America's Voice Live starts now. Welcome to America's Voice Live. I'm Steve Guraid. It is Monday, the 24th of November. Let's get to today's top stories. As always, thank you for spending part of your day with me right here in Real America's Voice. We truly appreciate your patronage. President Trump is tightening the timeline on his 28 point plan to finally bring an end to the war between Russia and Ukraine, giving Kiev less than a week to respond, though he made clear that the framework remains negotiable. Also, I'll bring on a new member of the RAV family to discuss Real America's Voice latest addition to programming, one that seeks to provide our Spanish speaking audience with conservative stories and developments congruent with our network exclusively in Spanish. We'll have more on that coming up. And then later, officials are investigating a recent riot at UC Berkeley during an ATP USA event that is where protesters apparently attacked others over the formation of a new chapter. I'll bring on a Turning Point USA contributor to break it down for us. And that and more coming. But I'd like to start with this today. Some breaking news today. Earlier today, a federal judge, Cameron Curry, dismissing the indictments against former FBI Director James Comey and New York Attorney General Letitia James. The Judge ruled that U.S. attorney Lindsey Halligan's appointment in Alexandria was invalid. According to the court, a 120 day limit on interim prosecutors had already run out under the previous administration, meaning only the district's federal judges and not the Attorney General, Pam Bondi had the authority to name a successor. As a result, the charges were dismissed without prejudice, leaving the door open for the Justice Department to try again with a properly appointed prosecutor. But for now, it does raise serious questions about what's going to happen next. Here we discuss this is senior legal fellow at the Heritage Foundation, John Malcolm, as well as constitutional lawyer and former Green Beret, Ivan Raichlen. John, let me start with you, lay this out for us. I was talking to you before we came on the program here today. The rules say 120 days. Pam Bondi thought she had the authority. The judge said absolutely not. Here we are. What's your take?
John Malcolm
Yeah. So the day after Donald Trump took office, the Biden U.S. attorney resigned and a guy named Eric Siebert was named as the acting U.S. attorney in Virginia. The 120 day clock started that would run out on May 21st. Just before that clock ran out, the District court came in and allowed him to stay in that position. The Statute says after 120 days the matter goes over the district court. Sometime thereafter, in early September, Siebert resigned. In late September, Bondi named Lindsey Halligan as the Acting U.S. attorney and then she and she alone stepped before the grand jury shortly thereafter and got indictments returning against Jim Comey and then against Letitia James. The question became whether Pam Bondi argues, well, I get to name a whole series of interim US attorneys and they each get 120 days. Letitia James and James Comey said no, that the better reading of the statute is you have a total of 120 days from the time a first interim U.S. attorney is named. After the 120 days, you don't get a new one. Then it goes to the district court in order to name an acting U.S. attorney until a Senate confirmed person is put in place. In this case, the court said that that 120 days had expired. Lindsey Halligan had not been properly appointed. Therefore the indictment was voib ab initio and essentially dismissed, putting the parties back to where they were that day before the indictments were returned.

So this is the D.C. circuit then, that chooses the prosecutor in the eyes of this court. Is this appealable? John, can they appeal this?
John Malcolm
Yeah, well, it's a district court that named, that named the Acting U.S. attorney and an appeal would go to the D.C. circuit. We'll see what happens. In the meantime, the indictments were dismissed without prejudice, which means in theory that the indictments could be returned again. But they may very well run into a statute of limitations problem, especially as to Jim Comey.

