That's so Criminal. This week we're covering the Tyler Robinson preliminary hearing live every day. If you missed today's proceedings, here's a recap of what you need to know. I'm Lyndon Blake and you're listening to that's so Criminal. That's so Criminal. Well, that was day three, you guys. I'm Lyndon Blake, host of Daily Wires. That's so Criminal. We got. You could look at it as a lot of information. You could look at it as a little information. I'm looking at it as a lot of information because. Because of the back and forth arguing over where to show this lan Twig's recorded statement that he recorded back on April 20th. We got a lot of insight from both the state and the defense of what is going to be in this recording that will be shown tomorrow morning, first thing, 9am for day four on Thursday. I'm going to pull up my notes right now just to get to this. So the majority of the day, this is just an afternoon session of the preliminary hearing for Tyler Robinson, the accused killer of Charlie Kirk was over this video. We knew this video statement was coming because before we even got to the preliminary hearing, there was arguments from the defense saying, hey, we don't want a recorded statement. We want twigs in the courtroom in person so we can cross examine him. Judge Tony Graf said, not necessarily for preliminary hearing because it is just about establishing probable cause. So the back and forth over this video, to boil it down, the defense was saying that showing this video, which they even said that their client appears to be confessing to twigs, which the defense says we're not going to call it a confession. But they said that would not be a fair trial to Tyler Robinson. And so the judge heard that you had the state saying, this is important. This is big evidence. I'm okay, with not showing video, can we just show the audio to the public? And that was argued back and forth. It got very intense because again, big piece of evidence here. So much so that we heard from the Kirk family attorney for the first time during this entire preliminary hearing saying, hey, as the victim's family representative, we say if this is going to be admitted to the court as evidence, show it, make it public, no redactions. All that to say what you're going to be seeing tomorrow morning from Lance Twiggs recorded statement will be about 20 minutes of the 37 minute video. We just left off with the defense wanting five pictures redacted from Lance Twiggs's phone. And the judge will think about that overnight as the state makes, edits those videos and takes out those redactions. From the certain moments that Judge Graff said don't need to be in there, but from what is not going to be in there. Again, because the both sides were arguing, we kind of got a taste of what's going to be in there. There's going to be text messages and there's going to be new text messages that the public has not seen. That was a part of this video segment. There was a note that was in there. There was also discord chats that we've heard about. Discord chats. This was all going to be in this video. So. And Judge Graff said himself though most of the video is the text messages, which is why he made some redactions just for the public's eye, for your eyes, for my eyes. The entire video as a whole will be reviewed by Judge Graff to be admitted as evidence if this goes to trial. So again, we did not get the Lance Twigs recorded statement today, but we know that is the first thing we're going to all hear Thursday morning when court is back in session in Provo, Utah at 9:00am Utah time. Another part of today was getting a better timeline about Tyler Robinson, his family, the family friend, when they went to the police station, the sheriff's office, I should say, in Washington County. This was all via Utah SBI Special Agent Brian Davis, the only witness we saw today and he will be back on the stand tomorrow. They have a lot more questions to ask him and he hasn't even been cross examined yet by the defense. And sometimes the defense doesn't cross examine because they're just there to keep records, make their objections in case this goes to trial. We've already seen them call witnesses themselves. They've done a lot of cross examinations, very intense so who knows? This preliminary hearing, a lot of eyeballs are on it. It is very intense. So there's a lot of stuff that you may have never seen before, including me. You heard experts, if you tuned into our pre trial coverage, excuse me, pre preliminary hearing coverage this morning, saying normally in a preliminary hearing, the defense just shows up. They don't really do much. It's more on the prosecution to prove their case, for the judge to see probable cause to take the person to trial. So just something to note, but while Brian Davis was on the stand, Sergeant Brian Davis, on day three of the preliminary hearing, he gave us some insight about when he got the phone call saying that someone was ready to turn themselves in for what happened on Utah Valley's campus. The killing of Charlie Kirk on September 10th. He said the first time he was contacted around 8:30pm on September 11th. So the next day, then he said that Tyler Robinson turned himself in alongside his parents and family friend Mike Mitchell to the Washington County Sheriff's office at 9 o' clock on September 11th. Tyler Robinson was not formally arrested until 4am on September 12th. Why? Because when Robinson got to the Sheriff's department at 9pm Then starts the interrogation, he was questioned, his parents were questioned, Mike Mitchell was questioned. They had all those conversations before an arrest was formally made. And then they took the DNA swabs, they did the fingerprints, they did the palm prints where you can see the entire hand there as he is being booked. That was some