20 year old Scott Macklem had a lot to look forward to. He was engaged, he was about to become a father, but his entire future was taken from him in the blink of an eye. On November 5, 1986, Scott was shot to death. He was killed a little before 9am in a parking lot outside St. Clair Community College, Port Huron, Michigan. About six months later, a jury found the man now known as Temujin Kenzu guilty of that crime and he has been behind bars ever since.

One thing that is common in the true crime community is for people to have very different opinions about cases. And of course, that is part of what makes being in the space interesting. Tossing ideas and theories back and forth can make for stimulating discussions, even if no one's minds get changed.

But the Scott Macklem murder is the rare case where there does not seem to be a great deal of disagreement. Even people who are ordinarily quite skeptical of claims of wrongful conviction look at Temujin Kinzu and say that he is clearly not guilty of the murder of Scott Macklem. A number of people who we deeply respect hold that view. In fact, not a single person online seems to be arguing that he is guilty as charged.

And this is the Murder of Scott Macklem. The Guilt of Temujin Kinzu Part 1 Tell him to leave you alone. As we looked more and more at the case of the murder of Scott Macklemore, we became convinced that Temujin Kinzu committed this crime. In our episodes this week, we are going to share the case for his guilt. If you believe in Kinzu's innocence, perhaps what you hear will change your mind. Perhaps it won't. But if it does not, at least you will have a better understanding of the case against him.

Next week we will be releasing more episodes on this case. Those episodes will focus on the specific claims that Kenzou and his supporters have made over the years about what they consider to be weaknesses or out and out fraud in the case against him. We are going to explain in those episodes why we don't feel those claims hold any water. We just want to stress again that those claims will be addressed in our other episodes. These initial ones are going to deal with the other side of the argument, the side that has for too long been neglected.

In next week's episodes we will also be discussing some troubling aspects of the so called advocacy currently being done by Kenzou and his wife Paula. They are actually doing things like posting the name and phone number of a rape victim online.

Those episodes will also cover some of the conspiracy theories Kenzu has put forth over the years to explain the murder. Here's a spoiler alert. They are all really stupid. In one of them, he asserts that the man responsible for the killing was Kenzu's own defense attorney.

Now let's begin by talking for a moment about names. Temujin Kenzo's legal name at the time of the murders was Frederick Freeman. He had some warrants out for his arrest in another state. And so to evade those, he was telling people he met that he was actually named John Lamar. That was the name most people knew him by in Michigan in the time leading up to the murders. He used other aliases too. But later, after converting to Buddhism, he changed his name to Temujin Kenzu. So we have one man with several different names and that can get very confusing very quickly. To keep things easier to follow, we are only going to refer to him by one name and that name is Temujin Kenzu, which seems to be the name he now indicates that he prefers to be used. So please be aware that we are silently changing references to John Lamar or Frederick Freeman or any other alias to the name Temujin Kenzu.

And let's make another quick note. We will, in the course of these episodes, be presenting excerpts from the transcripts of Kenzu's trial and other hearings. For the sake of conciseness and clarity, we have edited those transcripts, but we have not changed the meaning of the testimony.

The accounts we saw online of Scott Macklem's case tend to paint it in broad strokes, making it seem as if the jury had to have made a horrible mistake and that Kinzu was absolutely innocent. They make it sound as if Kinzu is a peaceful and contemplative soul who was only targeted by small town police because he happened to be interested in martial arts. But if all of that was true and his innocence was so glaringly obvious, then why on earth would so many legal authorities in Michigan look at the case and come to the conclusion that that he should remain incarcerated? We found it difficult to believe that all of those attorneys and judges would want an obviously innocent man to stay in prison. That meant they must have had good reason for their stance. And that in turn meant that the recent coverage of Kinzu's case likely left out some critical details. So, bewildered by all of this, we looked into the case and found that there was indeed much that has not been reported. We also found that Kinzo has repeatedly lied about matters both great and small. And the fact that he has done this, the fact that he has lied, is absolutely important and crucial to remember as we discuss this case. A lot of what is out there about this case, a lot of what you may have heard is based on those lies or half truths or admissions or outright fabrications. So I want to start by giving you one quick example so we can all get a sense of who exactly we are dealing with here before we get more into the details.

Ken Zhu has claimed that his trial was unfair. He claims that he wanted to testify on his own behalf, but that his attorney would not allow him to do so. He has not only claimed this, but he has sworn to it in an affidavit. He wanted to testify and his attorney wouldn't let him.

That is a lie. It was Kinzu's own wish to not testify. We know this for a couple of reasons. First of all, Kinzu's trial attorney, David Dean, said so in a 2005 interview. Defense attorney David Dean said that Kinzu did not want to testify in the trial because Kinzu did not want his character to become open for attack at this point.

