We're going to start off this episode with some news and try to determine whether or not we do have any pro2a states, which does not look like we do. Gonna hit some. Gonna hit a review of a gun that I've got up on Gunbroker for one of my customers. A little derringer. Pretty neat little gun. Gonna do some use of force cases. They're different. One home invasion, one carjacking. But you'll see some similarities between the two Got a theme. Got a theme on this?

Yeah, well, if you don't, you're an. And then we're gonna talk about some Washington good laws, and then we'll talk about that fast drill we ran. That's a little bit pressure on me. Now, the fast drill, the fundamentals accuracy speed test. Yeah, we did that. We're gonna shoot that again next weekend. I got some. I got some other people coming out. That's not.

I got it with my. Yeah, we'll talk about it and whatever. Such an idiot. All right, with that, let's jump into some news. And this first one, if you're a sports fan, you probably saw this on the news because it was just the other day where James Harden was arrested in Houston for having a gun in his vehicle. And the news media just irritates me on this story when you start trying to find it. You got one news media said he was pulled over for a traffic violation. He got another that he was following behind some friends, and one of his friends in a vehicle in front of him got pulled over. So he pulled over behind him, which is what actually happened. So one of the cars that was in front of him gets pulled over for a traffic violation.

Yeah. So he used to play for Houston. Now he plays for Cleveland. I'm not sure where his residence is, whether it's in Houston or Cleveland. To me, it didn't matter once we started getting into this story and why it irritates me so much. So he gets out of his car once his friend gets pulled over, walks up, starts talking to the police officers, and I guess one of the other police officers went back and looked in his vehicle because they. They were able to view a pistol in a cup holder, unholstered on holstered pistol and a cup holder. So they arrested him on carrying that firearm in his vehicle in the open. Now, in Texas, it is a constitution carry state, and this is what it's talking about. Do we have any Pro2H dates? And you know, it could have been so easy for this police officer. You got to put that gun.

If he'd have had a license to carry in. In Texas, he'd have been okay.

Yeah, he would have been okay if he had a license to carry. But since it would have been okay if it had been out of view.

Yeah, but since he didn't have a license to carry in a constitutional carry state, yeah, he had to have it in a holster. If it had been in the holster set in the cup holder, it had been fine. Yeah. But since it was not in a holster, they decided to rest it.

I would have told him that cup holder was my host, which all they

had to do was say, hey, hey,

put the gun up so we can't see it.

That's all they had to do.

But they arrested the guy.

Yeah, that was the only charge.

That was the only charge. It's a hundred dollar to get bailed out to bond out. $100 for James Harden to bond out. He probably had that in the floorboard of his car. But the irritating. I had a gun gut Boater. The irritating part is he not only. So he had to bond out. Now he's before his court case. Since he had to bond out. Part of that bond is he's. He can't have a firearm, ammunition or anything, any kind of weapon. He can't drink alcohol and he's got to go take urine urinalysis. He got to do drug tests every month for this. It shouldn't have been illegal to begin with. The cops shouldn't have arrested him.

Look at some of the comments, but. Well, there must be. There must be more to the story. Well, there's nothing. It's not being spoken of, so don't care if it was just by what's in the story. It's ridiculous that they arrested him. Ridiculous.

Now, I don't think anybody should get preferential treatment. Everybody should have been let go on this. In a constitutional case, any state we

talk about police officers should not be arrested. People over there, they should look at that and say, hey, you may not know this, but here, since you don't have a concealed carry license, you need to have that in a holster. That's all they had to do. They didn't have to arrest the guy over.

That's part of the problem with Constitution carrying all these states because there's so many little caveats to it that you can't do certain things that nobody knows all of it. So you think Constitution carry. You think you can carry a gun. I don't know why you think that. Because you got police officers that are going to do the bidding of anybody that tells them to do something and not even justify it.

been handled differently and it should have been handled differently.

Could have been. He could have been educated a little bit on what their Texas law is and then going on with life.

These guys weren't out robbing places or doing anything like that. And I heard, I saw some. Some comments about people. Why is James Harden having to carry a gun? He ought to be the higher security.

a channel to protect himself. Here's a guy that probably should be able to protect himself because you never know what somebody's going to try to do to him because what he's got. I mean, my goodness, I just get irritated with all the comments and talking about, yeah, he should go to jail. No, he should not go to jail.

I should have never been arrested.

It's an infringement. We shouldn't have to have all these, hey, if I want to have a gun in my car, I should be able to carry my car ever how I want to carry it. Yeah, the gun's not going to go off. No, it's not a P320, was it? Right.

But you know, he wasn't even in the. He was not even in the. Why is the policeman even looking in his car?

