We'll talk about. Why are they lying? Are they getting paid to lie? Why would anyone get paid to lie? That sounds demonic. You know, it's a sin. It's a sin. You're not supposed to lie. And if you get paid to lie, well, what does that say about you? Okay, so a couple of things here. A couple of things. Let me. Oh, real quickly. I gotta play this real fast right out of the gate. Diligent denizen is on the ground in Utah, apparently because he has been doing some excellent reporting there for the last few days. And today he was at cowboys smokehouse in Panguich. If you know your Tyler Robinson lore, you know that there is a tale being told that Tyler Robinson might have been in Penguins Utah at the cowboy smokehouse on the evening Charlie Kirk passed away. And the timing is relatively interesting to me. I'm gonna play this and let you know what he has to say. It's on his X fee, Diligent denizen, but go check it out if you want to. But I want to play this because there were a couple of things that caught my attention. Three things that caught my attention. What's up? You guys just left the Panguitch cowboys smokehouse. Spoke with the owner, Ralph Perkins for about 30 minutes. He said that he was not there the night that Tyler Robinson was purported to have been here on September 10th. But his staff reported that tower was seen there, recognized Tyler sitting at the end of the bar, and he did not have a name on the debit card that Tyler was allegedly to have used to pay for his meal. Said he was around here 9:30pm on that evening, about 30 minutes before they closed, had a meal, and then left. So I asked him if I could have A copy of the ticket he declined. Asked him if they had any cameras up that evening so that they did not have a camera up on the front counter. There was a camera sitting above the bar where Tyler was allegedly sitting. However, it was not working so. And when I looked up there today, there's only a hole up in the ceiling where a camera should have been. So that's interesting. He said that he turns it over to the FBI. The FBI never followed up. He also said that he is the owner here, is friends with the one of the FBI agents working the case as they are part of the LDS community. So kind of interesting how tight knit they are. Anyways, have a good day. Well, I have my doubts about several of the things that were said there. Not his reporting. I think his reporting was excellent. But a couple of things that jumped out at me. One is I've never used a debit card without a name on it. That would be the first. Maybe a gift card. You know, I guess if someone gave you a gift card and you go use it, it doesn't have a name on it. But typically a debit card is going to have a name on it. I've never seen a receipt that didn't have one. So that's number one. You know, you pay and then it, it has your name on it so you know that you're the one who paid. And then you sign it and they know that your name matches. That seems pretty standard to me. I don't know, maybe this is a cowboy. Things were happening weirdly in Utah. Maybe this is one of them. So that's number one that jumped out at me. Number two, the camera wasn't working that night. Why? What is this? Jeffrey Einstein. Is this the jail cell at Manhattan Correctional Facility? Why is the camera not working on that night? And why is there a hole up there now? Who took the camera? Long live the camera. Bring the camera back. Bring the camera back. Okay, so that's number two. Number three thing that jumped out at me. And I want to show you why this jumped out at me and why it is so suspicious to me. He showed up at 9:30. Showed up at 9:30, 30 minutes before they closed. Well, he also showed back up on Utah Valley University's campus at 12:30 or the House next door to his campus. And the problem with that is it's three hours away. It's three hours away. Three hours and three minutes if you take this back road. 2 hours 57 minutes if you take this road. So if he's eating dinner at 9:30. How is he back in Orem, Utah? And you'll see where this ends. I mean, it just takes you right next to where he was. Takes you right here. He was right here, you know, or right in this area. Right here. Like around, like one extra minute, maybe. I mean, it took you right to it. So why, how did he do it? How does he bi. Locating? How is he getting both places at the same time? I, I don't, I don't understand how that works. And then I guess if you want to throw away a line for a little extra fun. Utah's weird, man. Why is he tight? Why is the owner tight with one of the FBI agents investigating this case? And what does that tell us about the case? Does it tell you anything? It tells me quite a lot as a matter of fact. Because of this discrepancy on the timeline, you can't be in orem, Utah at 12:30 and on the road back to Orem, Utah at 12:30. You can't be in both places at the same time. So I think it'll be very interesting if he can tie down that timeline, because if that