Most of the people here have been here their whole life, or maybe third or fourth generation. My great grandparents homesteaded the farm right next door in Viola. Most people tend to help one another.

Joseph and Denise Clifton have lived in Viola their whole lives. She is studying to be a nurse practitioner while he works as an insurance adjuster. Often far from home, he would go

to work during big catastrophe storms. He might work for two weeks and he might work for two or three months.

When their son Jenkins arrives, the couple starts looking for more space and solitude.

We didn't enjoy living right in town. We didn't enjoy the neighbors and traffic and all of that. So we began looking for something a little more out of town and kind of away from everything.

The family eventually finds what they're looking for. A farmhouse on the outskirts of Viola with lots of property known as Hidden Woods Trail.
Denise Clifton Jones
Moving to the Hidden woods trail property was very refreshing if you enjoyed being isolated. Our home was in the middle of our 80 acres and there wasn't anyone around and that's what we wanted. Joe wanted the farm, he wanted the land, place to hunt. He wanted to eventually have cattle.

Denise's brother Derek Brown agrees. The farm is a great find.

It was close to town, had good hunting, good location. It was a nice place.

Soon after arriving, the Clifton's nearest neighbor comes by to offer a warm welcome.

I knew Carl Engel, I guess my whole life. He was always talkative, always friendly.

Yeah, it's a lot of work.

But Carl Engel, he has primarily been a farmer behind Joe and Denise's house.

Carl hasn't come alone. He's brought someone for the Cliftons to get acquainted with.

I worked with Gay Lynn way back and then hadn't seen her in years. She didn't work with us for. For too long.

Richard and Gay Lynn Gordon have called Viola home for just a few years. Judge Don McSpadden of the 16th district in Arkansas joins Richard Irby and Derrick Brown in discussing the reclusive man of the house.

Rick was running a small farming operation where he was running cattle and cutting some hay and selling some hay. As far as what I knew of Rick Gordon, you just almost wanted to keep an arm's length.

The house had been, you know, maybe updated once in the last 15 years or so before they bought it. Needed a little bit more room. They added on and built a garage.

There's just one tricky issue with their new property. A dirt road runs right past their front door. It's not entirely clear to all whether it's public or private and who's entitled to access.

As you would travel down the dirt road, you would cross onto our property, it looked like you were still on a county road, but you weren't. By now you were on private property. And you would meander through, eventually ending up in front of our home at a gate. And there was a lock on the gate. And we were given a key to that when we bought the place.
Joseph Clifton
Jenkins, wait for mom and dad.

But the gate doesn't stop everyone from getting through. Like teenagers on ATVs looking to party in the fields beyond, Denise has to rescue her son from the onslaught.

Jacob. You're okay. You're okay, baby.

Hey. This is private property. You're trespassing.

Denise and Joseph soon learn they're not as secluded as they thought. Denise's brother in law, Doug Johnston and Judge Don McSpadden explained.

Most of them was probably teenage kids drinking and people trying to Go back in there wasn't up to good generally. At one time, I remember there was a meth lab busted back in there, which was a few years before Denise and Joe purchased that property.
Judge Don McSpadden
You have to understand that at this point in time in the state of Arkansas, there were a lot of methods users. There were a lot of mobile meth labs.
Denise's Brother-in-law Doug Johnston
This is unacceptable. I don't want these party kids coming around Jenkins.
Joseph Clifton
Don't worry. We're putting an end to this.
Denise Clifton Jones
I absolutely worried about mine and Jenkins safety because we were so isolated and with those kinds of people ending up on our property. It wasn't safe. It didn't feel safe.

What's worse, Denise learns the gate across the dirt road is essentially useless.
Denise Clifton Jones
What we found was that multiple people had a key to that lock. After, you know, multiple times of people driving up to that gate and trying to get through it, My husband actually built a new gate at the edge of our property to keep people from being able to get to the home.
Denise's Brother-in-law Doug Johnston
Good job, honey.

This move doesn't just keep out strangers. Now established neighbors who have long used the road will have to take another lengthier route around the cliftons land.

A number of people who lived there were just used to using that road and depending on it. For some of them, especially the farmers, it was a main way to get to their land and their cattle and for them to be able to do their business.

One of those affected is Carl Langel.

Carl Langel had explained that he really had to have that access to get back to his land.

Okay, sure, we get kids coming through here once in a while, but that's not a big deal. But I need to access this road so I can get to my property.

Joseph readily obliges with a key to his new gate.

Here, this is for the padlock. You get through anytime.