In fairness, perhaps you were thinking that maybe Dean lied in the interview because he did not want to admit he stopped Kinzu from testifying. But hold on. In a 1987 interview with the Times Herald, Kenzou himself said exactly the same thing. The reporter says that Kenzu told him he had chosen not to testify and then quotes him. These are Kenzu's own words. I was afraid Mr. Cleland, aka Prosecutor Robert H. Cleland, would use prejudicial information against me. I thought he would try to slander me. Everyone has some skeletons in their closets.

So what we have there is Kinzu himself agreeing with his attorney. It was Kinzu's own choice not to testify because he was worried about his skeletons coming out. All of Kinzu's talk about not being allowed to testify, including his sworn affidavit, to that effect, they're all lies.

So that tells you who we're dealing with here. We want to make another point though, one we hope you keep in mind as we discuss this case. The truth is almost like a jigsaw puzzle. The pieces fit together nicely. If different people talk about the same event in much the same way, it is a good sign that they are telling the truth. If the things they say don't fit into the puzzle, it might be a sign that they are lying or wrong.

One more thing. In fairness to Kinzu, he was absolutely correct to be worried about his character causing him trouble in the trial. As we are about to hear, Temujin Kinzu is a brutal rapist. That is not something we should turn away from. It is who he is and he has not changed. Earlier this year on Facebook, he publicly attacked a woman. He raped a woman named Crystal. You will hear her story a little bit later in this episode. When you do, please remember that he attacked her online in 2025. This is who he is.

To understand what happened to Scott Macklem and why, you need to first look at the relationship between Kenzou and a woman we will refer to only by her first name, which is Crystal. She had dated Scott Macklem since high school. But they broke up after starting college. Yet they remained friendly. In fact, they would eventually get back together.

During the time Scott and Crystal were apart, she had the terrible luck to meet Temujin Kenzu. He came into the store she worked at and asked her out. The two went out on a date. Kenzu started spinning all sorts of wild stories to her. He told her all about his obsession with martial arts, either then or later. He also told her that he, in fact, was part of a mysterious organization that sent him on special jobs. He told her one of his former girlfriends had talked about this organization, and so Kenzo had had to break her legs.

At the end of their date, Temujin Kinzu raped Crystal. Kenzo then made it clear he wanted to see Crystal again, and he scared her into complying. He threatened her and her family. He spoke of spying on her house. He terrified her. Crystal saw him hit a woman named Shelly that he was involved with. He told Shelly that if she cried, he would hit her twice as hard the next time. On one occasion, Crystal went to his house. There was a variety of martial arts paraphernalia all over the place and also a gun. But for now, let's pick up the story of Crystal's visit to Kinzu's home in her own words. We take this from excerpts from her court testimony when she was examined by prosecutor Robert Cleland. Anya will be reading Crystal's words, and I will read the words of prosecutor Cleland.

I said I wanted to go home because it was getting late. It was about 10 o'clock and I wanted to go home. So I got up and I went to get my keys. He grabbed the keys that were on the little table in the living room. He grabbed them and he said, no, come on upstairs. And I said, no, I just want to go home. And he said, no, come upstairs. And I said, I just want to go home. You know, I'm tired. So he grabbed my arm and he pulled me upstairs to the attic.

How does one get upstairs in this particular little house?
Anya Cain
There was stairs, but the door was in the roof. You had to lift the door up so you could go up into the attic.

And how did you get up there?
Anya Cain
He dragged me up there. He pulled me up the steps.
Kevin Greenlee
What happened when you arrived upstairs in this attic room?
Anya Cain
Well, he took me. There was like, when you got up in the door, it was like where he had all storage and stuff. And back farther was a little room. And it had like a bed in there with just a mattress on it and threw me down on the bed. And he started kissing me and stuff. I said, don't. I don't want to do this. I just want to go home. He said, get back. He. He ripped my shirt off. And I got up, I started crying. I said, I want to go home. I don't want to do this. Get back here. All of a sudden he said, why do you keep teasing me like this? He said, you only do this in front of Shelly. And when he did that, he turned around and smacked me in the face with his fist. He did that three or four times and just started yelling.

He said, you only do this in front of Shelly?
Anya Cain
Yes.

Do what in front of Shelly?
Anya Cain
I didn't do anything in front of Shelly. I was sitting on the couch. He. He just made it up. He wanted. It was like he wanted to start a fight just to take, like, his anger out on me. He kept throwing me around the room, picking me up, throwing me against the wall.

