All week we're watching every minute of the Tyler Robinson preliminary hearing live. Here's your recap of today's proceedings. I'm Lyndon Blake, and you're listening to that's so Criminal.

Welcome back in. Thanks for sticking with us throughout the day of Tyler Robinson's preliminary hearing, Day four. We now know it'll wrap up tomorrow. Both sides think it'll wrap by lunch on Friday. This was a big hearing. My name is Lynton Blake. I'm the host of Daily Wires. That's so Criminal. I want to wrap this up and get straight to the evidence that we were shown today in the testimony that we were given from Lance Twigs. Via recording, we were able to see Lance Twigs, Tyler Robinson's roommate at the time Charlie Kirk was killed and his lover. And it was full of information. We got a picture painted of what life was like in that apartment where these two men lived before the shooting and the days that followed the shooting. I want to go to the first sound bite of Lance Twiggs. This is when he said that he saw Robinson on September 11th. Listen to what he said Robinson told him.

So he acted erratically. Was he pacing? Just sitting down, relaxing?

No, he was walking around a lot.

And that's within the Home. And did he talk about what he had done?

Didn't go into detail. He just. I just asked him in person if what he said was true the night before and he said it was. He started crying a little bit and said he wishes he hadn't done it and then kept going around and just doing stuff, I think to keep himself busy or distracted or something.

Did he talk about what he was going to do next.

And then eventually said that he would talk to his parents or turn himself over.

And when you left, was that how you left, understanding that he was going to turn himself in or go to his parents house?

Yeah. And I didn't really want to be at our apartment while any of that was happening, regardless of what went down.

Well, there you have the images of Lance Twiggs and his testimony under oath about his interactions the day after Charlie Kirk was killed with Tyler Robinson, who appeared to cry and said that he wished he hadn't done was startling, honestly, to see Lance Twiggs on camera for the first time to see a current image of him. That recorded statement was from April 20th of this year. His hair long, dressed in a suit, he was loudly chewing on gum. Eventually they made him spit out his gum during his recorded statement so he could be understood clearer and just be, you know, more professional instead of that chomping but fascinating to see him. And that interaction, like I said, was September 11th that he was just describing. And he goes into detail about the first time he was contacted by Tyler on September 10th. I'm going to get into those text messages, but I want you to hear it from Lance about exactly when he was contacted from Tyler Robinson on September 10th.

And did you hear from Tyler? Did he call or text you before then?

No, he sent that message in the group chat I mentioned, but he didn't message me directly at all that day.

Okay, when did you first hear from him on September 10th?

It was at 11 o' clock with that like automated message.

Okay, 11pm yeah.

And then we were able to see the text between Twiggs and Robinson in their raw form is what I'm calling it, because they were able to show pictures in the courtroom of Lance Twiggs cell phone. You can see it right there. I'm gonna read through some of these texts. And some of these texts have been made public and that's why they were shown in the court. Anytime you saw a black screen today or Muted volume That was something that was redacted from Lance Twig statement that they didn't want to be presented to the media there in the court. But some of the texts said, from Tyler to Twig saying, shouldn't be long until I can come home, but I got to grab my rifle. Still, to be honest, I had hoped to keep this secret till I died of old age. I'm sorry to involve you to that. Twigs responded, you weren't the one who did it. Right. With a lot of question marks. And Tyler went on to say, I am. I'm sorry. And more texts were revealed. Just a lot of back and forth where it seemed like Tyler was trying to get his rifle back from that wooded area close to Utah Valley's campus. And it was just fascinating to see some of the responses that Twig said, granted, he has youth immunity, meaning that anything he said in his testimony, anything that he's given the authorities, it cannot be used against him. But when Tyler's going back and forth about getting the rifle and there's policemen there and there's officers on ground, Twigs is like, you do you need that rifle for hunting? And that brings me to my next point. It was just a very casual conversation between Twigs and Tyler Robinson at this point. And he brought up hunting because he told authorities. And we're about to play that sound bite that he thought Tyler was engraving these bullets for a hunting trip. Remember, we knew, based on evidence that prosecution has admitted that's already been made public, that there were engraved bullets. And here's twigs explaining why these bullets were being engraved in the home he shared with Tyler Robinson.

