Trading day in 2026. New Year's Day, New Year day after New Year's don't count because no one was around to at their desks. 47 points higher in the S P, 165 higher in the NASDAQ. It gets even better. Gold up $125. Approaching that all time high of 45:50 or so. Ballpark again. Remember, had the big sell off at the end of the year. Now it's making its way back up. Oil up a dollar. Not great news. But jump over to crypto board guys because here's some good news for you in case you weren't paying attention. Bitcoin 94, 000. And by the way, some good news in the bitcoin market. I'm a technical trader. I've done this my whole entire life. 30 years of trading Wall street bitcoin by making a high of 94, 74720 took out a prior high, a short term high of 94, 600. New high. Which means technically technicians are looking at this right now. There's half the world trading on technicals. They believe that will be a further up move in at least bitcoin, if not the whole crypto market because bitcoin does lead the crypto market. All right folks, our first guest, Harvard law professor emeritus and author of the Preventive State the Challenge of Preventing Serious Harms While Preserving Essential Liberties. Always happy to have Alan Dershowitz with us. Mr. Dershowitz, first of all, this weekend President Trump gave the go ahead on Operation Absolute Resolve. Captured Venezuelan President Nicolas Maduro and his wife Celia Flores, brought them back to the United States. They've been charged in the United States Southern District of New York. It's no cakewalk for them, I'll tell you that right now. They've been charged with narco terrorism, conspiracy, cocaine importation conspiracy and weapons offenses. Was. First of all, let's start. I know why Trump did it. He knows New York. He knows Southern District of New York is pretty much the baddest badasses that there are as far as prosecutors in the country. Your thoughts? And I just want to ask you this. The left is all about saying this was an illegal arrest. You tell us. Break this down for us, Alan.
Alan Dershowitz
Well, the same left that calls this an illegal arrest was thrilled when the United States under Barack Obama went after Osama bin Laden and killed him. Remember, they could easily have captured him and brought him to the United States to put him on trial, but they killed him. This was a kill operation, and it was not because he was dangerous. Osama bin Laden was killed for revenge because what he did was a horrible, horrible thing, killing all of those people. If that was lawful, this is even more.
Eric Bolling
Forgive me, forgive me. I'm not a law professor. I'm not even a lawyer. I play one on TV sometimes. But it doesn't matter what they call legal or illegal. Is this a legal arrest? I think really that's what matters the most, not what politicians playing politics in the past.
Alan Dershowitz
So go ahead and go after anybody anywhere in the world who has been indicted when the country won't bring them up for extradition. What Israel has done is the same thing. If you have people endangering your country from abroad, they don't have sanctuary, whether they're the president of the country or the head of a terrorist group, or in this case, both. And so the apprehension and bringing him to New York was entirely legal, number one. Number two, even if it was illegal, the Supreme Court has held repeatedly that doesn't impact the jurisdiction of the court to try him and hold him accountable for crimes he committed against the United States. Now we have to get to the issue of proving beyond a reasonable doubt that he committed those crimes. And that's in front of Judge Hellerstein, a judge I've known for 50 years and was one of the fairest judges in the Southern District. So I think we're in for an interesting, interesting trial.

Alan, why do you think Trump decided to do this? Surgically remove Maduro and his wife versus what Obama decided to do with Osama bin Laden?
Alan Dershowitz
Well, I think Trump gave him a choice. He said, you can surrender. In fact, we'll give you a gilded place to live in Turkey. We won't even go after you. And he said no. And when you say no to Trump, you know that Trump's going to come after you. He's not going to take no for an answer. And I think this has sent a very powerful message to Colombia to Cuba, maybe to Iran. I hope to Iran. And so this was an important foreign policy decision as well as an important legal decision.

Yeah, I would, I would. You know, I'm not sure this is your expertise, though. I would submit that Trump did this in Venezuela first because that would eliminate one of the places if he decides to move on, the mullahs in Iran or the ayatollah. That's one place that he, the ayatollah, could not hide himself. I mean, there certainly is potentially Cuba, maybe even Russia, but who knows? But eliminate the most obvious, I would say. But what about the other countries or dictators in the region? Should they be worried about their imminent arrest?
Alan Dershowitz
Only if they are hurting American citizens. Mexico, Mexico, you know, in promoting democracy in other countries, that's the business of the people in those countries. But if they're hurting Americans the way Iran has hurt so many Americans or the way Colombia has hurt Americans, I think they have to be concerned, as Trump put it very delicately, they have to watch their rear ends.