is an accurate timeline and the ticket would go a long time, long way towards telling us about what time he left. You typically pay at the end of your meal. Rarely do you pay at the beginning. Sometimes at lunch, I guess. I used to be a server at a little lunch place and we, we would deliver the ticket with the meal so that people could pay at their leisure and we wouldn't hold them up while they're trying to get back to the office or whatever. But that didn't happen at dinner time, you know, you know, sell them on a dessert or whatever. So I think this is a very interesting visit the diligent denizen is doing out there. Keep in mind, he's the one that broke two days ago. That Tyler Robinson's family absolutely 100% does not believe he did it. That the story that's being told that Tyler Robinson told his family he did it and that they turned him in because of that is a lie. It's not true. This is just good old fashioned gumshoe reporting. You know, just get on the ground, get in the area and see what you can find. That's what he's doing. That is what he's doing. Okay, I want to run through the theme tonight is the, Is the. I actually had a theme that was a little more foul, but I've, I've cleaned it up a little bit. These dad gum liars. These dad gum paid Shill liars. I'm sick and tired of them. It's just getting ugly. We're going to talk about a few of them today. We're going to talk about how shameless TPUSA has become in the wake of Charlie's passing, that they're not even remotely the organization they once were and how sad that is. And. And we got a little fun with airplanes, I think, towards the end of the program. So buckle in. Buckle in. I hope you. Hope you're seated. Hope you've got your seat belt fastened. Hold on. I gotta get this light fixed. It's always screwed up every time I go live. There we go. Let me get this. Let me get this open underway. I think it will be informative and entertaining because this is your opening statement. When supposed experts or analysts accept payments from the very industries whose products or practices they publicly promote, the consequences extend far beyond individual ethics. I hope you enjoyed the alliteration I put in there. That was for you, nerds. It erodes trust, public trust. It distorts the evidence base that guides things like policy and behavior. It's deeply dishonest. It leads to preventable harm on a mass scale. Without full transparency about who's being paid what and by whom. What appears to be objective, independent analysis is actually shaped, sometimes subtly, sometimes very aggressively, by financial interests. The harm is broad. It's multifaceted. It leads both policymakers and the public. It misleads policymakers and the public about risks and delay changes that could save lives economically. It can impose enormous costs through things like increased health care burdens, lost productivity, environmental cleanup. Socially, it undermines faith in institutions. It fuels skepticism that spills over into other areas when revelations eventually surface. And they often do, sometimes, though not until decades later. And sometimes it takes investigative journalism or even lawsuits or some sort of archival research. The damage is already done. Accountability is difficult to achieve decades after the harm has been committed. In the mid-1960s, concerns were growing about the links between table sugar and heart disease. The sugar industry founded the not so subtly named Sugar Research Research Foundation. Their job was to take proactive steps to protect Big Sugar. Internal documents show that the industry was alarmed. Emerging research, a lot of it linking sugar to heart disease and whatnot. We're starting to show that low fat, high sugar diets often raised cholesterol, caused obesity. And rather than fund a neutral inquiry, the Sugar Research foundation was born. It was funded Buy Big Sugar to do a literature review, and they hired prominent Harvard nutrition researchers. And the industry paid them handsomely. The Sugar Research foundation not only provided the funding, it also selected the papers that would be included in the research. It supplied critical studies for rebuttal of other research, and it reviewed drafts. And it explicitly directed the work of the scientists to emphasize things like fat and cholesterol as the primary dietary culprits. While of course downplaying and critiquing evidence that sugar might actually be the cause. The result was a two part review. It appeared in the prestigious New England Journal of medicine back in 1967. And it concluded there was no doubt that reducing dietary cholesterol and replacing saturated fats with polyunsaturated fats were the key that would prevent or even reverse heart disease. And it applied a very skeptical lens to any study implicating sugar. Crucially, the Sugar Research Foundation's role, including their funding, the influence, it was never disclosed. This was a standard practice at the