So apparently when we were talking about the. Why say apparently the Canik prime and the Canik Prime Radian, we. We made a comment about that being a kind of comp. Or a suppressed barrel in both of those. And those are compensated barrels, not suppressed barrels.

Anyway, so that is a correct. That is a wrong statement there. They are compensated barrels.

And the next. Next correction is. I also. We also made a statement that we were going to review that shooting by ICE as part of our use of force. And we're not gonna. We're not gonna do that. Just there's been enough reviews online from people from both sides and everybody has their own opinion on it. I'm not.

We're gonna talk. We're gonna talk about it from a 2A point, though.

Yeah, from a 2A point of view, but not necessarily the. The use of force that the ICE agents used on. On the. On the gentleman. So just kind of.

That's not really a correction. That's a clarification.

Yeah, a clarification. And I do want to reaffirm that this podcast is a pro to a podcast. Not a pro Republican, pro Democratic podcast or pro Trump Trump podcast.

We're Pro2A, so we're going to be Pro2A regardless of what your political beliefs are and regardless of what. Yeah. Who's caring, who's not caring. Everybody has a right to carry. We're not going to be wish washy on if, if you're against our political beliefs then you, you should be not carrying or what are you having a stroke? I'm just thinking about what some of our, some of our government officials have been saying recently. Patel, Gnome, Trump, all these guys and,

and anyway they came out and lied about it. So then they, then they talked about how they shouldn't be carrying guns and then just double down on it. Well you can't have a gun in a protest. Well yeah you can. And then you go look at comments on articles and all the supposed right right wing I guess conservative individuals individuals are talking about. Well he was clear new legally because he didn't have his permit on him. That's not, that's not carrying illegally. No that's that's a citation for $25 in, in Minneapolis that if you go and show your, your permit then it is is thrown out. Who cares But I don't care anyway. Exactly.

We fight for years. You know we shouldn't have to have a permit to carry. So why are we going to get mad when somebody does carry?
David
Yeah, I don't need somebody's permission whether

they did or not.

Well anyway it's not, it's. They get the laws wrong then they, then you see comments about people. Well as soon as you see a police officer you need to tell them you're. It's law that you tell them that you're carrying. It's no, it is not.
Jody
I don't know anywhere that's law.
David
So let's, let's get our facts straight before we start just going off on one side or the other because you didn't like the guy or like his views so he doesn't get to carry. That's not what we, that's not what second Amendment advocates should be doing. We should be advocating for the second Amendment.
Jody
And I was glad to see a lot of the second Amendment organizations did start coming.
David
Yeah. Oh I had something I was going

to read from Second Amendment foundation. Even the NRA which maybe was is not as strong as it could have been, but at least they did come out. And some of these other organizations, Gun Owners of America, all these organizations are now coming out Pro2A and not just pro whatever their political beliefs are. Yeah.
David
So Colin Cole knew our made a statement. This just kind of brief what he said not getting into the video and all they said this conversation is being hijacked and that's intentional. What's being framed as a pro Oz versus anti debate is actually something else entirely. A fight using guns as a proxy. And that's where the lies start on both sides video and he goes about the video, how he breaks it down and he says on his video here's what he's. When he goes and breaks down the, the shooting and it's if you, you want to go watch if you hadn't seen it, you the colon noir breakdown of the video is very good. And he goes, he dresses why simply carrying a farm does not make someone a criminal. What Minnesota law actually says about carrying that protest which is it's legal, why it wasn't smart and wasn't legal are not the same thing. The uncomfortable reality of anti gun rhetoric even from people we've defended why actions matter more than sound bites when judging politicians. And that's one thing I listen to this another guy and he made a comment I really don't care what some of these, what Trump said about it because I care about his actions. Well his actions aren't backing it up either.

So now we'll talk about some of the actions.
David
It does matter what our, our leaders say about the second Amendment. It matters. So then it goes the real legal standard for deadly force under the fourth Amendment and on and on and says this, this isn't about locking the protest. This isn't about locking eyes. This isn't about defending stupidity. It's about constitutional consistency. And that's what we're going to be talking about is the, your belief in the second Amendment doesn't disappear at the moment person, a person carrying isn't on your team. And that's what kind of got me about this whole thing. How, how quickly the conservative side, right side wanted to frame this guy shouldn't have been carrying. He was carrying illegal. He didn't do this or that so he don't get to carry and he deserved to get shot because just because he was killed and that sort of stuff and that's not political.

