Oh, this is something we were talking about the other day. The ATF gun registry. So this was out for Ammo Land. And a new report from Reason confirms that. What? Ammo Land has been warning American gun owners for years that the ATF has quietly built what amounts to a backdoor gun registry in violation of federal law. This is different than what we were talking about, but I mentioned it, where if you have a FFL or a gun owner go out of business, they take all the 4473s. Apparently they've made a big database out of that and creating.

Well, they made a database out of all the 4473s. There's no way they're getting rid of that information. No. So they may not know what gun you have, but they know you have a gun.

They haven't made a database out of all the 4473s. They made a database out of the ones they got. Made a database out of all the nicks checks that have been through. Yeah, it's different. The 4473s have all the gun ammo or the gun information on it. The serial number, the type of gun, the number of guns, all that stuff. The next check just does is just a nick check. It doesn't have that information.

They have a database of who has guns.

They have a database who has guns. And they have a database of these people or these 4473s that have been turned over. So, yeah, you've got.

Michael Cloud, Republican out of Texas and 26 of his colleagues have demanded answers from the ATF about the scale and legality of this database. Well, there is no legality of the database. So it says that hundreds of millions, possibly over a billion, firearm transaction records have been digitized from former dealer files. Which is completely illegal. But they still do it.

Yep. They have a list. We've always Known they have a list.

So yeah, they were using a Biden era rule that requires FFLs to retain the transaction records indefinitely to do this, but they still shouldn't be able to digitize it.

So, oh, this happened the day after our last episode. So I'm sure if anybody listens to other gun podcasts, they've heard about this. Janine Pirro, formerly from Fox, who is now, what is she? What is she now?

Yeah, but she come out, she come out and says, I don't care if you have a license in another district. I don't care if you're a law abiding gun owner somewhere else. You bring a gun into this district, count on going to jail and hope you get your gun back. This is our great DOJ who's pro second Amendment. She tried to walk it back the very next day. Of course you did it said. But she attempted to reframe her earlier comments, writing in a social media post that she is a proud supporter of the second Amendment. I think she also said she owned a hangover.

But she first came out, when she first came out into there, she was Talking about the D.C. gun laws being unconstitutional and she would not enforce unconstitutional gun laws in Washington D.C. right. Well, yeah. Now somebody you can't carry a gun is unconstitutional. So we got Control Pew out of sue in California. I think this is, this might be related to larosia. I think this is related to La Rosa case where California is suing Matt LaRosa and Control Pew for providing files for their 3D printing. So now they've countersued California according to the complaint filed. And this was filed on February 11, which links to written guides, photographs and digital design files, including 3D models. So you got multiple states suing over these 3D printing files and trying to make it unconstitutional or trying to make it a crime if you have them. So they're getting, they're out of Florida and California is filed a civil enforcement action in San Francisco against them. It's gonna be interesting to see how that turns out. Maybe his next episode this week in Guns. He'll say something about it whenever they they provide one. I know the guys on this this was we like shooting said they were going to try to get him on their show so.

idea but people put on there to legally defend themselves against first self defense or put on there to legal man legal homicide and they put that on there and it's been approved but put God given right and that wasn't approved. But so apparently the ATF has comes a little bit of common sense and so they started approving the previously denied avoided Form 1 applications. It sparked that outrage. So they'd gone back after they had such an outcry over that one guy who who posted it I guess sent it to GOA and GOA really put that out there that they were doing that. So now they're starting to approve those. So we'll see how that goes. But it's still crazy that you have to even do anything to get a suppressor.

Yeah that what it was Virginia that was and it may come up later but they were trying to add a 500 tax to suppressors. Yeah, there's one of the. Is one of the bills that they were trying to get past that one actually didn't make it out of committee. No.

Yeah. They got like 20 other anti gun bills. And that one didn't come out. But that one actually the reason it didn't get out of committee was because of the medical community stepped in and said it was for good. For hand protection. Yeah.

Yeah. Which it is. That's what it should be. It's what it should be used for. But I just get irritated that everybody's so excited. Then we won. We're looking at what we won. Well, there's like you said, 20 other bills going through Virginia. There's bills. There's a new bill coming into Connecticut trying to ban Glocks. There's California doing the same thing. There's more bills going in California.