Picking you up how?
Anya Cain
By my throat.
Kevin Greenlee
And when you say picking you up, you mean picking you up off the ground or just moving you around?
Anya Cain
No, picking me up off the ground.
Kevin Greenlee
Was he able to do that?
Anya Cain
Yes, he was just.
Kevin Greenlee
With two hands on your throat, he was able to pick you?
Anya Cain
He picked me up. He grabbed me around my windpipe of my neck. And there was a window up there. And he told me if I even thought of screaming, he would just throw me out of it. The window. So he let me back down, and I didn't say nothing. And I. I would just ignore him, just let him go. And he just sat there screaming and yelling at me.

As far as you know, were there still people downstairs?
Anya Cain
Yes, I thought there were. Shelly was there when I left, finally. She never came up while I was up there. He kept. If I didn't say anything or nothing, he just kept smacking me, hitting me in the face constantly, throwing me all over the room. I told him, finally, I don't feel good. I'm going to get sick. And finally, after we were up there, it was a long time, he let me go back downstairs and I.

Did anything. Did anything sexually physical happen in that upstairs room?
Anya Cain
No. He tried. He tried, but I didn't. I, I, you know, like, I threw such a fit after what happened the last time, I didn't want him touching me again.

When you went back downstairs, who was there, if anyone?
Anya Cain
Nobody. The room, the house was empty, but Shelly's door was shut to her room.

What happened then?
Anya Cain
He brought me Maalax or something to give me. So I didn't feel so sick. And he tried to be really nice to me again. And he had grabbed the sword from behind the couch. And he sat on the couch there and had the sword. And I thought that was the end. I didn't think I was going to be around any much longer.

Was that like a bamboo sword or a steel sword?
Anya Cain
That was a steel sword, the real thing. And he sat there and he stared and then looked at it. And I said, what are you thinking about? And he said, nothing. And I said, well, what are you going to do now? And he kept telling me, don't you lie to me again. He put the sword down and he came toward me again. And he knelt down in front of me and he grabbed my legs and he whipped them out from underneath me. And I fell on the floor and he started kissing me again. And we got into a fight and I tried to get him off me. He said, don't, because I'll kill you. Right then he grabbed my throat. I couldn't talk, I couldn't even breathe. And he ripped my short shirt off and he ripped my pants off. And I didn't even fight him. I just let him go because I hurt so bad all over. And then finally he got mad because I wouldn't do anything. And he got up and he just hit me a couple more times. And he said, you really don't love me, do you? And I said, no, I never did. And I got the keys finally, and I was on my way out. And he grabbed the sword again. And all I kept feeling was that sword going through my back if I walked out the door. Finally, after I talked to him and left, or talked to him and pleaded with him to let me go. It was about 4:00 in the morning and I finally left and I was on my way home and my mom and sister had come looking for me. And I met them on County Farm Road, like three miles away from our house. And I had gotten home, got in the house, and dad was upset with me because I stayed home. It was like 5:00 by the time I got home. And they had asked me what happened were the marks on my face and where. Where the marks on my face and neck were from and why my shirt. It was a couple buttons missing. They asked me what was wrong and I had told them that I had gotten a fight with a girlfriend because I had to go look for her because she had been missing for a couple of days and her grandma was worried about her because they couldn't find her. And I said that she was drunk when I found her, and so she got in a fight when I put her in the car.

So you were not telling your parents what was going on then, physically between you and the defendant, is that right?
Anya Cain
Right.
Kevin Greenlee
What was your motivation? Why were you not telling your father and or your mother or your sister?
Anya Cain
He told me, before I ever told anything that he would find out about it because he had friends on the police force and friends in the hospital staff, and he would find out anything that I told anybody. And if he found out, he would kill me.

Did those marks remain upon your neck quite a while?
Anya Cain
It was really hard to talk. I couldn't talk for, like, three or four or five days afterwards.

So when you hear disturbing things like that testimony, you understand that Crystal did not want Temujin Kinzu in her life. And we should tell you here and now that other people back up Crystal's story. They saw her bruises, her injuries, her fear. He really did those things to her.
Anya Cain
But despite Crystal's wishes, he refused to go away. As you heard, he threatened her. If she went to the police, he would kill her. He also threatened her family. If she caused him trouble, he would kill them. He knew where Crystal worked. He'd come in and threaten her if she didn't let him use her car. Andy made it clear she couldn't keep secrets from him. He told her he had listening and eavesdropping devices that would let him hear what she said to others.

Crystal believed all of this. She thought that if she displeased Kinzu, then she and people she loved would risk great harm. People around her saw her bruises. They noticed her withdrawing from them. They wanted to help, but they did not know how.

Crystal's sister Tracy, was one of the ones who was concerned. In the next edited excerpts from her testimony, Crystal will tell the story about an encounter between her sister and Kenzou. Once again, I will read Crystal's words, and Kevin will read for prosecutor Cleland.

