And quite frankly, I think a lot of overseas money, a lot of people that maybe, you know, live in Switzerland, but are giving money to the thing, they're exposing this. And they have to understand we're going to be relentless on this. Until you get to this, you're not going to kill the snake what tried to destroy a republic and is actively trying to do it every day and just waiting. And remember, they're playing the game here. To delay is to deny. They think they can outlast Trump. This is what they're doing. They think they can outlast Trump. And we have to go to the heart of it. The amount of wealth that is in that country right now from government officials, not from private business owners. These are for people in the military and the government. It's sickening. He was a big supporter of President Trump, big supporter of stopping this war. But we are definitely winning. I'm glad that the New York Times got it right. What is going on is that on 21st February, President Donald Trump issued what they call a national security presidential memorandum unveiling what he has described as an America first investment policy yesterday on Maria Bartiromo's program on Fox Business. And by the way, hat tip to Maria, she has done extraordinarily important work on this, including two specials, not just her daily stuff, but two hour long specials entitled Underwriting the Enemy. She had Scott Besant, good friend of the war room, obviously, now, praise God, the Treasury secretary on her program on the Daily show yesterday. And let me just read you a quote from Scott Besant, the Treasury secretary, quote, I think it's up to us to let American investors know how their money is being used. Would ordinary Americans want their money being used to suppress Uyghurs? Would they like it? If it's being used for Chinese military activities, Would they like it being used for Chinese surveillance opportunities? Of course not. So we are going to continue investigating this and where necessary, block it, unquote. Now contrast that with what Steve Mnuchin did in the first term, or for that matter, any other treasury secretary you want to come up with. They were all endlessly shillings for Wall Street. And Wall street, as you say, Steve, has had an absolutely fixed determination to garner the fees and the various bennies of doing business with China by putting our pension funds, our 401 plans, our mutual funds, whatever, into the Chinese Communist Party's maw. And that includes, by the way, Chinese companies that are owned or certainly working for the Chinese military. One example of which is right upon us as we speak, Steve. J.P. morgan, bank of America, Morgan Stanley and Goldman Sachs are intent on bringing to the United States capital markets an initial public offering that was recently launched in Hong Kong for a company called catl. It stands for Contemporary Amperex Technologies Limited. It's the largest electric battery manufacturing concern in the world, 36% of the market. They've got an effort underway right now in Michigan to try to put a plant there that would support Ford. But the truth of the matter is, Steve, as the Department of Defense get this under Joe Biden, right before it finally petered out, that administration, in January of this year, the Pentagon announced that this company, Catl, is a Chinese military company operating in the United States. Now I have to ask the question, what the hell is a Chinese military company doing in the United States, operating or otherwise? Well, it's not the only one. There are about 66 of them on this list of the Pentagon and more that aren't yet on the list but should be and probably will be under this new presidential order. But the point is, Steve, it's worse than that. Back in June of last year, John Moliner, the super chairman of the House Select Committee on the ccp, Mark Green, the chairman of the Homeland Security Committee in the House, and a guy who is now the Secretary of State of the United States, Marco Rubio, wrote a letter saying to the guys at Homeland Security, by the way, this outfit Cattle should be on the list of companies that also exploit slave labor, which is illegal in the United States, to bring their stuff here. So all of this is going against it all evidence of material risk to investors. And these five major U.S. investment banks, banks are not telling the people that they want to have buy these securities from cattle anything about those material risks, let alone what Donald Trump is doing with his America first policy.
