Tyler Robinson is accused of killing Turning Point USA founder Charlie Kirk on September 10, 2025. This happened at a TPSA event on the campus of Utah Valley University. Tyler Robinson is charged with aggravated murder along with additional charges. Now, for the first time, Erica Kirk will be in the courtroom as the prosecution lays out its evidence against the 23 year old. A source familiar with the situation tells the Daily Wire, quote, the world is going to see what the state has.

Erica is going to be there with Charlie's parents, Kathy and Rob, and I'm told they're going to be there as a, quote, unified support system. Judge Tony Graff will hear the evidence, and he's going to decide whether there's enough of that evidence to send this case to trial. It's also been reported that prosecutors plan to play a recorded statement from Lance Twiggs, Robinson's roommate, and by Robinson's own description, his lover. Here's what you need to understand going into next week. The biggest thing. A preliminary hearing is not a trial. There's no jury. The state isn't proving innocence or guilt. The hearing exists for one reason, to let a judge decide if there's probable cause to send Tyler Robinson to trial for Charlie Kirk's murder. In the federal system, that step happens behind closed doors through a grand jury indictment. But Utah doesn't use that process. They use a hearing system, which means the public gets to see the evidence laid out in real time. Here's how it'll run. The state calls witnesses, the defense cross examines. Then the defense gets its turn, and the state cross examines them. Judge Graff hears the arguments from both sides, and then he rules on probable cause. Some people sometimes call this a mini trial, but there are real differences. For example, this. Sometimes the state isn't required to present all of its evidence and the defense isn't required to present its case at all. And you won't hear objections to hearsay because hearsay is allowed here. That means a witness can say he told me or I read this, and no one can object. There's another key difference, and this one matters. The judge is required to view the evidence through the lens most favorable to the state. That's the standard for this kind of hearing, full stop. So say we're in the courtroom and there's some sort of tie, for example, between the evidence. The favorability of the decision of the judge goes to the state during a preliminary hearing every time. Victims have a legal right to be present at proceedings like this one. So that's why Erica Kirk and Charlie's parents will be in that courtroom, and they plan to stay there the entire week. And it's not going to be easy. Prosecutors may present photos from that graphic scene at UVU, along with other disturbing evidence. The family in this case has the right to step out before anything graphic is shown. Erica and the Kirks won't be doing media availability during the hearing. They won't be giving statements to reporters in the hallway. Instead, the family will release one joint statement before the hearing begins.

Coming up, why this hearing almost didn't happen next week at all. What's actually allowed inside the courtroom and how you can watch it unfold live. The preliminary hearing was originally scheduled for May. Then it got delayed and the July 6th start date wasn't chosen by Erica or anyone on her team. Judge Graff was the one that set the date, and this happens to fall in between a packed stretch on the TPUSA calendar. Erica is the CEO of Turning Point now, so she'll be in Washington, D.C. for events both before and after the hearing. After it wraps, she's scheduled to speak at a TPSA leadership summit on the 12th, where she'll address students, and she's going to make sure they have the space to grieve together as a community. There's still a chance. The timeline shifts again. Robinson is appealing multiple rulings, including Judge Graf's decision to allow media cameras inside the courtroom. If that appeal gains traction, the hearing itself could be postponed. If you want to see this for yourself, you'll have options. There's 13 seats reserved for the media inside the jury box, assigned on a rotating basis determined by the court. Then there's 30 additional seats that are open to the public, and the courthouse opens at 8am for anyone planning to line up. No electronic devices are allowed inside the courthouse at all. No phones, no laptops, nothing. But the hearing will stream live on the Web and on X. And there'll be a photographer who will be capturing both still images and video for the outside world to see. So here's where things stand starting Monday. The preliminary hearing will determine whether Tyler Robinson stands trial for the murder of Charlie Kirk. Erica Kirk and Charlie's parents will be in the courtroom. The evidence will be public, and a judge, not a jury, will decide what happens next.
