A
We got it low this time.
B
Oh, welcome to everything, guys. We mean turn it up. I mean, we already started. You can't wait till it ends to turn it up.
A
I'm just gonna turn it up. We're gonna start.
B
It's too late.
A
All right, we're on. This is episode number 75. We're like three years into this podcast now. It's crazy. All right, let's go into some news. Hey, we're gonna start off with some good news for you.
B
No, we're not.
A
Well, according to some two a people supposed to a people gun people. This is. This is awesome news from. From peg. Heseth. Pig. I did say pig. I went hegseth. I said
B
Pete.
A
Pete. Pete Hegseth. From the department of war.
B
Yeah.
A
So he, he has signed a memo allowing soldiers to carry personal sidearms on dow property. And I'm gonna turn this over to you because you work at a army base.
B
Oh crap. They're calling it dow.
A
They are so stupid. I've been dealing.
B
I've been DOD my whole life.
A
It's deal. I don't know why they do that.
B
We want to call department of war now.
A
Well, the official name is still department defense. If you look at the websites and stuff, it's still department of defense.
B
All right. So, so stupid. Well, let's get into this a little bit. So as of April 2026, U. S. Secretary of war Pete Hex.
A
Not peg, Pete head says. Hey.
B
Hey. Seth signed a memorandum authorizing off duty service members to carry privately owned firearms on US Military installations. The order directs commanders to approve requests for personal protection with the. With a presumption of approval.
A
Oh, let's pause there for a second.
B
Reversing. Well, let me just go into reversing previous gun free zone policies on basis now. Target population. The policy. The policy applies to uniformed service members on U.S. military installations. Keep that in mind. What I want to tell you here in a minute. Where I work, US Service members authorized process authorization process request to carry and store personal weapons will now be considered whether presumption of necessity for self defense requirements. Applicants must be at least 21 years old. How old do you have to be to join the military?
A
If I recall correctly? 18.
B
I'm pretty sure it's 18.
A
Yeah, I'm pretty sure.
B
So those, those, those guys, you can't when you're on duty. But if you're off duty and you're coming on the base now, you don't trust you?
A
We don't trust you. Then we trust you to fight in
B
a war force but not to carry a firearm. They must be at least 21 have a valid state authorized permit or law enforcement officer safety act.
A
Wait a minute, wait. A state permit from.
B
Yeah, yeah, yeah. Be in good discipline, disciplinary standing and complete annual proficiency training. Rationale. Hexa cited the second amendment and the need for increased security on basis arguing against previous restrictions on personal weapon possession on military property.
A
Hey, if we're gonna cite the second. How about let's start the whole thing where it says we're not going to infringe upon some other rights. All right.
B
So. And then we, we, we just. You. You had me go listen to a podcast where people on the gun right side was just praising this like oh yeah, this was some big thing. I work on a military base. There are 45000 people at the base I work on.
A
That's a lot of people.
B
Of those 30 of those 45 000, there's less than 1000 that are US service members. The rest are government civilians or government contractors. We are. The base I work on is a gun free zone. This order that Piggyhead says just did does not affect that one bit. So I'm still disarmed. Going to work and coming from work,
A
2% 2% of the people on your base are. Will be affected by this. And probably not even because I heard anything from your. Anybody there that said this.
B
Well, no, they're not going to allow it. It's not going to change anything. It's all just sound bites. For them to act like they've done something and they did nothing.
A
They want to act like they're this big pro 2A or they're not.
B
Because if they are, all they had to do is say all military bases are now no longer gun free zones. Yeah.
A
And everybody legally can carry. Can carry. Yeah. And leave it at that.
B
Yeah. And. But they didn't do that and wouldn't
A
have made the caveat that you still have to get permission from your base commander or whoever it is you got to get permission.
B
Or that age requirement or. Or off duty. I'm not. So. So if you're active duty then you can have your personal weapon on the base.
A
Yeah.
B
How do you get it on if your own duty. I mean not acting but if your own duty.
A
It's a useless thing that he did and they just do it just so they can say they're Pro2A and they're not. And. But a lot of these gun people buy it. Every time the Trump administration does something, look how Pro2A. The Trump administration is. No, they're not. They're. They're just not. It's ridiculous. There is some, I got some pro, I guess some positive news and negative news related to the.
B
I guess we're in the news. So let's continue on.
A
Yeah, yeah, but I thought you'd love that. That story.
B
Yeah.
A
SCOTUS is now. They're allowing the Illinois public transit carry ban to stand. So they're using the sensitive places argument.
B
Yeah. That's crazy. Our Supreme Court is so weak.
A
Well, yeah, yeah. And it's. I don't understand how they can say that's constitutional. They use the historical crowd, which I get tired.
B
I hate historical and I hate common use. I hate those two things that we somehow have to use to decide if you get to use your have your rights or not.
A
Yeah, they use it. There could be kids and stuff on these. In these areas and these areas can be crowded and these areas are government
B
areas and all the more reason to have a vowel. Yeah.
A
I mean you get people hurt all the time on these, on these public transit from in Illinois and in New York and all these other places. But they're, they're allowing them to stand. The first Circuit Court says that the second Amendment does not protect buying guns there. So the three judge panel held that the second Amendment does not guarantee the right to acquire or purchase firearms. This was a case related out of maine to a 72 hour waiting period that was brought to. That infringed on people's rights and said no, no, the second Amendment means you says you can bear arms. Didn't say anything about buying. Yes.
B
Crazy. That's where they would use every argument to try to prevent us from having our rights.