And Cuba as well. When I notice when the, the questions in that, in that January 3rd presser, the last question someone asked about Cuba, Trump lit up. He lit up, he talked about Cuba. He, he, he said, hey, Marco, why don't you address this? And Marco Rubio made no bones about warning the Cuban people. You don't mess with this president. You think there's something on the table in store for Cuba.
Alan Dershowitz
Well, it's not the Cuban people who are messing with America. It's some of the Cuban leaders. Remember, socialism and communism are bad things, whether they're in New York City with Mondami or whether they're in Venezuela or Cuba. Socialists are not. There's no such thing as democratic socialism. Socialism inevitably leads to the end of democracy. As, as the mayor of New York said in his speech, he wants to do away with individualism and move toward kind of collectivism.
Eric Bolling
You can't ownership, forget ism. He wants to move away from individual ownership and move towards collective ownership. We're going to get to Mamdani in just one second. The burden of proof for Maduro. How does this play out over what could be literally years, perhaps?
Alan Dershowitz
Well, it will take at least a year or two. And there is a heavy burden of proof to prove because the charges are very open ended. Narco terrorism, conspiracy. There will be witnesses called, people will get deals and I'm sure they're going to even try to get a deal from his wife. We don't know what the relationship is between him and his wife, whether his Wife potentially could roll over and testify against him. But there seems to be, at least According to the 25 page indictment and appendices to the indictment, considerable evidence. But presumption of innocence applies not only to American citizens, but to any person brought in front of an American court. So they have a heavy burden to prove all the elements of the crimes beyond a reasonable doubt. The first question that's going to come up is going to be an interesting one, and that will be bail. Whether he is entitled to have house arrest in some fancy gilded cage where he has paid security, people who his friends will pay for. We don't know whether he can afford to pay for anything because the government's going to try to seize all of his money. But he has friends that can pay for security guards. And I argued a case actually in the Southern District about that and prevailed in my case. But the courts are very tough on that. They say just because you're rich enough to afford security guards doesn't give you a benefit that poor people don't get. So that will be.

I have two important questions. And then when I get to. Mom. Danny. So please. Tight. Why the wife? Why arrest the wife, too?
Alan Dershowitz
Well, only if she. For two reasons. One, if she committed crimes herself, she's a lawyer. Second, if she may have evidence that her arrest will cause her to provide to the government, now she has privileges, also spousal privileges, etc. He has privileges. He's going to argue that he's a president and presidents can't be prosecuted. America, they're going to argue he wasn't a legitimate president. The judge said already he's going to put that decision off, but he'll have to decide that.

One very quick question, your constitutional law professor, is. Is occupying or running Venezuela constitutionally sound?
Alan Dershowitz
That's a very, very difficult and much different question. And the law on that is unsettled. And it's not really a question of law. You know, occupations have occurred all over the United States, occupied Germany and Japan. Israel's occupying the West Bank. We see Russia is occupying many parts of. We see occupation all over the world today. And it's not so much a matter of constitutional law. The Constitution doesn't really speak about that issue.

Okay. So I guess any sort of challenges would end up at the Supreme Court level. I guess I'm just looking at what the left is probably going to.
Alan Dershowitz
They would not accept a case on whether it's an occupation. They would turn that down.
Eric Bolling
Got it. Got it. Okay. Mamdani. Mamdani. Wow. I don't even know where to start with this guy. First of all, he's sworn in, as you can see, under City hall number two. He brought in probably some of the least qualified people to run the Department of Education. And as we pointed out, the some sort of ownership of. He wants to change the way New Yorkers own things from individual ownership into maybe collective ownership. And then, Alan, you point out he was sworn in on the Quran. Tell us about that.
Alan Dershowitz
Well, I don't mind being sworn in on Quran. That's fine. Jewish mayors like Beam was sworn in on the Jewish Bible, not the New Testament. That's fine. What I care about mostly is that he is a vicious anti Semite. He says every Muslim country has the right to be a Muslim country. He doesn't complain about Jordan being a Muslim country or Egypt, but you can't have a Jewish country. If you have a Jewish country, he won't recognize it. And he supports BDS boycotting only Israel, not boycotting Iran, not boycotting Cuba. He's an anti Semite. He hates Jews, he hates the Jewish state. And to have a mayor of the largest Jewish city in the United States be somebody who has attitudes like that toward Jews is extremely dangerous to the safety of Jews. So we will be keeping an eye on him. I will be looking at everything he does in terms of the potential for lawsuits. For example, if BDS boycott is directed against Israel, that's illegal. That's against New York law, it's against federal law. And we will have him in court faster than he can, you know, swear his oath of office. So be. Be on your guard, Mayor.