No, because I can see if we, you know, when we make trips and we have multiple vehicles going down the road, if somebody pulled over, I'd pull over and wait for them and probably get out and see what's going on.

In Florida. The three day waiting period in Florida. Again, this is why I say, do we have a Pro2HD?

A three day waiting period in Florida is about to go away. Well, shouldn't have been there to begin with. The Florida Attorney General is settling a landmark federal case that declares Florida's three day firearm purchasing waiting period unconstitutional under the second Amendment. Well, of course it is. It's an infringement, apparently. It doesn't matter though. But no, finally.

Today's got a longer delay than that.

Washington. Oh, yeah. It didn't surprise me. Didn't surprise me at all. So we got a little bit of good news. And this is seem, this is say, might seem odd, but the Supreme Court declined the Justice Department's petition to review the 5th Circuit ruling that struck down the federal lifetime felon imposition ban. And this was applied to a man whose qualifying offense was failing to pay child support. So he was charged with a felony for failing to pay child support. And they took his gun rights away from him. So this was, it was overruled. Struck down in the fifth Circuit. The Justice Department appealed it, of course. Our great 2A pro, 2A Justice Department.

Why would they even bring anything up with that?

They did and the Supreme Court declined to hear it.

Well, what's it got to do with them?
A
It did because I don't know, but it did. Anyway, they declined to hear that case. So it's gonna, it's gonna stay there with the fifth Circuit ruling. So hopefully we start seeing some of these riots being able to give back to some people that deserve them. I was looking at, when I was looking for news, I looked at this firearms news article and it was about the Tate Adamiak case and what the ATF director stated on the Cam Co. Interview. Now the one we talked about it might have been last episode. We talked about that. So he had our same talk, same feelings about it. Here's the. The ATF director was. Had no problem believing what the ATF said and was only concerned about the length of the term that he was imprisoned, but not the case facts itself. And so they were very critical of that.

We got a Tennessee bill. So this might sound like good news.

But turns out it's Never good news.

SB0350, which is. Which would sign into law I think here just recently. It goes into effect, but doesn't take effect until January 1, 2027. This is going to restrict landlords and this is out of Tennessee. Restrict landlords from banning tenants from lawfully possessing, carrying, transporting or storing. Storing firearms and in their homes and places that they rent.

So they can do that.

They couldn't. Or the landlords could ban them from. Yeah, right now and starting January 1st. They can't. Yeah, but that's good. Shouldn't be able to keep somebody from having an arm. But the government gave themselves an exemption. So if it's a government owned facility, say public housing, that's from the government, they can still ban you from it. So I got to think about it. You know, this is more of a power thing than anything. They want to maintain their power over people. They not let the private. Private owners of property do that. But they want to have the ability to do. They want to maintain their power. And it seems just. Just so ridiculous that they're going to somebody.

First one is out of California. So you've got a father that shoots and kills an armed intruder, and they was breaking into his home. So basically, you had a guy, he goes next door to see one of his neighbors, and he's as. He's over there talking to his neighbors. He hears screaming coming from his house and then some gunshots. So he takes off running back toward his house, and when he gets there, he finds a guy armed with a shotgun. Now, this shot, this guy armed with a shotgun apparently had gotten into an argument with his girlfriend down the road, stabbed her.

The father's girlfriend or his own girlfriend? His own girlfriend. All right, I'm with you.

Well, apparently it did. He shot him.

Anything? You just said he got in argument with his girlfriend. I was confirming it was with the guy with the shotgun's girlfriend and not the father's girlfriend. That's all I'm saying.

This guy who had come into the father's house with a shotgun, had earlier, just previously, before he got to this house to start the commotion, had gotten into an argument with his girlfriend in a car down the road. He stabbed her, got out of the car, ran up toward this house with his shotgun and was trying to break into the. Trying to go into the house. I don't know.

I don't know. I guess he was just trying to find somewhere to get and get away from him. I don't know. I don't know. I didn't talk to him. I don't know.

Continue on. So he got in an argument, stabbed his girlfriend, ran to somebody else's house,

tries going to the house with the daughter that was in there. As he comes running to the house to find out what's going on, the guy shoots at him with the shotgun. He pulls his own firearm and fires at the intruder, striking the intruder and I believe it ended up. Ended up killing him.

to find out why he went there. No, no, apparently not.

Yeah, yeah. So I want to talk about it from a use of force because no charges have been filed. He was this wrong one. Hold on a second. Let's see. No charges.

I thought this guy was arrested.

Yeah, that's why I was gonna say the homeowner taken to the sheriff's office for further investigation. Case will be submitted to the DA for review. So right now there's no charges filed, but he was. He was arrested, taken to the sheriff's office because you don't just.

In question and what. We'll talk about that because we always say be prepared to be arrested in these type of events because you shouldn't really talk to the police. But it's hard to do. We'll talk about.