A
This should get held. This should get on the Supreme Court docket because the 7th Circuit had already held that the right to bear arms includes the right to acquire arms. So there's a, there's a difference between the two circuit courts. So technically that's supposed to go to the Supreme Court now. But I don't trust them to do anything with it.
B
No, they're weak.
A
But so. Yeah. So a couple. Just ridiculous. They say how are you supposed to, how are you supposed to get them? Because there's a lot of laws going into place now where you can't make them own.
B
Yeah. So that's the whole point. That way you don't have them.
A
Yeah. Here's a. I guess a positive. So the DOJ is threatening to sue Virginia if the, if the new gun bills that are sitting on the governor's desk are signed into law.
B
Well, we'll see because that happens tonight.
A
Yeah, well, threatening and doings two different things. I don't foresee them doing anything. Even if they do. The gun laws are going to go into effect tonight, right?
B
Yeah. The only way they don't is if she sends them now. Well, she can send them back for to be amended. She's not going to veto them. The only way that it doesn't happen is she sends them back to be amended.
A
She doesn't even have to sign it. She can just go into law.
B
She didn't have to sign what I think they'll do. Well, I think she may try to amend a couple of them but it's Virginia's gone way left and it's not good.
A
Well, I mean Rhode island. So Rhode Island, Rhode Island Democrats are moving to ban possession of commonly owned firearms, expanding their already existing ban on buying those firearms. Now they're adding possession.
B
So we talked about this when we did Rhode island, you know, a few episodes back and did was you're going
A
to be a felon. Not just by keeping the fire.
B
You're going to have to, you're going to have to sell it somebody outside the state or destroy it.
A
Yeah, bull crap.
B
So now you can't sell it. You're going to give it up to the, to the government or give it to somebody, you know, outside of the state.
A
So there was some, some thoughts that the ATF was going to update their fire frames and receivers rule. But no, no, the ATF is, is going to keep the Biden era frame and receiver rule in place. So this is the one that basically outlaws you, you know the polymer 80 stuff. The what? The so called ghost guns.
B
No, you mean friendly government. Yeah, that's what you're talking about.
A
Yeah, that's the one.
B
Yeah, that's the good, yeah, the one that are for us.
A
Yeah. The only thing they, they do is go after some, some they'll go after states that are putting in laws and say they're going to sue and stop the states from doing it. But they're doing the same thing the states are doing. Exactly.
B
Yeah.
A
They don't want state to take in, take over their power. They want their own. They want it all to themselves.
B
So they could, they could do a lot. They don't do it.
A
Yeah. So the Washington in Washington D.C. after a three judge panel struck down the DC's magazine ban the Piro Janine Pirro and the DOJ requesting or requesting an unbonked review Even though she had previously stated she would not enforce the ban. I mean, so here again, I just want everybody to understand this is the people that we touting is Pro2A, this bait, this big Pro2A Trump administration. And here, here is Janine Perro who's I think she said she owns a gun. Right.
B
Everyone says own a gun.
A
But it was the Anbach review on that. So instead of going with what the three judge panel did, she wants to go, go after that. You know, we talked about the Virginia gun stuff, the laws fixed and going to play. So it did, it had a huge, huge effect on gun sales in Virginia. So there was a huge, huge surge in gun sales following those gun control bills going to the governor's office. And I'm sure today, I bet you today the amount of guns bought in, in Virginia.
B
Yeah, because everything goes into effect.
A
Yeah, I bet you just got to be crazy.
B
Well then they just end up doing like Rhode island and making them illegal.
A
Oh, I don't doubt it.
B
They won't stop. No, it doesn't stop.
A
And there's no consequences even if they do get found unconstitutional. They just put another law in place and now we're back into the, in the legal system for another five or six years even if it ever goes through it. So and this is, here's another, according to the NRA that, here's what the NRA says. This is you like, you'll like this. Trump administration continues to deliver for gun owners.
B
Where do they come up with this?
A
So this is, this is related because the USPS announced they proposed a, a proposed rule to allow certain firearms to be legally shipped through the mail. So this is, this proves that they're the Trump administration.
B
Great work for us Guns.
A
We get some of these little things. It's just awesome. And we got out of. Where was this out of? I can't remember where this was at. It might have been out of Washington. Now Missouri, this is out of Missouri. So this is Missouri versus Lechocky, the court of appeals and this is kind of a positive slant on the second self defense and more. The prosecutors and the government is all upset about this too. They're not going, they don't like this at all. So the court of appeals ruled that a defendant was entitled to a self defense instruction after displaying a knife during an altercation. And the court held if there was, if force was in dispute, it was up to the jury to decide whether or not it was self defense or not. So this lady gets into an argument there. These, I think these Two homeless ladies and they were into shelter and they get into an altercation. One lady kind of, according to the victim, kind of lunged toward her. So she pulled the knife out and at that point they were separated by somebody else and no, nobody got stuck. She's pulled a knife and she was arrested for it. And she wanted to use self defense during her jury trial because she said she was in fear of great body harm and they wouldn't let her use self defense in her in that trial where the court of appeal said, well, she should have been able to because they shouldn't have made that decision. It should have been lift up to the jury. Whether or not I don't, you know, I look at this, I don't know why we can't. They can't use. No matter what use. Use that as a defense.
B
I agree.
A
Let the jury decide if it's a good defense or not. Yeah, it shouldn't be up to a court decided. Yeah, you can use this defense or this defense. Use whatever defense you have and they can agree. The prosecutors can tear it apart if they want. No, this wasn't legitimate, but yeah, it shouldn't be pretrial stuff.
B
No, it shouldn't.