new information that we got some, you know, in concrete of the timeline. Plus there was new video shown of Robinson going in one of those interrogation rooms in custody. Didn't see much of it, but new surveillance footage of him in custody after he turned himself in, that's so criminal. Lance Twiggs, he was, he was the main focus today because of that recorded statement. But we did also get some more information about how they got to that recorded statement that we're all going to hear a part of on Thursday. Twigs was interviewed twice in this case. Once in the early morning hours of September 12th and. And then again on April 20th of this year, which is what will be played in court on day four for this preliminary hearing. He was interviewed with FBI agents in those early morning hours of September 12th. Both times he was interviewed, it was recorded, so both are on record. And his phone was taken away from him on September 12th. This is at the St. George Police Station on those early morning hours, two days after Charlie Kirk was murdered during the second interview that happened on April 20th for Lance Twiggs, he was with his attorney. He was with Ryan McBride, who was with the state that is having this case built against Tyler Robinson. He was with Sergeant Brian Davis, the SBI agent that has been present since he got the call that Tyler Robinson was turning himself in back in September. These were people that were present on April 20th for twigs second recorded interview. Both times, Twigs knew he was under use immunity. Let me define that for you. I wrote down the definition today. So use immunity basically means in simple terms that whatever he's saying in these recorded statements cannot be used against him. He has immunity because he is giving over his account. He is a witness. He has given authorities information. Why this interview first raised questions for the defense is because they were given a transcript of the interview. I'm going to kind of get technical now, but just so you understand where the defense is coming from, where the prosecution's coming from. And of course, I mentioned the Kirk family attorney, where they're coming from. In this interview, the defense argued that it was not so much of a Lance Twiggs testimony, but it was more so answering questions from Ryan McBride. And the defense was saying it was more so him saying twigs, I'm talking about that. Robinson told me this. Robinson said this. And the defense thought that that would not be a fair trial to Robinson. So a lot of it was Twigs saying things that, yes, confirming, not so much giving his testimony. As the day rolled on when the defense kind of upped their opposition to this interview being shown to the public. Again, court will see this video. Judge will see this video in its entirety. This is what's just going to be shown to the public. The defense was like, there are things in here that would. If a potential juror was watching this preliminary hearing, this would taint the trial. So that's why I said at the beginning, you could look at this as a whole lot of nothing today since so much evidence was laid out in day two with DNA talk with surveillance footage. Or you can look at this as we're getting a good picture of what to expect tomorrow with what is going to come from this Lance Twigs recorded statement. So again, preliminary hearing, not a trial. If you hear it referred to a mini trial, that is slang terms, it is a hearing for the judge to decide if Tyler Robinson probably is the one who killed Charlie Kirk and should be taken to trial at a later date. So those are a lot of things that went on today. It was a very technical day in the courtroom in Provo, Utah. I do actually want the statement. The Kirk family representative in court arguing for this entire video of Lance Twiggs to be made public.

But I feel as if we need to. I want to be clear as to what the Kirk's family's position is on all of this. The Kirk family believes strongly that if the evidence is being admitted in this preliminary hearing, it should be made public for the world to see. No redactions. This court has tools at its exposure, tools at its disposal to make sure the defendant receives a fair trial. You'll use them if you find that you need to. That's it. Your honor, to not be transparent here, to not be open, to not let the world see what happened will create doubt and distrust in the judicial system. And that's not what anybody wants. That's not what any of us believe should happen here. And we'd ask the court to consider the position of the family in making its ultimate decision.

So there you heard it. Erica Kirk has said it from the beginning. She wants the world to see the evidence they have against Tyler Robinson. And the judge was very respectful to the victim's family, to the defense and to the prosecution. And he talked about having a fine line between transparency and people's constitutional rights. The judge wants to respect all parties in this and he said he understands and he spoke to the Kirk family and he really said that he understands they're coming from and the defense even said, Mr. Novak, one of the defense attorneys even said I understand where the victims are coming from. But the judge did rule. About 20 minutes of the 37 minute video of Lance Twigs on camera talking about what happened on September 10th will be played to the court starting tomorrow at 9:00am Utah time. I will be joining everyone 15 minutes before court begins tomorrow morning. We'll recap this. I will analyze more stuff from today's hearing and bring you any new information and and maybe we'll have time for some Q and A cuz some of our viewers in the comments have asked for it and I am all about that because this is complicated stuff and we want to make it understandable for everyone.