Did there come a time when you ever saw the defendant in the possession of weapons other than karate weapons, Ninja or kung fu or that kind of thing? Any firearms of any variety?
Anya Cain
Yes, I did.

How did this come to pass? Can you set the scene, please, for the jury?
Anya Cain
It was on a Sunday, and it was the day he told me he could read my mind. I was down there at his house.
Kevin Greenlee
Why had you gone there?
Anya Cain
He had told me to come down to his house on Sunday because he had to talk to me. So I went down there. It was on Father's Day, and I went in there. And he was telling me then how he could read my mind and everything. And we were arguing because I wanted to leave the house. I wanted to go home. My sister had come to the door because she had heard me talk, say he lived behind the Tally Ho. And her boyfriend Jim was with her, and he thought he might know where it was. So they drove down there and they saw my car out in front of the house. And she stopped, and he went and met her at the door.

Where were you when that happened?
Anya Cain
I was in the living room. It was just me and him. Then Tracy had come to the door then.
Kevin Greenlee
So Tracy is your sister?
Anya Cain
Right. She came to the door and she asked to speak to me. And he wouldn't let her in. He wouldn't even let her come in through the door. And I can't exactly remember the whole conversation, what they had. But finally I went out to the door, and she saw me. She. Because I was supposed to do chores that night on the farm for dad because it was Father's Day. I told him I'd give him the night off. And I. I didn't show up because he wouldn't let me leave. And finally Tracy came looking for me because dad was upset because I had promised him the night off. And she had said at the door, I thought you were going to give dad the night off. I said I was going to, but I haven't been able to leave. She said, well, come on, we're leaving. We're going to do chores and everything. But she had already finished chores, but she wanted me to get out of there. So I got my purse and stuff and I grabbed the keys, and I was on my way out the door. She'd already gotten in the car. And when her and Jim were leaving, Jim, spin the tires on the car. And I was out in my car already. And when I was in my car, just about ready to shut the door, I saw the defendant run back in the house. And I. I didn't know what he was going to do, and I didn't want him to hurt my sister. So I raced out of the car and I ran up on the porch and I stopped him at the doorway.

What was he doing? As he was coming out of the doorway?
Anya Cain
He had a hold of a gun. And it. Like when I stopped him, I stopped him with both hands, and I was looking down the barrel of the gun.

He was holding it.
Anya Cain
Yes, Coming out of the door. And I said. As soon as I said that, a lady across the street yelled, who's that? Who's squealing the tires and stuff. This is a private drive. And the defendant started yelling that it wasn't his fault, calling him all kinds of names. She said, this is a private drive and they can't squeal their tires down there and everything. And I told after he said, well, it's okay, it's okay. We'll take care of it. So I pushed him back in the house. He said, how did you know I was going to hurt him? And I said, I just had a feeling that you were going to try something. So I got in the car and I left.

Finally, I'd like you to describe what you saw as you were looking at the barrel of that gun. First of all, was it a pistol, a handgun, type of an affair, or a long gun?
Anya Cain
It was a longer gun. The barrel around it was kind of thick and it had a large hole with a BB on the end of it, like for a sight, I guess what you call it.

Did it have a wood at the other end? Did it have a place to hold on, a shoulder?
Anya Cain
No, all there was was just a wooden handle. No shoulder strap.
Kevin Greenlee
Using your fingers or estimating in terms of size, how large, approximately, would the hole at the end of the barrel have been?
Anya Cain
It was quite wide.
Kevin Greenlee
You're holding your fingers perhaps an inch apart.
Anya Cain
Not the whole barrel, the outside. From the outside of the barrel, probably about an inch or around that.

Have you been around long guns before being born on a farm, rifles or shotguns?
Anya Cain
Yes, but I've never been trained or nothing.
Kevin Greenlee
Just from visualizing it. Are you able to know the difference or describe the difference between a.22 caliber rifle or the shotgun?
Anya Cain
No.
Kevin Greenlee
I'm going to step out of the transcript for a moment to say that at this point, Prosecutor Cleland showed Crystal both a rifle and a shotgun. She said the shotgun more resembled the weapon she had seen Kinzu use. This is quite important because Scott Macklem was murdered with a shotgun. Let's get back to the transcript. In this section, there is a reference to Michelle or Shelley Woodworth. This is a woman that Kinzu was living with at the time. So, back to the transcript. Was there anything else about that incident that you can relate recollect before you left, or did you just leave then and go home?

No, I just left then and went home. He had went back inside with the gun.

Had you seen that gun before that moment or not?
Anya Cain
Yes.