A
It said everywhere. You do it in Alabama too.
B
I know it's ridiculous, but.
A
Yeah, I thought that was. I thought that was interesting. I thought I had one more. I got one more.
B
Oh, okay.
A
This is, this is related to that. So an earlier appellate decision said deadly force like using a firearm or a knife can use. Be used to protect yourself against death, injury or assault if the force is reasonable. So this new ruling, prosecutors feel the ruling will affect victims of violent crimes. I don't know. How's that going to affect victims for violent crimes? I don't know. So it's. They think it will broaden when people can use deadly forces. Self defense.
B
Well, I mean self defense. Let them jury decide.
A
Yeah, there's. There's criteria.
B
I could sit on a jury and decide, hey, was that self defense or not?
A
Yeah, exactly. So that's why it kind of irritated me about that is that's not unusual. But yeah. So that good. I think a good decision by the. The Pellet court there. But we'll see what happens after that. That's all The. That's all. What are you looking at?
B
Have we not done Texas yet?
A
We ain't got to the tease yet.
B
I know. I thought we did it earlier.
A
No, no. Why are you looking at the map?
B
All right.
A
That's all the news I got. You get anything else from the news.
B
I doubt it.
A
All right, let's move on to some gun stuff. And this is more kind of talking about what basically we've talked about last episode or two. Those two carbines, pistol caliber carbines that we've been testing out.
B
Testing the one I bought. You know about our guns. Yeah. So I got the Smith and Wesson 9 millimeter carbine response.
A
Yep.
B
Took it out again this, this past weekend. I was gonna put that Zulu tactical stock on it. So we get. We. I bought that.
A
Yep.
B
DNA. Yeah. I mean I thought a little recoil, just a little bit. It'll be kind of cool to have it on there. Go to. Go to put that thing on there in the little base plate.
A
Little base plate off the. Off the back of the lower receiver.
B
Yeah. Don't fit. So. Nope. We know.
A
Yeah. We could probably find one that fits in.
B
As we do that, as we take it apart, a little piece falls out of my gun and we're looking at this little. This little metal piece and trying to figure out, well, where the crap does that go? And. Nah, I don't know. So I throw it in my pocket, put the gun back together, we jump in the truck, head out to the range. As we're driving to the range, I YouTube. Yes. Find out where it goes.
A
It was YouTube's awesome on that kind of stuff.
B
Oh my gosh. Yeah.
A
Yeah.
B
So I was able to put it back in.
A
Not correctly the first.
B
I put it in a little bit wrong. And as I'm shooting it and it doesn't hold. It doesn't stay open on the last. On an empty. Empty mag. So looked up YouTube again and showed me what I did wrong on that. But the gun shot really well.
A
Yeah. Comparing.
B
I'm not going to change the stock on it. It's. It's lighter than yours because it's polymer.
A
Yeah. We. We compared it to my Diamondback pcc which is a. Is a full metal gun. It's.
B
Yeah.
A
And it's definitely heavier. The RICO on both of them were very loud.
B
Yeah. Man, that thing shoots so good, man. Just. You just. It's. It's just. It just shoots straight. Yeah.
A
You got that nice red dot on.
B
You know, I put that sick red dot on it. I like it.
A
I got the del PVO on my. On that. I put it on that diamond back. Those things are so easy to. To zero.
B
Yeah.
A
And I put that little true glow red dot on my 40s.
B
Yeah. PC it's such a big moa. It's hard to.
A
Yeah. But it's a good little drip.
B
Yeah. Yeah. It's not. I mean, it's not terrible.
A
79 bucks. You can't say it's a little cheap for a little cheap red dot on there if you don't want to spend
B
like a home defense rifle. I mean, it's not bad at all.
A
Yeah, My only problem, I'm still having issues with my 40.
B
Hey, maybe you should use. Right.
A
I did try. I loaded that 9 millimeter Glock mag into my 40s and WA.
B
I didn't do well. Yeah.
A
And then one of the rounds broke. Part of the casing broke off inside the barrel.
B
Right.
A
So it wouldn't load anything. Yes. And once I got home that day, I just. I put a rod down the barrel and knocked up. Knocked it out and it's. We'll take it back out again this weekend and see.
B
You still need to email those folks.
A
Yeah, they're not happy with it. It's still not loading. It'll jam some of those rounds into it. It needs a feed ramp. Yeah, but that. The Diamondback that we shot, it doesn't have a feed ramp either.
B
Yeah, I'm pretty happy with my Smith and Wesson shooting Good. Like it. Yeah, it's gonna be a good home defense weapon.
A
Yeah. Yeah. So, yeah, that's all the gun. That's all the gun gear stuff I had. That's it.
B
Yeah. Well, I'm hood. I put another size. I've put maybe 150 rounds through that rifle so far now. So I'll keep shooting it, see how it does hang. Cleaned it yet? I have put some oil in it. Yeah, I've sprayed it a little bit just to. But I guess at some point I'll clean it. I'm shooting another few hundred rounds before I do that. Probably still shooting My. My MC9LS. Man, I like that gun. That's such a good gun. Such a good shooting gun.
A
I sold another little TP9 Elite subcompact this past week. Those are.
B
Yeah, those are still good. Guys. I like. I still like that gun. That's just. I like the MC9 LS just a little bit better. So anyway, good gear. Keep shooting it. Go see how it goes. All right, what you got next?