Yeah, they were tight on time to begin with. And so then you have that issue. Ivan, what do you make of this? The rules are the rules, it appears, and the rules were not adhered to by Pam Bondi, at least in the reading of the statute by the judge. Your take?
Ivan Raichlen
Yeah, just a couple of points of clarification. So this is actually in the Eastern District of Virginia, Alexandria Division. So Eastern District is based out of Richmond. And the appeal would actually go to the 4th Circuit in Richmond would be my take on it. The other thing is that effectively what this does, if this stands, that literally means that anybody that's an acting or an interim appointee for whatever period of time, whether it's 120 days or not, essentially anybody can do any sort of lawless activity during that period of time and they will never be held to account. So it makes absolutely no sense. And I don't see this staying as is, you got to keep in mind that the magistrate, I think the magistrate ruled on this, if I'm not mistaken. But even then, the judge that made this decision, if it was the judge, you got to look at who appointed that individual and then you go from there in determining why they did this. One other thing I'd like to point out is the political atmospherics behind these decisions. The that many people fail to look at just recently, on January 17th of next year, meaning about eight weeks from now, you will see a governor, Abby Spamberger, who is a loyalist to John Brennan and the Attorney General, incoming Jay Jones, will be sworn in in eight weeks. And so what are they going to do? They're going to essentially probably use the levers of their discretionary authority and beyond and a trifecta Democrat state now to do the bidding of what Letitia James was not able to do in New York and then escalate from there. And then also the six counties in Northern Virginia that are all headed up by districts or, excuse me, Commonwealth's Attorney that are Democrat, they're probably going to start doing what Fannie Willis and Alvin Bragg failed to do on steroids times a trillion squared. So keep that in mind.

So tell me what you tell me what, you tell me what you're warning us of. What are you warning us of, Ivan? What do you think's coming?
Ivan Raichlen
I think you're going to see Lawfare and beyond escalating beyond anything that Jack Smith, Fanny Willis, Alvin Bragg, Letitia James did during the last four years from Virginia.

John, your take on that?
John Malcolm
The appeal will go to the 4th Circuit, not the D.C. circuit. I misspoke about that. Look, there's nothing to stop lawfare from, you know, happening now in states that have a so called trifecta, as Ivan pointed out. I don't think that has anything to do with the indictments being dismissed in this case here. If Lindsey Halligan had walked in with a career assistant U.S. attorney from the Eastern District of Virginia, they wouldn't have had this problem. The problem was she was essentially, according to the court, a private citizen who was never validly appointed to anything. And she was the only person who appeared before the grand jury when these indictments were dismissed. She now has been named a special counsel, could go in as early as tomorrow to try to get these cases reindicted. However, as I say, at least with respect to Jim Comey, she's going to have a serious statute of limitations problem. The lawfare point that Ivan talked about, look, you know that can Happen at anywhere, at any time. We live in a highly politicized environment.

Yeah, that's sad. All right, Ivan, Special counsel designation. Here's the real question that people have. James Comey has no friends on either side of the aisle. For a variety of, I'm going to say, valid reasons. I don't know if he's guilty of the crime. He has not been adjudicated yet. Is he ever going to stand trial? Is he ever going to be held accountable for his actions when he was the director of the FBI?
Ivan Raichlen
I mean, the way I look at it, I've looked at this very closely. Obviously hasn't gone through a court of law, but through the court of public opinion. And all the evidence that I've seen, what they're charging them him with right now is essentially, effectively jaywalking. He was very central figure in the entire Crossfire Hurricane op. He coordinated and communicated with John Brennan. And then that leads into whether or not you call that seditious conspiracy and then treason. I am of a strong belief that it does meet the elements of all of those crimes, and those are the crimes that he should be actually charged with. So even though this may. The statute of limitations for this may have told, depending on how the judges, the court rules, I still say that the evidence is clearly there to indict him and then convict him of potentially treason, which does not carry a statute of limitations that doesn't have one.

So let's talk about Letitia James for a moment here, John, Mortgage fraud. If I did what she did, and a number of other people serving in Congress, by the way, some on both sides of the aisle, I wouldn't be able to just walk away and say, well, it was no big deal. I made a mistake on the paperwork or whatever the defense is. I didn't quite put that in the right spot or whatever. Look, I couldn't walk on that, John. So what's going to happen in her case, do you believe?
John Malcolm
Well, I don't know that there's a statute of limitations problem with her. I don't know when she filled out these mortgage fraud applications. And look, the government has to prove, as it does in all of these cases, an intent to defraud. Innocent mistakes do happen. There may be some explanation. I haven't heard her defense, but, you know, mortgage fraud is a serious thing. People have been charged with that and been convicted of it. And it's entirely possible, but that she, she will get indicted again and then she'll have her day in court and we'll see what happens, Ivan, I'll give.

