And without further ado, this is episode 618 of Going West. So let's get into it. In June of 1996, a 30 year old woman in Delaware politics disappeared after a mysterious dinner in Philadelphia. But when loved ones found a secret diary in her apartment, police began to uncover a murder mystery that was plagued. Plagued by secret affairs, scandalous cover ups and jealous manipulation fueled by control and power. This is the murder of ann marie fahey.
E
Ann Marie Sinead Fahey was born on January 27, 1966 in Wilmington, Delaware to parents Kathleen and Robert Fahey. And she was the youngest of six siblings. Growing up in a very tight knit Irish Catholic family, Ann was described as
D
warm and compassionate, just the kind of
E
person that others could rely on when they were in need, and that she always had a very quick sense of humor. But sadly, when ann was just nine years old in 1975, her mother Kathleen lost her battle with lung cancer which left the entire family completely devastated and especially her father Robert. Now it's safe to say that Ann really struggled during her childhood because after the death of her mother, her father began a very heavy addiction with alcohol and just wasn't able to keep up with the finances of the house. Ann attended Padua Academy, which is an all girls private Catholic school. And as a teen, just due to tough times, there was typically nothing at home to eat. The electricity and the water were often shut off and she resorted to taking showers at school. But Ann was very resilient as well as very studious. And when the power at home would shut off, she would use a flashlight to get her homework done. She often kind of moved in and out of friends of the family's homes, sometimes for weeks at a time just to escape the kind of, you know, toxicity that she was experiencing at home. As you can imagine, she and her father had a very rocky relationship at best. And she even one time threatened him with a field hockey stick after he stole her babysitting money to buy More booze.
C
And this babysitting gig was actually what kept her in Delaware when her father moved to New Jersey. Because Ann moved in with a family friend during her sophomore year of high school, declining to move states with her father. But like Daphne said, Anne was very resilient. And she graduated from Padua Academy in 1984. Setting her sights on local politics, Anne attended Wellesley College, located in Massachusetts, enrolled on a hockey scholarship, where she graduated in 1989 with a degree in international relations. But before that, her father Robert actually passed away in 1986 from leukemia. So now Ann is missing both of her parents. Well, during her time in college, she worked various jobs in order to supplement tuition. But after graduating, she entered into a six month exchange program in Spain before ultimately returning to the US to try her hand in the political scene. Now, Anne started her career working in administrative and clerical roles in the Delaware state government. Her brother Brian remembered of Ann, Annie would walk into a room and it's like someone threw the light switch and all the lights came on. She was ambitious, she was hard working and very driven, which is no surprise why in 1991, then Democratic Governor candidate Tom Carper actually hired her, first as a staffer in his Washington, D.C. officer, but then Ann ultimately wound up as his personal scheduling secretary. And this is when he won the gubernatorial race in 1992. So Ann ended up back in Wilmington around this time. Now, she was living with a roommate at the time in Delaware, but by 1996, when today's story actually takes place, she had gotten her own apartment in Wilmington, located in the city's cool spring neighborhood.
E
Well, on Thursday, June 27, 1996, and worked her regular shift for the governor's office. But later that night, she had plans to attend dinner with someone at an upscale restaurant in Philadelphia, Pennsylvania called Ristorante Panorama. Now, obviously we're talking about two different states here, but to paint the scene, Wilmington to Philly is only about 30 to 45 minutes drive northeast, so not too far at all.
C
Yeah, she can definitely make this trip pretty easy.
E
So during this time, Ann was dating a man named Michael Scanlon, who she had met in September of 1995. So, you know, the previous autumn, 31 year old Michael worked as the community affairs chief at MBNA America bank, and their relationship reportedly had been pretty good. So that night, multiple witnesses remember seeing Ann at this restaurant with this man, but noted that she seemed kind of unhappy.
C
Now, obviously right now, people don't know who this man is. They just saw her at this restaurant with a man, right? They have no idea if that's, you know, Michael or somebody else.
E
And nobody there knows who Anne is either.
C
Yeah, exactly. So it doesn't matter. Yeah, yeah.
E
And you guys don't either, of course. But we will again get into that.
D
So.
E
But yeah, good point. Because it's not like people know their relationship. They're just picking up on her vibe. So basically, the waiter who served her remembered that the dinner was extremely tense and that Ann barely touched her food. Then just after 9:30pm Ann left the restaurant with this man and she was never seen again. Now, the next day, Ann was off from work. This is Friday, June 28th, and nobody thought anything of it.