A
All right, let's move on to some use of force stuff. This segment brought to you by Clear Creek Shooting. For all your firearm needs, check out clear creekshooting3.com. If you can't find anything on the website that you want, shoot me an email and I can find you something at a good price. I Got one? Yeah, yeah, most likely. And just keep in mind, if you do buy something on my website, I have to have the FFL that you want it shipped to. I cannot give you a final pricing with shipping and everything until I get that information. So I can't just ship guns to people.
B
I had to.
A
I had to have an ffo. I sold a couple guns for a guy that worked off gun broker or a couple. Sold one Kimber, pretty nice little gun. And I got a guy right now, he's getting a gun made. I can't remember what it was now I'll look it up and show it to you. He's going to use me to transfer it for him. So. Pretty cool. Pretty good stuff. It's first. So this first use of force and both of the use of force I have today come from the active self protection YouTube channel. So, you know, go over there and check it out because you can see some of them. Some of them you can't see.
B
That one you sent me, I've seen before, by the way.
A
Yeah, the. That was the protester. Yeah, yeah, yeah, yeah, I've seen. Yeah, I've seen it and I remember when it happened, but we didn't. I don't think we talked about it. I kind of want to talk about it because there's some. There's some charges pending related to that case and we'll kind of talk about that. And both of them, these cases, you'll see, has some similarities on. On being responsible for where your rounds go. One bad consequence and one lucky consequence. And this first one is going to be the one that kind of got lucky. So this is, this is a.
B
Not for the one guy.
A
He, he. No, not for him. He got shot like 16. Yeah, about 16 times. One. One round missed him.
B
16 times.
A
You got. At least he got shot. He got shot at at least 18 times. And I can't remember how many hit him.
B
On this first one.
A
Yeah, I'm not talking about the protest.
B
Oh, okay. I thought that's when he's doing first.
A
No, I'm not doing that one first. I just said I wouldn't do it.
B
I thought you did. No. All right.
A
This first one, I can't remember where it was out of. It is inside the United States and you're at a. It was at a convenience store where they actually had a security. Armed security guard in the convenience store. So it's of kind. Kind of tells you this is probably not the best area in their little town, wherever it was. So basically you had an individual that had already been trespassed from the property. And he was outside, and they were telling him to leave. Security guards inside the facility, inside the convenience store. And this guy comes back in and trying to come back into the store. As soon as he walks through the door, the security guard puts his hand out and pushes the guy back. Well, this. This irritated the guy coming into the store, so he immediately pulls a gun out of his waistband and holds it up. Well, the security guard is. He's carrying a long gun, so he's got a shotgun on a sling on, and he's got a sidearm. For some reason. No, he was ready. For some reason, he went to the sidearm instead of the shotgun. I don't know if he felt more comfortable with it, but he. He immediately pulled the sidearm.
B
Well, close proximity, though, so I'm assuming he could have been.
A
Could have been.
B
He had.
A
He had room to pull that shotgun. Yeah, but he pulls his sidearm, takes immediately fires around, and apparently was aiming for the guy's head. So because he shot a little bit to the left, you see the bullet hole go through the door right next to his head. And this is the round that goes across the street into a neighbor's house.
B
But didn't hit anybody.
A
Didn't hit anybody left.
B
Okay.
A
And that's why I'm saying this is. You'll see something different at the next.
B
I'm assuming that's FMJ rounds, and I doubt it's my guess that's going through a glass door. It's not even a.
A
Even a hollow point. I'll stop there. But he continues shooting and starts hitting this guy pretty. He papered him pretty good, hitting him in the legs. A lot of them were going low. This guy's already fallen. As this guy's going to the ground, he fires off at least one round that hit the security guard in the leg. So he got shot in the leg. So this security guard continues to shoot.
B
Yep. Threat still there. Okay.
A
You can see the gun in the. In the trespasser's hand as he's still laying on the ground bleeding. You see blood going everywhere. Yeah, he's still laying there. Yeah, he's still holding the gun. So the guy continues to shoot right out. Ran out of ammo.
B
Okay.
A
Pulls a shotgun up, uses.
B
When you first told me he pulled the shotgun, I. Where the crap did he get a shotgun? I didn't know he had it on him. So he went to the shotgun.
A
He went to the shotguns, I think fired at least twice.
B
John Wick. That Guy. Oh, he video sent you today.
A
Good video.
B
It was a good video.
A
That dude made a good video. It looked just like the movie.
B
Yeah, Better. So this guy went John Wick on him. Oh, he, yeah, he went, he went from pistol to, to shotgun. He went.
A
Pistol just got shotgun and stopped threat.
B
I assume it stopped the threat permanently.
A
My guess, I can't remember, but I would imagine
B
a bag and went to a shotgun. Yeah.
A
So let's, I want to talk about it from a use of force standpoint on whether or not this was. If, if it was excessive, I guess is what we should look at.
B
Well, the threat's still there.
A
Yeah.
B
I mean, when do you, when are you supposed to stop? He already, he, he's already been shot. He's shooting the guy. The guy still shoots him. He's. He's still trying to stop the threat. So.
A
And the guy's still holding the gun.
B
If he did drop the gun or, you know, anything like that, then I would say it's excessive. But he's still holding the gun and it's still pointed up and oh, I'm 100
A
the first time I watched the video that, man, this dude, he's gonna be in trouble because you've seen, you had a little bit of delay between the pistol and shotgun and oh man, he's gonna get in trouble for those. But, but then you look at the guy and he's still holding that pistol. Yeah, still holding it. And he shot him.
B
He may not could have done anything. He may have been, you know, at a point of, I mean, so many bullets and he couldn't move.
A
But YouTube wouldn't let me send that one to you. You wouldn't see it on that, but
B
it sounds like he did what he needed to do.