You the last word on this part of it, which is lawfare. America's sick of it. They are everything that seems to get put in place that you know would close the border or prevent illegals from being here or holding people accountable, Lawfare comes into play. And you said it. If you have a Democratic Congress come 2027 January, we're going to see things that we've never seen before. I'll give you the last word.

Yeah, I mean, on that analysis with Letitia James, I would agree with John. But to answer your, Steve, is that I don't see it stopping until folks are held to account. So I only expect more escalatory lawfare moving forward beyond what we've seen thus far. So I don't see it getting any better.

And John, your final thoughts?
John Malcolm
Well, look, welfare is a real problem. It could be just like you used to have an independent council when both sides believe that their ox is being gored, they eventually put down their weapons, at least for a little while. But lawfare is a definite problem on both sides of the aisle.

Now, Marco Rubio tight lipped about some of the details here because he says it's sensitive at this point. That makes sense. But from what you've read, what you understand, it seems to me as well we're close. What do you think some of the sticking points might be?
Jonathan Gilliam
Well, I think the biggest sticking point would be trying to rush this thing too fast. And listen, we've all been guilty of saying we need this now, now, now, that seems to be a common theme amongst everybody else but President Trump and his team. And that is a good thing. I mean, I'm terrible about saying we need to do this now. And President Trump and his team, Marco Rubio and the rest of his foreign diplomacy team, they move at a speed that the situation dictates. And I think that that is, that is the real crown jewel of all of this. He is not giving up. He continues to push forward. And I think when it comes to Zelinsky and Putin, they're both playing two different games. Putin is playing a strategic game, and I think Zelinsky is playing a game of wait and see and, and prolonging. And eventually the prolonging game is going to crumble because Putin is a strategist, he's a tactician, he's a trained KGB agent, and he will take the time that he needs to.

And so I think that between those two individuals, that's the sticking point. But the more President Trump and his team takes this slow and methodically, the further I think they're going to get along for the, in the grand scale of things.

You know, there's an old saying in sales that time kills all deals. Maybe that's why President Trump is pushing so hard to put it together, because time kills all deals. If it sits there too long, the deal is no longer a deal. People walk away. And look, Putin's not to be trusted. Right. I think we both can agree on that pretty clearly. So maybe that's the push, maybe that's the, the time sensitive nature of this. Your thoughts?
Jonathan Gilliam
Yeah. And so that is the thing that President Trump and his team are working against is the fact that wherever they shift, I don't know if you've noticed this, but if they shift to like pushing for a peace agreement quickly, Putin backs off and delays his rhetoric, or then he'll carry out an attack. Right at the moment they think they have a peace deal. But so the fear is if they take too long now, that he'll capitalize on that by being more aggressive and moving forward quicker because he knows that the entire diplomatic chain of events is taking a long time. So he'll take advantage of that. And so you're constantly wrestling with that, with Vladimir Putin, trustworthy or not. We know he's not trustworthy from our point of view, but again, he's a statistician and he, and he will wrestle with these issues in a way that Zelinsky won't. But President Trump is.

Jonathan, let me ask you this. You know, as your time as a Navy SEAL, because when this war first began early in 2022, I had the, you know, the idea that it would last a week or two, maybe three, but that the Russia would just roll through Ukraine. It didn't happen. The Russian bear is not nearly as strong as it used to be, and it seems to me that it's been grinding on for three and a half years. Yeah, they can grind on, but does Vladimir Putin really have an advantage by doing that?
Jonathan Gilliam
I think he has more of an advantage now than he did because before the money was flowing freely, the technology was flowing freely into the Ukraine, and many people on Ukraine side were benefiting from this greatly. Now, I'm not saying that all that stopped, but when President Trump came in office, that pipeline started having some valves that he could shut down. And I think now that that is occurring, Vladimir Putin can take the time and pick and choose where he wants to hit, whereas before he was being goaded into fighting because of the sheer technology and money that was poured into back Zelensky. So.

So, no, that's fine. I think you're exactly right on those. I do want to hit this other topic, though, before we run out of time. As a Navy seal, as a member of the United States Navy, I want to ask you your thoughts on Senator Mark Kelly and others calling for active military to ignore orders from the Commander in Chief, say don't follow illegal orders, don't fall on lawful orders, don't give up the ship.

