All this coming after the Justice Department said it would pause the implementation of the fund to comply with a court order. A federal appeals court says the Pentagon cannot block transgender troops from serving in the military.
Legal Correspondent
A divided three judge panel on the D.C. appeals Court upheld a lower judge's ruling that President Trump's executive order preventing transgender troops from serving in the military likely violates their constitutional rights. The appeals court did narrow the injunction to apply only to service members still in the military, but not new recruits seeking to join. The Trump administration is likely to appeal to the US Supreme Court. Last year, justices allowed the transgender military ban to take effect as litigation plays out.

rulings from the Utah judge overseeing the case of Tyler Robinson, the accused killer of Charlie Kirk.
Legal Analyst
Tyler Robinson's lawyers wanted to restrict public access to a July preliminary hearing, saying access to it and the evidence would jeopardize a fair trial. Judge Tony Graf Jr. Denied the motion, saying much of the evidence the state indicated it intends to offer during the preliminary hearing is already in the public arena. Judge Graf did grant a defense motion alleging prosecutors a pretrial publicity order by speaking with media outlets. Evidence will be heard at the next hearing June 12 to determine whether the evidence establishes the elements of contempt. Prosecutors say they intend to seek the death penalty if Robinson is convicted for Kirk's murder last September. Grinal Scott, Fox News State of Florida