Where had it been?
Anya Cain
He had told me before he showed me. There was two nails pounded in the wall above where Shelly slept. He said he Always slept with the gun. Besides him, in case of anything. Anything ever happened, the gun was right there.
Kevin Greenlee
Was. Did that strike you as being odd in view of the other weapons and all of his karate and ninja experience?
Anya Cain
Yes, it did.
Kevin Greenlee
Did you talk with him about that?
Anya Cain
No, I never said anything. No, no, I. But it was just the fact he was so good with his swords and stuff, why he wouldn't whip out a knife and kill somebody incidentally, like he thought he would. He had told me before he had the gun in case anyone came at night. He had it right there and he could do the job.
Kevin Greenlee
So, again, let's pause here and step away from the transcript and talk a little bit more about the gun that Crystal saw Kinzu brandish at her sister, which, again, is the gun she had previously seen at his residence. The description she gave of that weapon is consistent with the weapon that would later kill Scott Macklem. But when Kinzu's residence was later searched, there was no sign of the gun. What happened to it?
Anya Cain
Well, perhaps the person who ended up doing the most to help Crystal was her former boyfriend, Scott Macklem. They still cared about each other and spoke of getting back together.
Kevin Greenlee
Kinzu tried to use Crystal's deep feelings for Scott as a way to control her. He would tell her that if she didn't do what he wanted, then Kinzu would kill Scott or have a contract put out on him.
Anya Cain
Eventually, though, Kenzu seemed to realize that Scott could pose a more existential threat to his control of Crystal. Her love for Scott might be enough to give her the courage to break free from Kenzu altogether.
Kevin Greenlee
Scott, meanwhile, did not know what Kinzu was doing to Crystal, but he could tell that Kenzoo was very bad for her.
Anya Cain
There was no love lost between the two men. One of Crystal's co workers recalled that there was more than one occasion when she saw Scott and Kenzou in the store at the same time. She said they met eye contact. They seemed to know who each other were. They seemed to stare each other down for great lengths of time when they were in the store together.

On one memorable occasion, Kinzu came into the store where Crystal worked to try to push her into moving in with him. They talked about that in the upstairs area of the store. Now we're going to pick up with what happened by hearing some more excerpts from Crystal's testimony. Once again, Anya will read Crystal's words, and I will read for Prosecutor Cleland. You came downstairs and Scott was there, right?
Anya Cain
Right.

What happened then?
Anya Cain
Scott was upset. I could tell because the defendant was there with me and I was upset.
Kevin Greenlee
And you came downstairs and what happened then?
Anya Cain
I started making conversation with Scott and just kind of left the defendant stand there. And the defendant just kept. I think he just walked around the store, walked around somewhere. But I was talking with Scott and Scott asked me what I was doing there. And I said, just talking, you know, I didn't want to start trouble or anything. And he said, I thought you were going to break it off with him. I told you that he was trouble. Just by the way you can look at him, you know what he was up to? No good. I said, just leave it alone. You know, just forget it. He was really worried about me. Then he said, I want to talk to you. Because previously we had talked about getting back together because we always stayed in touch.

Did you continue your conversation then in the store or not?
Anya Cain
For a while we did. And then I walked out to Scott's car with him out in the parking lot. We sat there and talked. And I told him I would be home because I was going to get off work early that day, about 3:30 or 4:00. I told him to meet me at my house. We talk everything over.
Kevin Greenlee
Where was the defendant during the time that you were out in this parking lot?
Anya Cain
When we were out in the car, we were both outside the car talking. And the defendant came out and he had like earphones on, like a small. Looked like a Walkman type stereo.
Kevin Greenlee
Like a tape cassette player?
Anya Cain
Yes, just a small one. And he had leaned up against the mailbox in front of the grove, and we saw him. And Scott had called him a jerk and said there's no reason I should be hanging around him and how I should just tell him to go away and tell him to leave me alone. I just said, talk about it when we get home. You know, I didn't want to strike up any trouble.