time. There weren't as many conflict of interest requirements, disclosure requirements, those that existed were minimal. I don't want to say minimal, but basically non existent in most journals. Most physicians, nutritionists and even the public had no idea that this influential paper, this ground breaking study that helps steer dietary guidelines towards low fat recommendations for decades, was actually shaped, funded and created by big sugar. The 1980 US Dietary Guidelines. All subsequent advice focused heavily on fat reduction while ignoring added sugars. This contributed to a shift in the food supply. Believe it or not. All of a sudden, mass production of food that was low fat, high sugar started being consumed by everyone. It also happened to coincide with skyrocketing and unprecedented rates of heart disease and obesity. Revelations came only in 2016. Just 10 years ago, researchers at the University of California, San Francisco published an analysis of internal Sugar Research foundation documents. And the exposure highlighted how industry sponsored research had successfully cast doubt on sugar's hazards and promoted fat as the dietary villain and heart disease. Well, that's sugar. What about drugs? Well, by now we're mostly all aware of Purdue Pharma's handling of OxyContin and how it represents one of the most consequential examples of this type of pay to play fraud in modern pharmaceutical history. OxyContin was introduced in the mid-1990s. It was a controlled release opioid for moderate to severe pain and was aggressively marketed as having a lower risk for addiction and abuse compared to other drugs on the market. These are claims that company documents and later admissions by company employees showed were at best misleading. Company trained its sales force to tell doctors that the risk of addiction was less than 1%. It promoted the concept of Pseudo addiction. This framed behaviors like requesting higher doses or early refills not as signs of dependence, but as indicators of untreated pain. The antidote to untreated pain, of course, was even more Purdue pharma medication. Purdue funded continuing medical education classes. They paid key opinion leaders like physicians and researchers to be speakers and consultants. And they developed extensive promotional materials that downplayed the risks and emphasize the benefits of chronic non cancer pain. Benefits for chronic non Cancer pain It worked. It worked spectacularly. Too spectacularly. Sales exploded from the relatively modest beginnings in the mid-1990s to billions and billions of dollars annually. The wild success fueled even more widespread over prescribing. Most doctors and patients didn't have any idea the financial relationships and marketing incentives were driving the narrative. In 2007, Purdue and three top executives pleaded guilty to criminal charges of misbranding the drug OxyContin. The company later agreed to pay hundreds of millions of dollars in fines and settlements. Later revelations through lawsuits showed the company knew about diversion and abuse. But they continued the aggressive promotion anyway. And this campaign played a significant role in the global, and particularly here in America. Opioid epidemic contributed to hundreds of thousands of overdose deaths, widespread addiction, the hidden financial ties between the company and the experts shaping the prescribing practices, well, that meant that independent medical judgment was necessarily compromised. The patients ultimately were the ones who suffered. The company and the doctors did quite well during those years. Further settlements and bankruptcy proceedings in subsequent years underscored the scale of the deception. Perhaps the longest running example of this type of insidious behavior involves a chemical called tetraethyl lead. This is the type of lead that was added to gasoline back in the 1920s. It was a partnership between giant companies like General motors, Standard Oil, DuPont, and they did it through a company called the Ethyl Corporation. Even at the time, lead was known to be a pretty potent neurotoxin. There were even documented cases of poisoning among the workers who were merely handling the tetraethyl lead. In October 1924, a disaster at a Standard Oil refinery in Bayway, New Jersey, saw dozens of workers suffer lead poisoning. Symptoms were hard to miss. They included things like hallucinations, insanity, and several deaths. Several incidents occurred at other facilities. Rather than halt or even seriously investigate this widespread use of tetraethyl lead, the industry naturally downplayed the risks. They argued that the extreme dilution in gasoline made public exposure relatively negligible. At a 1925 U.S. public Health Service hearing, industry representatives framed concerns as limited to refinery safety. There was no broader public health concern, they argued, experts advocated. Experts advocating alternatives were marginalized. Public hearings