Yeah. Glock. Yeah. The problem with the people say it's easy to convert to an automatic firearm. So now they're just banning. Trying to ban it. It's just a roundabout way to ban all semi automatic handguns. You got the third, you know we're talking about 3D printed stuff. Third, the third circuit rules that 3D printed gun files are not protected speech. So they read that is not a protected first amendment right. Used to get those files which it had been ruled before that it was. And that's where the control Pew sues California and federal court over that. Some good news in which we talked about New Hampshire before being such a pro second amendment state. New Hampshire House approves legislation allowing carry on college campuses by prohibiting colleges and universities from banning guns. But it's just through the House now. It's got to go to the Finance committee which I don't know why the whole House approves it before the Finance committee approves it. And I don't know why it has to be approved through a finance committee. But then after that again then it goes to the, to the Senate following that. And you already brought up the Virginia stuff. So I was going to talk about that and then the last thing I had was, you know, we talked about all these states and these anti second amendment laws they're trying to pass and now we got you. You sent me a text. Alabama's doing the same thing.

One's trying to pass a red flag law and another one's trying to pass and it's not going to get out of committee. Gun storage. Yeah, gun storage. So neither one will get out of committee. But it's, it's one of those, it never stops. They never stop trying to, you know,

like I talked about. Well there's no consequences for introducing unconstitutionals. Yeah, you know, okay, if you're not going to put them in jail over, at least kick them out of office over it when they knowingly do this and not let them.

It's one. It doesn't have the mag, the extra mag pouch with it. Cuz, you know, If I carry 30 something rounds of.

But it's extremely comfortable. It conceals very well. So it's, you know, this is the one that was made for the Prime. The Canik MC9 Prime. And, and the MC9 I don't have. I have the MC9 LS, which is the same form factor. So it's good, good fit to it. I hadn't tightened up a little bit to, to make it like I wanted it.

So when you bought that, you had to buy it for the prime. They didn't have one specifically for the ls.

Yeah, so it did take about three weeks for me to get this, this thing in.

It's very comfortable. Conceals really well. But one thing I did notice, you know, the MC9LS has a full size grip, so it did print a little bit. So I took one of their. Their wedges and I got the. The standard medium wedge and I put on it. And it. It. The way I got it oriented, it pushes. It pushes the, the barrel out, which makes the grip come in a little bit more in and conceals much better and add a little comfort because it's a foam wedge. But. But that makes that. This little foam wedge makes it conceal very good.

So have you tried that gun in one of those Romero hosers that we

have to see out? Yeah.

Pretty bad in that.

Well, it's with the, with the red dot. I don't have one. It really fits my. Oh, I get you with the red dot.

It. I figured with the longer, longer grip, it would print pretty bad with those.

Yeah, it. I'm gonna say with the, with the wedge on it. It does really well with this holster. So. I like the holster so far. Pretty comfortable. Yeah.

Oh, they did. They do a good job with it. This is. You got a little bit of movement here, so you can. It moves with a little bit on the back. They're pointed right at you. Hey, it's in the holster. Calm down. I didn't see that. I can see. Yeah, there's a screw. Retention screw there. You can get a little more retention on the back. There's a retention screw on the front with the. We got the clips. There's a couple other retention screws.

And you said there's a lifetime warranty on those.

Yeah, but. Yeah, you got to go look at that. I mean, like, like yours that got broke in a. And we'll put quotes around this accident. Yeah.

Comparing it with my Echelon mainly and the Cannon SC.

And the Canon SC TP9SC. Yeah, the TB9. Those guns shoot so well.

Yeah, I keep shooting that. If, if mine didn't have so many problems with it, you know, if it didn't have the.

You kept breaking the chamber indicator.

Yeah, I didn't now just blows dirt and powder back in my face every time I shoot it. I'd still be carrying that one probably. Yeah, but they, they shoot well the comparing it to the Echelon. Yours is a little bit heavier gun, a little bit thicker. But I didn't notice on neither one of them if they both felt very similar as far as far as felt recall.