C
Right. Because, you know, they obviously don't know what she's doing on her time off. Like she could be doing anything.
D
Yeah.
E
So like, no alarm bells. Yeah. It's not like she had a shift and she missed it or she had, you know, work day and she missed it.
C
Exactly.
E
But then the next day after this, on Saturday, June 29, 1996, when Ann had missed a scheduled dinner with her boyfriend Michael at her brother Brian's house, people closest to Ann became very concerned. So with that, Ann's sister in law, Kathleen and her boyfriend Michael headed over to Ann's apartment to check on her. But when they arrived, the door was locked. So in order to gain access, they got in touch with her landlord, who was able to unlock the door for them. When Michael and Kathleen entered Ann's apartment, they noticed a foul smell permeating through the place. And they quickly came to realize that it was actually the smell of spoiled groceries that had been left on the counter.
C
Yeah, not the, the foul smell that you guys were probably thinking of.
E
Right. But still a concerning smell nonetheless, because they're like, why are her groceries on the counter? They also noticed concerningly that Ann's purse, wallet and checkbook were left in the apartment as well. But there was no sign of Ann.
C
There was also a very nice dress that had just been haphazardly flung over the back of a chair. Shoeboxes were scattered around, and her apartment was just basically in disarray. So immediately this was such a strange sight because everybody knew Anne to be a neat freak. You know, she always had things orderly. She was very, very organized, and she would have never left her place in that kind of state. So Michael and Kathleen began to scour Anne's apartment for clues, because from the jump, they just knew that something was wrong. And that's when Kathleen stumbled upon one of the most important pieces of evidence in today's this hidden diary of Anne's. So Kathleen obviously very curious about this. She decided that she was going to open it up and read it. And the last passage written in it says, I have finally brought closure to Tom Capano. What a controlling, manipulative, insecure, jealous maniac.
E
So who is Tom Capano?
C
Yeah, that is the biggest question. Well, let's talk about it. So Thomas Joseph Capano was born on October 11, 1949 in Delaware, making him 16 years older than Ann. He was 44 and she was about 28 when they met. So anyway, Tom was a very successful attorney in Delaware who had come from a very wealthy real estate family in Wilmington. His brothers Jerry, Louis and Joey took the path of their parents, focusing on the family business and garnering immense wealth. While Tom, who was again the oldest, although still successful and wealthy in his own right, chose a very different path. Tom served as the state Assistant Attorney General at one point and he was the right hand man of Wilmington's mayor, as well as legal counsel to the governor, Michael Castle. Tom studied law after high school, earning his undergraduate degree from Boston College and then his law degree from the University of Michigan. Now, Tom met his wife Kathleen, who went by Kay in 1971, and the pair had dated for just a year before they married on June 12, 1972.
E
And this of course is a different Kathleen from Ann's sister in law and her mother. There's three Kathleen's in this story.
C
Yeah, a lot of Kathleen's year. Well, the couple went on to have four daughters, Christine, Catherine, Jennifer and Alexandra, as well as Kathleen. No, I'm just kidding. No, they didn't have a kid named Kathleen and the family settled in Greenville, which is a very affluent suburb just outside of Wilmington. Now again, by all accounts, Tom was known as this highly successful and powerful man with connections to various political elites. And Ann was very drawn to him, even though Tom was already married by the time they met in the summer of 1993 and began having casual lunches together that eventually culminated in a whirlwind affair. Yes, Tom Capano was stepping out on his wife of 26 years in order to have this secret relationship with a woman 17 years his junior. Because, you know, when they met again, Tom was 44 and Ann was about 28. So Anne's sister in law, Kathleen, finds this diary and she's completely dumbfounded because most people in her life, you know, especially not her new boyfriend Michael, had any idea that Tom even existed. They didn't know who the hell Tom Capano was.
E
Yeah. So not only is Anne missing, but they're like she's writing in her diary about this man we've never heard of. She has a boyfriend. Now she's talking about this other guy.
C
Yeah. So. Yeah. So this is really, really concerning. So Kathleen and Michael contact the police to report Anne missing. And this sparks an investigation into Anne Fahey's disappearance. And the first person that they needed to look into is wealthy attorney Tom Capano. Traditional old banks charge overdraft and monthly fees. But why pay to get your own money? ZAMAZING Zazzle.com. So at this point, police had a name to work with. You know, this is super helpful to have found this diary. So they're wondering if maybe Tom Capano knew anything about Anne's last whereabouts. So they tracked him down on June 30, three days after Ann vanished at his home in Greenville, Delaware. And he told them that on the night of Thursday, June 27, he did in fact meet up with Ann. He explained that they had dinner together in Philly, everything went well, and then they left the restaurant at 9:30pm and he drove Ann home, dropping her off at 10pm but not before checking her faulty air conditioner and then leaving.