He asks, you here. Remember how I was engraving bullets? Was he engraving bullets before this?

Yeah. I don't remember exactly when, but he had said he was planning to go hunting with his family. And he asked me for a. If we had, like, a Dremel to. Because he said he wanted to create messages on bullets. And I just told him where Dremel was and told him to make sure he doesn't, like, set off a bullet on accident in the house. But I didn't really think about it until then.

How long before September 10th was this that he asked about the Dremel?

I don't remember because he'd been talking about the hunting slash camping trip for a couple months, but I. I don't remember when he was specifically asking to engrave the bullets.

So. So are we talking like a year before?

Oh, no, not. Not that. Not that long. It would have been, I'd say, at most a Month before. This was when he was asking.

And that was an interesting point that Twigs brought up. About maybe a month before, he noticed that Tyler was talking about engraving bullets. And then in te messages revealed, we learned that Tyler Robinson, of course, said to Twigs he's been thinking about taking out Charlie Kirk doing that horrendous act on September 10 for about a week. He said he believed that was all text messages revealed there in court. Introducing Meta glasses. You have questions. They've got answers.

And I want to say this, that Lance Twiggs, we have been told this, but now we are seeing him be cooperative with with authorities. He handed over his phone. They used the Cellebrite to pull data off his phone, to pull all these photos, these texts off his phone. But you can see in photos, he just held up the text at a certain point for them to be photographed. And this is all playing for us to see, all playing in the courtroom. And that's where, of course, Tyler Robinson was present. And I want to give you some inside ball, so to speak, from reporters inside the courtroom. This is coming from Michael Ruiz with Fox News. He said that inside the courtroom that Tyler watched this twig's testimony very closely. Tyler was scratching his throat. When Lance talked about the last time he saw Tyler before Tyler went to surrender. That was that first sound bite we showed you from their interaction on September 11th. He Also, Michael Ruiz also observed Tyler starting to squirm around a little bit in his seat when they talked about Twiggs Dremel tool. That is the tool that was allegedly used to engrave the bullets. The Dremel tool came back in the courtroom as a witness took the stand. Jennifer Fouumina was back on the stand for the Utah State Bureau of Investigations. And she was able to go through their findings of the bullets and what they were engraved with and the DNA behind all of it. I'm going to quickly read through. This is shown in court, the bullet engravings. Some of this was known before. Some of this has been seen for the first time on the bullets in the evidence on these photos. So some of the bullet engravings notices bulge. O wo. What's another bullet? Had this question Mark. Another bullet had. Hey, fascist.

