This after the recent disruptions during the government shutdown. Criminal charges against former FBI Director James Comey and New York Attorney General Letitia James are tossed out by a federal judge not on the merits of the cases, but in a fight over the legal authority of the interim U.S. attorney involved. The judge ruling that Lindsey Halligan's appointment was defective and that she's been serving unlawfully, which the Justice Department disputes. Today's ruling is without prejudice, which means those cases could be brought again. Comey just posting the charges accusing him of lying to Congress were based on malevolence and incompetence. James has described the mortgage fraud case against her as political. The Pentagon says it's investigating misconduct allegations against Arizona Senator Mark Kelly, threatening to recall the retired Navy captain back into active duty for a possible court martial. The statement does not specifically name a video Kelly was part of with other Democrats urging service members to refuse illegal orders.

President Trump initially called the video seditious. While he'd said sedition could be punishable by death, he later wrote these lawmakers should be in jail. Kelly said on a Sunday talk show he will not be intimidated and that all they did was reiterate what is already the rule of law.