were shortened or even canceled. The industry changed the name of the molecule from ethyl lead triethyl tetraethyl lead to ethyl. They promoted ethyl gas and they avoided the word lead in marketing. To prevent alarm, they influenced or supported research that minimized the dangers and even later attacked the independent scientists themselves. Their favorite line of attack, tell me if this sounds familiar was to accuse these scientists of being crazy or evil, or at the very least fraudulent or biased. For decades, most people, including drivers, parents and even many physicians, had no idea the extent of the lead gasoline industry's knowledge of their own products harm much less of the efforts to suppress concerns being raised. Leaded gasoline remained pretty dominant until catalytic converters necessitated its phase out beginning in the 1970s. The United States did not officially ban leaded gas until 1996. Long term consequences of the leaded gas that we all you were alive at the time all lived around Widespread IQ reductions, millions of premature deaths, increased rates of behavioral and cardiovascular issues, persistent environmental contamination. These are just three cases. There are countless more that shares striking similarities. Industries face inconvenient evidence responded not with open scientific debate, but with targeted funding, selective research, narrative control and secrecy about their conflicts. In each instance, the payments or the incentives were largely invisible to the public and even to many in the relevant professions at the time. Revelations almost always came too late, but they only came through persistent researchers digging into archives. Maybe they relied on whistleblowers or lawsuits, sometimes investigative reporting. And in nearly every single instance, it was long after the policies that were shaped had already accumulated harm. The broader lesson here is pretty clear. Undisclosed industry funding, undisclosed research, undisclosed funded messaging creates this systemic bias. It protects the insiders and it harms the public. The pattern has been perfected and unfortunately it's being pushed into non industrial usage. Tonight we'll take a look at a few of the people being paid to shape public opinion on what is perhaps the most high profile and consequential political event of the past several years. That is the investigation into who killed Charlie Kirk, how and why. That is your opening statement and it is an absolute persistent menace that so many people are on the payroll pushing this Fed slot narrative. Some of them now admitting they are in fact Feds. They're just flat out admitting it. That's where we've come and we're going to take a look at a few of them because I think that the same thing that caused the sugar harm, the lead harm, the the Purdue Pharma harm is taking place in this case, and it's doing it by design. They're taking advantage of people who don't have the time to go through all of the evidence and say, what the hell is going on here? Why does it look like this? I want to begin the process of going through it just like the. Just like we could not go through every industry where this has happened in the past. That will be the case tonight as well. We will not be able to go through every single interview or every single, excuse me, instance of this happening. But I do want to grab a few people. I want to grab just a few people, and I want to highlight them because this is who we're up against, and they're not being honest about it. For example, start tonight with a guy named get rid of the pop up. I'm on this poison site over here, tpusa. I gotta go tonight to our boy Graham Allen, Robert Graham Allen. This is a page of TPUSA contributors. You see these contributors here? These people are paid. These are not people out here volunteering their time. So when one of these people is calling you a bad name, let's go to, let's say Officer Tatum. Let's say you hear him go, mama, and he starts badmouthing you. Just know that that is an investment TPUSA has made into Mr. Tatum or Captain Jack, Agent Jack, as he likes to unironically call himself. But let's start with Graham Allen. Let's start here with Graham Allen. Graham is an interesting case, probably the most interesting case, because In February of 2025, February of 2025, at a time many of us suspect that the decision to remove Charlie Kirk from Earth was beginning to take shape. It was in that month, February of 2025, that the actual Pentagon, the United States Department of Defense, now renamed Department of War, I think renamed Department of War. I can't tell if it's Department of War yet or not, but they have changed the name, and I don't think it's gone through Congress. So I'm not. I'm not sure what it's technically legally called, but we'll call it the Department of defense, because in February 2025, it was still that conservative podcaster Graham Allen started a new job at the Pentagon on Monday