Penney had originally faced a second degree manslaughter charge, which carried a 15 year prison sentence. However, the judge agreed to dismiss that charge on Friday at the prosecution's request. The jury on Monday rendered a not guilty verdict on the remaining charge of criminally negligent homicide. Alvin Bragg's office controversially charged Penny last year after the then 25 year old restrained Jordan Neely on the subway. Neely, a troubled man with a history of mental health issues and a lengthy rap sheet, had a pulse when authorities arrived on scene but later died. Lawyers representing Penney said that their client acted to protect others from Neely, who was threatening subway riders and had a history of violent behavior.

Mangione was also in possession of a handwritten manifesto that criticized healthcare companies. The arrest came after local police received a tip from a McDonald's worker who recognized Mangione from surveillance photos released by authorities.
