The Vice President breaks that tie and he did. J.D. vance voted for the bill and so it passed the Senate. Three dissenters on a Republican side, Collins of Maine, Paul of Kentucky, Tillis of North Carolina, they did not like the bill. So now it goes back to the House for a vote. And the House bill wasn't the same as the Senate bill, but I do expect that the House will pass this. 218 votes are needed or as close the first time. But any congressperson who wants to run again on the GOP ticket voting against the bill is done. So just keep that in mind. Pressure is enormous and that is the subject of this evening's Talking Points Memoirs. So this is President Trump's D Day has to get this bill, as I've explained a number of times. I'm sorry to be repetitive, but this is very, very important. It's really not about the bill per se because the bill is loaded with federal spending that's non vital. It's called pork and it's there. And that's why Elon Musk doesn't like it. That's why Rand Paul doesn't like it. That's been the case since World War II. But I'm not making an excuse that the bill is just ridiculous in some of the stuff that we, the taxpayer, are going to have to fund. But this point in history is key. So if the bill fails at the end of the year, all our taxes go up and go up significantly. Okay? If that happens, there will be a recession because consumers are strapped now. They can't afford to pay any more taxes to the government, state, local, whatever it may be, can't so that there'll be a severe pullback in our economy which will doom President Trump. He's done if that happens because he'll lose the midterms, both houses. So now it's not just a vote about pork and overloaded federal Spending. It's a vote about do you want to keep this president or not? Okay. In power. So I know where I do. I want Biden back. And the Democrats, not a single Democrat voted for this bill. And the reason is because if they voted for it, they be shunned out of the Democratic Party. So we don't really have, you know, freedom of conscience anymore. So there's two big things attached to this bill that are just a scandal. The first you've heard over and over and over again, it cuts Medicaid. It does not cut Medicaid payments. Doesn't. But the media lies about it over and over and over. So that not smart people, people who don't watch or listen to this broadcast think that Medicaid is going to get cut and all these people are going to be thrown into the streets with no medical care. Okay? What the bill does, and again we explained it and explained it and explained it, is it tightens up people's eligibility. All you have to do to be eligible to get Medicaid is to search for a job or volunteer for a job for 20 hours a week. That's it. You either have to look or volunteer. 100% of people should be able to do that. I shouldn't say that. 95%. There are 5% who are medically debilitated. They can't do it. And there is an exemption for them, a medical exemption. If you are medically frail, that's what the bill says. You don't have to do that. But the layabouts, okay, and they number millions, have to do it or they don't get Medicaid. That's the so called Medicaid cuts, okay? So when you hear that on the media and yesterday ABC News did a piece and they said that older people are not going to be able to look for a job. That is a deception by ABC News because they didn't mention the volunteer aspect or the medical exemption. ABC News just didn't even mention it. I mean, come on, I used to work for that organization. I was proud to work there. It is now a dishonest operation. The second lie is that this bill aids tax cuts for the rich. No, it doesn't. It carries on the tax cuts that was passed in 2017. There aren't any other tax cuts with the exception of the tips. Up to $25,000, you can take a deduction. So my son is a waiter this summer. He gets tips on his income tax. He'll be able to deduct, okay, a lot of that. And so he'll keep the tips also for senior citizens paying tax on Social Security, you'll get a bigger deduction. Anything wrong with those two things? Trump promised the tips thing, so he's delivering on that. Right, but it doesn't aid the rich. Bernie Sanders, I mean the guy just goes on and he, and he just says his stuff. That's just patently