The hypocrisy on both sides is irritating.
David
You got. Well then you get the Democrats left side that are hey, we're for 2A. No you're not. You're using it as a, as a means to, to show the hypocrisy of the ride at this point I'm used

to the hypocrisy on the left which is so that would, that wasn't as bad to me as the hypocrisy on the right.
David
We just need to be consistent with our message. If we're going to be pro second Amendment then we need to be pro second Amendment. I know we said some of this in the last episode but they gone we. We got to be better because liberals are going to keep trying to pass laws. They're going to keep pushing stuff.

We see this, we see that in Hawaii with, with laws being passed now. We see that in Virginia. We see it everywhere. We see across the board laws that are getting passed and we're talking about that in some of in the new stuff and we'll talk about some of the stuff that that the ATF is doing and just so happened to have done it right after shot show which is interesting timing in that.
David
Oh you mean the ones that said they were pro second Amendment.

Those guys. We'll talk about something that is going on now that just happened right after shot show was over. The they did. I thought I find a while the timing of that is interesting.

So let's kind of give it an overview of what the other than the raining we just did. What's. What's our. What's the episode going to be about today? We got a little bit of guns and gear about everything.

What it's always about. We're going to start off with some

in the news gear little in the news. Now I don't have. We're not going to. I didn't get an opportunity to go shoot my my new Canik MC9LS because I had to go to had to go to Corinth, Mississippi and do look storm cleanup man. There's a lot of ice and trees down.

So it's kind of good job and then a little bit of self defense scenario stuff.

We have one use of force case and then we have one case where there could have been a use of force used to stop someone and it wasn't. So we're kind of looking at both of those those cases a little bit a little bit different than what we've done in the past. So we'll kind of go that route this time.

26. So just, just a few. Just the days after Shot show ended.

So basically Shot show ended on the Friday the 23rd, I believe. So the 26th would have been on that following Monday. So here's what they did. The US Government, through the atf, filed a rare statement of interest in a private infringement lawsuit brought by Rare Breed Trigger against Timothy Hoffman, who I think he was out of Tennessee, who designed a similar trigger to what Rare Breed has their force reset triggers. And basically a year or so ago, where the ATF settled with frt, the Rare Breed people and quit that case because they were going to lose. So they stopped and just settled it and they basically told Rare Breed if they went after everybody that was making any kind of similar triggers that they would help them, which is ridiculous in itself. So they're stopping this guy who is 3D printing some similar triggers to Rare Breed. So Rare Breed has been notorious for going after anybody that has any kind of, any kind of binary or force reset trigger similar to theirs. So here you got the ATF saying that they're going to be Pro2A in the various days after Shot show, they sign on with an organization that's suing up another guy for making a trigger.

Back to what we said before. Don't, don't just tell me what you're going to do. Go do what you actually say.

So, so just, just irritating and, and just showing the absurdity of the NFA. Following the $200 fee going away, you had a National association for Gun Rights staff member. He successfully registered a potato with the ATF as a silencer.
David
What to do with your dog? Man, Your dog's barking right outside. Right outside the dog's room. Oh my gosh. Yeah, we got your dog put up. Let's, let's do this.

All right. So by the definition of a silencer, according to the atf, if you attach something to the barrel and it causes the sound to decrease, then it is considered a silencer. And by putting a potato on a barrel, it technically decreases the sound level. So he was able to get that through. And apparently I was listening to the. What's those guys this weekend?
David

This weekend. Guns. They were, they had mentioned this as well and they said there was quite a few other people try to do that. And ATF is now not allowed to go because now they're saying that you can't put a serial number on it. Yeah, but it just shows you how silly silly it is. But this guy was able to do it under the definition of a silencer in which which I don't know how the ATF and can say that it's not it according to their definition. So they're not approving these documents, these form ones or form fours. Then they could, somebody could open themselves up for a lawsuit.

Yeah, they can do whatever they want because they get away with it.

There was so since the, the first I think 21 days of January, there were 300,000 NFA applications for suppressors. It's a lot. That is crazy. They had 150,000 of them improve approved already. Looks like their turnaround time has still been pretty, pretty fast.
David
Yeah, I'm still waiting till it's not an NFA item.
Jody
No, I agree, but it is a simpler process and you don't have to pay the 200 fee. But still suppressors are just too high. Now technically you can create your own suppressors. Nothing saying you can't create a suppressor in Form 1 or Form 4. I can't remember which form. It's one of those two forms. You yourself serialize it.

you can, but then it's not going to cost you. Yeah, the 800900 for suppression, you could 3D print one for 10 bucks probably and use it a few times and you know, print another one. But. All right, so I did see some news. I'm sure everyone remembers the school shooting, the Uvalde school shooting in Texas. Wasn't that in Texas? Yeah.

Yeah. So the, the officer who hesitated was cleared of any wrongdoing. Yeah, I thought I had more on it than just that. Oh, good.

So yeah, gun news.

Fourth Circuit ups holding most of Maryland's sweeping sensitive places gun ban. So again we keep seeing these, these laws getting put into place. And it takes me back to where the guy asking the question during the ATF meeting and the DOJ meeting at shot show where he said, well, why don't some of these lawmakers get charged with creating unconstitutional laws? And they say, well it's not against the law to make an unconstitutional law. I could agree. No, this is, this is why it continues to happen because these courts,

there needs to be consequences for, for these laws being enacted like they Are. But yeah, I, I understand if you're trying to make a legislator makes a law and then, or proposes a law and then somebody says, hey, that's unconstitutional, I can understand that. Hey, you don't want to be held. You don't want to go to jail for screwing something up like that. But, but I get knowingly make something.

I know our government normally does it to us all the time. I know.

And it should be some accounting accountability.
David
The accountability would be voting, but we can't even do that. Right.

Or the Supreme Court having some system in place that would enforce the rulings that they have.
David
Well, the problem is we have a populace that wants to be told what to do and how to do it. Obvious.

From the, from latest. From code and from this, this latest shooting.

Supreme Court maintain the freedoms that we want to have with the problems that we currently have in the leadership. It isn't gonna happen. Okay.

Supreme court heard nearly two hours of arguments on the confused, dumb Wilford versus Lopez case. And this was on the 20th of January. So it was because I know one of the guys that was at the shot show doing that doj, part of the DOJ had made arguments in this case. So he was there. But this is around the vampire rule case from the.

Oh, yeah.

And it looks like from the questioning from the conservative majority, it sounded that they sounded very skeptical of Hawaii's approach. And basically they're just saying if it's a private business, you have to get permission to carry there. Where it should be exactly the opposite. The private. If it's a private business, you should be able to carry there. Unless the private business tells you you, you can't. So it's, it's going to be interesting to see how they rule. Hawaii's got several other bills and trying to put into place now before the

ruling comes out, and.

Which is, which is ridiculous.

Yeah. One of those is the Senate Bill 2720. Yeah.

Before you get to that, though, let me just say.

Just let me. You got to Hear this. So during the arguments, the Hawaii lawyers put on part of their argument. They used a, an 1865 Louisiana law that prevented blacks from having firearms, arguing that it met the test of history and tradition. I get so sick of the history stuff.
David
But they tried to use something that was unconstitutional. Yeah, I get it.
Jody
Who cares if it history. Let's just go by what the laws, what the Constitution is supposed to mean.
David
Well, here's what Hawaii is trying to do and I think Illinois as well. But this is Hawaii. Senate Bill 2720 requires any gun company that wants to sell its products and in the state to pony up cash into Hawaii's farm injury restitution fund.
Jody
What kind of. You say farm?
David
Yeah, that's what they call it. Farm injury restitution.
Jody
Trying to say firearm.
David
No, farm injury restitution fund. And once you pay your money into the this fund, you will be given a valid firearm injury cost recovery license which will allow you to sell guns in the state of Hawaii. And if you don't, then you don't get to. Then you, then you don't get to sell in the, in the state. You're shut out of the gun market. Something similar is trying to be passed in Illinois as well. So it's these, it never stops on the left to push anti gun policies. And that's why I said we have to be consistent on the right of where we stand with the second amendment and that's we should be able to carry and have guns anybody, anywhere, anytime. There you go.

This first case is out of Utah. So you had a woman critically injured after being shot during an attempted carjacking outside of a fitness center. But the suspect was also shot and injured in the encounter. So you basically had a lady walking out to her car. What was the guy that. One of the individuals that was indicted over this was a lieutenant colonel. I can't pronounce his first name. Nick Mila, 20 years old.

A lieutenant colonel, 20 years old. No, there's no Way I looked it up.