Then did Scott leave?
Anya Cain
Yes, Scott left then.
Kevin Greenlee
And then what happened?
Anya Cain
The defendant went ahead and got in my car at that time. He had my keys.
Kevin Greenlee
How did he get them?
Anya Cain
They were in the store along with my purse and stuff. He could have got them, but in.
Kevin Greenlee
Any event, he had your keys.
Anya Cain
He had my keys.
Kevin Greenlee
The defendant went to get your car and.
Anya Cain
Okay. And brought it back. And he parked it out there. And I was in. I was crying and stuff in the mall. And he came in, he says, come on, we've got to talk. Because I had to take him home that night because he didn't have a car. So I had. I had gotten the keys back. I had the Second set back or something, because I had a second set of keys. Set of keys, too. I had got in the car. He started hitting the steering wheel. Driving like a maniac out of the parking lot.
Kevin Greenlee
He had the key, so he was driving.
Anya Cain
Right. I also had a set, and I was going to drive, and he wouldn't let me drive.
Kevin Greenlee
He got back behind the wheel and started the key and was doing what in the car?
Anya Cain
He was banging on the steering wheel and on the dash and called me a liar and saying I shouldn't lie to him all the time. Why do I even mess around with him? Why do I talk to Scott? It was going to get me in trouble if I kept it up. We pulled into the parking lot at Kmart.
Kevin Greenlee
Was he talking this way and behaving this way and driving that way all the time?
Anya Cain
Yes, all the way out there. He was yelling at me, and I was crying, and he was saying, well, if you're going to keep this kind of behavior up, the organization's just going to take care of you. The organization's going to take care of you. No question, if you keep lying. Because if all the people we went out and recruited and told like you're telling, we'd kill them, no questions asked.
Kevin Greenlee
What was he telling you, if anything, about what had happened in the parking lot between you and Scott?
Anya Cain
He was saying that he had repeated everything that we had said. He said that he knew that Scott called him a jerk and stuff like that. He had heard everything. The conversation that we had.
Kevin Greenlee
Did you. Did that surprise you?
Anya Cain
I had a feeling he was listening. But when we pulled in the Kmart parking lot, he pulled out this earphone and this little cassette thing that he was listening to. It looked like, but it wasn't. It was a listening device.
Kevin Greenlee
What size and shape was it?
Anya Cain
It's about the size of a transistor radio. And it had earphones. And it. He said, listen to this. And I put the earphones on, and you could hear. There was a man parked in a semi in the parking lot, and you could hear him talking.
Kevin Greenlee
So this is apparently actually a device that you could hear things at some distance away. Is that correct?
Anya Cain
Yes.
Kevin Greenlee
And he was demonstrating this for you, Right? What happened then?
Anya Cain
He said. He said, well, I have to go into Kmarts and get a few things. Just. I said, just let me take you home, because I have to get home. He said, no, you're not. You're coming in there with me. I said, no, I just want to go home. So he got out of the car and slammed the door and took the keys. He came over my door and opened the door and pulled me out of the car. He was hanging on my arm, and he was pulling me inside Kmart. And we went back in the restaurant and sat down. And he kept saying that if I kept telling lies like this, there's no way he could cover up my story anymore for the organization. He'd have to take care of me. And if I didn't stop telling Scott everything, then he would kill him, too.

Okay, let's step away from the testimony for just a second to emphasize something. As we just heard, Kenzou threatened to kill Scott also.
Anya Cain
That was not a rare occurrence. He did that often. Again, let's return to the testimony and hear more from Crystal herself.
Kevin Greenlee
Is it possible for you to estimate for this jury the number of times that you had heard him, the defendant, Temujin Kenzu, say things that were threatening.
Anya Cain
Towards Scott Macklem, how many times he threatened Scott?
Kevin Greenlee
Is it possible for you to estimate the number of times that that would have happened?
Anya Cain
Numerous times.
Kevin Greenlee
More than three?
Anya Cain
Yes.
Kevin Greenlee
More than 10?
Anya Cain
Roughly 10? 12. There was a lot I couldn't count.
Kevin Greenlee
Was it. I'll ask you this if this is a fair assessment. Was this a somewhat constant source of conversation between you and him?
Anya Cain
Yes. That was in every conversation. He used that all the time to get whatever he wanted.
Kevin Greenlee
So Crystal finally did get to the point where she felt strong enough to tell Kinzu that she did not want him in her life anymore.
Anya Cain
Let's once again return to the testimony to hear what she told the court about that.
Kevin Greenlee
Ultimately, you told him to just that you didn't want to talk with him or see him or have anything to do with him anymore.
Anya Cain
Right.
Kevin Greenlee
Can you tell us anything else about that phone conversation?
Anya Cain
He had called me the last time, and I was really upset. I said, why can't you just leave me alone? I've never done nothing to him. I promised I'd keep my mouth shut. I won't tell anybody. Just leave me alone. And he said, there's no skin off my back. And he was really rude and cocky about it. And he. He kept saying, trying to convince me that I should still should leave the house because I was going to be a nobody for the rest of my life if I didn't do what he told me. He made it very obvious that if he ever got his hands on me again, I probably wouldn't be alive. He kept telling me, he says, well, you know, he says, if there's. It's nothing for us to go in and wipe out your whole family. He said, we can take everything that your dad ever owned or worked, ever worked for away from you. He said, we'll just leave your family with nothing. That was all big threats, you know. He would take everything that I loved, Everything that I loved, had. He would take it away if I didn't listen to him or come back. Finally, after I hung up, I went downstairs. Mom knew I was upset, and no way was she ever going to let me talk to him again. I was a mess.
Kevin Greenlee
And was that, in fact, the last time that you talked with him during this period?
Anya Cain
Yes, it was sometime the last week in June, because me and Scott were getting back together. You know, we were still talking about it. We never made any real commitments again, but we were still trying to get back together Because I had locked myself up in the house for two weeks. I wouldn't go out, I wouldn't eat, I wouldn't answer the telephone. I was just scared to death. You know, after what happened, I was afraid he would still come back and get me. Every morning I had to do chores and you have to get up at 5:00. And I prayed to God every time I got in that car in the mornings that it wouldn't blow up Because I was just so afraid that someday he would get even with me. When he had called, when I got back together with Scott, because he kind of picked up the pieces for me because he helped me get outside, because I wouldn't go outside and everything. Scott kept trying to talk about it and tried to have me tell him what had happened, and I would never tell him. And it always kind of confused Scott. And he was upset because I wouldn't tell him the truth, what kind of threats or what was made or what he told me. And I kept telling Scott, I don't want anyone to get hurt. And I wouldn't tell him anything.

