One hour from now, Charlie Kirk's accused assassin Tyler Robinson is due in court for his first in person appearance before a Utah judge, a hearing that will focus in part on a request to unseal the transcript from a closed door portion of an October hearing.

An attorney for the media coalition here intervened and asked that the transcript be made public, arguing in part that keeping it sealed is, quote, creating an impression of unfairness and secrecy, even though the proceedings may in fact be fair. So now the judge may unseal that transcript and we may find out what was discussed.

Fox's Matt Finn in Provo, Utah, where state prosecutors are asking the judge to clarify a gag order and who is considered a witness. Kirk was shot during a public at Utah Valley University, an execution in Tennessee. 64 year old Harold Wayne Nichols just put to death by lethal injection 35 years after he was sentenced to death for the rape and murder of college student Karen pulley in 1988. Nichols had confessed to several other rapes in the Chattanooga area. America is listening to FOX News.

Judge Paula Zinnis in Maryland found Kilmar Abrego Garcia has been detained since he was wrongfully sent to El Salvador without lawful authority. She said a judge never signed a final order of removal for him. Abrego Garcia had been deported to El Salvador earlier this year despite an order meant to prevent his removal. When he was brought back, a grand jury in Tennessee indicted him for human smuggling three years ago. When he was released from custody in Tennessee and went back to Maryland, immigration officials picked him up again. They've been trying to sort out removing him to a third country, though most of the ones proposed have said they won't accept him. He's requested that if he's sent anywhere, he be sent to Costa Rica. Even as the war in Ukraine continues, the International Olympic Committee is taking a step toward reintegrating Russia and its ally Belarus into world sports today, advising governing bodies to let the country's youth teams and athletes compete with their national flag and anthem again. SpaceX is set to send more satellites.

Into orbit Elon Musk's SpaceX is planning to launch one of its Falcon 9 rockets this afternoon from Cape Canaveral to deliver another batch of Starlink satellites to orbit. Those provide space based Internet service to people around the world using either special terminals and routers and and even to some standard smartphones. This particular Falcon 9 first stage engine has been used 15 times before, including to send crewed missions to space such as one for NASA, to the International Space Station and the privately funded Polaris Dawn. The rocket is expected to land on a drone ship in the Atlantic and be reused again.