I looked it up. Even looked up the court proceedings, and he was listed that way as well.

So you had a lady going after a vehicle, and some of this was caught on camera, and some of it was not. So the police responded to reports of a shooting at around 10:45pm in the parking lot of this fitness center. When they arrived, they found the victim with gunshot wounds wounds, and she was shot in the abdomen. And I didn't say where the shooter was shot, but apparently he. He fled, was taken to the hospital by some friends, dropped off at the hospital by somebody. So documents report that Mila, which is that Lieutenant Colonel, approached the victim as she was walking to her car, and then she was seen a few minutes later on surveillance footage flipping back towards the gym. So through witness statements, they said that the man was holding her at gunpoint, demanding her keys, which she would not give to him, and then was some way or another able to get to her firearm. And they both shot at each other, hitting each other. He's now being indicted along with a second person who was in another vehicle waiting on him.

So it's. Let's just talk about this use of force case of. I mean, we can bypass legal and moral. Of course, she was definitely had the legal authority to protect herself and it was morally correct for her to use. Use lethal force. But I. I look at it more from a situational awareness type thing. So you got her out. Out at 10:45pm Walking back to her vehicle. Yeah, I didn't. There's some information I would like to have had on this case. Where she was parked, was it well lit? Where was her gun? Was, was it on carry, on body carry or off body carry? Apparently she was still able to get to it and use it effectively. But I would been interested for that report to say that and once. I hate these reports because they never say that. Are you looking it up?

Well, apparently the guy named Galusha Pennypacker is generally recognized as the youngest person to reach higher command in the U. S. Army. Becoming a brigadier general at age of 20, 18.

He joined at age 16 and achieved the rank of colonel in 1864, then brigadier general at 20.

So her situational awareness, a lot of it is just. We're not, we're not sure. Let's just talk about what you know. If you're coming out of a fitness center or wherever, going to a parking lot, male or female, and you're alone, or even if you're with someone, you need to be aware of your surroundings and who's around you. It seems like you had two people coming up in a car. One got out with a firearm and then approached this lady. So I don't know how much chance she had to avoid it. And I don't know where she was parked, if it's a well lit area or not. But things like that you need to think about when you're parking your vehicle in these, some of these, some of these parking lots. How she was carrying it doesn't say. I would imagine it was probably not own body since she was leaving a fitness center. She probably had it in a bag or something, but she might have put

it on her when she was.

But you know, she had it so good on her part for being armed. And it sounded like she was pretty ready because even though he was pointing a gun at her, she was still able to get her gun out and fire on him. Even though she was hitting the abdomen, she was still able to use her. Use her gun effectively. And she survived. Thank goodness. Gunfights.

Are the other guy survive?

Yes, yes, he's been indicted, so he's. He's fixing to go to prison. I tried to find the court cases, but you had to pay to get all the court cases off of it. But all the information. But yeah.

So carrying. Good on her part for being ready.

Good on her part for using her firearm effectively. Yeah. I think we just need to be more careful how we.

She had two. She was a terrorist, apparently, according to our government. So that's what you're getting at. So good. Good job on her part. So I think it was a. Definitely a good use of force on her. Saved her, saved herself.

Yeah, go. You can go on YouTube and watch this one. It's an interesting, interesting little shooting. So you had basically what looked like an office where you had three gentlemen sitting inside of an office. I don't know what they were. Two.

Two guys behind a. Okay, two guys and lady. Yeah, okay. Yeah, yeah, two. Three people sitting in an office. Two behind the desk, one sitting over kind of a.

On a couch.

Chair or couch? Yeah, across from them.

You had one individual on camera that you could see come in with a gun already out.
David
Yep.

It seemed that the three. Three people kind of ignored him at first. They shot one one time.
David
They didn't really pay attention to him. Then he fires off around.
Jody
Fires off around. Then he starts taking stuff from them, you know, their possessions, any money that they had.
David
And they still seem somewhat relaxed.
Jody
They were. They were very calm. None didn't. Didn't panic. The two people behind the desk. At one point, the gentleman with the robber with a gun turned, kind of turned his head and his back to them to talk or to face the guy that was sitting on the couch.
David
Right.
Jody
This was an opportunity that, That I want to talk about that the guy had. Because one of the gentlemen that was behind the desk had a gun in his. In his belt, waist belt. He could have pulled his gun at this point and used it, but he did not. He did not. And this is what we need to think of when we. We run through these scenarios ourselves or what we should do in certain scenarios, or whether or not you should. Should have at this point. Because after this point, when he turns back toward this guy, he sees the gun, takes the gun from him now he's got a gun.

