Unconstitutional. I'm Daria Albinger, Fox News. And that is what a federal appeals court says about the cornerstone of President Trump's trade policy, tariffs. Fox's Alexandria Hoff says the president disagrees and he is promising a fight.

President Trump's tariffs, they're going to remain in place for now. This ruling does not go into effect until October 14th. That's to give time for the Trump administration to file an appeal to the Supreme Court. That panel wrote the statute bestows significant authority to the president to undertake a number of actions in response to a declared national emergency. But none of these actions explicitly include the power to impose tariffs, duties or the like, or the power to tax. Now, President Trump emphasized the timeline in his response, adding, a highly partisan appeals court incorrectly said that our tariffs should be removed. But they know the United States of America will win in the end. If these tariffs ever went away, it would be a total disaster for the country. It would make us financially weak and we have to be strong.
