All are accused of being in the country illegally from Venezuela. Two were charged with assault. Now the top federal prosecutor in Minnesota tells a judge new evidence is inconsistent with the officer's allegations and charges should be dismissed. Details of the story kept shifting, and an unsealed FBI affidavit says ICE was chasing the wrong car and that the men had dropped the broom and shovel when the officer drew his gun and were running away when he fired it. Their attorney says the men are overjoyed with the prosecutor's request to drop the charges and that the ICE agent should be criminally charged. Chris Foster, FOX News.
