I want to start a little differently today. I think I'm going to freestyle the open more. I started writing an opening and I have some bullet pointed notes still pulled up here, but I don't know that I want to read them because I want this to come from the heart, but I might look at them occasionally and rely on them. Something happened on Candace's show last night that spilled over into the broader, what I call creator wars. The broader arguments that go on amongst the, the, the people who do podcasts, the people who put up content on X, the people who put in content all everywhere else. It spilled over into that. And what she did was Blake Bednars had, had been pushing on Candace to put up some videos, to put up some. Or I don't even know. I honestly didn't fall off that closely. I don't know what he was pushing her to do, but he was pushing her to do something. There was a dispute over whether a video was transferred and it turned hostile between them. He was attacking her, calling her name, saying she wasn't doing certain things that he wanted to do for whatever reason. And last night she kind of turned the tables on him a little bit and said, hey, why didn't you get sued? You've been accusing Brian Harpel of being, being the, I don't say trigger man, that's not quite the right word, but the, the, the person who activated the device that took Charlie's life. You've been accusing him point blank for months and months and months. You don't get sued. I, I have somebody on who says, yeah, it kind of looked like a guy that was there. And I get sued. What's the difference? Why, why, why me? Why not you? In response to that, Blake did what he's done several times over the past year or so, and I have no idea. Or six months or so. I have no idea why he does this when people attack him. But he deleted all his channels, his YouTube channel, his X chann. So they start spatting. And then I see it filter down and this is what I hate. I see it filter down into the community. I see the, the fans of each person get fired up and they start lobbing bombs. I can't believe she did this. I can't believe he said that. And I started thinking, because this is how I analyze everything. I started thinking not whose side am I on, that's irrelevant. In any fight, it's an irrelevant first instinct. Whose side of mind that's irrelevant? I'm just one person among millions, right? Or tens of Thousands or hundreds of thousands who are interested in this argument. So what difference does it make whose side I take? I'm just going to sit back and watch it. Let me see what I can learn from this. Then I start analyzing. When is it okay for this to take place? When is it okay for people to start going after each other? Now, for most of you, this is irrelevant because you just tune on, you tune in, you want to watch some. You want to be entertained, you want to be informed, you want to know what's going on. I'm really speaking to a small group of very invested podcast listeners, people who take these shows very seriously, who get very invested, who get on the websites and get on the. The fan sites. And I mean, this. We're talking like, if there's 300, 350 million people in America and then there's like, 3 million who listen to political podcast, and then there's like, you know, 3,000 who get disinvested. I'm talking to those 3,000. But it's a. It's good application for everybody in life. So we're going to go through this here because I think it's important. Here is the question when you are wondering whether you should engage in a fight with another creator or another fan or another show or get all upset, you've got to ask this gatekeeping question that in my mind, this is how I handle it. Is this person on my side? Is this person on my side? This extends beyond podcast wars. This extends beyond creator wars. This is. Is this person on my side? If the answer to that question is yes, I'm going to approach it differently than if the answer to that question is no. And what do I mean by my side? Is this a globalist, or is this somebody who's America first? If it's a globalist, that's not my side. Meaning, are they trying to outsource jobs to our greatest allies in China, in all over the third world? Are they trying to outsource American jobs? Are they trying to just have unlimited immigration in the United States? Are we trying to just destroy the American way of life and culture? If the answer to that question is yes, you're not on my side, but that doesn't mean I'm going to fight with you. But that means you're not on my side. Well, now we know you know those people are not on our side. Let's. Let's not talk about them, because I don't care if you fight with those people. I might not, but I don't care if you do. Now, let's talk about people who are on our side, meaning the American first side. All right, if you're on the American first side, are you on the right hand side or the left hand side of that? Because believe it or not, there are some left wingers out there who are the American first side. If, if you are on the left wing, I'm. I'm not talking to you either because I don't care if you fight with those people. But if you're on the right wing of America first. Now let's really drill down and say, is this worth fighting about? Are we talking about a single issue we're upset about, or is this multiple issue? So, again, is insider versus outsider, Are you on our team or are you on the other team? And I'm using team kind of broadly here. Are you fighting in general for the same things I'm fighting for? If so, I don't know that it's a good idea for me to fight with you. I don't know that it's a good idea for us to get into it. So if it's with an outsider, you got to say, why are we. Why am I fighting with this person? And there's really only two reasons. One is you're defending from an attack, meaning this person's launched an assault on me. And so I have to defend myself. And sometimes to defend myself, I have to poke the bear a little bit. I have to find their weak spot and destroy them. I don't want to do that, but sometimes it becomes necessary. So am I defending from an attack? If not, and it's everything else again, probably don't want to engage that person in that, in that setting. Finally, you, you gotta ask, is this person a public figure or some sort of creator or some sort of person of influence? Or is this, Is this like a private citizen? For example, I'll use the Candace George thing here. A lot of people have been attacking George. Did he get a dui? Did he not get a dui? Did he have a weapon on him? Did he not have a weapon on. Did he wreck a car? Did he not wreck car? I don't care. You know why? Private citizen, private citizen. I really don't care. I'm going to talk about Ali Beth Stuckey tonight because I don't particularly care for her opinion on certain things. And I think she looks really foolish. I don't even know who she's married to. I would never attack her husband. I would never attack her husband. Why? As far as I know, not a Public figure. I don't even know she's married. I assume she is. Looks like she keeps having kids, so I, I assume she is, but I don't know that for sure. Is this person a public figure? Is it a private figure? If it's a private figure, meaning somebody who wants their privacy, somebody who's trying to remain to themselves, somebody who's just, you know, maybe managing the affairs of the business, like Ben Shapiro, public figure, whoever the accountant is at Daily Wire, not a public figure. Now, we're not attacking that person. I don't care what they say. I really don't care. Irrelevant. We're not attacking that person. I, I use the famous example of Brita. No, Brita. The, the, the, the Twitter troll. I don't. I'm not attacking Brita. I mean, what, am I going to come out here and savage the poor thing? I don't know anything about her. You know, I, I've looked into her a little bit. She's. She's kind of moderately annoying, but she's kind of harmless. She's not out here cussing and being super angry and mean and everything. So let her go. Let her go. You've got to evaluate the class of the person you're dealing with. Here's what you can't do. And this is the mistake I see a lot of creators making in particular, but a lot of the fans of the creators, everything else, they just go on the attack. There's no discipline in that. They just go on the attack and they start. They're going Leroy Jenkins on everybody. And I'm thinking, why? What are you trying to accomplish? What damage are you doing? Not to, not to the other person, to yourself, to your credibility. This happens time and time and time again. And it, I was reminded of it with the Blake Bednars and Candace Owens thing. I had no idea why Blake was launching an assault on Candace. Candace is free to run whatever show she wants to run. She's free to cover whatever stories she wants to cover. She. She's free to show whatever video she wants to show. If Blake provides her a tip and she doesn't want to follow it, that's fine. For example, today Candice said she had paid someone or offered someone a very generous tip, by the way. I don't offer $10,000 tips. My family would panic if I did such a thing. My wife would panic. Mrs. Coleman would be beside herself if I offered a $10,000 tip to somebody. But Candace is very successful. She wants to offer $10,000 tip for a video that's her fault. That's her business. Not fault maybe, but she offered a ten thousand dollar bonus to somebody who would bring them a tip on a particular issue. Fair enough. Now let's say she got the tip. Let's say she gets the video in house. Is she obligated to show us the video? No, no. It's her show. She can show it or not show it. It's irrelevant. She's not the government. You don't have a right to foil what's in her folders. You don't have a right to demand she show you something. Let's say the tipster gives it to her and they put it on a condition. I will give this to you to satisfy your curiosity. If you still want