Okay, thanks.

But Denise is not on board and tells her husband.
Denise Clifton Jones
So Carl Langel had an adjoining property. And that would be like me saying to my neighbor, I want to drive through your yard to get to my back shed.

What's the point of putting in a gate if we're just going to hand out keys to everyone?
Denise Clifton Jones
The fact that the gate was moved shouldn't have mattered to anyone because no one had any business coming onto our property other than us.

When Carl returns with his brand new key and neighbor Richard Gordon in tow, he's in for a surprise.

Your key doesn't work anymore.

Oh, we changed the lock.

The Cliftons were hardening in their idea that this was not Only you know, a road alongside their house, but they considered it their road.

How are we going to get through?

You can't. There's another route you can take.

Yeah, yeah, but that'll take way longer.

Mr. Langel said, what am I supposed to do? I need this access and that. Mr. Clifton had said, that's not my problem.
Carl Langel
Look, just open the gate and let us through.

You can take the long way round.

Denise is very strong willed and determined. A person who's willing to fight for what she thinks is right.

All of the problems started after we moved the gate to the edge of the property.

It began to escalate. Things started happening.

Carl vents his frustration to Richard and hatches his next move.

Well, Carl angel actually went and hired a well known attorney to look into this issue. And that attorney began by writing the Clifton's letter.

The letter goes into detail about the inconvenience to many in the community.

The gate they installed blocked Hidden Woods Trail, which Langel had been using more than 20 years to reach 80 acres of land that he owns.

While Carl's lawyer works to settle the conflict in court, Richard Gordon calls the police about another issue. A piece of farming equipment known as a disc.
Derrick Brown (Denise's Brother)
Carl Engel had sold Rick Gordon a disc and it was, you know, 12 or 14 foot wide.

The disc was located on property that was accessible down the Clifton lane.

In order to retrieve the disc he bought, Richard needs access through the Clifton's gate. Authorities make his case to Joseph.
Police Officer
So the way he explains it, he needs the disc to do his farm work. So can you do him a solid and open the gate so he can get to it?

I believe Joe said okay.

Much appreciated Joe.
Denise Clifton Jones
He understood if there was a plow back there that they needed to get out. He wanted to help. He's, he was a helpful person. He was not, you know, not the type of person to just say no.

The Cliftons are willing to accommodate but change their minds when they received the letter from Carl Langel's attorney seeking unfettered use of the road through their property.

We're not opening the gate for anyone.
Denise Clifton Jones
Our attorney felt like if we had people driving through our property that it would be difficult to win the case.
Derrick Brown (Denise's Brother)
The issue was that it needed to be locked down and limited. It's not a county road and there shouldn't be people in and out of there at three o' clock in the morning and they shouldn't be back there doing, you know, who knows what that was all that it really boiled down to.

When Richard arrives in his vehicle only to be turned away from the gate, he is furious.
Richard Gordon
What the hell? The cops said you were going to unlock it for me.

Things have changed.

The Cliftons sort of dug in and said that they were not going to change their decision.

I won't tell anybody. Just, just open it for me.

Richard Gordon, though, was more persistent. I guess you would say.

I've got to get my desk so I can get my crops.

It's not an option for us. It stays closed.

You can take the other way around.

Going the long way around is going to make it harder and take longer.

One point to make is that this was not certainly a super highway. This is a rural area. The neighbors around there would use that for convenience or to get to their farmland. But it certainly wasn't a racetrack or people traveling up and down that road day and night.

Yet the Cliftons won't relent.

The Cliftons really dug in and they said, we're not backing down from this. We have the right to put that gate up and, and keep people out and we're going to do that.

My son, we're on the four wheeler. He was, you know, young and certainly I was being very careful. We were just taking a joyride down the dirt road on the four wheeler. There was Rick Gordon coming out of a gate from the property that adjoined me.

I actually pulled over to the right hand side of the dirt road to allow to go around us. And I'm getting out of his way. I'm yielding to him. And he slung gravel all over me, which didn't matter, but all over my son. That bothered me, you know, Here I was trying to be good and give him the right of way, and then he did that.

I really don't know that there was proof that he, Mr. Gordon, intentionally tried to run them off the road or injure them.

As tensions mount, Denise gets a disturbing call from the babysitter.

Denise, you gotta come home.

She said, denise, I saw someone in full camo with a gun.