untrue. He knows it's untrue. Okay. Oh, it's for the billionaires. Eight years we've had this system, okay. All you're doing is continuing it. So those two things are paramount in the Americans not understanding what this bill actually says and does. Will it pass in the House? Probably these 218 votes. And that's coming up now. Last night I was on News Nation and Cuomo and Vitter, you know, were pounding Senator Ron Johnson, who doesn't like all the pork. Johnson and I share that. But he voted for the bill because of the Trump danger. He doesn't want to destroy the Trump administration. Vitterd and Cuomo criticized Johnson for doing that. Here's what I said. Go. The bill is a bunch of bull, but there's no choice. In this time in history, the Democrats don't want to cut any entitlement spending or supervise who gets it or keep it away from undocumented people or, or do anything. They'll cut border funding, they'll cut defense. That's all. There's not one Democrat on Capitol Hill, not one will vote for this bill because it doesn't cut Medicaid. That's a lie that's spewed out over and over by the corrupt TV journalist so called. All right? It supervises. It does exactly what Bill Clinton did in 92. And if you don't look for work and you're able body and you don't have a kid in the House, you're not getting it. Okay? And that is fair to the hard working people who are paying their taxes and don't want a bunch of drug addicted layabouts gaming the system. Am I clear? As Jack Nicholson once said. Yeah, crystal clear, Jack. Okay, so it was 96 that the cash Assistance act passed under Clinton. But there was, you know, Newt Gingrich was the speaker and there was this movement that began in 92 to clean this up. And Clinton, to his credit, did clean it up a bit. All right? He did impose requirements to get cash assistance. Quote, recipients must work after two years on assistance. With few exceptions, 25% of all families in each state must be engaged in work activities rising to 50 fiscal year 2002, single parents must participate for at least 20 hours per week the first year, increasing 30 hours per week for fiscal year 2002. Parent families must work 35 hours per week by July 1st, 1997. Okay, so Clinton got it, everybody got it at the time that you just can't have lazy, addicted, whatever people gaming the system. Now if this bill passes, it will save about a trillion dollars according to the Commonwealth Fund and the Congressional Budget Office. A trillion dollars over 10 years. That will be saved by the federal government. Obviously. With a $36 trillion debt, we need that now. Is it going to add to that debt over the same period of time? The trillion dollar savings is just Medicaid. Just Medicaid. The other spending will increase the debt if President Trump doesn't do what I am suggesting. And that is okay. Sell oil from federal land like ANWAR and use all of the profits to pay down a debt and use all of the tariff profits. $1 billion a day is coming into the U.S. treasury from around the world. All of that money should be earmarked to bring the national debt down. Next time I see the President or talk to him, I am going to mention that I hope he will get behind it because that can bring it down. All right, so summing up, not one, as I predicted last night on News Nation, Democrat voted for it because if they did vote for the bill, they'd be drummed out of the party. Okay. And if the Republicans in the House vote against it, they're going to be drummed out of the Republican Party. That's the way this system is now. It is vicious. This is D day for Donald Trump. He must get this passed. So if you want to keep him as president. All right, an effective president, a president that can get legislature done. Okay, then you have to vote for the bill. There's no other choice. And that's the memo. Let's face it, the US economy is under stress. National debt rising, trade war shaking the markets. His name is Michael Demiano and he teaches at Widener University Law School, which is in Pennsylvania. First question, professor, about the judge shopping. It just seems to me that no matter what ideology you are, that you would know one judge just stopping the whole apparatus of executive orders is just blowing up the Constitution. Am I wrong?