So yeah, didn't notice anything in the recoil.

They both shoot really flat.

The grip length on the. The LS is better than the echelon, a little bit longer than echelon so you can get a good grip on it even without an extended mag. The Echelon has better.

Yeah, definitely better slide cuts. The. Yeah. This one, this one. I wish I had a little bit more grip, but I hadn't really. It hadn't bothered me yet. But I may end up some point putting grip tape on it. We'll see.

It'd have to get tan grip tape to be able to do it.

Yeah, that FDE color looks good.

So. But now as far as comparing the guns, they shoot very similar. Yeah.

Close to the same size gun anyway. But they, they both shot well.

If I would, I would have bought that one or the prime. If the Echelon hadn't come with everything that it came with. It came with like five, five mags, a couple bags. It came with a lot of extra gear and I'm Glad I got it.

It's a good gun, so don't let. I like. I'm liking the holster. I wish it. I wish I could have gotten it a little bit quicker. Seems like three weeks was a little long for a codex holster. Yeah, but they do a good job. So it does look good.

It's probably better than what I could have made.

I like the way they closed the end of it up.

Yeah, we. I brought my AR pistol out, we did a little comparison with it and just to see, just to see how well that stock did as far as recoil, felt recoil, any kind of movement, and it's a flat shooting rifle. Of course, my, my AR pistol shoots really flat as well.

But you, you don't feel that, you don't feel that recoil at all?
A
No, no, the, the difference in the felt recoil surprised me. I mean I can. You can. My AR pistol, five six. I mean it's what, a 10 inch barrel on it and I mean it's not a lot of recoil, but you can, you can feel it pushing you back a little bit. But your rifle, man, it's, it's like nothing. You don't even feel it move at all. It was.

I took my 22 out the next weekend. Me and Misty went out and shot it and it was just not as. Not. It almost is loud of recoil as that.22.

So that, that stock being offset like it is really surprised me how well it. It took away. Recall, felt recall.

Oh, all right. So this is. This is a store owner and his wife. They had a little pharmacy and not, like I said, wasn't sure where it was at, but it's outside the country. But it didn't. Didn't really matter. This went about. So you get. The lady was standing close to the door. The counter was kind of an L shape where they kind of going from the back of this pharmacy around, turning and going toward the door. So she was standing there close to the counter, saw these two guys right up on a motorcycle, and you could tell she thought something Was up just from way she was acting.

And then she sees the one guy start to come in. So she moves back over behind the counter, but still close to the door. Well, as he comes in, he immediately pulls a gun.

Yeah. As he's walking through the door, she kind of takes a step toward the door too, which I thought was odd.

Yeah. But once he comes through, he pulls his gun with a store owner. The man standing at the back of the store does a pretty good draw for two.
A
Second draw.

Second draw and is. But he does it. One hand, starts shooting one handed. Right hand pulls draw, shoots one handed.

They both start shooting. They're both shooting at this point.
B
He's trying, but the robber was having to rack his. He didn't have it chambered.

So he got a shot off before this guy.

Oh, I think we already. Well, we're not going to talk about what he should do.

He should have had it chambered, but he should have had it chambered. I tell you that. I don't know. You can come rob somebody, have your gun chamber.

the first shot looks like he catches the guy.

But as you said, he starts moving.

They're both shooting and he starts moving and shooting. Not he's kind of shooting behind his back. Kind of.

So his second or third shot strikes his wife.

Yeah. Killed his wife. I mean, she goes down quick.

Yeah. It must have hit her in the head because she went down pretty fast.

He didn't know it at first until he fired a couple more shots. The robber goes out the door, stumbles and he dies outside the store. And then that's when he sees his wife laying over there in the corner.

He was, he was a bit, bit distraught over the whole ordeal.

I think he figured out pretty quick it was him that did it, not the robber. I think.

But let's go through what he should have done.

Well, let's talk about the use of force.
A
Legitimate use of force. I mean, he came in, pulled a gun. He was trying to rob him. He, he, he immediately goes to his weapon. It was, he was very aware of his surroundings, which is good. He was prepared where he was. His gun was on him. It was not on a shelf and he didn't have to go retrieve it somewhere. It was on him. He, he drew quickly. He was effective with it to begin with when it was effective use of it. Effective use of it, but accuracy was way off.