to pay the 10,000, that's fine. But you can't play the video. You can only describe the video. She has to make a call. Is she willing to pay the 10,000 of those circumstances? And if she does pay the 10,000 of those Circumstances and chooses not to show the video because she's honoring her promise to the person who provided the video? That's not my business. It's not your business. It's not anybody's business. It's her business. It's her show. These shows, you put a lot of work into one of these channels. A lot of work. I had no idea until I started doing a show four or five days a week. How much work you have to put into these channels every day. How many things I'm missing. You know what happened to me tonight? My son walked in about 4 o'. Clock. What you doing, Dad? I said, I'm getting ready for a show tonight. He said, okay. I said, what are you doing? He said, I'm going to play baseball. I said, oh yeah? He said, I wish you could come with me tonight. I said, I know, son. I'll be there tomorrow night. You know, you. It's a sacrifice. You. You have to sacrifice things to do this. I got a wife and eight kids. It's a tremendous sacrifice to sit in this room from 7am to 11pm Pretty much every day to. To bring the show. If I choose to not cover a story, not your business. And I'm not saying that's happened. I don't really get that from very many people. But Candace does. But I talk to her sometimes. I know the prep they put in. I know how many people work on that show. I know how much research they're doing. And if she doesn't want to cover something, it's not your Business. It's not Blake's business. It's not anybody's business. And for her to be attacked on it is just insufferable, particularly by people who claim to be on the same team. If we're trying to figure out who killed Charlie Kirk, how and why, don't attack the people. Stop it. Stop it. So that's what I do. That's what I chose to do over the last 24 hours, is the Candace versus Blake war was taking off. And I see it time and time again, and I see it with big people and small people and all these other people. I see people trying to make their name off of attacking this show. I see people trying to make their name off of attacking Candace. I see people trying to make their name off of attacking Jesse. I see people trying to. It is nonsense. People trying to attack Coach. Coach. That Coach, he's like the nicest human being I've ever met. Coach had a baby. I forgot he had a baby that day. He took my call, and when I realized that baby, I'm like, hang up. Go be with your baby. I mean, just too nice. Too nice for his own good. So I say all that to say all of that to say. When you're evaluating the attack. This is not just for the Charlie Kirk story. Anything else. When you're evaluating who to attack, when, how, and why. Please, guys, please use some discretion. Use some discretion. If you're going. If we're. If we're talking about politics and we're talking about the upcoming election, you're talking about who to attack, and you think that person's on your team that might not be the person to attack at that given time. Oh, but, Baron, they're not ideologically pure. I don't care. No one is, you know, the only ideological, ideologically pure person on the planet. There's only one. There's only one person who is completely right on every single political issue. Do you know who that person is? You. You. You're the only one on the planet who's right on every single political issue, because I'm guessing you're the only one on the planet who believes exactly as you do on every single one of the hundreds of political issues, whether to build a park in your neighborhood, all the way up to abortion, gun control, immigration, and everything else. You're the only one who is ideologically pure. Everybody else has a defect somewhere in their thought process. Everyone else. And so from where I sit, you guys are all wrong on some issue. From where you sit, I'm wrong on Some issue. Guess what? That doesn't mean we're not on the same team. We can very much be on the same team. Very much be on the same team. So I will leave it alone at that. I just had to get that off my chest because it's happening more and more and more. And part of it is a large group of very disparate thinkers were brought together because of the Charlie Kirk investigation. So there are people who are now working together who've never known each other. There are people working together who've never known each other, who've never worked together. And they've been doing it now for five, six, seven, eight months in a row. And so you're starting to see some personalities begin to grind against each other. And I just think it's unfortunate. I really think it's unfortunate. I am not a person who wants to go out assaulting people. I will like tonight I'm going to play a video from Ali Best. Ducky. I don't particularly care for her politics. I don't particularly care for her opinion on this particular story. And I'm going to cover it. And then we will after that. But I'm not attacking her. I'll attack her bird hands. She does bird hands a few times in the video. You know, the liberal women, they do the bird hands. She does that a little bit. So I'll attack that. You know, I think that's ridiculous, but I do want to draw a distinction and I want to draw out why I disagree with everything she's saying in this particular, like, four minutes of this video. And I also want to talk about the Tyler Robinson hearing is coming up probably in the next 10 days or so, give or take eight, 10 or 11 days. It may last up to three days. It's the preliminary hearing. There is some discussion. We will find out tomorrow, I believe, whether the hearing will be pushed off beyond May 18. I don't know the answer to that question. No one in the on earth except Judge Tony Graff right now knows that question. If he's already made up his mind on whether he's going to to kick off the preliminary hearing beyond next week or beyond 10 days, I think May 18 is when it was scheduled. So he's the only one that knows that. So I will operate as if they are going to a forward because I think there's probably a better than 50 chance they will end up going forward on May 18th. So I will evaluate these pleadings and I think there's two, maybe a third one. I kind of want to look at. But there's. There's one very important pleading I want to. To look at today. It is the witness and exhibit list. And I want to go through it with a. Not a fine tooth comb, but I want to go through a couple of items on there very carefully because they shocked me when I saw them, frankly. They absolutely shocked me. And I'm hoping they don't mean what I think they mean. Okay, let me pull up this. Pull up this video because I want to set it up. Dang it. I want to pull it up before. I want to set it up before we pull it up. Candace's show tonight talked about whether or not the Erica running out crying at the White House correspondence dinner was staged. I have been suspect of that. She and I talked about it off the. Off the. Well, probably shouldn't talk about this. I think it was probably an off the record conversation. I'll say my part. I told her I didn't think it was real. I said, I don't. I'm not gonna say what she said. I don't think it's real because I don't think the person who posted the video is the one that took the video. I think there's evidence on her site. I think there's evidence in the video. She's not the one that took the video. I'm not going to say what the evidence is because I'm trying to run it down, but that's my opinion. I don't. I don't. I think it's fake. I think the whole crying running out is fake. It's. It's possible. It's real. I'm not going to declare definitively. I know 100 it's fact. It's fake. It's staged. They set it up. They. They were going to have her crying running down the hallway saying, I just want to go home to set up her taking a break and take you stepping us back from the limelight because that's a very dark place to be. Because if that's true, then Erica needs to resign. Andrew needs to resign. Perhaps the President of the United States needs to resign. I mean, what you telling me you set this whole thing up for that moment? Maybe. I don't know. I don't know. I don't know. But I want to go through this because Ali Best Stucky uses this opportunity to launch an assault on people who criticize Erica Kirk. And that bothers me. It bothers me. So I want to play a couple of bits out of this. I don't want to. It's an hour long video. I think I'm going to play, like four total minutes, maybe less than that. So a very small percentage of this video am I going to play, but I want to play it because it is an exemplar. I don't particularly care for Aliba Stuckey's presentation style, but that's not what I'm attacking tonight. It is an exemplar of everything that is wrong with the people who attack us for asking questions about what happened on September 10th at Utah Valley University. It is an exemplar of everything that's wrong with people who ask who attack us for saying something's wrong with Erica. That's not right. There's. There. You could say everything you want to say. You can try all you want to tell me that she's acting like a normal person under the same or similar circumstances, and the answer is no, she's not. No, she's not. She's just not. And I don't know what that not means. I don't know if it means she was involved. I don't know if it means she's being duped. I don't know if it means she's getting bad advice from Andrew Colvette, but I know it means she's not acting normally. So let me play a little clip of this. Grossness that we see in human nature is not just through something murderous like this, but people's willingness to mock this kind of event and specifically to mock Erica Kirk. I mean, this woman, Charlie Kirk's widow, can literally do, according to these people, nothing right. She can do nothing right if she's at home. Oh, well, she's in hiding.