A
Yeah, I mean you, you look at the, you know, either your criteria or the, the five elements of defense. We go your criteria. Situational awareness. I mean, he was aware of this guy.
B
Yeah.
A
He was standing there guard watching for him.
B
He was ready.
A
He was ready. He was effective.
B
Oh, it was definitely effective.
A
Got to be careful though, in that first shot. Don't go for the.
B
No, let's go center mass.
A
Don't go for a headshot.
B
Yeah, let's go center.
A
Go center mass. Take him down.
B
And he may have, he just may have been. He could have the trigger.
A
Yeah, but normally you're not going to pull it up. You're going to pull down. Yeah. Now he's a right handed shooter and he pulled it to the left, so. Which seemed odd to me. Yeah, I Would have thought he would have pointed to the right.
B
Yeah.
A
So. But anyway, it was. So if you look at it from the elements of self defense, you know, he was definitely the innocent person the guy came in. You know, he did put his hands on him, but that didn't. Well, he couldn't use. Use lethal force for that.
B
No, he's trying to prevent him from coming into the.
A
He'd already been trespassing.
B
Yeah, he's trying to prevent him to coming in. He pulled the gun. He, he.
A
You got imminence, you got proportionality, you got reasonable witness.
B
Yeah, I think, I think he did what he had to do.
A
Yeah. I think the only. If he had been charged, which I don't believe he was, if you went to the jury reasonable, this would have been the only thing he would have been, I guess, a little bit worried about from a jury.
B
Yeah, well, I'd just be nervous about any jury. Yeah, I think it was okay, but yeah, I'd be worried about what a jury would think.
A
Yeah, yeah, absolutely. So good. Good job on the security guards part. Yeah, it's ridiculous. I mean, and if you're. If you're trespassing from a place, just
B
don't go in there. Crap.
A
And you see a. You see a security guard strapped with a shotgun sling on, just don't go in. Right. Don't pull.
B
It's not that big of a deal. Go somewhere else. I'm sure there's another store right around the corner. Yeah.
A
I don't think he thought that security guard would shoot because when he pulled his weapon, he didn't.
B
He just kind of pull. He ain't doing that again.
A
No, that's a good reason. You don't brandish a weapon either.
B
You don't pull it, you better use it.
A
Yeah, absolutely. Yeah. So dumb. Dumb move on his part.
B
So.
A
All right, let's move on to the next one. This was out of a. Of a. This was from a protest in Utah. So 2023 or so. Yeah, it's been, it's been a couple years ago, but here, just recently there's been some charges filed related to this. Really? I think it was late 2025 or the first part of this year. You got. Yeah, I think December of 2025 is when some charges got there. So you basically got a guy who's been known to carry a long gun at some of these protests before, and this was a no. A no Kings protest. Yes.
B
Which is the hicking carry. I mean, it's legally legal to carry.
A
Yeah. No issues with him Carrying.
B
I mean, it may be dumb.
A
Yeah. And I've got some issues. The way he did it. I'll explain what that issue is. The way.
B
Yeah, I do too.
A
So basically what he did is he, he had his AR style rifle broken down in the backpack.
B
Yep.
A
And when he got to the protest, and I think he's. He was a pro or anti Trump. No Kings protest guy. So he was there to. Yeah, he wasn't.
B
He was protesting to protest.
A
He was there to protest the Trump administration.
B
Okay.
A
So. Because there was some.
B
No reports. I don't know if we know this, but Trump's not a game. Yeah.
A
You know what's, what's crazy is this is a good reason you don't trust AI on everything because you go read the AI story and it talks about this guy came out with the gun, running toward the car.
B
He did not. Yeah, well, that's what they said.
A
That's what the first initial.
B
That's what reports. And then you go watch the video. And it shows that they're lying.
A
Yeah, absolutely shows that they're lying.
B
Yeah. So he goes behind some.
A
Yeah. He goes back behind a barricade and takes his gun out of his back and puts it together. Then, then I don't know if he slings it or if he's just carrying it.
B
Yeah. Like he maybe had it on a sling, but carrying it with the barrel down, which he wouldn't. It didn't sound like he was brandishing it or pointed anybody.
A
Yeah, it turns out it wouldn't even loaded.
B
Oh, I didn't know. But you don't, you don't know that in the case, then you got these two guys that are security there and they did not look to. At least one of them did not look to be in the best of shape. So.
A
No. And I don't think, you know, this is, this is a private. They hired these private security guys to come and.
B
Well, they, they immediately come over and pull their guns.
A
Yeah.
B
He starts running.
A
Well, didn't. Until the shot starts.
B
Yeah. He pull. Yeah, they. They shoot at him.
A
One guy, One guy shoots.
B
One guy shoots at him. He ends up shooting three times. One of those misses the bystander and kills the bystander.
A
Yeah. So I can't remember, did the. I think that did armed volunteer. They are the guy that was carrying at the, at the protest. He did not get hit. I don't believe.
B
I believe he did. Yeah, I think he got hit one time.
A
Okay.
B
Yeah.
A
You know, they're not getting this. This security guard is not getting Charged with no man slaughter.
B
Not man.
A
For shooting the Boston.
B
Yeah, the Boston.
A
But not getting charged for shooting it.
B
Right.
A
Protester.
B
Right.
A
The protester was actually arrested.
B
Yeah.
A
And was. Spent several days in jail.
B
Five days in jail. Then they released him. No charges.
A
Because everything he was doing was legal. Yeah. I've been stupid. Yeah.
B
Probably not the brightest move, but. Yeah, but legal.
