But after Wednesday's hearing, there was still a legal fight over what to do because she said if he's released and immigration enforcement takes him into custody, she can't control where they detain him. Furthermore, prosecutors wanted assurances that he wouldn't be deported, that he would remain in the United States to face the charges against him.