Have you ever heard anyone complain that Erica Kirk is not out front? Because right there, I think that's a totally dishonest attack from Ali Bestucky. And you're gonna. This is gonna be a recurring theme. She is slaying dragons that are not breathing fire near her. I don't know a single person. I watch a lot of podcasts. I interact with a lot of creators. I talk to a lot of members of the audience. I read a lot of emails. Despite me telling you I don't. I. I have yet to encounter a single human being who says, you know, Baron, you know what? We don't see enough of. We don't get enough Erica Kirk. Why is she not out there in front of everybody? Why is she not out there leading? You'd think she'd be at some of these events. I never encountered a single soul who has ever said that. That is a lie. It is not something you read. You don't see it on X. You don't see it on YouTube. You don't see it on Facebook and Instagram. You don't see it on grumble. There's nowhere on the planet where everybody's like that. Darn Erica Kirk. Where has she been? A, you don't have an opportunity to say that because she's freaking everywhere. B, the major complaint is she's frigging everywhere. They want her to go home. Do you know the sigh of relief people had? Not because she was hurting, but when she's running down the hallway crying, saying, I just want to go home. You know how many people are like, oh, thank God. Thank God the day has finally come. Please let her go home for once. That's the only time I've ever heard anyone say, where is she? Well, that in the time she lied about not being able to go to Georgia, that was the only other time. But that was just because she was lying. Allegedly, in my opinion. Allegedly, in my opinion. All right, so that's. That. She's slaying a dragon here that's not breathing fire. But let me. Let me just, like, 13 more seconds of this.

