On this vote, the yeas are 52 and the nays are 42. Three fifths of the Senate duly chosen and sworn, not having voted in the affirmation affirmative, the motion is not agreed to.

The shutdown now in its sixth day. Democrats are calling for a continuation of subsidies in the Affordable Care Act. Republicans say they want a clean continuing resolution that would fund the government through late November. President Trump telling reporters Monday he's open to making a deal with Democrats on health care if it is a good deal. A federal judge is not blocking the National Guard from being sent to Illinois for now.

Federal Judge April Perry decided against a restraining order that would have temporarily stopped the National Guard in Illinois and Texas from being deployed to Chicago. She gave the Justice Department till Wednesday to respond to Chicago's lawsuit. Earlier Monday Governor JB Pritzker accused the Trump administration of inciting the city's residents with the other forms of federal law enforcement already deployed.