A
So you had the other security guards made a statement that he did not fire because there was too many people around. He was afraid he would hit somebody.
B
Well, he seems smarter.
A
Well, I think. Yeah, he's definitely going to try to get himself out of it. He's not charged.
B
Yeah. Hey, crap. Yeah. Yeah. I'm saying I didn't. If I didn't fire. I'm saying I didn't fire because there was way too many people there and this guy wasn't shooting at me.
A
So let's talk about it. Let's talk about the use of force to begin with. So you got somebody at a protest, didn't have a firearm at first, and then comes walking out with a long gun. It's going to get. I get it.
B
You.
A
Security is going to want to question that. I think they jumped the gun a little bit.
B
Well, they did. They. They acted way too quickly to pull their weapons and start shooting.
A
Yeah, yeah, absolutely. Too quick.
B
Now, they should have done like our security did at church at one time and kind of hid behind doors.
A
Yeah. I didn't get two people that's never been back to our church.
B
Yeah, well, that's a mistake.
A
Yeah, I guess we're supposed to question that, but whatever.
B
But, yeah, so I think they. They over. They. They jumped it. They jumped the gun.
A
Yeah, it was too quick. Yeah. Since the guy wasn't. They had their firearms out. This guy.
B
I don't think they should have done that. I think they should have come up to the guy and say, hey, man, everything good? And he deposited. Yeah, I'm just exercising my rights and I'm here protesting with y'. All. That's all they had to do. But they.
A
Yeah, but, you know, I get it. I agree. But even this, they had their firearms out, and the guys was not. He was not pointing his. So they should have, you know.
B
Well, I don't think they should have pulled the firearm out at him.
A
No, they shouldn't have. But since they did, they should have yelled for some or they yielded directives.
B
Well, I think they did. And he started running from him, and then they shot at him.
A
It was not a good use of force.
B
No, I don't Think so either. I think it's going to be. I think he's going to get convicted in the man. So you got to be careful where you shoot.
A
It's a bad situation. You know, if they. If they had hesitated and then this guy started shooting, they're going to get questionable.
B
Well, there.
A
Your security should have stopped him. Well, I'm just saying this is.
B
Yeah, but they would have. At that point. They'd have shot him and then stopped him. That had been big heroes.
A
They would have been here.
B
You know, even if they shot somebody, Somebody after that, it had been.
A
It wouldn't have been charged with it.
B
Right.
A
Yeah. If this guy had been an actual mass shooter and you accidentally hit somebody trying to stop him, you're not going to get charged for that in most cases.
B
I think they just reacted too quickly.
A
Yeah.
B
And as opposed to trying to determine what's actually going on.
A
Yeah. So he.
B
They found that situation. Wouldn't want to be in that situation. They were in it. They. They messed up.
A
Yeah.
B
Now he's facing manslaughter because of it. Yeah.
A
So.
B
Yeah.
A
Yeah.
B
Tough place to be in.
A
It is. You gotta. You know, it was not the brightest thing for the guy to do. The way he. If you want to carry a gun straight, you know, carry it, go ahead and sling it on, Walk around.
B
Walk around.
A
No problem with that at all.
B
Don't go running behind something, put it together and come out.
A
And come out. Yeah. Then if somebody sees that, they think that's what they did.
B
They saw that and they start yelling for security. Yeah.
A
So that's what I'm saying. It's kind of tough position for them to be.
B
Oh, it is.
A
He now faces 15 years. Sucks.
B
That's why you got to be careful where you're shooting.
A
And he was there trying to help people.
B
He was there trying to help. Now he's.
A
Now he's screwed over because, you know, the. The general public, like we are. We. We're definitely responsible for all our rounds.
B
Go. Oh, absolutely. We don't have. What is that. That the cops have. We don't have that. Oh, my gosh.
A
Not limited immunity. It's. I don't know why you would say it now. Golly.
B
They're so dumb.
A
Yeah.
B
Goodness gracious. Hey, I know all y' all out there are yelling. That's what it is. Whoa. We're going to look it up because we. We can't remember crap, man. It's always we talk about the whole time.
A
I know. We talk about all the time.
B
Come on, now.
A
Qualified Immunity?
B
Yeah.
A
Yeah.
B
We do not have qualified immunity.
A
Goodness gracious.
B
All right. Anyway. So that's all right. What else you got?
A
That's the only two stories I had.
B
Oh, wow. It's gonna be a short episode, isn't it?
A
Yeah, it's pretty. It's gonna be a short episode, but. But yeah, that's only two stories I had.
B
Well, good for you. Yeah. We want to talk a little bit. We're at the South Dakota this time.
A
Yeah.
B
You want to talk South Dakota a little bit?
A
Yeah. South Dakota gun law. So you can. You can bypass the next chick with a valid concealed carry permit only with the. The.
B
The Enhanced now. All three of them are they go now?
A
I just looked it up on the next ATF Brady list.
B
I don't think that's right.
A
It is. I looked it up on the Brady list.
B
I'll tell you a minute.
A
Yeah, I can look. I'll look it back up again. I looked all three. All three were on there. But they are ranked ninth in gun ownership. 55.3 per 100 and they're right behind
B
Alabama and South Dakota is a constitutional carry. State must be 18 years old and to be able to carry.
A
I'll look at this.
B
So the permit types or you can still get a permit. There are three. They offer three types of permits. They call them a regular, a Gold and an enhance. No fees for any of those move removed since 2022. So then that's nice. Yeah. I'll go into what those are. There is no state permit required to buy long guns or handguns.