Why isn't she showing up at this University of Georgia event?

Yeah, again, that was because she lied about it because she was there and the ticket sales stuck, and she didn't want to walk into an empty auditorium. That's. That's my opinion, because I think it's pretty obvious if you track all their planes, that her plane was absolutely there on time. But that's neither here nor there. Other than that, no one has ever asked, why is Erica Kirk not here?

Why is it she. Why isn't she doing more? And if she's out there, where are her kits? Why isn't she taking care of her home?

And here's. Here's where I want to go with this. Why? I want to ask the question I want to answer it. I think you guys will answer it in your own minds. But I want to ask the question, why was Charlie. Charlie notoriously and famously traveled 250 to 300 days a year. He was on the road non stop. He lived on an airplane. He lived in a hotel. He lived anywhere except home. He was constantly gone. Was there anyone out there going, why is Charlie gone so long? Not just Charlie. This happens to a lot of people. There are a lot of people who are on the road nearly constantly. What is the major difference? And I don't think that this is a, a point that's lost on Ali Bestucky if she's being honest. And I don't, I think she's being deeply dishonest in this video. And it disappoints me. But this is not a point that I think is lost on anyone. The primary difference between Charlie Kirk and Erica Kirk is that when Charlie was on the road 300 days a year, Erica allegedly, in theory, was with the kids. And that goes for a lot of people who run the road a lot. I used to travel a lot. My wife was at home. I finally stopped traveling because it was hard on the family. But I used to travel two, three, four days. Two, three, sometimes four weeks a month on the road pretty non stop. And it was very hard on the family. Now imagine if I was gone and my wife tried to take over that schedule. I think it would be a very natural, obvious question of who, who are with the Coleman kids? Where are they? It would be a very natural question. A very natural question. And so Ali Beth, when people ask the question, it is out of genuine concern for her mental health. Her husband died doing this exact job. It's got to be stressful. And it's out of genuine concern for two small children who are being raised in this environment. Say, very legitimate, genuine set of questions. And so I don't, I don't find it a particularly honest, a particularly honest portion of the discussion. Now I'm going to jump ahead a little bit. Again, this is just about a 30 second clip, maybe less than a 30 second clip. I want to play here. I, I honestly, I'm sparing you guys. I could have played more. There was like 12 minutes of this podcast initially I was going to play. And I thought, I can't do that to them. That's not, that is wholly unfair to them. To make them sit through 12 minutes of this woman whining into the microphone. So I'm not going to do that. I'm not going to do that. But I do want to jump ahead because she said something a minute or so later that caught my ear.

And then this, and then to hear that there's a gunman trying to assassinate people in the administration the way that her husband was assassinated. She probably just feels like evil is following her. And of course, she's thinking, wow, I'm risking my own life here.

Yes, that's. That's Alibeth. That gets precisely to the root of the problem. She's risking her own life here. Her kids are. We always talk about the vice president being one heartbeat away from the presidency. What we mean by that is the moment a president ceases to have a heartbeat, the vice president is then sworn into office. Her children are one heartbeat away from being orphaned. That's a very scary proposition. And for a lot of us, because we have this innate desire to see children raised by their parents, for a lot of us, that's pretty terrifying when you think of the fact that someone undertakes a pretty dangerous job. I'll let her finish here. I got 11 more seconds of this.

And that's obviously not what she wanted. Anyone would think that this would be a secure event because you've got the succession to the presidency there. And so I imagine that she was so traumatized.

Okay, if. If. If they thought it was a ser. Cure event, because the succession of the presidency there, meaning the Secret Service, is there, if that's a legitimate reason for believing it's a secure event, then there is no excuse for the University of Georgia event. So what she's doing here is having her cake and eat it, too. She wants to complain that we ask questions about why weren't you at the University of Georgia event after you committed to it and after everybody in the building thought you were there, including the University of Georgia workers, including the vice president, who was on his way when he found out you weren't going to be there. There's no way that the vice president only found out two hours before the University of Georgia event that it was somehow unsafe for Erica, because if that's the case, she'd have to already be there. You can't travel from South Florida to Athens, Georgia, in under two hours. It's, like, physically impossible. There's no plane that flies that fast. All right, now I want to get into the depth of the problem here, because Ali Beth is going to go on a preaching tirade aimed, I believe, at people like your humble host, certainly Candace Owens, and you, the concerned viewer, the viewer who. Who wonders what is really going on and is this woman as innocent as she is purporting to be talking about Erica Kirk, that Catwoman here? I, I want to pray for Ally because she sounds like she has a terrible cold in this. She's not able to breathe out of her nose. Let me play this here. Yeah, this is, this is where she talks about the dangers to your soul, ladies and gentlemen.

Okay, you are just playing this very dangerous game with your soul. You're gambling, you're gambling here. Like this is such a dangerous thing for you to have to bring before the Lord one day, that you found it to be an entertaining sport to mock someone's widow, that you claim these people on the so called right that you claim to admire. Now, I am not someone who is saying

I paused it right there on purpose. I think she realizes she's about to contradict herself and she's stuck. And she's making a decision right now whether she wants to proceed with this next line that's in her notes or not. She just made a deal. She just made a whole thing about how if you criticize a widow at all, if you criticize a widow, then your soul is in jeopardy. You're in fact gambling with your soul. That little blazing bee at the bottom right corner blaze might as well be the blazes of hell when it comes to you people who mock widows, when you, people who question widows, when you people who ask questions about widows. She says you're on the so called right. Oh, you're not really a conservative. If you have questions about this widow or if you, if you don't think she's grieving properly and she clearly is not, you don't, you're, you're, there's something wrong with you and you're gambling with your soul. You're probably the message she's sending. You're probably going to lose your soul. You're probably going to have to face God one day. He's going to strike you. He's going to smite you because he's the almighty smiter of everyone who's ever criticized the widow a single time. And that's what you're guilty of. Go to hell, young man. That's what you're going to hear. That's what Ali Beth is telling you now in her notes. And obviously someone put in there, you're allowed to criticize public figures. And so she says, well, I'm not, I'm not someone who's saying that you can't criticize a public figure. I'll back it up a little Bit so you can see it. But I want you to look at that eye. Pause as she ponders. You can see the wheels spinning. You can see the last 13 brain cells she has left. You can see him spinning around in her head thinking, am I supposed to say this? Is this line something I'm supposed to say now?