Well, you're absolutely right. Thank you very much for having me on, Bill. It's a pleasure to be here. But you're absolutely right in your description of the problem that having one district judge with the power to issue a universal nationwide injunction prevents other judges from getting involved in issuing opinions on the same issue. And usually the way that you get ultimate resolution of these issues is to have a bunch of cases in the lower courts each focused on particular plaintiffs. And if there's a disagreement with those lower courts, then the appellate courts can sort out the disagreement. But we don't just pick one district judge as part of some kind of policy making strategy and let that judge impose an injunction on the entire country unless the Supreme Court gets involved on some kind of emergency basis.

Okay, but the three liberal judges on the Supreme Court surely are intelligent enough to recognize the anarchy and chaos that would come if every party could judge shop on every presidential decision. Right? They're not stupid.

Certainly true. Yes. And, and in fact, as, as your, your clip before, before me pointed out, Justice Kagan has already pointed out that problem.

Yeah, she during the Biden contradicted herself. So the only conclusion that fair minded people can come to is that at least three members of the Supreme Court don't care about the Constitution at all. They want to use Their power at the nation's highest court to advance their liberal ideology. That's the only conclusion you can come to.

I think what you have is a fundamental disagreement about judicial power, that what the liberal justices see as the role of the federal courts is solving injustice or declaring what the law is. They see the courts as this kind of institution just to get involved and stop illegality whenever they see it. That's not the way the federal courts are supposed to work. And the six justices in the majority correctly pointed out Justice Jackson's flawed understanding of the Constitution in that way. Federal courts are supposed to resolve disputes between parties who are affected by the litigation. And if it turns out that the plaintiff is right and what the government is doing is illegal or unconstitutional, then the district court should enter a remedy that solves that plaintiff's problem.

Right. I mean, the ruling was right. But what disturbs me are these three justices. That's what disturbed me. They want to dismantle the Constitution. They want to dismantle it, and let's be honest about it. They know the anarchy and chaos that would be caused by judge shopping on every single presidential executive order. They understand that. They don't care. They're almost subversive when it comes to the Constitution of the United States. Last word.

I think Justice Barrett had it exactly right when she said that Justice Jackson would impose an imperial judiciary. That's the. And I think that's what you're referring to when you're saying subvert the Constitution. You say judges are up here and everybody else has to follow what the judges say. That's not the original understanding of the Constitution.

But I carry it further than that. These judges, justices are in business to advance a liberal ideology. They're using their position for politics, not to really analyze what the founding fathers had in mind. That's my point of view. Do you concur with that?

I agree. I think that being an activist or a what we call a result oriented judge is just about the worst thing that you can be on the court.