So after Scott and Crystal got back together, they had a rather serious problem. Kinzu would not leave them alone.
Anya Cain
When you read through the testimony at the trial, it becomes clear that one thing that was critically important to Kenzu throughout his time with Crystal were her car keys. He was constantly demanding them, Constantly threatening to hurt her or those she cared about if she did not turn the car keys over to him. To Kenzu, it seems as if the car keys in some way symbolized his control over her and her submission to him. Because of all of that, we feel it is interesting to point out what happened with the car keys After Crystal stopped seeing Kenzu. So Here are some more edited excerpts from Crystal's testimony.

And you had two sets of car keys?
Anya Cain
Yes.
Kevin Greenlee
When did you get the second set made?
Anya Cain
I had the other set. It came with the car.
Kevin Greenlee
So all along you've had two sets?
Anya Cain
Yes.
Kevin Greenlee
Never anymore.
Anya Cain
I never carried it in my purse with me all the time until I started having trouble.
Kevin Greenlee
When did you lose that set?
Anya Cain
I never lost a set. It was stolen.
Kevin Greenlee
When Was it stolen?
Anya Cain
August 29, between 12:00 and 5:00.

Where were you?
Anya Cain
I was in bed.
Kevin Greenlee
And someone got in your house?
Anya Cain
No, they were left in my car. When my sister came home at 12 o'clock, she had noticed that the. Or no, she came home a little after 12 and she had noticed my car dome light was on in the garage and she went out and shut the door and never thought anything of it. And the next day dad went out to take my car and he could never find the key for the car. They were never found. So I had to use the second set that I had.

So not only were Crystal's car key stolen, but at some point after that, she had at least one item stolen from her car. A fuzz buster. That's kind of a radar detector. So over and above where the key seemed to have symbolized Akinzu, there are a couple of other reasons why we mentioned the stolen car keys.
Anya Cain
Namely, the keys were eventually found and in a most unexpected place. After Scott Macklin was murdered, the keys were found in his glove compartment. How did they get there?
Kevin Greenlee
As we will hear, after the murder, Crystal had a long phone conversation with Kinzu. In that conversation, she brought up the subject of the stolen car keys. Let's listen to an edited excerpt from her testimony with Anya reading Crystal's words.
Anya Cain
That was the first question I brought up to him. I had asked him, I says, well, did you take my keys? And he said, what keys? And I said, well, they were found in Scott's car. They had been missing like for a month. They were found in Scott's car in the glove compartment the day he was killed. Right then the defendant tried to tell me that, well, Scott must have had them, hid them from you, he must have took them from you and didn't want you to have them. I said, well, that's stupid. Why would my fiance want to keep my car keys away from me when I had another set? All of the time he couldn't accept that. He said, well, I didn't do it, didn't do it. And then also I had brought up to him, to him about my Fuzz buster in my car was stolen and I brought up to him that Scott's tires were flattened in the parking lot at work. Just strange things like that all kept happening, you know, since I broke it off with him.

So at the end there, Crystal referred to some vandalism that had been done to Scott's car. That was the other reason we wanted to highlight this. Let's hear a bit more from Crystal about this subject.
Anya Cain
One morning Scott came out to his car and he had found all his golf clubs, clothes, books, everything all over his yard. The neighbors yards across the street on their yard.
Kevin Greenlee
The fact that cars belonging to both Crystal and Scott were suddenly targeted in crimes seems highly significant. It is not a coincidence. Someone was angry with both of them and wanted to punish them both. Who could that be if not Temujin Kinzu?
Anya Cain
Let's make another obvious point. The person who broke into Scott's car clearly had access to the vehicle. That person could have hidden Crystal's keys in the glove compartment at any time.
Kevin Greenlee
There are other indications that someone other than Scott was getting into Scott's car. One of his co workers, Sherry Stroud, remembered an occasion where some money went missing from the vehicle. The police drew an obvious conclusion. There is a possibility, the investigating officer wrote in his report that the suspect, Temujin Kinzu, could have been going through the victim's car.