C
So this actually does line up because witnesses saw both of them leave the restaurant at 9:30. But from there all we have is Tom's account of events.
E
Right, so detectives then also checked his Jeep Grand Cherokee parked in his driveway. You know, they're trying to really figure out what's going on here and make sure that they're checking everything, which is really amazing considering we don't have a body or anything yet. But they didn't find anything suspicious? Well, detectives believe that Tom wasn't telling the whole story. So they did a bit of digging and they found out that Tom and his wife had separated in September of 1995, which, remember, is when Ann and Michael started dating. But they also found that while he was married, not only had Tom been cheating on his wife with Anne Fahey, he'd also been engaged in affairs with at least eight other women over the course of his marriage. Was like, how does one have the time?
C
Yeah, this guy was like a habitual adulterer.
E
Insane. So in the heat of he and Anne's secret relationship, Tom had been seeing two other women. Susan Louth, who worked as a legal secretary, and Debbie McIntyre, who was a 47 year old private school administrator and had apparently been seeing Tom Capano for over 15 years by that point. Which is like, oh my God, that is such a long affair. Oh, and by the way, Debbie McIntyre, this other woman that Tom is seeing, her husband was actually a law partner in Tom's firm. And Debbie herself was good friends with Tom's wife Kay, you know, or so Kay thought, which is like, it's really,
C
really, the whole situation is so messy because it's like this is your, your business partner and you're literally like sleeping with his wife. Catchy. Scummy.
E
Yeah.
C
So getting back to Ann's introduction to Tom, when she first met him, she fell pretty hard, writing in her diary, quote, I am madly in love with him. Now, originally, Tom told Anne that he was on the outs with his wife and that he planned to leave her. Yeah, okay, Tom. But as the affair went on, Ann realized and accepted that she was his mistress, Even though, you know, the thought of that kind of really made her feel uncomfortable. She wrote in her diary on April 24, 1994, I'm afraid because I'm in love with a man who has a family. I fantasize my life with him all the time. He's very gentle, intelligent, handsome, and interesting. And Tom actually kind of played on Ann's insecure nature with his confident, self assured attitude, making her feel important During a time where she struggled with anorexia and bulimia. He would wine and dine her, buy her expensive gifts like handbags, clothes, and jewelry, and take her with him on trips to Virginia. I mean, she was just absolutely smitten by Tom. But to Tom, you know, this was merely a game, One that he knew pretty well by this point, as he had done this with numerous women before. He loved the power, and he absolutely loved the control. Well, by 1995, Ann was kind of beginning to see Tom for who he really was. And this was around the same time that she had met a man closer to her own age again, Michael scanlon, and the pair began dating. So detectives are looking through all of this, and they're now seeing that Ann had actually tried to break things off with Tom on a few occasions. Ann's psychiatrist, Dr. Neal Kay, later said she was actually trying, in her way, I think, to let him down easy, to try and break it off in a gentle way. Well, by 1996, Ann was in this new relationship with Michael. Things were going really well for her, and she was just kinda tired of being used by Tom. She wrote. For one whole year, I allowed someone to take control of every decision of my life. But then came a massive bombshell that raised red flags for investigators right away. When on July 2, 1996, Ann's Hairdresser, a woman named Lisa d', Amico, came forward with some very damning information. She told detectives that Ann had relayed to her that when she began dating Michael, Tom absolutely freaked out and began stalking her. Tom was in no way used to rejection, and this sent him into panic mode, Panic that he might lose his control over Ann. When she began dating Michael, Tom demanded his expensive gifts back and would show up at her apartment unannounced. His manipulation knew no bounds because he would call her repeatedly, buy her flowers, and send her numerous emails and harass her on a near daily basis. But Ann still had a soft spot for Tom. And she allowed him to continue to hang around despite the fact that she was just no longer interested. He had even purchased her a plane ticket to Spain with him in December of 1995, hoping to rekindle their affair. But she actually turned that gift down. I mean, at this point, Tom was so desperate and starting to become unhinged, and Ann knew it. In one email that she sent him after their split, she wrote, quote, tommy, you scared me this weekend, starting with Friday and all the calls you placed. It really freaks me out when you call me every half hour. I mean, that's just how, like, unhinged Tom is at this point.