Right, right.

Well, now the Pentagon is threatening to court martial Mark Kelly, former member of the Navy himself. What are your thoughts on all of that?
Jonathan Gilliam
Well, all of them, but I think two were former military. They could all be court martialed and they all should be looked at in a conspiracy. A group that is trying to further their ideology using criminal activity. I think that they could all be brought in and tried with conspiracy, sedition, treason. They could be charged with those things and just the charge alone, even if they didn't stick. The fact that you could do that would change a lot because I've been saying this over and over again. All of the agencies and the branches of the military, they have not been cleaned up. Good things have been done. But while these agency leaders run the agencies, they're not able to fully investigate and stop what's happening in these, in these agencies. That's why I believe President Trump needs a justice czar, just like he has an immigration czar, somebody who can concentrate on cleaning these things up while these other people run the agencies. Because Mark Kelly and the rest of them were speaking to someone. They weren't just out there making sound bites. The speech that they gave, that video they gave was very specific. So they were speaking to somebody. And those people are still in.

I'm going to read you something here. As somebody who did not serve in the military, I respect you for the service you gave, and thank you for that. But it's 18 U.S. code 2387. Activities affecting armed forces generally. Whoever with intent to interfere with, impair or influence the loyalty, morale or discipline of the military or naval forces of the United States, number one, and this is pretty clear, advises, councils, urges, or in any manner, attempts to cause or attempts to procure insubordination, disloyalty, mutiny or refusal of duty by any member of the military or naval forces or the United States. And it goes on to say, by doing that, which to me, as a layperson, as an ordinary American citizen, to me it's pretty clear that's exactly what they did. They attempted to create insubordination, to create problems with the military that's punishable by 10 years in prison and considerable fines. Am I reading that right?
Jonathan Gilliam
You are. And then when you add into that article too, of the ucmj, most people don't realize this, but when you sign on the dotted line to go in the military, it really doesn't end when you separate or you retire, you can be called back in, especially in this case where they're using their position, official position, to cause, disrupt, cause distraction, disrupt or cause sedition or treason within the military. So they are directly affecting the military. President Trump and Pete Hexith have the authority as the Article 2 of the UCMJ. And because of that USC code that you read, they have the authority to recall these individuals long after they're out and court martial them. And that's exactly what needs to be done and send a message. We need to start sending a message to show the left that we have the ability to strike just like they do. And in this case, justice not lawfare would be served.

Of course they are conservative, but we are having problems that with the ICE operation that are necessary with law and order of President Donald Trump. The Democrats are taking control over the Democrat Hispanic media and they are telling lies all the time telling that Trump is like the devil who is deporting like good people. And what we are doing in the RINI show is to tell all the Hispanic audience that the ICE operation are deporting bad people that are criminals, that are illegal aliens. And we are telling the truth to Hispanic community which is really important to win the elections, to win the midterms because you have to know what's going on in New York. Mandani socialist and communism mayor he won the elections. One of the reasons because of the Hispanic voters that they thought that Trump wants to deport them. And that's not real. I have the visa, I have a lot of Hispanic friends. They are really nice people. They work a lot. America was a country because of the Hispanic community. They worked really hard. And now in the Right News show weekly we are going to have the best influencers, the best journalists in our social networks, in RAF, in Spanish, in YouTube channel, every Sunday at eight in the afternoon talking about points like Venezuela, talking about the president of Mexico, Claudia Schema, who is attacking journalists like me who is attacking the freedom of speech, who is dealing with the narco state. And we are talking about leaders like Milei, like Bukele. So it's the space where the Hispanic community can talk about the things that imports to American people.

No, sure. Real quickly, before I let you go. Legal immigration is supported by the majority of Americans. Illegal immigration is not. So when ICE agents act to deport people here illegally, my guess is people in the Hispanic community as a general rule support that. I'll give you the last word.

Yeah, that's true. In America, most of the population, they hate illegal immigration. But what Democrats and globalists like George Soros are doing is spreading misinformation. Bad news.

