Trial to Darius Bean. Demetrius Haley and Justin Smith were granted the new trial by U.S. district Judge Cheryl Lippman. She took over the case after the original presiding judge, Mark Norris, recused himself. Judge Norris never gave a reason for stepping away, but Judge Littman noted one of Norris clerks was shot before the originally scheduled sentencing. Norris told investigators he believed the shooting was gang related and that one of the officers on trial belonged to that gang. Norris also told a federal prosecutor that the Memphis Police Department is infiltrated with gang members. Lawyers for the ex cops cited Norris's bias in their call for a new trial.
