Federal Appeals Court will hear arguments today to consider if construction on the president's new White House ballroom can go forward. More from fox's Jessica Rosenthal.

A lower court judge had ordered that construction on the new ballroom stop. Judge Richard Leon agreed with the National Trust for Historic Preservation, which had sued, saying the changes require congressional approval. But a three judge appellate panel allowed construction to move forward through at least early June when they hear arguments. The deputy director of the Secret Service has filed documents explaining that stopping this project could put lives in danger. And during the appeals process, President Trump has confirmed details about renovations to the presidential Emergency Operations center under the ballroom, stating it has bomb shelters, medical facilities, facilities, bulletproof glass, biodefense and communications throughout. Now it will also help restart a closed plant in Maryland. 75 million will fund the opening of a new coal export terminal in Oakland, California. Critics say the coal can be harm to the environment and could cause serious illness. In a statement, a Sierra Club Beyond Coal campaign manager Lori Williams adding the administration that claims to want to make Americans healthy again should be doing everything in its power to shut down coal plants and limit emissions.