Scott's friends and colleagues knew exactly what he was going through. He told them about it. Let's hear Kevin read an excerpt from a police report filed by an investigator who talked with one of Scott's co workers at the menswear store, talked with.

Al Gobind and he related that all of the employees were quite close around the store and that Scott had mentioned in conversation different times about an acquaintance of Crystal's following him around and threatening him and being weird with Crystal and that he had experienced vandalism and theft from his car. One day Scott approached Al at the rear of the store and stated that the subject he mentioned was now in the store near the front. Al stated that he'd looked to see two males looking at clothing. He saw the face of one real good. The other had his face turned down in a way so he could not describe him. Gobein said that later, after the crime, Sergeant Bound showed him some photographs and he identified Temujin Kinzu as the one he saw in the store that day. Gobein stated that the subjects did not approach Scott, who elected to remain at the back of the store. He felt Scott was not necessarily afraid. However, just did not want anything starting at the store. Gobein stated that nothing further happened and the subjects finally left the store.

That officer also spoke with someone else. Let's get back to his report.
Kevin Greenlee
Jerry Keller stated that he was a close friend of Scott's and they worked in golf together. In January or February 1986, Scott mentioned to Jerry that he was having problems with a guy bothering Crystal and himself and asked Jerry what he should do. Jerry suggested that Scott contact the police. Scott was described as concerned at the time but not necessarily fearful. In July or August 1986, Scott again mentioned that he was still having problems with the suspect and had a white jacket and shoes taken from his car and also Crystal had some car keys stolen. Scott mentioned the guy's name is Atimajan Kinzu and said he was an ex boyfriend of Crystal's.

Now, Keller got the date of the beginning of the harassment wrong, but we feel it is absolutely crucial to point out that Keller got the name of the person who was harassing Scott and Crystal correct. He knew the person responsible was Temujin Kenzu. Let's hear Kevin read the investigator's report on his conversation with Todd Boswell.

Todd stated that during pheasant hunting season in October 1986, he and Scott went hunting behind the farm of Crystal's parents. They first stopped in at Crystal's house where Scott was discussing something with Crystal. Although Todd was not close enough to hear what was said after departing to the field, Scott seemed upset and said that he had to be careful because some guy was after him and also bothering Crystal. Scott did not mention the suspect's name but described him as a psycho and the guy tried to start something with him. A few days ago Scott was clearly.

Telling Todd about Kenzu. The man was stalking him, making him uncomfortable, scaring him. Let's talk about something that showed up in another police report. The investigator is writing about a conversation he had with Crystal.

Kevin will read it in reference to a Halloween get together where Kinzu was supposedly in attendance. When Crystal mentioned her engagement to Scott, she could not note any reaction to that on Kinzu's part at the time. During this conversation, Crystal mentioned that she remembered on one occasion she believed was November 1, 1986 at about 1:30am when she and Scott were driving a smaller vehicle occupied by two white male subjects passed them, then seemed to deliberately slow down in front of them to about 15 miles per hour. Scott then turned north and headed out Vincent Road and the vehicle then was following them. She and Scott felt that it may have been Kinzu, but it was too dark to be certain.

I think it is time to review and highlight a few facts. Just a few short months earlier, Kenzou had wanted Crystal to move in with him. She refused and in fact cut him out of her life altogether. It seems like on Halloween Kenzou learned that she was going to marry Scott. He apparently terrorized the couple as they.

Several pieces of evidence strengthen the case against Kinzu:
Stolen Car Keys: Crystal's car keys were stolen and later found in Scott Macklem's glove compartment, the very vehicle involved in Scott's murder.
Kinzu's Possession of a Gun: Crystal testified about seeing Kinzu with a steel sword and later with a gun, which matched the murder weapon used against Scott.
Witness Identification: Police officer Al Gobind identified Kinzu from photographs as someone who had observed suspicious behavior on the day of the murder.
Áine Cain highlights the significance of these findings:

Kinzu's obsession with controlling Crystal and his subsequent targeting of her ex-boyfriend Scott Macklem reveal a clear motive rooted in jealousy and the desire for control. His aggressive actions toward Scott indicate a willingness to eliminate perceived threats.
Kevin Greenlee points out Kinzu's manipulative tactics:
