It was illegal. I'm Lisa Lacera of FOX News. That's the ruling from a federal judge on President Trump's deployment of the National Guard to Portland, Oregon. The judge writing the deployment violated the primary federal law covering the call up of National Guard units into federal Service and the 10th Amendment of the Constitution. And the Trump administration's bid to temporarily halt food stamp funding is denied for now.

The Department of Agriculture saying in a memo it would complete the process necessary to ensure that Supplemental Nutrition Assistance Program benefits would be delivered to states this month amid the government shutdown. But at the same time, the Trump administration asking a federal appeals court to freeze a judge's order requiring it to spend more money that goes beyond what's left in a contingency fund to pay out partial SNAP benefits for the month. A number of states had sued arguing not releasing the funds violates federal law risking roughly 41 million Americans in need going hungry.
