Thune says talks on policy differences should be separate. The Senate will take up both short term spending bills. Transportation officials say if there is a shutdown, 11,000 FAA employees will be furloughed and that air traffic controllers will keep working but will not be paid. A federal judge in Massachusetts finds the Trump administration went too far with a crackdown on campus protests over the war in Gaza. The ruling says efforts to deport Gaza noncitizen protesters were unconstitutional.

U.S. district Judge William Young, a federal appointee of President Reagan ruled so called ideological deportations are a violation of the First Amendment. Judge Young sided with lawyers for a group of university associations who argued that immigrants lawful political speech was targeted and it creates fear in non citizens who attend schools. Attorneys for the Trump administration say no policy to revoke visas exists based on political speech and that the government is just enforcing immigration law.