We're watching you, Alan. He is famously said if Bibi Netanyahu step foot on plants a foot in New York City, he would have them arrested. Is there any legal grounds to do so?
Alan Dershowitz
Well, I've spoken to Bibi. Bibi is my client. I've represented him. I put together a legal team to defend him. And when Bibi next comes to New York, I will be walking arm in arm with him. And if Mandami tries to arrest him, he will end up in court because that arrest would be unlawful. The United States government provides diplomatic immunity to anybody coming to New York who is the president, prime minister, coming to speak in front of the un so he would be acting unlawfully and we would take him to court immediately.

Commissioner of New York would not participate in an arrest of Prime Minister Netanyahu. And so that would cause him to fire or she to leave. The only qualified person he has appointed so far to run New York, my former student Jesse Tisch, who's a great, great police commissioner.

He was targeted by cartels trying to scare him away. Always have to have Oscar L. Blue Ramirez with us. Oscar, you sent us some really scary photos. Tell us we're gonna roll them while you tell us what you saw and what this is from.

Yes, we were five days ago and the border, almost seven days ago at the border with Colombia, Venezuela. We reported there's a lot of tension. There was a deployment of the National Guard to the borders and this is the result of the extraction of Nicolas Maduro, the narco dictator, narco terrorist extraction. And after this extraction, you can see on the video, the Colombian authorities militarized the border that I was located at. This is exactly the same location. So Colombia already deployed the military to their borders. Not only Colombia, but also Brazil also has deployed on the part of Pacaraima, in the part of Babista and Roraima also they have deployed their authorities. This is the result of the attack of the United States. The explosions that you heard, that you saw, there's some graphic photos of the individuals who. They passed away. 32 Cubans, they were the ones that they were surrounding Nicolas Maduro. This mentions, and this tells you that the Cuban intelligence and Castriesmo and the communist extreme Cubans, they were the ones that they were in charge of the protection of Nicolas Maduro inside of Miraflores, in the governmental palace where he was safeguarded, like in a safe box, like in a fortress, where, you know, he was running away and going to a bunker. And then the authorities of the United States captured him and taken him now to justice.

You know, I assume you saw the press conference with, with Trump on January 3, announcing the capture. We had known it happened the night before, early in the morning, whatever it was. I noticed him really light up when, when the, when the, the last question was about Cuba and Trump really, he got animated and, and I know, you know, so here's my question. You're. You were in the border between Venezuela and Colombia. Colombia has to be a bit nervous. They've been accused of similar things and also Cuba as well. Where do you think the Trump administration's, let's call it. Sights are set next?
Oscar Elblue Ramirez
Well, you have, you have to, you know, the situation with Venezuela is going to take a little while. You have two other individuals who are bad actors, Yozel Cabello and Padrino Lopez. Those are the ones that they need to be extracted. And they asked Marco Rubio why he did not extract those two. And he said, you're making a big deal out of Nicolas Maduro. Imagine if I moved to three people. Now the situation with Venezuela is that also they has a big Iranian presence, fractions of Hezbollah near the dock area where they were loading. How crazy is that? Where they were loading all these illicit substances to the international waters. Now, if we move to what is going to happen, the trickle and domino effect, it has to do a lot with oil. Now, the Venezuelans were the ones that they were funneling oil and helping Cuba and also Mexico. It is the One that is also helping Cuba with oil. Just on the year 2023 to 2024, more than 7 million barrels of oil Mexico provided to Cuba. So what is going to happen now? The United States has control of this. They're going to apply more sanctions to Cuba or they're going to close the whole axis of oil from Venezuela to Cuba. That is the next thing. And I believe that the next step it is going to be inevitably to remove Diaz Canel, this communist dictator from, from Cuba and free the Cuban people. Also.

Very quickly, since you bring up Mexico, there are far more drugs coming across our border from Mexico than ever worse coming from Venezuela. I think even one of the officials on the Sunday shows I saw saying 10% of the cocaine coming into the United States is, is Venezuela. I'd assume a lot more is coming from Mexico. Is Mexico going to see any sort of Trump fire?