E
And the fact that we have this email just to prove it, to see, you know, the diary entries and the emails, to know of his manipulation is huge.
C
Yeah, it is. And, like, he's just not letting go again. He really cannot take this rejection well.
E
On July 5, 1996, it had been over a week since Ann was last seen, and everybody in her circle, as well as detectives, began to grow very suspicious of Tom. Anne's disappearance was also now making national headlines, so much so that the FBI became involved. And even former President Bill Clinton was making pleas to help find Ann, making numerous calls to the Delaware governor Tom Carper's office. Remember, again, this is who Ann worked for. But Tom Capano was keeping his mouth shut and maintaining his innocence. And as an attorney, he immediately obtained
C
his own attorney, which is kind of crazy because Tom knows the law so well at this point that, like, he knows that if he keeps his mouth shut and he just lawyers up, he's got a good chance of beating any of these allegations, you know?
E
Yeah, he's got that inside knowledge.
C
Yes, he does. So Tom did his best to avoid speaking with investigators, but the pressure was becoming too much to ignore, and he finally granted detectives a chance to speak with him on July 25, 1996. But he demanded that if he speak to authorities, the conversation must only surround the nature of his relationship with Ann and avoid anything unrelated to her, like his personal life. Then, the very next day, July 26, the FBI was able to find out that two days after Ann went missing, Tom purchased a new Oriental rug for his home on June 29 from a place called Airbase Carpet Mart in Newcastle.
E
Never a good sign to buy a new rug after somebody goes missing, especially when that is essentially your mistress.
C
Yeah. Well, they also found out that although Tom and Ann did have that dinner in Philly, which was of course, confirmed by witnesses, but also by toll road surveillance, as well as credit card Receipts. Neighbors of Ann's don't remember seeing Tom's car return to Ann's apartment that night. So they're like, we don't remember seeing them come back to Ann's place. Which was inconsistent with what Tom told investigators. Also, Tom's maid, a woman named Ruth Boylan, told police that she had cleaned Tom's house on July 22, and that she remembered that a love seat and some carpet in the home had been replaced.
E
Oh, God. Like, this is just looking so much worse.
C
Yeah, it is really not looking good for Tom, especially.
E
Cause, like, I just bought a new rug myself, you know? But the fact that he did that. A love seat and you're replacing carpet, it's like, I don't know. This feels like more than, like a home project.
C
Yeah. And it's like, you know, typically, nothing like this would raise red flags if somebody did this. But the fact that you're being connected to a missing person's case and then you do these things. Yeah.
E
Suspicious, not looking good. Well, to make matters worse, the FBI learned that Tom's younger brother Lewis, asked a project manager of his to empty a half filled trash bin on July 1 that had been sitting on the Concord pike construction site, which was being developed by Lewis. So this is weird because it's a half filled dumpster. So it's like, wouldn't you want to fill it up all the way?
C
Yeah.
E
Like, what are you really trying to get rid of here?
C
Interesting timing.
E
So this man, Shaw Taylor, actually met up with FBI agents at a truck stop in order to relay this tip. Because he's like, yeah, he wanted me to dump a half empty dumpster for him. Like, he knew that was weird. Like, that was weird to even him.
C
Yeah.
E
But that wasn't all, because it came to be known through another tip that Tom's other brother, Jerry Capano, had sold a fishing boat that was missing its anchor. Let's put a pin in that for now. So it seems like authorities were getting closer and closer to finding out exactly what happened to Ann. But then the FBI figured out that on June 3rd 30th Tom stopped into Happy Harry's, which is a discount drugstore in Delaware, and he asked the clerk about blood remover. Like, something that would remove blood.
C
So insane. Because it's not even. He didn't even use the words like, hey, stain remover. Yeah, like, I need to remove a stain from something. He's like, do you have any blood remover?
D
Like, what?
E
Do you have something that can remove blood? Is crazy.
C
Crazy.
E
Which Again, accidents happen. You might cut yourself and get on your shirt. But again, all of this happening in secession, it's like, it's too weird to be normal.
C
Yeah, this is all in the, you know, the orbit of this investigation.
E
Well, two days prior to that, law enforcement learned that Tom showed up at his estranged wife Kay's house. This was on June 28th at about 7am asking to use her Chevy Suburban SUV.
C
And remember, you know, they have been split up for a while, they both live in different places now. And Tom is randomly, just randomly showing up at 7am saying hey, do you think I can use your car?
