The judge overseeing the federal case against Luigi Magione did not officially set a trial date, but it is likely that jury selection will begin in early September. Mangione's lawyers are asking Judge Margaret Garnett to throw out the most serious charge of murder with a firearm, the only one that carries the possibility of the death penalty. Judge Garnett is weighing what, if any, evidence should be suppressed and will issue a ruling on the matter. Mangione has pleaded not guilty to both state and federal charges against him in the death of UnitedHealthcare CEO Brian Thompson in Midtown Manhattan in December 2024.
