Fairfax and Arlington school districts are suing the Department of Education for placing them both on high risk status. Their suits say the department funds to the schools, including formula funding, discretionary grants and impact aid grants, will be done through reimbursement only. Both school districts are allowing students to use bathrooms that correspond respond to their gender identity. And the Department of Education says this is a violation of Title 9. But the districts note in their separate filings that they are bound by a recent federal appeals court decision that said Title 9 and the equal protection clause require them to allow students to use the bathroom that corresponds to their gender identity.