Well, Sotomayor, policy oriented. I know this for a fact. Sotomayor wants out. She's tired, she doesn't feel well, but she's hanging on because she doesn't want Trump to appoint the next judge. So we'll see how that evolves. Professor, thanks very much. Happy fourth of July. We appreciate the help. All right. Governor Gavin Newsom suing Fox News. This is just bogus And I'll just explain why. So the governor is going to run for president in 2028, there's no doubt about it. And Kamala Harris will run for governor in two years. 26. Those things will happen. So Newsom is trying to get rally all of the Democrats behind him and he knows that many of them, perhaps most probably most, hate Fox News. So there was a phone call made. I guess Newsom called Trump, but I don't even know because I haven't seen a transcript or anything like that about the National Guard in L. A. This happened around June 6th. Okay. And Jesse Waters got the timeline wrong about the phone call, according to Newsom. No, I don't know. I haven't seen a transcript. So I don't like that. And then John Roberts, another Fox News guy, he called Newsom a liar or something like where Waters called him a liar. And they called them names and they put disparage him. So Newsom said he was defamed. Number one, he's a public figure, so that's not going to fly anywhere. Number two, he's suing for 787 million in damages. All right? That's the exact number Dominion won against Fox. This is just ridiculous. So what's going to happen is it'll either be thrown out in summary judgment or Newsom will withdraw it. Now, I'd like to know who's paying for this, okay? And I'm going to work on that this week to find out who's paying the legal bills for this for Noosa. And I bet you it's a political action committee, you know, one of these source type places. Maybe not Soros, but you know how it is. But this is just a publicity stunt, okay? Not a stunt is a House oversight probe into Joe Biden's mental acuity that's advancing and it's fairly serious. So the committee has issued two subpoenas. Dr. Kevin O', Connor, who said, hey, Biden's fine mentally and physically. And now we know Biden has prostate cancer. Okay, Doctor, good luck. And Anthony Bernal, who is a senior advisor to First Lady Jill Biden. Those two men have been subpoenaed. They have to test them, testify before the committee or to be found in contempt of Congress. Now, they were asked to do so voluntarily. They refused. Okay? Others that are going to be asked to testify are Corrine Jean Pierre, okay? Anita Dunn, Ron Klain, Jeff Zentz, Andrew Bates, Ian Sams, all the big shots. And they want to get them under oath. The Republican congresspeople on the Oversight Committee and say, you know, because they could trap them. That's what they're trying to do with these people. Now, there's no doubt in my mind, and I wrote this fairly clearly in confronting the presidents that Joe Biden was infirmed while he was president. I am 100% convinced of that based on the facts, based on what happened and more things are going to come out. But you should be aware that those things. Early July, O' Connor is supposed to be up July 9th. So right after the 4th of July, we're going to have all of this testimony, okay? There is a group, Feeding America, left wing group, but they're do gooders. I mean, I don't object to them. They want to get food into the hands of poor Americans. Pretty noble. I give money to food charities on Long Island. Anyway, they issued a letter, okay, objecting to any cuts whatsoever for Supplemental Nutrition Assistance. Snap. What? Snap. Food Stamps. Now, as everybody knows, the United States owes $36 trillion and it's going up at an astronomical rate every day. So the Trump administration is trying to get more stringent qualifications to get food stamps, to get Medicaid. That's what they're trying to do. Trying to, oh, imply oversight. It's a good thing because we can't keep wild spending like this. And our lot, there are millions of layabouts who are gaming the system, getting free this, free that, and they could work. But why should. I am a heroin addict. I don't care. I don't want to work. All right? Now, three very high profile entertainers, Matt Damon, Scarlett Johansson, Sheryl Crow signed on to this letter, okay? I don't hold anything against these people. Here is the statement, all right? From that quote, ongoing high grocery costs mean food is out of reach for so many families and many of our neighbors simply do not have enough to eat.