A
The. Let's see what we got. South Dakota regular concealed carry permit. Yes. Enhanced concealed carry permit. Yes. Go card concealed carry permit. Yes. I'm just telling you they're all yeses. I told you that. So if you've got something different. I'm going by the ATF's website.
B
So the these for these permits, a regular permit, no firearm safety course or federal background check is required. A go card permit requires fingerprinting and a federal background check.
A
What is that? What does that provide you?
B
I want to tell you in a minute. Enhanced permit requires fingerprinting, a federal background check and firearm safety course. So I mean it helps on some. Some reciprocity with some other states do require like training. Okay. Is basically it. I had it somewhere.
A
I mean there's got to be some in state levels of differences between a Enhanced and a Gold. I'm curious to what. What each of those provided can you carry in different places.
B
The regular permit allows holders to carry concealed and Is recognized in a number of other states. The Gold Card permit, in addition to the benefits of a regular permit, proves passage of the National Instant Criminal Background Check System when purchasing a firearm. And you say they don't all three do that? They must require the regular. Must require a Nicks check then.
A
I just told you it didn't. I just told you it did. I looked at.
B
Well, you're not getting a gun without a Knicks check.
A
Huh?
B
You gotta have a. You're not listening to what I tell you. You're about to piss me off, man.
A
You mean you're not gonna go without a Knicks check?
B
You're not buying a gun without a Knicks check.
A
I guess you are. If you have that permit, you are. No.
B
You're not either. No, no. Because that doesn't require it. The regular permit allows holders to carry concealed and is recognized in a number of other states. The Gold Car Permit. You not listen to what I told you. What to.
A
Yeah, I am listening, but I'm telling you right here. Here is. You're an idiot. You're an idiot. I mean, idiot.
B
I'm coming across this table and punching your stupid face.
A
Here's the Brady permit chart on the ATF website. You see this? Don't you see this Brady permit chart? Now, I want you to look at this part. Qualifying alternatives to Nick checks. You see that? You see that column right there? Qualifying alternative to Nick's check. You get that part right?
B
Yeah.
A
You understand that? All right. All right. You say it has a yes or a no when it.
B
Continue on, man. Continue on.
A
All right. South Dakota. Let me move down here to South Dakota. Let me go here. Let me show you Alabama. Let me show you Alabama. Concealed care permit. Yes.
B
Hey, you gotta show me Alabama.
A
All right, Let me show you. No. Delaware. No. Let me get to south dakota.me ro. Scroll on down here to South Dakota. South Dakota. Regular concealed carry permit. Yes. Enhanced concealed card.
B
So you're telling me I can go to South Dakota and I can get a regular permit, which. This has no firearm safety course or federal background check required to get a regular permit. It's what this says.
A
You see what it says here?
B
But you. Do you hear what I just said? Does that make sense?
A
One of us is wrong. It ain't me.
B
Yeah, one of us is wrong.
A
You.
B
That's dead gum.
A
Right?
B
One of us.
A
You see right here?
B
I'm not going to South Dakota. Well, you can't.
A
You can't buy a farmer South Dakota anyway. You're from Alabama.
B
I'm going punch in your face.
A
Man, you see it right there, right? I mean, it's right there.
B
It's right here, too.
A
Which one do you think is more correct? The ATF website or your little website?
B
Where did you get that from? Well, this is not a government website, so it's probably more correct than what you. You got.
A
Who's. Which one are we gonna have to go by?
B
I don't know. Now this one.
A
I don't think you're getting a record. Concealed care permit without doing a background check.
B
That's what this is.
A
That's incorrect. You might need to check your sources.
B
The go card permit, in addition to the benefits of a regular permit, proves passage of the NICS Nicks background check when purchasing a farm, resulting in no required waiting period. The enhanced permit requires a firearms training course, provides the purchase background check exemption, and is recognized in seven more states than the regular license. So there you go.
A
Yeah, well, according to the Brady chart, you can bypass the next check with any of those.
B
Open carry is permitted in South Dakota. You must be at least 18 to open carry. There are no magazine capacity limits. There are no ammo restrictions. As I said before, the minimum age to consider carry in South Dakota is 18.
A
You already said that.
B
I know. I'm just saying. I already said that.
A
I don't know if I trust you now.
B
South Dakota is a very good state, it appears.
A
Yeah, I don't care.
B
You can carry in the vehicle at least. They're 18. And. And who can legally possess a forearm can carry a handgun in a vehicle without a permit.
A
I'm gonna check. AI. So here, let's just see something.
B
Kenny can say you can carry it. Roadside rest stops. You can carry in state national parks, wildlife management areas. Let's see. That is. That's. That's even without a permit. So this may be our best state yet. You do not have a duty to inform an officer that you're carrying. There is no public access to the concealed carry registry. There is no. Not. They do have. There are no red flag laws. They do allow for non resident permitting. And that's mainly for members of the military and their spouses stationed in South Dakota. No, no. No. Weapon allow signs are not enforced. And there is preemption. The state has preemption of firearms laws in South Dakota, if a county, township or municipality attempts to pass or enforce an ordinance and in violation of state preemption law, the attorney general will bring an action in the name of the state for the injunctive relief against the municipality.
A
All right, let me. Let me just read what What AI says, I take it with a grain of salt, but South Dakota does not require a new NICS background check for purchasing firearms if you hold an enhanced GO card or regular permit issued on or after July 1, 2018. And that that would been that it's five years. So that would have been over 2023, because these qualify for an ATF NICS exemption. However, obtaining the enhanced permit itself requires a comprehensive fingerprint based background check and periodic NICS permit to purchase NICS exemption details qualified permits. Concealed carry permit requirements. Regular permit requires a NICS check upon application.