And his shooting one handed, moving back to your left.

Well, not only moving back your left, moving and basically running away, shooting with the. With the gun. Not even have an idea where the bullets were going to hit his wife.

He could have hit somebody else outside.

Yeah, it was. Yeah, it was. It was. He needs to shake on that video. Oh, it does sound better. So much better when you get in on the microphone. I think I get so close to this stupid. Well, get up on it.

It would have been better if she had been armed as well.

Yeah, I don't know if she was. I don't think she was. But by the time everything was going on, she then got shot. So I don't know if she would. Had time to draw her weapon.

Yeah, the best thing for her would have done was to move over behind her husband, move further. Move further away instead of being right there at the door.

Because it appeared that. See, she was a little nervous about the guy because he kind of lingered around outside for a minute and then he comes in because she had moved around the counter. But then she took a step toward the door almost like she wanted. She was going to try to help him when he came in, but then she. She's almost. She was in the line of fire at that point.

Yeah, I think she might have froze.

Yeah. I don't guess she thought her husband would be running away shooting either. So. Yeah.

Even if he, you know, what rear did you think?

I know he's armed and if I wouldn't, I would just get out of the way completely.

Yeah, yeah, I'm with you. She probably looks kind of froze a little bit. Didn't know what to do. If he just stayed on his mark or just moved a little bit to the right, still facing him, or moved to the left facing him, but not running off shooting behind your back. He'd have been better off. But he didn't want to get shot at that point. He should have quit shooting. That's what he should have done. He should have stopped shooting. And then he didn't know if he.

I don't think he saw the. I don't think he saw the first shot. Well, I think he was shooting wildly at the very beginning.

Well, I was from that area. I don't think she was there at this time. But while the Uber driver had two teenage passengers in the back seat at the time. So Daniel, this is the guy that did the shooting. He was arrested on February 6, hours after the morning shooting on inbound Interstate 50, 55 near Damon Avenue. Do you know where that's at?

The victim remained behind Daniel's dark gray Toyota. And then when he exited at the. At Damon Avenue, as he. As he did, the victim allegedly saw Daniel rear passenger's window roll down, heard a loud bang, and he was shot in the right thigh. So as he was exiting, the guy had his back window down, reached back and shot at the guy.

He claimed he felt threatened because the other. Other driver rolled down his window while the cars were parallel there. His arrest report said.

All right, so let's move on to Pennsylvania gun laws. Hopefully you got something written down for that before.

Before you jump into it. Before you jump into it, this. So you cannot bypass a nick's check by having a Pennsylvania gun permit. And they are ranked 37th in the country in gun ownership at 40.7% of households having least one gun in their house.
A
All right, so Pennsylvania is not a constitutional carry state, but is a shall issue. You must be 21 years old to come to get a concealed carry license or concealed carry on all states.
B
Now, at least all states shall issue, or there's some major.
A
I still like saying that. So concealed weapons license is issued at the county level by the sheriff's office. There is no permit required to purchase a firearm. And although you're like this, because this kind of goes into what we said earlier. Although there is no comprehensive firearms registration, the state police maintain a database of all handgun buyers. So that's state level. In Pennsylvania, private party transfers of handguns must be conducted through a licensed dealer or at a county sheriff's office. And a background check is required. Open carry is legal for anyone 18 years or older. This is Pennsylvania. Because we forgot by now that you forgot. Well, you're not paying attention. I'm listening. You must have a concealed carry license or license from a recognized state to carry a loaded firearm in your vehicle.

Which states are recognized by Pennsylvania?
A
I'll get to that in a minute. I got it listed. Look at you. So you must have a. Now you must have a c. Concealed carry license to open carry in the city of Philadelphia. So you can open. Open carry is legal for any 118 year older without a license. Except for Philadelphia. There is no training requirement to obtain a concealed carry license in Pennsylvania. There are no mag limits. There are ammo restrictions. But I want to read this to you. So ammo restrictions include ktw, Teflon coated bullets or other armor piercing ammunition with the intent to use the ammunition in a crime. So you can still have it. But if you, if you use it in a crime.