I'm not. She had a big swallow. I'm not someone who's saying. Looking off the left. She is terrified that she's about to say, that she cannot figure out how to get out of what she's about to say. And I promise you, she was considering abandoning this next line, but she went with it. And it. It really buried her that you cannot

criticize a public figure. She's a public figure, okay? She's the CEO of a massive, very influential nonprofit organization that is in the limelight that has helped get very powerful people elected, okay?

Then why are you talking? Then why are you talking? You just gave me a lecture that I cannot criticize this woman. Then you say, I'm not saying you can't criticize public figures. She's the CEO of a massive organization that's very politically powerful and gets political people elected, okay? So if I'm allowed to criticize public figures, particularly public figures who are of powerful political organizations who get powerful political people elected, why are you talking? What is the purpose of this podcast? Get a daisy. Get a better job. Get somebody who can help you line up some notes in some sort of practical order so that you think through what you're going to say before you fire up the camera and the microphone. Get somebody who will help you organize your thoughts before they say, three, two, one, go. Because you just negated everything you said. And you're going to spend the next five minutes of this podcast trying to dig your way out of this hole, and you can't because it is a fact. What you just said is reality. Being a widow is not a free pass. To be a psychopath, to act like a nutcase, to say stupid things, to lie constantly. It is not a free pass. You just told us that you are allowed to criticize public figures. You are allowed to criticize people who run large political organizations. You are allowed to criticize people who get people elected. That's why I wanted to use this podcast. I wasn't originally going to use this. We had a conversation today if we were going to use this tape or not, and I thought, well, probably not. And then I heard her say this line. I thought, no, this is great. When you are running a large organization and you are a demonstrated liar time and time again, which I believe, in my opinion, she has been a demonstrated liar time and time again. That is a fair critique. There are people who were hired to be head coaches of Division 1 football teams. Notre Dame came comes to mind. I can't remember who that was. Years ago, he was hired to be the head football coach at Notre Dame. It was determined later he had lied on his resume, and so they fired him before he'd ever coached a game. There was a guy who was hired to be the head coach at the University of Alabama, probably the. The most high profile head coaching job you can get in college football. He was found to be cavorting with women of the night on company time. He was unceremoniously removed. He was fired the next day. Name was Mike Price. Gosh, I wish they'd have kept Mike Price because Nick Saban is who they hired after. But that's neither here nor there. And what that means is when you are a person of tremendous power and influence, when you are somebody who's at the very top of your game, you're not above a critique. And you're admitting that you are telling us that. Now, what she's going to try to do is separate this frog hair into 13 different pieces and say, you are allowed to criticize this one little sliver of frog hair over here. But everything else is off limits. I call bubkus on that. I think it's garbage. It's a terrible argument. She's about to try to go down. And I don't think this was in her notes. I. Because she stops looking at her notes at a certain point. I don't think any of this was in her notes. I think she realized she had just undone her entire argument, and she's trying to scramble and put something back together.