B
Boom. That's what I said.
A
Yeah. Application for the permit. Not an application for a gun.
B
No, I think you're misreading.
A
It says concealed carry permit requirements requires a Nick's check upon application. It's all right, man.
B
No, I think you misread that.
A
Misread it? It says review the ATF Brady permit chart. Detailed information. This is where this is coming from.
B
Whatever. It just goes back to what I said though. You're not buying a gun without an X check.
A
Yeah, yeah, you're getting it. You're not getting it when you. If you have the permit, you don't have to do the next check to get the gun. If you have a permit. That's what I'm doing.
B
Well, you've got a next check already then. What I said is you're not getting a gun on the next check.
A
ATF service.
B
You get it when you buy your permit or will you get it when you buy your gun? You get it.
A
2021. ATF certifies South Dakota concealed carry permit is valid alternative to Nick's background check check. And that was in 2021.
B
Well, it's only if they do a background check.
A
Well, they must do one. So whatever you said, they didn't. According to USCCA, they don't trust USCCA
B
more than I do.
A
AI.
B
Whatever. I'm just telling you.
A
South Dakota Attorney General, this is in 2021. Jason revs morgue announced that today that the United States Bureau of Alcohol, Tobacco Farms and Explosives has certified the that South Dakota's regular concealed carry permits qualify as an alternative to a background check conducted by the National Insect Criminal Background Check System. The ATF has already declared that South Dakota's gold card concealed carry permit and enhanced concealed carry permit issued on or after January 1, 2017 qualified for a NICS exemption. This is a big step forward in protecting the Second Amendment rights of South Dakotans. Or set the codings. This clarification of the law allowing purchases without redundant and burdensome regulations on legal gun owners.
B
Well, if you're in South Dakota, let us know what to do if you have a regular permit, if you have to get a nics check or not.
A
Why would. Yeah, I would imagine. What good is a permit if you don't do the nick check?
B
Well, apparently they just said they use it for buy guns.
A
Well, yeah, but you have to do a background check to get a permit, so I think the.
B
Well, this says you don't.
A
Well, you're wrong. I'm right.
B
Whatever.
A
Yeah. Well, I mean, don't get all mad about it if you do do something about it.
B
All right. What else you got?
A
That's all I got.
B
South Dakota is a. Is probably so far our best state.
A
A good state.
B
Yeah. I didn't see anything in the state that I did not like.
A
Ranked just behind. Alabama is for gun ownership, but not much behind us. I think we had like 55.8. Yeah, they don't have.
B
If you go get a permit, they don't have fees.
A
Yeah, that's awesome.
B
They've done things that every state should be doing.
A
Yeah, it shouldn't be any fees on that at all. It doesn't cost them to do anything. Those next checks are. Don't cost anybody to do. Other than just somebody's time.
B
It seems like a good state.
A
Yeah. So just. So I do have a couple shirts. Well, one is on the way and one is getting made. So. John, his shirt is. I think. I can't remember where he was from now. Dang it. Is it Nebraska?
B
No, I don't remember.
A
I think it might have been Nebraska. Sorry, can't remember. Anyway, I shipped it. It's on the way. And. And I hope I don't. I hope I pronounced this name right. Jurgen. Jurgen. G U E R, G E, N. It's not Steve, is it? No.
B
Okay.
A
No, I just told you it was Jergen. That's his first name. His last name was even harder.
B
I thought that was his last name. I couldn't even.
A
Nowhere getting near his last name. He gave us a nice comment. Thanks for that. Getting your shirt made now and get that shipped out as soon as you
B
send me that comment.
A
I don't think so. Well, thank you. Yeah, you're welcome. Probably get it wrong just like you did the South Dakota stuff.
B
I don't think I got this wrong.
A
I read it off the Brady chart. I don't know why you had to continue to argue.
B
Whatever.
A
How far? I mean. I'll tell you how far.
B
I mean, I guess we can sit here and argue about.
A
To argue about it, because I'm right. So good.
B
Good State.
A
Yeah. What we got coming up? What state we got coming up next? Texas.
B
Yeah. Yeah, it be next.
A
We've done Tennessee.
B
Yeah, we've already done Tennessee, so I think it's Texas.
A
And we done South Carolina. I just got the market.
B
We did that South Carolina before South Dakota.
A
I know that, but I don't have a market.
B
We did it last episode, man. Put a pin in it.
A
All right, all right. Good deal.
B
I don't have anything else.
A
That's all I got. We are everything. Guns.
B
We're out. You're crazy, man.
A
We probably ought to talk about this
B
before we do these episodes.
A
I was right, H. Whatever.
Title: I’m About To Come Across This Table!
Date: April 13, 2026
Hosts: David and Jody Smith
In this lively episode, David and Jody dive into the latest firearms news, critique recent legislative changes and court rulings, review pistol-caliber carbines they've been testing, and analyze two compelling self-defense cases. Spirited debate emerges during a deep-dive into South Dakota’s gun laws, with the hosts highlighting the real-world confusion gun owners face when navigating legalese and federal/state regulations. The tone is conversational, humorous, sometimes confrontational (true to the episode’s title), and always unapologetically pro-Second Amendment.
David presents two use-of-force cases, both illustrating the critical importance of round accountability and appropriate escalation.
Summary by section per guidelines. Use this as a detailed guide if you missed Episode 75—perfect for gun owners, enthusiasts, and those interested in Second Amendment debate.