He hands it off to a second guy.

Second guy, which now comes into the picture because. So that guy could have been in the room the whole time. So it might be why.

It may be he didn't use. Could be.

Apparently the guy on the couch said something. He said something to the robber that made the robber pretty irritated. Shoots him in the arm and then shoots him five more times. Yeah, One time is he.

And he's walking out.

Starts to walk out and turn around and shoots him a six time.

He's already laying there bleeding, not moving. He shoots him another one as he's walking out. Here's one more.

So. And he didn't shoot either of those. The other two people.
David
So now they got lucky.
Jody
Yeah, they got lucky.

He shot that guy without him blinking. Man didn't hesitate. He just kept shooting.

Yeah, he. I don't know what the guy said

or if he did say anything, but he said something.

He must have. But it just goes to show that you've got to be prepared. It looks like the guy, he was the only person in that room carrying. You had two other individuals there that weren't.
David
Yeah, I think that. I think there may have been somebody in that room he didn't pull.

Yeah, I think so too. I think that second guy was probably there and you just couldn't see him on camera because that was the question that the active self protection had. This guy had the opportunity when this guy turned his head, but not at that second guy.
David
But then. Yeah, I'm not sure the second guy had a gun though, because he got handed that gun. So I don't know.
Jody
Yeah, if he didn't have a gun, then he should have kid. He should have pulled at that point. You've got to take your opportunity when it presents himself. We've seen it in other cases.

Oh my gosh, that's awful. Here now. All right. Anyway, take the opportunity when you get it. We've seen other cases where there's been robberies and the individual wait until the robber turn. Well, with the. The one with the guy that couldn't

Yeah, he took a. He took a Opportunity where that guy can't see him because he's wearing him at that time.

So, yeah, take your opportunity. David's available.

If you're carrying a farm, you need to run through these scenarios in your mind trying to figure out what you're going to do in certain situations so you're better prepared for it if they ever do happen. Hopefully they don't, but you need to.
David

If you're going places, if you're sitting where the public can come in, if you're in areas that you might be carrying and are worried about something occurring, have an idea of what you're going to do in those type of situations, have a plan ready. So I did talk to one of my host sellers a few days ago and I was asking him about the Cannock Prime Radian when it's going to be coming out. You Know a lot of times the cannon is. I love their guns but man they're slow at rolling some of these new guns out. He said we should start seeing these probably in the March April time frame. Hopefully the optics as well. So you know we talked about last episode. All the optics.

Yeah. This is our third episode in a row, three weeks. So before you get started. Oh my word. You cannot bypass the next check with the concealed carry permit from Oregon. Okay. They are ranked 15th in US in gun ownership with 50.8% of homes in. In Oregon having a at least one firearm in their home. That's all I've got on it now. Hopefully you got.

Oh, I got tons of information. So the age of concealed carry. That's 21. That's 21. It is not a constitutional carry state. So you. You do have to go get a license, a permit, and you have to meet a firearms training requirement. Yeah, I'll talk about that in a minute. And then you can't open carry at 18. You can't carry in your vehicle with an organ serial carry license. There is no duty to inform.

Hey, calm down. I'm asking questions. You can carry with a. Where they concealed carry license in parks and national forest. Also in roadside rest areas. You have to have a. A concealed carry license. Okay. Concealed there are. Now there is red flag laws there in Oregon, so. So there is Preemption. But I was gonna read the red flag law. So Oregon has a red flag law. A law enforcement officer or a family or household member of a person may file a petition enjoining the person from having in the person's custody or control owning, purchasing, possessing, or receiving or attempting to purchase or receive a deadly weapon. So it's even one firearm. They throw a knife in there if they wanted to, I guess, depending on how they define deadly weapons. So I'm sure they could. So overall, I mean, it's very similar to North Dakota. Yeah. I mean, it's not a terrible state, but you shouldn't have to have a requirement to get a license, and you shouldn't. Shouldn't have red flag laws. So that's. That's very brief and limited on. On Oregon. I've been busy, man. Give me a break. Well, we said 21 to conceal carry, 18 to open carry. We went through most of it. Give me a break.