So let's talk about from use force. Readiness.

Yeah. Because he was able to get to it by the time he got back to his house.

house, situational awareness is the first one.

Okay. Well, I mean, yeah, I don't know how wary was he heard shooting and screaming coming from his house. So I think everybody have been aware of that. Good job on his part to go then readiness we already talked about. You know, I had to give him credit for that because there's sometimes where I go walk my dog around the block that I don't carry.

And so I got to get out of that habit, make sure I'm carrying as I'm walking around the block because who knows, something could happen while I'm walking around the block or something could be happening at the house when I get back. So that kind of opened my eyes a little bit.

Reminder, you knew this, but you're not carrying now.

I got my dog in here. Now are you carrying? We go. We're gonna go through this same thing again, Right? But, yeah, good job on. On being ready. Morally and. And effective. Effectiveness was effective. Yeah. And he was getting shot at with a guy with the shotgun. He was still able to draw and put. Put rounds on target. So good job on his part. It didn't seem like he. He didn't injure anyone else, so he was responsible for all of his rounds. He used it effectively. So, yeah, I mean, good job. I mean, that's.

That's tough.

Getting shot at, still being able to return return fire. So he didn't get hurt. Thank goodness. His daughter didn't get hurt. He'd stopped the threat. But he's still getting questioned. And there's still a potential for some legal aspects of this moving forward. I hope not. But you never know. Now, this is in California, so you never know what's going to happen there with that. Hopefully he. They didn't say if he legally owned that firearm or not because, you know, if he didn't, they're going to charge him with that.

Whether it was a. A good use of force or not, which all accounts, it looks like it was a good use of force.

Yeah. To me, it seems lawful and moral.

Yeah. And they tried to determine, you know, there was no. No link between this guy and the family, so there was no reason to think they knew this person or that he knew them or any. Any reason.

What other options do you think he had? I don't know if he really had any.

I don't know if he had. I mean, you hear your. Your daughter, your wife, family members screaming and shooting, shot shots going on up your ass. If you don't go over there and do something, you're a coward. You're a coward. Yeah, you are. You are. Whether you have a gun or not. You've got to go over here too.

Okay, so you got a guy, the carjacker, who's apparently in a. In a collision with a couple other vehicles previously. So he hit a couple cars, gets out of his car and takes off

He leaves one vehicle and goes to another place and tries to do.

You got a guy, stabs his girlfriend.

The theme is better to be father shooting somebody.

So he gets in a car accident, tries to run away, finds a car in a parking lot. It's got a man, the father, a wife and a kid in the car. He opens the door, grabs the father, trying to pull him out of the vehicle. The wife and daughter, or wife and kid were in the back seat. They both jump out and take off running. He pulls the father out, and as he pulls him out, the guy, the father, already has a gun in the air. So he's already pulled his gun but has not yet tried to use it. As he pulls him out, the carjacker jumps into the driver's seat, where the father runs around to the opposite side to the passenger side. The wife and daughter have already moved away, and he fires through the passenger side, striking the carjacker, killing him. They take him to hospital, but I think he dies there. So we can kind of talk about this from a use of force case, whether or not we think it's justifiable or not, and his use of force and what he could have done different, he. No charges have been filed, and he was cooperating with police. I couldn't find where he was at.

But, yeah, a little worrisome. Hopefully they won't charge. Charge him with anything.

When he runs around to the other side and Defending property. Defending property kind of worries me. But he. The carjacker was unarmed. But you don't know that. You don't know that. You don't know.

Yeah. No, you don't. So to me, I think I'll run over your.

Yeah. Yeah. And you don't know. At that point, he. He really could have been unaware of where they were because everything that was going on, he might not have been aware of where you get that tunnel vision. He might.

I don't think it should be. I'm just saying, with the jury, I don't want to trust.

What do you mean short episode. Before we, before we jump to your stuff, let's just talk about the ranking of Washington. They're ranked 35th in the United States for gun ownership with 42.1% of individuals having one, at least one firearm in their household. And you cannot bypass the next background check with their concealed carry license. So a couple, couple of items there from Washington. Not surprising. I just said that, didn't it? You cannot. You know what, I can look it up. It did say something about it.