Yeah, you know, I wasn't gonna say this, but I am. I'm gonna let me lower here. So when I was first a lawyer, one of the things you want to do is you want to get some courtroom experience. So there's only a set number of ways you can get it right. Because not a lot of people are going to hire a first year lawyer to go in and try some big high profile case. So you want to get in courtroom, you want to get to in front of the judges, you want to get to meet people around town. So one of the things our firm did where I was, was they encouraged you to become a, a lawyer for Children, a lawyer for children. And what that means is if there's a parental dispute, you've got a father over here and a mother over here and they're going through a divorce. I don't know what they call it in every state, but where I was, they called it a pro Amy. You were a pro Amy lawyer, meaning you, you were a friend of the, of the court, but on behalf of the child, the father had a lawyer, the mother had a lawyer, the child doesn't have a lawyer. And so you go to class and you learn how to represent children, you learn how to talk to them, you go to their school, you, if they're old enough, I mean, if they're like 18 months old, obviously you don't interview the kid, but you know, if they're fifth grade or above, you go to the school, you meet with them at the school, you talk to their teachers, you go meet with the parents. If they have a, they go to a daycare or something, you go over there and you run by one day and you talk to them one afternoon and you're just going to get a feel for the kid's life. And then when you go in front of the judge and the judge is weighing, you know, visitation and who should have primary custody, a lot of times they'll want to hear from the pro Amy lawyer, the lawyer on behalf of children. Because the standard in these things is supposed to be anyway, best interest of the child. It's not always done that way, but that's allegedly the standard, the best interest of the child. I had to stop doing it. I had kids at home. I had to stop being a pro Amy lawyer. And there was one case in particular that set me off. But there were multiple cases in a row that really bothered me. One case, there was a father, this was a poor, poor couple and they'd split. I don't know if they'd ever been married, but they were both very involved in the kids lives. There's a father who wanted custody of the children because he thought the children were in a dangerous situation. And the father lived in a lower middle class neighborhood. But it was stable like it was, it was not a middle class neighborhood by any stretch of the imagination, but it was not like project housing. It was a lower middle class neighborhood. You know, bars on the windows, gunshots in the neighborhood and all that. But it, but, but you know, pretty stable, pretty stable for the most part. And he had been married I think 12 or 15 years to another woman. They had a kid together, they were raising the Kid. The kid had good grades, went to school. They had a bedroom for the. For the young man that he could come be in anytime he wanted to. Kid was like, I don't know, 14, 15 years old maybe. I went to the school, talked to the teachers, and the teachers were like, something's going on at his home. We don't know what it is. It's very disconcerting. He won't talk to us about it, but he's. He's not right when he gets here in the morning and. And you can tell something's going on. So I go to the house and I meet with the mom. I'd already met with the dad. I'd met with the school. I'd had trouble catching up with the mom. I go meet with the mom, and as I'm pulling up, the police are leaving. I thought, oh, okay. The mom was in a very lower class neighborhood. Not. Not middle, not lower, middle, lower, lower. And I roll up to the house and the police are leaving. And I'm like, what the hell was that about? You know, just trying to make small talk. And she's like, oh, well, they're looking for so and so. He stays over here quite a bit. I was like, what are they looking for him for? Well, he's wanted for murder. Well, did he do it? I'm just curious at just talking among friends here. She's like, I don't know. He's a drug dealer. It's possible. I'm like, okay, so we got a drug dealer who's over here a lot who's wanting for murder. Okay, strike one. I go inside, there's no power. There's no power. Like it's. It's, I don't know, October or something. So it's not excessively hot, it's not excessively cold, but there's no power. And so I was like, all right, well, when I'm doing these home visits, I like to see the bedroom, you know, just get an idea that the kid's taken care of, has clean clothes. You know, we open the pantries, open the fridge, make sure there's food available if the kid is hungry or whatever. The kid doesn't have a bedroom. Kid sleeps on the couch. Okay. I open the pantries. There's like a half a box of noodles and like a little thing of tomato paste, like that's it. Refrigerator is basically empty except for a couple of Miller ices or something that are knocked over. And I'm like, oh, gosh, you know, this is no wonder the teachers are Having this situation. So I. I go into court and I. I requested. I said, I think, Judge, if you would, I think you should drug test both of the parents. And he was like, why? Well, because there's a. She told me there's a drug dealer living in her house. He was wanted for murder. We still don't know where he is. There's no power on in the house. There's no food in the house. The teachers say there's something crazy going on. She won't let the kid go visit the dad, who very much wants to take care of the kid because he believes the kid's in danger. Why don't you just drug test him? That'll give you an easy out. Because if the mom test positive for drugs and the dad doesn't, easy peasy, there's your decision. And the judge is like, let me think about it. Fair enough. We come back, I don't know, two weeks, a month later, whenever it was come back, the judge has decided, nope, not going to drug test the parents at all. Brings the mother in and asks a very simple question like, hey, do you love your kids? Oh, yeah, I love my kids. Do you want to keep your kids? Oh, absolutely. Okay, they're yours. Your case is over. And I thought, this is not right. Like, this is. This is not the job I'd signed up for. It didn't pay that well. It was a lot of work. It was dangerous at times work. And I thought, this is not. This is not part of the court system I want to be involved in. There were other cases where it was very clear the parents did not like the kids at all. They were abusive, they were neglectful, and all that kind of stuff. I only raise these issues to say. I don't raise these issues to say Erica is guilty of any of these. But I raise the issue to say that when somebody who doesn't know the situation at home opines and says, I promise you, she has the best interest of the kids at heart, I promise you, she knows better than you do. I promise that. Not necessarily. Not every person knows how to be a parent. Not every person's a good parent. The fact that they were able to pump a unit out a couple of times does not mean they are qualified to be a parent. Now, I am not saying that I think Erica Kirk is neglectful or is not a good parent. What I'm saying is this is not a good line of attack for Ali Bestucky. It's certainly not a good enough line of attack that she should laugh about It. I promise she knows better than you do. Well, not every moment. Not every. Dad, I can assure you, the fact that you're a genetic donor to a human being is irrelevant to whether or not you should have custody of the kids. Whether or not you know best, what's in the best interest of the kids. It's just not an argument. So what I learned overall is you are allowed to criticize a public figure, but only on their public figuredness, nothing else. So if, for example, oh, gosh, I'm trying to think of, like, who's the worst human being on the planet? I don't know, say there's, like, a serial killer and he gets to be elected president. You're not allowed to mention the serial killing. Like, if you want to criticize him, you can only talk about his job as the president. Like, is he showing up to the speeches? Is he. Is the White House in relatively good order? Like, you are