I don't know anybody starving here, nor County. And I have a house in Suffolk County. I don't know anybody starving there because every Catholic church on Long island has free food. I think everyone. And there are food banks all over the place, okay? And if you qualify, you can get the government subsidy. But if you aren't looking for work, if you don't care to get a job and pay your own way, they're gonna boot you. And it's okay with me, if you have dependent children, they're not going to boot you. Okay? So these movie stars, they live in a world not in a real world. They don't live in a real world. Are there people hungry? Are their kids hungry? Yeah, because their parents are irresponsible. Parents are taking all the money and all the stuff they get into, buying drugs or alcohol, whatever they're doing. But if you need food, you can get it. We're the most generous people on earth, okay? And all these new bill wants to do is put work requirements onto SNAP and Medicaid and then they're telling the states, you cannot tax Medicaid North Carolina at the highest level anymore. You have to drop it to 3.5% because the federal government has to reimburse the states when they tax Medicaid services. Do you understand that? So the Trump administration goes, we're capping it at 3.5, they're not cutting it, all right? They don't want to be paying these astronomical reimbursements to the states. This is just logic. But the left runs with it. And so they're cutting Medicaid. People won't have health, people won't have food. Because the Democratic Party does not want to cut $0.01 out of the budget. They want to increase it. Did you know that in modern times, when a Democrat is president, federal spending is twice what it is when a Republican is president? Did you know that? And this big bill that Trump has, no Democrats going to vote for it now, one, because they don't want any oversight. They want to keep adding and adding and adding to the cost. And that's what socialism is. That's what it is. Now, does Matt Damon and Scarlett Johansson understand any of this? I don't know. They signed the letter. They have a perfect right to sign the letter. If I ran into them, I would be very polite and respectful. I, I might ask them, hey, you know, what's your objection to federal government saying to the state, you can't game the system by charging all this tax that we have to revert, you know, reimburse you for. Can't do that. And they, I don't, I can guarantee you they wouldn't know what I was talking about. UPenn Ivy League School, Philadelphia could be the most liberal college in the country possible. They have capitulated to Donald Trump, surrendered totally. The University of Pennsylvania will block transgender athletes from female sports and erase the records set by trans women, particularly swimmer Leah Thomas, who's a guy, but now she's not. Now she be. But look at the neck on her. Anyway, UPENN has agreed to a number of action items, their words, to resolve what department calls Title 9 violations. That's which they were sued by the Justice Department. So they've surrendered totally. Another victory for Trump. Okay, and he'll continue to win because these universities not going to get any money, grant money, birthright citizenship. Update. Now, I have said that I do not believe Donald Trump's going to win this. The Constitution is clear. If you are a baby born here in the United States, you are a citizen. Doesn't matter whether your parents are documented or not. The exception is if you are a baby born to an ambassador of foreign country, to somebody is here on a temporary means as far as working is concerned and structured, they are still those people under the authority of their home government, like the United nations people. Okay, then they're not. That's the only exception. So Donald Trump issued an executive order saying, no, like that we're not going to have any more right citizenship. And here's what the order said, quote, his policy in the United States that no department or agency of the United States government shall issue documents recognizing United States citizenship or accept documents issued by state, local or other governments or authorities purporting to recognize United States citizenship to persons when that person's mother was unlawfully present in the United States and the person's father was not a US Citizen or lawful permanent resident at the time of the person's birth or when that person's mother presence in the United States was lawful but temporary and the person's father was not a US Citizen or lawful permanent resident at the time of said person's death. That means you can't sneak across to give birth. So that Trump issued an executive order. No more of that. But the Supreme Court paused it. Okay. So you may know the Supreme Court is on vacation. Hello. Have fun. They don't go back to October 6th. So I think that this pause will be extended into the fall. That's the logical way. They're not going to come back to hear all of these arguments which they'd have to hear the Supreme Court. So that's what I think will happen. That is your update. Part of justice announces Operation Gold Rush to fight health care fraud. This is big now. So it is estimated that every year in the United States, the U.S. treasury loses $300 billion to fraud. Now think about that. $300 billion people are stealing from the U.S. government, our tax money by perpetuating fraud on the health care system. So yesterday the Fed's department, Justice announced they broke up a $15 billion scam. Okay. And wasn't yesterday, it was Monday. 300 arrests including doctors, nurses, health care workers, pharmacists, all of that who allegedly game the government. Good work. Pam Bondi Unity had a Biden administration didn't care. Good work. Big protests. Fourth July weekend, Free America organized by the Women's March far left. I think they're looms. I do. So there organized 150 protests including DC, New York, Wisconsin, Florida, Massachusetts. Okay, behind this, Planned Parenthood, Emily's List, pro abortion pact, National Organization for Women, all of these far left groups and they kicking money in there telling everybody to show up at a person place. And it's a push for free America. So ladies, let me just break it to you right here. I'm free. There's nobody suppressing me that I know of. They do. I'm going to Fight back in a very vociferous way. I'm free. I don't know. And my neighbors are free. All my employees are free. I got a lot of them. I'm running three corporations. I don't know who's not free. I'll put that not free person on this broadcast. If you can come up with one person who's not free in this country. Simple man, simple request. Give me one regular person, not some murderer or drug dealer. Okay? In LA, they don't have any. July 4th, because these people out there are organized and they want to cause mayhem. And so the city wisely says, no, you can't do anything.