E
We know Tom has his own cars. Yeah, probably multiple, you know, like so this is really weird. And this, you know, after police found all this out, this is when Tom was officially labeled as a suspect in the disappearance of 30 year old Ann Marie Fahey. So a search warrant was issued for Tom's home on July 31, as well as for his Jeep Cherokee and his wife chevy. And after 11 hours of searching, they were able to find two drops of blood. And when this blood was tested, it was a perfect match to Ann's. So at this point, authorities were seeing this case as a potential kidnapping because although the evidence was of course beginning to pile up, they still didn't have a body and they had no idea if Ann was still alive or if she was deceased. So they would have to keep pushing for those answers.
C
Now at this point, the FBI sent a letter to Tom's attorney notifying him that Tom was now under federal investigation by a grand jury. For four days at the beginning of August, from the 12th through the 16th, investigators conducted a search of two different landfills. Landfills that Louis Capano, again Tom's brother, was known to discard of waste at. They were looking specifically for, of course, a rug and a loveseat, as well as any other evidence that Tom may have owned, discarded and then replaced.
E
Yeah, because they only have two drops of blood. But they're like, we think we know where more blood is and it's on this furniture.
C
Yeah, they think they can find it because now they're making the connection to that half filled dumpster. They're like, we gotta check these landfills.
E
Uh huh.
C
But unfortunately that search turned up nothing. Now things on the surface appear to slow down in the investigation as early 1997 rolled around and a grand jury had stalled the case because not only did they not have a body, but they didn't have a murder weapon either. Well, detectives knew that Tom had many affairs, so they wondered if maybe one of his mistresses might have some information that they weren't privy to. So they got in Contact with Debbie McIntyre. Again, this is Tom's mistress of 15 years. And she explained that in the months leading up to Anne's disappearance, Tom had begged her to buy him a gun.
D
Bro.
C
Yeah, crazy.
D
So.
E
And yeah, can you get a gun for me? So it's not in my name. Oh, my God.
C
Yep. And she actually revealed, after some intense federal pressure, that she did just that, she actually bought him that gun. She purchased Tom a.22 caliber handgun on May 13, 1996, from a place called Miller's Gun center, located in Wilmington. Now, in order to corroborate this, because of course they didn't have that weapon in their possession, they checked store receipts and sure enough, Debbie had purchased the gun after deep manipulation by Tom telling her that he needed it for protection against an extortionist.
E
So why didn't he bite himself?
C
I mean, yeah, if this is not the most obvious, like cover up, like premeditation bullshit you've ever seen. So now police are really hot on Tom's trail. But it would take another six months for the case to see any new developments.
E
Well, at least at this point, detectives knew that the only way to bring Tom down was to get people close to him to kind of like find fold on him. And they knew that Tom's brother Jerry was that key. See, Jerry had some criminal history himself, stuff that involved illegal possession of unregistered firearms and drugs. So police figured that if they could talk to Jerry and give him like an ultimatum, you know, like either jail time or utalk, he might just turn on his older brother Tom. And guess what? On November 8, 1997, Jerry was finally ready to chat. He met with federal officers that day and explained that at 6am on June 28, 1996, like a year and a half earlier, Tom showed up at his house in a panic. Then Tom admitted to his brother that he killed somebody who was extorting him and demanded the use of Jerry's boat. Remember, Jerry got rid of that boat. Jerry then admitted that they took the boat out to sea, stuffed Ann Marie's body in a cooler, shot holes in the cooler when it wouldn't sink, and eventually chained her body to boat anchors to drop her into the ocean. Remember that anchor was missing? But Jerry wasn't the only person to confess here because their other brother Louis also spilled the tea. Admitting that Tom brought him a blood stained sofa and rug from his house and asked him to dispose of them in his company's dumpster. So this is, like, all matching up?
C
Oh, yeah. Everything is coming out now. And this confession came just two days after Jerry's on November 10th. So Tom, at this point, was absolutely cooked. On November 12th, 1997, 17 months after Ann Marie Fahey disappeared, Thomas Capano was finally arrested for her murder. But what's even crazier is that when Tom was arrested, he was attempting to flee the country. He was actually intercepted on Interstate 95 headed for the Philadelphia International Airport. But the FBI snagged him just before he could make it there.
E
He would run.