Denise's babysitter was with Jenkins. And she seen somebody standing in her backyard. And she wound up calling Denise, I'm on my way.
Denise Clifton Jones
That ride home, I was in a panic. And I didn't have good cell phone signal between there and home. It was pretty nerve wracking. That was as fearful as. As I had ever been for my son's life. I was thinking he was gonna hurt my son. He was gonna kill the babysitter.

Police are called. Richard denies any nefarious intent. Only wandering near the Cliftons home because he was deer hunting.

Deer hunting?

It was a misunderstanding. Your babysitter overreacted.

He probably tried to insinuate that day like it was just this big accident.

Basically, they would say, you know, there ain't much they can do unless they actually catch him doing it.

When Joseph returns, his complaints likewise fall on deaf ears.

This man has been harassing us. He tried to run my wife up the road the other day.

I'm sorry, there's nothing I can do.

For the Cliftons, there's no obvious or easy escape from their neighbor.

I think he is a horrible, vindictive, mean stuff sociopath. He has absolutely no regard for any human being other than himself.

On the other side of this dispute, Carl Lengle and Richard Gordon endure a waiting game. While Carl's legal suit slowly heads to court.

I can't believe they called the police on you.

About time I teach them some respect

Gordon described how being sent twice to the Vietnam war. Caused all kinds of emotional and mental problems he had dealt with for 40 years. And that was one of the reasons that he, I guess, was looking to move to a place which was he would consider to be more stress free.

He came to Viola to get away from it all. But according to judge Don McSpadden, Richard's Refuge is falling apart.

I called the police that day. I keep calling, and this guy keeps doing all of this stuff to us, yet nothing gets done. And I demanded that someone come out and fingerprint the lock. Do something, you know, enough is enough. It's not going to stop.

Nothing comes of Denise's request. Whoever glued the lock is never found. In the midst of all the strain, Joseph's job sends him out of state yet again.

I called Joe. He didn't answer. I kept the phone up to my ear because I did not want Rick Gordon to think that. That it was just me. And I made the split second decision to just keep going. It was kind of like playing chicken. Who's going to stop? I will never forget the look in that crazy man's eyes as he came towards me and I was driving towards him. He was not going to pin me and my son down there. We were getting out.

Richard swerves at the last second, avoiding a collision. Maybe this was just an accident, but if not, next time, Denise and Judge Don McSpadden declare she intends to be ready.

When the Cliftons return home from their short trip, they find nothing's changed. Richard still appears to be upset with every move his neighbors make. And as Judge Don McSpadden and Denise's brother in law, Doug Johnston explain, the family is growing more and more fearful of Richard Gordon.

Getting the house ready to sell and finding a new home will take some time. Still, Joseph and Denise believe they have a way out of their nightmare. The events of September 3, 2009, proved them wrong. Husband and wife are in separate vehicles. She's returning from work. And he's also en route to the farm with son Jenkins in his truck.

I was in clinicals in Batesville, and my normal routine when getting off work was to come straight home.

And that day was different. And I can't really explain it, but I remember calling him and he was like, oh, my gosh. Why would you even ask? Of course we're gonna go home and haul trash off and do some things around the house, and I'm gonna fix you supper. You take your time.

Joe, we're in the country. At least half of the vehicles you see on the road in this area, they're going to have a gun in the truck or car. And Joe was an avid hunter. He had a rifle in his pickup at all times.

When Joseph and Jenkins pull up at home, they discover they have an unexpected and unwelcome visitor. Richard Gordon.

When Denise arrives sometime later, she immediately senses something amiss.

I came around the corner to find his truck in reverse.

And I didn't see any activity. I was alarmed immediately.

Something wasn't right.

As I got to Joe's window, his window was down. He had on a white T shirt. He was slumped over towards the middle of the truck.

I could see the bullet holes in his side. It was like something slow motion. But it was chaos all at the same time. And as much concern as I had about him, I needed to make sure my son was okay.

I was screaming for Jenkins.

Jenkins. Jenkins, answer me. Oh, my God.

And I saw my son wiggling out from underneath the back seat. And he stood up. The look on his face of just absolute terror. He was sweaty. He was pale.

I got him out of the truck to do cpr. When I did, the truck started rolling backwards. And I jumped back in and put the truck in park. And it was like a million things going on all at once. I can remember my baby boy looking up.

You can wake up.

And he said, mama, what you doing to my daddy? Because each chest compression that I would do would just make blood come out. All of his bullet holes. I knew he was gone.

Police who arrived on the scene knew of this dispute between the Cliftons and Richard Gordon. And so a group of them immediately went to Gordon's house.