They require fingerprinting. So open carry is legal for 21 or older without a permit. But heavily restricted in gun free zones. We'll bring up gun free zones shortly. Concealed carry is permit required. There is no constitutional carry. You have to have a. And I'll get into concealed carry license in a minute. But there you have to have a concealed carry license. To carry concealed still must be 21 rotor 21 for purchase handguns and for CPL eligibility. The minimum purses age for a bolt action, pump action or single shot long gun is 18. There are only currently 10 states that meet the, the specific criteria to be able to have a, to be a. To have reciprocity with Washington. And I'll. I can just tell you those right now. You ready? Here's the 10 states. Idaho with the enhanced permit only from Idaho, Kansas with its standard license only. Louisiana, Michigan, Montana, if you have the enhanced permit. North Carolina, North Dakota if you have a Class 1 North Dakota permit. Ohio, South Dakota and then Utah. As long as you have Utah, provisional concealed firearm permit is not recognized though. So you got Utah, South Dakota, Ohio, North Carolina, North Dakota, North Carolina, Montana, Michigan, Louisiana, Kansas, Idaho are the 10 states that have reciprocity with some limits with. From those states. So, so that's, that's the states. Did you hear? Alabama. There is no duty to inform, but you must show your CPO upon request. Request by an officer. CPL required for loaded handguns in a. In a vehicle. Long guns must be unloaded in a vehicle. In a vehicle. Yeah. And if you have a. And handguns must be unloaded and locked away. If you don't have a consult carry license the sensitive places this is some of the top ones. Schools, courthouses, correction facilities, daycare centers, licensed mental health facilities, parks, libraries, zoos, transit centers open carry restricted on state capitol grounds and while attending protests. So let's say where you go you can't even go to a park.

All right. So effective on May 1st, 2027 there will be a permit to purchase sensitive places expansion is of mid-2025. Let's see they added aquariums I already said the public libraries and the transit facilities. Let's see I don't know because I didn't just get everywhere is of a bill passed and for this year and they're going to add to that list of sensitive areas all playgrounds, parks, amusement parks, recreational swimming areas or all now gun free zones. I don't even know where you carry

So open carrier like I said is legal for 21 or older who legally allowed to put as a firearm. However, Washington law prohibits brandishing displaying a weapon in in a way that manifests an intent to intimidate or warrants alarm. Crucially, open carry is prohibited in all sensitive places listed below Even if you have a permit all those places.

So currently there's no but it will be it's going to change in 2027.

There's no reason Private property signage signs prohibiting fires on private property like malls or grocery stores do not have the specific force of law in Washington. But they serve as a notice. If you remain on the property after being asked to leave, you can be charged with criminal trespass.

Yeah, I mean that's any kind of trespass. Anytime they ask you leave it on private property property. I mentioned that 30 minutes. That's basically what Florida is going to. You can't delay providing a permit any longer than it takes to do the background check. So if your background check takes three days because sometimes they'll get delayed, then of course you can't get the permit. But if it's, if it's a instantaneous background check, then you should be able to get your permit.

So even, even in vehicle carry, even if you had a concealed pistol license, you still all long guns, rifles, shotguns were always illegal if they're loaded inside a vehicle.

All right, so off arm transfers including province sales must be conducted through a ffl. Let's see what else we got. Assault weapons ban the sale manufacturing import of semi automatic rifles defined as assault weapons. Weapons is prohibited. Possession of those already owned is grandfathered. All firearm purchases are subject to a mandatory 10 business day waiting period. Seller distribution of magazines holding more than 10 rounds is prohibited. Possession is currently, currently legal. Washington state prohibits the sale of any firearm frame or receiver that does not possess a valid serial number. Construction and or manufacturing of untraceable firearms is prohibited by state law.

All right, so to get a concealed carry permit can take up to 30 days if you just go buy a firearm whether it's for home protection without a concealed carry permit or with a concealed 10. So the FFL did it's gotta hold that for 10 days.

All right, so this. This, like I said, this is called the fast drill. Look it up. Pretty cool little drill. Definitely going to do it some more. It. We did it with a. I will say it was a little bit more on the difficulty scale from the target we were using compared to the target that is identified for the fast drill. Because the hours we use the USPSA target with a smaller hitbox. The body shots. Not a difficult shot from the A zone to the body, but the headshot to a two four. Two by four head box is. Is a difficult, difficult shot to do quickly, especially for.

Yeah. It's set up seven yards away from the target. You put two into the head box, you draw a slide lock. Draw the slide lock. Yep. Draw two in the head box. Slide lock, mag change four in the body. Yep.

And I will say I was happy with my groupings. Even. Even the head shots where I would most of the time come a little low. My groupings were still really good. My groupings on the body were really good. I was consistently well under six seconds

for all of them.

But I did. I didn't do. Not at one clean run with my concealed carry.

I had the run going. I got Excited. After I got the. When I. When I saw the two head shots go perfect. And then I pulled one a little bit to the right getting on one of the body shots.

So just to give you the ranking, if it 10/ seconds is a novice, less than 10 seconds is an intermediate, less than 7 seconds is advanced, less than 5 seconds is expert.

I see my dot much better draw look bad. I'm not focusing on that spot dot on the target. I'm more interested in trying to look through that.