C
I know, he seems like the type of guy, right? Well, after Tom was arrested, a local fisherman from Delaware named Ken Chubb was watching the nightly news when he saw the headlines detailing Tom's arrest and the murder of Ann. But when he heard about the fact that Tom and his brother had gone out to sea to dump a large cooler that carried Ann's remains, his heart sank. Because back on July 4, 1996, Ken had been out fishing about eight miles off the coast of Delaware when he spotted a massive, expensive commercial grade fishing cooler swaying in the open ocean.
E
That is insane.
C
So crazy that this guy actually found it. So Ken pulled this 40 and a half gallon cooler onto his boat, and he noticed that it was riddled with holes from gunshots.
E
So he's like, fine.
C
I know. He's like, what the fuck? This is crazy. Now, of course, Ken had no idea why this cooler was out there, but he did know that the cooler was expensive. So he figured that he would take it home and patch up the holes and then just keep it for himself.
E
Ken, Seriously?
C
Yeah. And I mean, you know, he's just being resourceful.
E
But, like, bullet holes and it's in the ocean. Something is wrong.
F
I mean.
A
Yeah.
C
Well, for 17 months, the cooler that was used to transport Ann's body sat on Ken's boat being filled with fish and ice. That is until Ken saw that news segment. So he informed the FBI that he had the last key piece of evidence that they needed, and he turned it over to authorities. So essentially, these two morons went out to sea with Ann's body in this big wall, white commercial cooler fishing cooler. They dumped it overboard. They thought that it was gonna sink. It wasn't sinking, so they shot holes in it, hoping that it would sink. If, you know, there were holes in the cooler, that didn't work. So then they took Anne's body out of that cooler. Then they tied Ann's body to that anchor that was originally with the fishing boat, the one that was missing. And they sunk her to the bottom of the seat, and they just left that cooler out there, which is why
E
Ken was able to collect it and. And put fish and ice in it. And wait, there's a body in here? Because there wasn't one.
C
Yeah, and he didn't, you know, he was none the wiser. He was just like, hey, this is a nice cooler. I'm gonna fix her up. Well, Tom Capano's murder trial began in October of 1998, with the prosecution laying out a complete timeline of events, which included Anne Marie Fahey's heartbreaking diary entries, her phone records, highway toll receipts, and the physical presence of the patched up fishing cooler in the courtroom to prove premeditation. But of course, the climax of the trial was when Tom's brothers took to the stand to testify against their older brother. But then Tom himself took the stand in his own defense, which many believe was a huge mistake and probably his biggest downfall, because instead of trying to invoke sympathy from the jury, Tom spent three days being a narcissistic, arrogant prick. And the jury saw right through him. He also spun this ridiculous cover story for the murder weapon, insisting that Ann's death was simply a tragic accident. So get this. This is what he told the court. He said that on the night Ann was killed that his other mistress, Debbie McIntyre, who purchased the gun for him, broke into his house while Tom and Anne were there watching TV, and that she was holding the.22 caliber gun and threatening to commit suicide. In this sort of jealous rage, Tom said that he then tried to wrestle the gun away from Debbie and the gun misfired, tragically striking Ann in the head.
E
Uh huh.
C
Yeah, sure. Tom then he said that in order to protect Debbie, he then disposed of all the evidence. But Debbie was also there at the trial and testified, basically telling Tom and the rest of the jurors that Tom was full of shit. And the prosecution backed this up, stating that if this was some sort of tragic accidental death, Tom wouldn't have needed to buy that large marine fishing cooler weeks before Ann's murder. And with that, Tom was done. On January 17, 1999, after five days of deliberation, Tom Capano was found guilty of first degree murder, and he was sentenced to death by lethal injection. When the verdict was read, Tom threw this huge hissy fit in the courtroom, this huge tantrum, accusing the prosecutors and even his own defense team as liars and cowards.
E
They had a lot against you tomorrow.
C
Yeah, I mean, it was don't even play. It was overwhelming evidence. You fucked up. Deal with it. In 2006, Tom's death sentence was overturned due to a US Supreme Court landmark ruling, but he was still subsequently re sentenced to life in prison without the possibility of parole. But it wouldn't matter much anyway because on September 19th of 2011, Tom suddenly suffered a massive heart attack in his prison cell in Smyrna, Delaware and he died at the age of 61. Anne Marie Fahey's body has never been recovered, but it is believed that she rests at the bottom of the Atlantic Ocean tied to the boat anchor that Tom used to weigh her down. Tragically, the world would miss out on the brilliance that one woman had to offer. And who knows how far politics would have taken Anne. All because of one controlling, manipulative and evil man that decided to take her life.