Now, the Guard is still in LA. I have my researchers look at it. This is 4000 National Guard still based in Los Angeles. 800 marines are there to big federal presence, okay? Because they know the Trump administration, the Department of Justice, Homeland Security knows nobody going to stop these people from going out and burning stuff down. So that's why they have to have the federal presence nowhere else but Los Angeles. You ought to be very proud out there. Your city government can't control your people. Let's go back to the Everglades. You've been in the Everglades. It's magnificent. Love it there. I got say I've been there 10 times. I took an airboat, extended airboat ride. Now, you don't walk around the Everglades, okay? There are people who live there. They live on stilted homes. You know, there's giant snakes everywhere, there's gators there's panthers, there's bears, every snake in the world. Vacations in the Everglades, okay? It's just ridiculous. Giant pythons. Anyway, the president thought it'd be a good place to have a migrant detention center. We reported it yesterday. But I didn't get to everything I wanted to get to, which is why I'm doing it again. Now, all this detention center is. Is a waypoint for the deportation. They put them there. Plane lands on a Runway. They got on a plane, they go to Venezuela, wherever they're going. Okay? So press, of course, thinks this is Third Reich stuff or whatever it may be, but here's the best sound bite. Go.

Well, I was thinking about that. I must say, it was meant more as a joke, but the more I thought of it, the more I liked it, if you want to know the truth. And they were. Seriously, they were actually crocodiles. They were crocodiles from Africa. They are a step beyond. But, no, that was really meant as a joke. But a lot of people liked it, and a lot of people think we should do it. Franklin. Well, you can't do it because crocodiles can't go in fresh water. They have to go in salt water. And you had nitwits, remember this? With the aluminum foil, trying to reflect more sun into their face, the darker you could get. Remember those Coppertone ads? The dog and the little kid. Now you gotta really be careful. So. Smart life. More than a hundred thousand diagnosed with Melanova this year alone. That's the estimate from the American Cancer Society. All right? And it's far more than that. But people don't know they have it now. Every day I have this cream that I have to put this cream all over me. And my dermatologist is the best in the business. I can't tell you who he is, but guy's really brilliant. I mean, he's taking stuff off me every three months. You know, boop, boop, boop, boop, boop. And you have to, especially if you have blue eyes and fair skin, you have to. So that's smart life. You got to look at yourself and see if you got anything there that doesn't look good and go to the dermatologist, check it out. Should do that. You know, once you get over the age of 50, every year, we don't want you to do, what happened to my father should never have happened. Thailand says, no more pot. So in 2022, Thailand, which is a libertine society, said, okay, pot fine. Not so fine, because all the kids are smoking pot. So if you go to Bangkok, I don't recommend it. Bangkok, fascinating to me. I was there on assignment. Stated the best hotel in the world, the Oriental Hotel on the river there. Order. Unbelievable hotel that is. But Bangkok Vice, that's what they're selling there. Drugs, you know, you name it, they're selling it there. So. And then if you go to the beach, the Adam on Sea, Phuket and all that, Mary is too. I like Thailand. I like the people, but boy, that society is rough. Anyway, the government of Thailand, which is a military dictatorship now said, no more pot because the kids, the Thai kids are smoking it all over the place. That's Gap. It's happening here, too. The media suppresses that story. All right, here is a final thought of the day. So if you have ever ordered food from a restaurant, okay, you know how agonizing it can be. Now, I am loud. I speak clearly. And when I order anything, I speak doubly clearly. And I have the person read the order back to me because they get it wrong so much. I was on the phone with some lady at a seafood place in eastern Long Island. I had to say, madam, I just can't do it anymore. I mean, I've given you the order three times. You can't write it down. And literally, the woman could not write it down. Okay? So on Friday, I called to renew some prescriptions, and I didn't get a person. I got a I. I got a first time, and I'm going now. Wasn't complicated. I had the renewal number. I know my name, I. And I know where I live, okay? So I got prompted by the AI. It was a woman's voice. And I gave the information fairly slowly, but not ridiculous. First take boom, boom, boom, boom, boom, boom, boom. And then I wanted to pick it up today, and it was there. So my conclusion is, and this is going to be everywhere, but this is the first time for me. But in a year from now, you're not going to have human beings answer the phone. You're going to have AI. But it worked. And that's all I care about. Okay? Now, are people going to lose jobs? Yes. And if you know someone who's marginal, they need to get a skill. They need to start to bear down. Because if you're working for an hourly wage and you're doing work like taking orders or whatever, that's going okay. You got to look ahead. You got to know. And is it a good thing? It's a good thing for efficiency. Certainly. It was a good thing for me to get this prescription so I didn't have to read it 18 times. But is it bad for marginal employees? And that includes kids trying to, you know, move it on up. But you gotta learn how to make a living, period. Can't be dependent on the government.