Well, it has to be. It was a domino effect from the illicit substances that were coming from Cartel de los Olles and also directed to the Sinaloa Cartel and El Cartel Jalis conueba generacion. And from here they were building their, you know, their laboratories. This is why the Trump administration has been pushing massively on the 25% terrorists to Mexico and suffocating the president of Mexico to pressure her to attack the Carters. This is going to be an incredible move and almost a checkmate if Donald Trump does everything the way strategically that he has been doing, pressuring every single country with the economy with Sanchez, with also inevitably the tariff and from there having control and pressuring them to expose dirty politicians to his full narco terrorists. And that is going to be the next move. Mexico. The Mexican president has come out and says that she condemns the arrest and the extraction of of Nicolas Maduro, that she says that it was an invasion of her sovereign nation. Again, you know, defending narco terrorists and not only not calling them what they are, narco terrorists so that it will be the next move to see how they are going to be pressuring still Mexico to expose them.

I want to ask you this very quickly. Maria Corina Machado, opposition leader, won the Nobel Prize, dedicated to Trump, seems to have a lot of support. Trump didn't think she had enough support. Do you boots on the ground think she has the support of the Venezuelan people around the country?

Well, the legitimate president is not her. It is Edmundo Gonzalez Urrutia. That was the guy that he was running for president. Maria Corina Machado was the vice president. Now, if Trump is saying that it is because he doesn't feel secure that the support must go 100% to her and possibly it is 100% to Edmundo Gonzalez Urutia. Now, it is a lot of people, they have the power. So Trump is going with the people that they actually have half the power right now. And that is the corrupt Del C. Rodriguez, that she's the one that stepped up to the plate and took the initiative to run the country of Venezuela. That's who Trump is negotiating right now. That is the one that basically said, we are going to have negotiations now with the United States of America. And that is the one that is up next to obey and to understand that, you know, this is the most important thing, Eric. Chavismo in socialism. It is on the verge of ending in Venezuela and it was the contaminated cancer that it was spreading all over the continent.

Hypocrisy is such an ugly color and yet Democrats wear it so well. New York City mayor now Zoan Mamdani, took a break from the warmth of collectivism to pretend like his opinions on America's foreign policy actually matter.

What would you bring to the table as a governor of California? You have immense powers as governor of California, and your responsibility is to protect the most vulnerable in the state. So if the president is going to send ICE agents to chase immigrants to the fields where they work, what I'm going to do is make sure that they take off their masks and show their faces, that they show their identification, and if they commit crimes, that they're going to be charged with crimes. If it's falsely imprisoning people, if it's kidnapping, if it's assault, battery, they're going to be held accountable. I also think if the governor has the ability to issue driver's licenses to people in California, if you're going to wear a mask and not identify yourself, you're not going to be eligible to drive a vehicle in California. There's a lot you can do. But most importantly, you have to go on offense. Otherwise, the most vulnerable in our community will always be on defense.

And I've also been doing some research on what's really happening in college athletics. I came across a couple of really great op EDS by an American patriot, Louisiana governor Jeff Landry, and a conservative activist and women's sports icon, Riley Gaines, both very close friends of mine, they get it right. College football used to be about tradition, school pride, team loyalty, earning the scholarship, wearing the jersey, competing for something bigger than yourself. Today, that foundation is starting to crack. What we now have is a fragmented system with unclear rules, broken incentives. Really. Notre Dame, not in James Madison University. In what Conferences competing against each other, schools fighting for short term advantages. And the sport is a whole lot weaker because of it. President Trump has acknowledged there's a serious problem in college athletics, and he's right. The system isn't sustainable. Here's the key point Landry and Gaines highlight, and it's one most people don't realize. When conferences, conferences, sell their media rights separately, they're actually making less money than they would if college football sold those rights together as one unified product. NFL does it, the NBA does it. And that collective approach dramatically increases the value of the media deals. Right now, college football is leaving billions on the tape, billions on the table negotiating piecemeal TV contracts. That lost revenue just doesn't hurt football. It puts Olympic sports, women's programs, and smaller schools especially at risk. A unified media rights structure would create more total revenue, more stability, and fewer internal fights. It would allow schools to pay athletes fairly, invest in their own programs, and preserve the broad ecosystem of college sports. This isn't about centralizing control or destroying conference autonomy. It's about smart markets. It's about using a proven model that already works for other sports. College football doesn't need radical change. It needs common sense. It needs structure. It needs leaders willing to put the long term health of the sport ahead of short term conference politics. Landry and Gaines are right to sound the alarm and right about the solution. If college athletics want to survive, selling media rights together is the only logical way forward.