Another bullet had arrows that went in every direction. Think of the emoji arrows that just go in every direction. Another bullet had. Oh, Bella Chow. Another one just said if you read another one, this you are another bullet. Gay. Another bullet. Lmao. And this is what Jennifer Famuina went through when she was on the stand there for Utah sbi. And then this was the state's witness. So at this point in the trial, or excuse me, in the hearing today, you had the state question her on a lot of DNA evidence. And basically, to put it in simple terms, she is saying that Tyler Robinson's DNA is all over the rifle, all over the cartridges that she found inside the apartment, all over the Dremel tool, the buttons of the Dremel tool. And to put it in a more official terminology terms, she said that the DNA profile is 1 trillion times more likely to originated from Tyler Robinson than the other smaller DNA profiles or random DNA profiles. And that was about the trigger. And then talking about the Dremel tool, the same statement. The DNA is 1 trillion times more likely originated from Tyler Robinson. The test shot bullet. There was a test shot bullet found at the home of Tyler Robinson along with targets where they say that the bullets there were test shots. It was, it was wild to see the bullseyes and the bullet markings on those, those targets there. And that's really how the state wrapped up their case for this entire preliminary hearing, by again going through all of Tyler Robinson's DNA evidence that they were able to lay out through their w on stuff all over the apartment, items from the apartment, and of course the items found at the crime scene, which we went over from the other day, the screwdriver and the towel. But on day four today, Thursday, we got to see photos of the rifle inside the towel for the first time. This is from the wooded area and we got to see the wooded area and it was very tiny. You think of it, at least in my head, as a lot of woods. Well, this is just very tiny bushes near Utah Valley's campus, right across from Campus Drive. If you go look at a map of Utah Valley, you can easily see Campus Drive's the northern road that kind of winds through campus. But they showed photos of the towel wrapped around the rifle in the bushes. You can see it just like a dark towel there. And then we saw the rifle wrapped in the towel as it was getting photographed for evidence. And then the towel by itself. There's the photo of the rifle wrapped in the towel at that point Just from being taken out of the bush. And there was that other picture of the rifle itself that you're looking at now. So stuff that has never before been seen by the public. You had the Kirk family attorney saying, oh, this evidence they haven't seen, they. They want transparency. They want to see it as well. So after going through all of those photos and exhibits, the state rests its case today. Now, that doesn't mean they're done going up to the stand, as we saw, after they rest their case, they will go up to cross examine any of the witnesses that the defense calls. But as far as what they're presenting to Judge Tony Graf to be considered for evidence to be considered for the probable cause case against Tyler Robinson, the State is done. The defense zoned in once again on the bullet ballistics. We have heard about this before. We got to the preliminary hearing. There was that ATF report that came back inconclusive, which is common. It just means the bullet fragments, they couldn't 100%, without any doubts, match to the gun that was used. And the defense went very hard on this. A lot of very technical terminology. We were shown test shots. We were shown actual pictures of the bullet fragments that the ATF and Samantha Carner, who was the defense's witness from the atf, gathered and tested, and they went through. And she was able to identify on these bullet fragments points that did agree, grooves and lines and markings that agreed. But she was saying that she had to conclude it was inconclusive because there was just. She described it as missing data points because the bullet was fragmented. And I posted on X a picture of the bullet that was shown in court, and you just could see how mutated it was and how that could be hard, that it was inconclusive. But of course, the defense, their job is to poke holes and hold her accountable if this goes to trial to what she said. So Michael Burt, very experienced attorney, was on the Menendez case. He really went to town on Carter and tried to slice it and dice it every way he could to the point where it went on for hours. And he was bringing up findings from 2009 when Judge Graff said, we have gone way past probable cause here. To quote the judge, he said, I feel like we are exiting the orbit of probable cause because, again, this is not a trial. It's not innocence or guilt. This is probable cause. So after reining Michael Burt back in, this went on later today, later than normal, because this witness had to leave after today. But they were able to move on. And the state did Just very briefly cross examine her and just kind of went back to her reports just for her to clarify a few things. This is very detailed. This is very, very technical. Very like, what can I find? To the point where Burt brought up dust being found in the barrel of the rifle and she was like, I can't tell you how it got there. And a gun can still fire. Obviously you're supposed to clean your gun and you want it to be clean, but a gun can fire with a little dust on the barrel. And that is how today ended with evidence, with presentations to the judge. And we got some breaking news right before the public hearing went off for the day. We will not know if Tyler Robinson goes to trial now until September. September 1, 10am is when Judge Graff will hear the oral arguments. So both sides, after this wraps up on Friday, will go back and they will take what they got throughout this preliminary hearing and make their final statement. The prosecution will state why this should go to trial. And you're going to have the defense give their final plea to the judge to make their case. And then that is when it will be decided if Tyler Robinson, the accused killer of Charlie Kirk, will go to trial. But we got a month and a half and the defense is still going to call, they say one more witness to the stand on Friday. For them, it is another ATF person, at least that's what they stated previously. That is another person with the ATF who deals with ballistics. So we can expect some more very technical ballistics analysis as this wraps up this preliminary hearing. But it was a long day with a lot of new information.
