Three federal firefighters who died over the weekend near the Colorado Utah border are now publicly identified.

They died Saturday in Mesa County, Colorado Emily Barker, 38 years old from Michigan and Nick Hutcherson, 27 from Arizona, both with the US Forest Service and 27 year old Sydney Watson from Alabama with the US Wildland Fire Service. Two other firefighters have burn injuries on a crew assigned to the Jones and Knowles fires burning on the Colorado side of the border. Those have now merged with the Sydney Mesa fire, which started on the Utah side. The destined injuries happened during what's called a burnover incident, resulting in shelter deployment when fast moving flames overtake the firefighter's position, leaving no way out. They lie on the ground under a quickly unpacked portable heat shield.

Fox's Chris Foster the Justice Department is taking two states to court over financial aid for college.

The DOJ civil Division in its complaint said laws in Massachusetts and Rhode island let illegal immigrants get in state tuition for schools as well as other financial assistance. Laws in both states allow the in state rates to anyone, even those in the country illegally who maintain residency. The DOJ seeks an injunction arguing it discriminates against US Citizens who may be denied the same opportunity. The federal government also wants to keep laws that allow financial aid and scholarships for illegal immigrants from being enforced.
