Yes, but the three judge panel, at least two of those judges in a case brought by Mark Kelly to defend his First Amendment rights as a retired member of the military, to look the military in the eye and tell them that they have an obligation, which they are taught in their academies and taught by the code of military justice, not to follow illegal orders. And from that ad with five other members of Congress, we have an appeal that looks like Mark Kelly is about to win. Mark Kelly, a decorated fighter pilot in the Navy, husband of Gabby Gifford, who hopefully people know was going to be probably a senator herself. As she ran for office. She was brutally shot and barely recovered, but not enough to ever go back into public life. Mark Kelly, space shuttle commander as well, Navy pilot in the Iraq war. He also is on the Senate Armed Services Committee, which does oversight over Pete Hegseth. You often see Hegseth battling it out in a losing battle with Senator and former Captain Kelly about these issues. But after, in November, around the time of the Caribbean military strikes of fishing boats in the Caribbean, Mark Kelly and five other members of Congress, including Senator Elisa slotkin, created a 90 second personal service announcement infomercial reminding the troops that

under their code, under their oath, which is exactly what they're taught in school, by the way. But Hegseth didn't like that, even though Pete Hegseth himself, I'll show you a clip, had a very similar statement that he made when he was in, when he was teaching at one of these war colleges. Peg Seth decides he's gonna admonish retired Captain Kelly. He's going to take away some of his pension. He's going to demote him. He's going to censure him. And Mark Kelly ran to court and, and got a district court judge, federal district court judge to stop it, hence the appeal. Now, that's exactly what Pete Hegseth said in his own presentation to a war college when he had less gray hair. It was just a Fox News analyst or whatever he is. Play that clip.

I do think there have to be consequences for abject war crimes. If you're doing something that is just completely unlawful and ruthless, then there is a consequence for that. That's why the military said it won't follow unlawful orders from their commander in chief. There's a standard, there's an ethos, there's a belief that we are above what so many things that our enemies or others would do.

What's the difference that, because you're both retired military at that point, and that was the core of the oral argument, what to do about retired members of the military who are also senators, with their own speech and debate privilege, their own First Amendment privilege providing oversight over that military. Because, look, we'll all admit that when you're in the military under the First Amendment, you are not going to be able to freely speak out against the chain of command or to undermine morale or esprit de corps.

never serving in the military, there's no limits on your First Amendment rights. The question here is, if you're formerly in the military, if you're retired, do you have the ability to freely talk to the military and that which is consistent with the code of Military justice, yes or no? And that was at the heart of the matter. See, the lawyers for the Department of Defense, they relied on a case, Perry versus Levy from 1974, but that had to do with an active duty captain, Captain Levy, who was telling black soldiers they should not serve in Vietnam, they should go awol.

We've got to analyze what happens when a retired member of the military is speaking out to the military active duty. That conversation, how does the First Amendment and the law apply to that? So they're going to be making new law here, but clearly it's going to be in favor of Kelly. Anybody that listened to the oral argument in Completion like I did, you got to come away with Pan and Pilar are going to vote in favor on that panel. Now, whether Karen Henderson, a George W. Bush appointee, I don't know. She's more concerned with, well, if he can be brought back into the military and court martial, why can't they also restrict his First Amendment speech? Because they can't. And I don't even think the Supreme Court is going to find that. My cat Chanel, she runs the house. I just pay the mortgage and scoop litter. Last year, I said something that the President didn't like. It was pretty simple then, and it still is, that service members need to follow the law. And in response, the President said I should be prosecuted and hanged. Then he tried to throw me in jail. And then Pete Hegseth, the Secretary of Defense, tried to censure me, demote me, and take away my pension, all for something I said that I had the right to say as a senator, as a veteran, but most importantly, as an American. Because you said on television violence, that we're depleting our ammunition. Things like this. Nothing is inevitable. There are always other options. During the Obama administration, the Iran deal, the JCPOA kept the enrichment at a lower level. Donald Trump tore that up. That's the reason where we're here. But this also was not inevitable. There were other things that we could do. The $1.5 trillion request from this administration, it's outrageous. When I got to the Senate five and a half years ago, the defense budget was just over $700 billion. Now they're asking for twice as much money. It's nearly the amount that the rest of the world pays for its defense.

It depends on the weapon system, but 2 to 3.4x of what we have today. So, yes, we're dealing with a reality under the previous administration of what they sent to Ukraine and what they allocated elsewhere.

I got it so we fired years worth of munitions and it is clear that we're these are being expended to try to achieve some objectives. That was the plan. But Mr. Secretary, this war is stuck. The Strait of Hormuz is closed, the Iranian regiment is in place, the nuclear material still in their hands. Americans are being crushed by higher costs and it's not clear to them at all what the goal of this war is.