not allowed to criticize his job out. You're not allowed to criticize this person outside of the job particular. Let's say a woman. Let's say a. Worst case, a woman's serial killer becomes president. Yeah, it's getting ridiculous, but this is what you have to do sometimes. Woman serial killer becomes president, most important job in the land. Totally despicable human being somehow becomes president. It's determined later, she's at, in fact, a serial killer. You're not allowed to mention it. You're not allowed to say, maybe she shouldn't be president. No, no, no, no, no, no, no. She's a widow. This woman's a widow. You're gonna have to stand before God one day, and you're not allowed to criticize a widow. Yeah, yeah, but she's a serial killer. That's irrelevant. That's irrelevant. She is a widow. Now am I calling Erica Kirk? Of course not. Of course not. I don't think that. I don't. I'm not convinced she's ever been involved in a single death. Maybe. I mean, we don't know, but. We don't know. But we should be allowed to evaluate her character. You told us we're allowed to criticize public figures. Part of that criticism should be character. So I bring all that up to say, I, I. This is not about Ali Bestucky. This is about who's on the other side of this argument. Because this is, as it gets ready for the preliminary hearing next week, this is going to be a real hot topic. Because what's going to happen is I'm going to show some documents in a second. But I'm going to tell you, if the preliminary hearing goes forward, here's what's going to happen. The prosecution is going to put some evidence in and the judge is going to find there's probable cause to determine that the case should go forward. I hate to spoil the surprise for everybody, but that's going to happen. Whether the preliminary hearing is delayed a month or three months or six months is irrelevant. This case is going to proceed. The ca. The judge is not going to say that the prosecution failed to meet its burden. It's just not. That doesn't mean we shouldn't have a preliminary hearing. It doesn't mean we. We. We shouldn't go forward. It doesn't mean any of those things. But what it. It does mean, it absolutely does mean that the case will go forward. But on the other side of it, we're going to get an onslaught of Ali Beth Stucky Slope stuck slop of people who are going to say, see? The judge heard the evidence. You guys are crazy. You don't know what you're talking about. The case is over. He's guilty of sin. Fry him up. He had a trial. They're going to call it a trial next week or the May 18th. Whenever it shows up, they're gonna call it a trial. It's not a trial. It's a hearing. I'm just telling you it's coming. I'm. I'm warning you it's coming. But that doesn't mean I don't want to look at the witness and exhibit list, because I think there's something on this witness and exhibit list that is very important. Very, very, very important. So let's roll through this real quickly. This is a witness and exhibit list that was filed by the deputy Utah county attorney. So this is the state's witness and exhibit list. You'll see some stuff that doesn't surprise you at all. Of course they're going to have some sort of investigating officer testify. That's going to be Officer Bagley from the UVU Police Department. We can probably anticipate what he's going to say. There was a crime. Here's what we did on campus to investigate the young man. You know, Charlie Kirk died on campus. I mean, just basic stuff. You just got to establish this stuff. Then you've got a couple of people from the sbi, four people here from the SBI on this page. These people might testify about any number of things that they did at the SBI Evidence collection. They could testify about testing results Any kind of, that kind of stuff. This is interesting to me because we are told Lance Twigs, to begin with, he's not testifying for another 18,000 years or so. If you look over here on the right hand side, 22, 25. So he'll be testifying in 18 millennia. But Lance Twigs is, is testifying by recorded statement in lieu of testimony. This is very critical to me. Very, very critical. Because the question is why, why wouldn't you just bring him in? If Lance Twigs is a good witness and is going to say what you think he's going to say, what's the harm in bringing him in? Let him getting cross examined. I mean, if, if, if you, if you, if you believe Lance Twigs is a money witness. Because we're constantly told this by the Fed slap crew. Oh, the parents are going to testify against him. His boyfriend's going to testify against him. Well, maybe, maybe. We certainly know he's going to give a recorded statement. And that recorded statement may or may not be prepped. We don't know what's in it. We don't know who was in the room. We don't know any of this stuff. We don't know if it's going to be audio or video. I think we can assume it's going to be video, but I don't know that we know that. That'll be interesting. I don't think we will see this. We might or might not see some of this stuff. It depends on the judge's ruling. I think there's a very low likelihood we would see this on television or, or in open court. I think that would be behind closed doors if this takes place and I'll tell you why in a minute. So those are your people testifying now. Who's not on there that we were told was going to be on there? Anyone? Anyone? Anyone recognize obvious people that we were told we're going to testify against Tyler Robinson? Weren't we told grandpa was going to get up there and talk about his gun? Weren't we told dad was going to get up there and talk about how he recognized the gun and how he became increasingly concerned and scrambled? Weren't we told that mom was going to be there to nail the coffin shut? I was told that. I was told that repeatedly by the Fed Slopers. I was told over and over and over that mom and dad were gonna testify against him. They were the ones that turned him in. He confessed to them. This is an open and shut case. We're a hundred percent sure he did it. My goodness. After all, if he didn't do it, why are the parents testifying against him? I don't see him. I don't even see Lance. I see a recorded statement from Lance. I don't even see them. Bring this down for a second, guys. This is an important development. This is an important development. Every Fed Sloper that talks about this case inevitably goes back to the parents. They always go to the parents. Even if the 3006 damage doesn't look like 30 out 6 damage. His parents turned him in and they're going to testify again, even if it's really suspicious. All the things that were taking place on the stage around him. His parents turned him in. They're going to testify against him. They're on the witness. Well, they're not on this one. I suppose they could update the witness list between now and then. But weren't you told. Weren't you promised that this was an important part of the case against him? Grandpa. Grandpa's rifle. Dad recognizing the rifle, texting him in a fury, asking him where he is, Just talking about how he turned himself in. We. Oh, yeah, he confessed right to us. If there's some kind of trail or maybe they got some footprints or something up there, they might have captured that by drone or they just get a nice high shot that covers the whole campus. And they say, here's the menorah over here where Charlie Kirk was sacrificed. Here's the LOSI center over here. Here's the tunnel he walked through, you know, get. Just get kind of a lay of the land for the judge in case he, for whatever reason has not, not ever seen the campus. We got a photo of a screwdriver. We don't have a screwdriver. We got a photo of a screwdriver. We got a daytime photo of sniper perch. This is the corner of the building. That's what they're calling the sniper. Then we have a photo and a photo. I don't know, I guess these are night photos. If they're distinguished from daytime photos. I don't quite understand the distinction there. But nevertheless. We got a video of a mother and the child with a crowd. This is. This goes back to one of the counts. One of the counts that they've charged him with is committing a crime in front of a minor. In order to do that, of course, they have to provide evidence of that. This is a preliminary hearing. They have to show they