Now Justice Sotomayor was among the skeptics of this argument that these reciprocal tariffs on nearly every country could be viewed as anything else. Well, the emergency powers statute the president has relied on never uses the word tariff and no president has ever used the statute to levy them. Nearly every justice across the spectrum had tough questions for the government, suggesting it may be an uphill battle for the White House to get to the five votes it needs to win.