Military. If there's disorder and chaos within the ranks, and that's what these Democrat members were encouraging. It's very clear. And not a single one of them, since they've been pressed by the media, and I'll give you guys credit for that, can point to a single illegal order that this administration has given down because it does not exist. They knew what they were doing in this video and Senator Markelli and all of them should be held accountable for that. Caroline, Caroline, Caroline. No, because Lindsey Callaghan was legally appointed and that's the administration's position. I know there was a judge who is clearly trying to shield Letitia James and James Comey from receiving accountability and that's why they took this unprecedented action to throw away the indictments against these two individuals. But the Department of Justice will be appealing very soon. And it is our position that Lindsey Halligan is extremely qualified for this position, but more importantly, was legally appointed to it.

Does President Zelensky come to the United States this week? Are there a couple you mentioned on the Foxy. A couple points?

Yeah. So there are no plans at this moment in time. As you know, things can change very quickly around here. So we'll keep you all apprised, but there's no meeting scheduled right now. As for where we are, I spoke with Secretary Rubio at length. I spoke with the President as well. Everybody inside feels operational optimistic about what happened and transpired yesterday in Geneva. Secretary Rubio, Special Envoy Witkoff, the whole team really worked through the points of that 28 point peace plan that the United States authored with input from both sides, the Russians and the Ukrainians, and ultimately the vast majority of these points have been agreed upon. The Ukrainians have worked on language with us together, and you heard that from their delegation directly yesterday. So we feel as though we're in a very good place. Of course, we have to make sure that all of these points are agreed to. And then, of course, we're going to have to make sure the other party in this war, the Russians, agree to them as well. But I think the president deserves a great deal of credit for the amount of energy and effort he's put into trying to bring these two sides to an end of this war. He wants to see this killing stop. As for any deadlines, he wants to see this end as soon as possible. More determined to go after Tish James than James Comey? Go ahead. Is the president more determined to go.

I don't want to detail sort of the technical talks that are happening right now, but there are just a couple and and we're confident that we'll be able to work through those. Will the president put pressure on Putin or Zelensky if this doesn't work? The president has been putting a lot of pressure on both leaders for this entire time. We've been talking with both sides. He has been talking to both leaders directly for 10 months now. So, yes, you can expect that pressure to continue. The president wants this war to end, Carolyn. So, Caroline, is the president more determined now since the judge is ruling today.

I wouldn't say he's going after them. I think the president is more determined than ever to see accountability in this country, yes, and to correct the wrongs of the weaponization of our justice system that we saw under the previous administration and Joe Biden. Are we entering a new phase in Venezuela and what does that entail? Ms. Well, as the president is so good at, I'll try to be just as good. I'm not going to broadcast any actions that may or may not be happening with respect to Venezuela. I know I've been very clear about the administration's position, as has the president and his national security team. We view the Maduro regime as being illegitimate, and the president has been very satisfied with the successful strikes against narco terrorists and foreign terrorists that are illegally trafficking drugs towards the United States of America, he's not going to tolerate that. And you can expect to see those strikes. What was President Trump's reaction to those indictments against Comey and Drinks being thrown out? His reaction was, we've seen this before. We've seen partisan judges take unprecedented steps to try to intervene in accountability before, but we're not going to give up. And I know that the Department of Justice intends to appeal these rulings very soon if they haven't already, and they have nothing. One question on Venezuela. Is there any plan, a meeting for this week on Venezuela? And another one, a clarification on this weekend because the president was asked about the former Brazilian president being arrested, and he mentioned that he spoke with this gentleman. Did he speak with Bolsonaro the day before he was arrested? Not to my knowledge. I don't know if that call took place or not. It may have. I can get you a firm answer on that, Raquel. I know it's of great importance to you for your reporting. As for meetings on Venezuela, there's meetings on a range of topics inside this building all of the time, and the president is constantly apprised of what's going on in the world, what's going on in the news, and he's very well written into all of the things that his team are working on. Please, you would not go into the sticking points of the disagreement between the two parties in the Ukraine peace process, but how flexible is the president in coming to a deal and will the Europeans be part of a final negotiation with Zelensky? I think he's been quite flexible already. We've been watching this war go on for 10 months. He's talked to both leaders countless times. Our team has engaged with both the Russians and the Ukrainians extensively. As I said, there is a sense of urgency. The president wants to see the deal come together and he wants to see this war end.