Police find Richard at home and take him into custody.
Judge Don McSpadden
Richard Gordon had said that he had gone by the Clifton property to look at land he had hoped to buy.
Janiece
Richard admits he shot Joseph, but insists it was a case of self defense.

Richard Gordon said that his encounters with Joseph Clifton got bad enough that he himself was alarmed. Richard Gordon says that Joe immediately threatened him and said, I told you what I would do if you were caught up here at this gate.

Richard claims Joseph leveled his weapon at him.

That's it. I'm going to shoot your ass for trespassing.

Gordon said that he shot. He had no choice but to defend himself. He then said that he, after the shooting, was so upset and scared. He did not make any attempt to call for help for Mr. Clifton or let anybody know that Mr. Clifton's son was in the backseat of the vehicle.

However, police soon find that statements from Jenkins and Richard's wife, Gay Lynn, along with evidence at the scene, tell a very different version of what happened.

He claimed Joe pulled a gun on him, which didn't happen because Joe's gun was still where he always keeps it in the truck.

Gordon drove back to his house, told his wife that he had shot Joe Clifton, graveyard dead and mixed himself alcoholic drink.
Doug Johnston (Denise's Brother-in-law)
His wife said that he said he guessed he wasn't a baby killer, so he didn't shoot the little boy. And then they sat on the porch. He knew that that little boy was sitting up there in that truck with his dad.

Gay Lynn told law enforcement that Richard retrieved his shell casings from the crime scene.

Mr. Cordon's wife said also when he returned home, she saw him go to the creek in back of the house and throw two things in it, which she said she assumed were guns that he owned.

The it was a premeditated murder. He planned it. You know, you don't sit out on a hot day in Arkansas with a gun at the side of the road waiting for somebody to come home who you've had an argument with for quite a long time. He knew what he was going to do. There's no reason to kill Jill. No reason in the world.

Richard Gordon is charged with murder and goes on trial. The plea bargain is put forward by his defense team.
Denise Clifton Jones
They're proposing that we settle on 20 years. And you know, I was doing the calculations and I said, he's not going to die in 20 years. No. It's a no for me.
Janiece
Richard's attorneys point to his tours of duty in the Vietnam war as a mitigating factor in his actions. Here's writer Richard Irby to outline the claim.

While on the stand, Gordon explained, explained that through the Veterans Administration he had been diagnosed as having ptsd, Post traumatic stress disorder. And that is a disorder that causes emotional and mental issues that sometimes lead to the recipients being very troubled people. The case went to the jury. After two days of testimony and more than 20 witnesses at and when the jurors went back to deliberate, the friends and family of Denise Clifton expected this would be a quick verdict, that Gordon would be found guilty without question of first degree murder.

But on this day, Joseph's family and friends get no justice.

The jury came back deadlocked and they declared a mistrial.
Janiece
At Richard's second trial, however, the jury finds him guilty of murder in the first degree. Judge Don McSpadden reviews his sentence.

The judge imposed maximum under Arkansas law, which is life in the penitentiary on the murder in the first degree in 15 years. Additional on the gun enhancement.

The citizens of Viola move on with their lives. But Joseph's tragic death is not forgotten.

The impact that Joe's murder had on Viola, I think the community was heartbroken. Anyone who knew him, truly knew him, loved him. There were over 700 people at his funeral. How many people can say that? I had always known that this was a fantastic community. But to tell you the amount of love and support for us during that time, there are no words to describe. It was unbelievable.

Denise's brother, Derek Brown, and her brother in law, Doug Johnston remained devastated.

Joe and I were very close. You know, I don't know how well he thought of me, but I thought extremely highly of him. To me, I felt like, you know, I personally had lost, you know, a brother.

It still affects us, you know, you don't ever get over nothing like that changes your. It was a very bad time in our life. Was hard to get through.

You know, when I think back on this, it's so many what ifs, what if we hadn't bought the property and what if, what if? And ultimately I continue to arrive at this. You never know. You never know who you're going to encounter. You never know how people are going to react. What I hate and what I regret is when I realized Richard was not normal and that he was an evil human being. I regret not doing something right away. I regret knowing and not acting. I remarried, my current husband and I have a daughter together. I can tell you it took a lot of years for me to get to the point where I was content. I think I'm there. You know, you don't ever get over something like this. I took Jenkins to counseling in the very beginning. I think Jenkins is a very well balanced, wonderful, bright human being. But much like me, he has gone through something no one ever should and he's damaged from it. We're both damaged from it.