You said intent. How do they know what your intent is?
A
Well, when you go commit a crime, then they'll just add another charge to you.

Okay? That's what you got that MO and you commit a crime. Whether or not you use that gun in that crime, you're gonna get. Yeah, you're gonna get busted.

Yeah. Or if you use it within that ground, you definitely have intent then. So that's. I just told you so. You can carry at state or national parks or roadside rest areas as long as you have a concealed carry license or you're a licensee from a state that Pennsylvania has reciprocity with. I'll tell you those in a minute. There is no duty to inform an officer that you're carrying unless they ask you. There are no red flag laws in Pennsylvania. So Pennsylvania overall is pretty good state, by the way. So weapon signs are not recognized or enforced. The concealed carry license is linked to your driver's license. So here, here's the reciprocity. So this is. I'll give you a list of the states that have no restrictions. And then there'll be some states that have some restrictions. We're not going to go into those restrictions because they're all different. So you acting like you falling asleep. I go in and write this stuff down.

We spent 20 seconds on Oregon last time. Now we spend a little bit more time on Pennsylvania. They just go, all right, reciprocity. Here's the stakes. Alabama, Arkansas, Idaho, Indiana, Montana, New Hampshire, North Carolina, North Dakota, South Dakota, Vermont, Virginia, Wisconsin, those are states without any restrictions. If you have a conservatory license from one of those states, Pennsylvania recognizes that's surprising. So now with restrictions, and you'd have to go look at what your restrictions are. Like Florida, the restriction is you have to be a resident of Pennsylvania to use their license in Florida. So it's this still not really. I mean, if you're gonna have a Pennsylvania license, didn't have any restrictions.

Well, you have to go look at what the restriction is. Like I said Florida was. If you had to be. If you have a Pennsylvania license, you have to be a resident for that license to. To apply to Florida. So it's just depending on. So all the states are different on the restrictions. So you had to go look up at particular state.

So the reciprocities is very, very good.

Probably over 30. Over 30 states they had. They have reciprocity with. So that's good to know. So if you're going to Pennsylvania and you're in one of those states, whether you're. I lost my word. What's the word I used a minute ago?

So after the dust has settled a bit, the federal government realized they can't make state laws of any kind. They had this big talk fest with lots of grandstanding and all the gun ban slogans they got from the usa. He's right.

And have settled on a few main points but have not. And he put in quote in quotations or in parentheses cannot release the full bill until it goes past the Senate in the next few weeks. They had a call and support from different sides of politics to find enough votes in Parliament. And this has caused some major dummy splits around the parties and brief. So there's several different parties in Australia. You got the ALP which sports holds the government. And they're like the Biden Democrats. You got the LNP are like Republicans but they must get help from the NP who are like Conservatives. And the Greens are known as the Watermelon Party. Green on the outside, commies on the inside. That's what he wrote. So everybody has a following out.

So luckily they're not. They're not done anything yet. They do have some title. Tighter federal control on imports would ban them at the border way of forcing states to comply and double up on paperwork for importers. So you must be a citizen to get a license. Not sure this would stop bad people from being bad people as 99% have proven to be bad. People don't have a license now. And their holy grail, a national gun buyback. Last time in 96 they think they got one third of all guns, but most were rusty POS guns that nobody wanted anyway.

Kind of like the buybacks that happen here. I think they get old guns.

Oh yeah. A third were registered and the other third became known as ghost guns. So that's not gonna work. And where he's at in Queensland has had a permanent amnesty on all firearms for decades. So if you can find a gun, you call the police and they come and get it. Almost no questions asked. So I still wouldn't do that. And he was talking about. A lot of people don't do that either. So luckily, even though with all the talk there they haven't put in any more gun control. That's going to be our first country we do. Once we get past all the states and trying to go through what all they have in place, we'll probably lean on Dave a little bit more to get some of that, get more information from him on how they do. He's already provided quite a bit on what he does and what hoops he has to go through to get to get the guns he wants.