I know the president mentioned that he wanted to bring in some workers that he could eventually send back. In regards to Ms.

The President does not support American workers being replaced. You are mischaracterizing what the president said. The president wants to see our American manufacturing industry be revitalized better than ever before. That's part of what he's doing with his effective use of tariffs and cutting good trade deals around the world. That's why he's recruited trillions and trillions of dollars in investments into our country. Those are creating good paying American jobs right here at home. As for the H1B visa issue, the president has a very nuanced and common sense opinion opinion on this issue. He wants to see if foreign companies are investing trillions of dollars in the United States of America and they're bringing foreign workers with them to create very niche things like batteries. He wants to see that at the beginning to get those manufacturing facilities and those factories up and running. But ultimately, the president always wants to see American workers in those jobs, and he's told these foreign companies that are investing here, you better be hiring my people if you're going to be doing business in the United States. So there's been a lot of misunderstanding of the president's position.

Ms. I won't get into the details of the conversation this morning other than what the president put out on Truth Social. He put out his own readout of that and I will leave it to that. But I did speak with him about the call. It lasted about an hour and it was a very positive call. The focus of the call was really Russia. Ukraine did come up, but the focus was mainly on the trade deal that we are working on with China and those relations and how they are moving in a positive direction. The president also addressed our farmers, and we are pleased with what we've seen from the Chinese, and they feel the same way. And the president and President Xi discussed continuing to stay in correspondence following their very productive meeting in South Korea.

As for your first question with respect to the deadline, the president wants to see this deal come together as quickly as possible, and he trusts that his team is doing everything they can to get it over the finish line.

I will tell you that health care is a topic of discussion that's happening very frequently and robustly inside the West Wing right now. The president's very much involved in these talks and he's very focused on unveiling a health care plan proposal that will fix the system and will bring down costs for consumers. As for the details of those discussions, I'll let the president speak for himself. As you all know, sometimes you report things and then President Trump comes out with an announcement, and those things are not always true from what you hear from sources inside the building. So I'll let the president speak for himself. Sure. Go ahead, Kara. After they had such a great meeting, any comment from the White House on that? I think talk is cheap and I think that the president is going to judge Mamdani by his actions that he takes in New York. The meeting was positive, as you heard from the president last week. And I think the fact that the president is willing to meet with somebody who said those types of things about him shows that he really is interested in being a president for all Americans, regardless of where they live or who their leader is. He wants what's best for New York. He loves New York City. He helped build the skyline. He spent his whole life there. And so he really wants to see New York do well. And so that's how that meeting played last week.

I would point any critics to the words of the Ukrainians yesterday in which they said that they feel very positive about this plan, they've been very involved, they have had direct input on the language of this plan and that we are in direct communication and correspondence with them. Any idea? Let me just finish with this. The idea that the United States of America is not engaging with both sides equally in this war to bring it to an end is a complete and total fallacy. And I saw a lot of misinformation and rumors and allegations against people in this building, such as Secretary Rubio and Special Envoy Winkoff and the president himself, that they are favoring one side over the other. That could not be further from the truth. I have watched as the president and his team have worked around the clock overnight with both sides on endless phone calls, endless meetings to try to bring this war to a close. And any suggestion otherwise is a complete misunderstanding of the facts. It's coming from people who have no idea what they're talking about or people who are pushing their own agenda. Or maybe people who don't want to see this war come to an end. I don't know. Maybe they're profiting off of it. Maybe they benefit from it in some way. But nobody in this building benefits from war. We want to see this war come to an end. And that's what the president and his, his team are proudly working to do. And I think the critics should just take a step back and think about what happened with Israel and Gaza. There were a lot of doubters and we got the hostages out. And this president secured a peace deal that still exists and is ongoing today. So everyone should just respect the work this administration is doing and watch the process unfold. Thank you. The owners of Bentley's Burgers and Fries in Nova Scotia, Canada, recount opening their mailbox and finding a letter with a sender address listing a Alabama residence.
