Under Donald Trump's directive, D.C. will become safe again and it will become clean again. But Washington, DC's Attorney General calls the move to appoint the new commissioner unlawful. And Brian Schwab is going to court to fight it, filing a lawsuit this morning alleging President Trump's going too far beyond his authority, calling the police takeover, including National Guard troops and federal agents, an affront to the dignity and autonomy for 700,000Americans who call D.C. home. And that suit comes a day after a Trump loss in court on another.

Spending is holding up for cars and other purchases. Retail sales rose 0.5% in July, up 3, 10% excluding autos. For the year ending in July, retail sales increased 3.9%. The numbers are encouraging and show signs of resilience since shoppers have pulled back on buying discretionary things. Spending was down in April and May, but jumped not 9, 10% in June. The month included the summer Amazon Prime Day event which was held over a four day period this year. Online retailers saw an 8/10 of a percent increase in July. Jenny Coselda, FOX NEWS.

The price of oil's down this morning about 75 cents to 63 bucks a barrel. Gas has dropped a penny. AAA's national average for regular $3.15 per gallon.