are capable of meeting the elements of the crime. One of the elements of the crime is there was a child present. Well, here's a video of a mother present in the crowd. So that's all that is. We got a written, written statement of a Right. Notice he's not up here. So he's not going to be testifying. That's just a written statement. We got a video of the shooting behind the questioner. I imagine this is the one we all saw. This is the first one that made us all gasp in horror. Is. I'm guessing this video. This is going to be the. This is going to be the one from. I. I would guess just off center. We all saw it. It's. It was the ghastliest image I'd ever seen in my life at that time. Witness statement of T. The stool that Charlie died in, the chair Charlie died in to go up and capture the SD card. My guess is that's this footage. I don't know what other footage there would be from behind him. Unless there was there. There was kind of that offset camera over here, I guess over here actually to his back left. I don't know if on this reversed image, but this is my back left. Now, this is interesting to me because we have four photos of the rifle, two of them in bushes, two of them in the box. We've seen, I believe we were told, anyway, we saw the photo of the box. I'm hoping we get higher quality footage, higher quality versions available to the press. But I don't know that that'll be the case or not, because I've got a question about the safety on that rifle in its condition that it appeared in the New York Post. And the New York Post is just too grainy and blurry to see whether the safety was all the way activated or not. But it looked to me like the safety was in such a position that the gun couldn't fire. I don't know if that's true or not. I don't know if that's true or not. So hopefully we'll get a. A better, a better photo out of this if we're able to get a hold of these photos. We may or may not see these, but apparently these are photos of the rifles in bushes. So maybe they took a couple of snaps before they gathered the rifle up and put it in the box, and then took a couple of snaps of it in the box. Medical examiner's report. This is required, I think, at this stage. Pretty much you've got to prove he's dead. You got to prove he died by gunshot. Hopefully that will be clear and won't cause a bunch of chaos. UVU for surveillance from September 10th and doorbell camera surveillance. My guess is we've seen all this already. I don't know whether they have additional surveillance footage that we haven't seen. But we have seen the UVU surveillance footage, at least the snaps of him, somebody walking onto campus, another one of him or someone walking upstairs. And then finally we had that grainy, distant footage of. Of somebody appearing to scamper off the roof and scale down the roof like Spider man, holding on with one hand while he maneuvered his way around a building. My guess is that's the. Those are the bait stamps there. That's my guess is we'll see that or they, whoever's the judge will see that. The doorbell camera surveillance footage. I'm not sure which Doorbell camera surveillance footage. This is. My guess is it's going to be the one from 1150 ish in the morning of him limping down the street in front of the house where Phil Lyman was. We got a written statement of noble. I don't know who that is. A written statement by Mike Mitchell. This is important. It's important that it's not live testimony because I think this Mike Mitchell is the family friend who worked for the sheriff's department. I think that if I'm not mistaken, that guy's name was Mike Mitchell. So if we have a written statement from Mike Mitchell, this could be the first indication if we're allowed to see it, if we're able. If the judge doesn't close this off and seal all this stuff, this will be the first indication, at least from his perspective of what it was that Tyler Robinson was thinking, saying, feeling, doing in those crucial hours after he had arrived at home, after he had already gotten in touch with his parents, but before he turned himself in. It's interesting to me that none of these people will be able to testify. I don't believe what time he turned himself in because if this is just a written statement by Mike Mitchell, he can't be cross examined. And I don't think any of these people would have been at the Washington County Sheriff's Department. Notice the Washington County Sheriff's not on here. Notice nobody at the Washington County Sheriff's Department is there. That's where he allegedly turned himself in. Why aren't they there? Why is, why don't we get one of them? Not a written statement, not anybody. Well here's a. Oh, there's the video from there. We'll get to that in a second. The video from Washington County Sheriff's office on 9, on 911 obviously is not going to be allegedly the video of him turning himself in because we're told that was deleted. So I don't know that we will. The judge will see the video of him turning himself in. What they may see, what this may be is the video footage of him taking the Miranda. What other video footage would they have of him? They said all the surveillance footage was gone, it been deleted. So I don't know what else that could be and I don't know why you would have any video surveillance footage if you didn't Mirandize him there. So that's interesting to me. These are not the forensic reports that would come from text messages from, from analyzing the handheld device itself to see where the text message is generated from, maybe the IP address, what device they came from. All none of that will be available. We'll just have screenshots and if you've ever used Chat GPT, you know you can create screenshots in a heartbeat. If you've ever used an actual phone, you know you can change anybody's contact and make screenshots, say anything you want. So that's to me pretty lousy evidence. Discord Chat, same thing. You have no idea who's logged into a Discord. Discord is full of crazy people. That's where the loonies of the loonies hangout is on Discord photograph of the note. Well, I'll be gosh darn. We think the photograph was taken by Lance Twigs and he's not going to be available to testify on the photograph. FBI press release photographs. We've already seen those. And then we have some photos of of the rounds from the rifle. There's four rounds. I think one will be spent, three will be non spent. Photo of a round from the apartment meaning that they think they've recovered a similar round in the apartment. The photo of the burned note. This was a great deal of of hand wringing was over. How do you take a photo of a burned note? We'll find out. Is it partially burned? Is it completely burned? Is it just a picture of ashes? I don't know. We'll find out. Or maybe we will. Alleged targets. Then we had this DNA report, the FBI DNA report, the ATF DNA DNA report. One was on the rifle and cartridges, the other on the Talon screwdriver. I think there was a great deal of discussion last go around on these DNA reports whether or not that that the defense would have access to the methodology that was used to create these. Whether they would have access to all of the information. In other words, are they just going to have a DNA report that says yes, Tyler Robinson's DNA was present, or we believe it was. But we not going to tell you how we arrived at that conclusion. And we're not going to tell you if there's anybody else's DNA present. That's not very compelling to me. You certainly wouldn't convict somebody on that. But maybe it'll survive, probably will survive. The preliminary stage. We got a ballistics report. I believe we've already seen this. This is the ballistics report that's going to say they can neither confirm nor deny the bullet matches the gun. A DNA report on the Dremel and the cartridges, I don't know what that's going to show. That doesn't go towards shooting. And then the tool marks report. So that's it. That's how they're going to prove their case. I go back up to this right here because this is to me, if I'm a fed slopper, you should be embarrassed. You fed sloppers should be humiliated right now. I was promised parents testifying against him. I was promised grandpa testifying against him. I don't see Grandpa, I don't see mom and Dad, I don't even see Lance Twigs. We're gonna.