as the Defense Department's digital media director. A defense official who was not authorized to speak on the record told this publication, Defense one. According to an email sent to the Pentagon's public affairs staff, Allen, quote, will further strengthen our ability to communicate effectively. The Official did not provide any details about Allen's job description. I've been asked by the President and by Secretary Hegseth to serve my country again and come to D.C. specifically to help with the Pentagon side of things, Allen said in a recorded message on his Dear America podcast. And that's all I'm going to get into there. Why all the secrecy, guys? It's a public position. It's a public position. Why are we being so secretive about it? Well, I'll tell you this. I've not seen any notice that the job is terminated. I haven't seen any notice the job is terminated. But Graham Allen is out there, and he's one of the chief defenders of the Tyler Robinson did it all by himself narrative. He's out there on a daily basis attacking Candace Owens almost on a daily basis. It's. It's pretty ludicrous. If you just go through his X feed, listen to his podcast. Oh, oh, about that podcast. We'll talk about that in a second. Here is an X post that Graham Allen put up that was, quote, tweeted by the Secretary of Defense himself. And he is looking awfully ominous in this tweet, if I do say so myself. Doesn't look like a very friendly character. I guess they let him keep his mohawk for some reason. As stated on my show this morning, I've been asked by POTUS and SecDef to serve on Serve My country again. When you get the call to serve your country, you answer it. Okay. You need to get. Well, I'm not gonna comment on this shirt. I will. You need to get the call to get a shirt that fits. Okay. Congratulations, Graham. Looking forward to working together to serve the country and American war fighters. That is noted Secretary of War Pete Hegseth, who still has not figured out how to do a full thruster to depth and extension. But that's. I don't hold that against him, ladies and gentlemen. Thrusters are tough. Okay, what did he do there? What did he do there? What did Graham Allen do at the Secretary of War or the Department of Defense? Well, we have an example or we have an explanation here in Yahoo. The Yahoo News, The X account known as the DoD Rapid Response has more than 155,000 followers and says it supports the mission of sex SecDef and fighting against fake news. It's managed by Graham Allen, a former conservative podcaster who's now the Defense Department's Director of Digital media. That's interesting. DoD Rapid Response. Is that kind of similar to the FBI Rapid Response that was trying to troll Candace Owens and was dropping all kinds of crazy stuff on her one day. That's a weird. That's weird. Why don't we just go fight wars? Why do we need podcasters tweeting for us? So it's so weird. Not. Not who I would call. I would not call him. I would call. I would call other people. It was while he was there that Graham Allen assumed an even other role. A new role. This is back in June of 2025. I don't know what this news publication is. Mighty Midas News. M E I D A S News. I don't know what that is. Mia Das this is Pete Hegseth allowed DoD senior advisor to enter Rumble streaming agreement Graham Allen mocked media and Pentagon staff while announcing his dual role. Oh, got a pop up. Oh, there we go. Graham Allen, the MAGA influencer and podcaster recently appointed to a senior advisory role at the Department of Defense under Pete Hexseth, has rejoined his Dear America show while continuing to work for the federal government as a special government employee without a salary. Huh. So I guess he got rid of his salary so he could go back into podcasting. But he stayed at the Department of Defense as Alan's dual role, Both as do DoD special government employee and right wing media personality, blurs the line between government work and partisan media. Allen originally took a break from his show to work for Hegseth at the dod. During his return to his show, Allen dismissed the authority of the federal courts while working for the Department of Defense, encouraged Donald Trump to ignore judicial rulings while working for the Department of Defense, launched personal attacks on journalists while working at the Department of Defense. He didn't spare his own colleagues either. Thankfully, the only the 0.03% of Pentagon staff whom he deemed competent and calling Washington D.C. the devil's butthole. This was his tweet here I want to say thank you to the 0.03% of people that are actually worth a flying. You know what, at the Pentagon, you imagine you're a lifer at the Pentagon. You're putting in work, man. You're 22 years in. You're just, you know, whatever it is you're doing, man, planning the next, you know, country full of brown people to invade and you're just doing your job, doing it the best you can. And some snot nosed brat who's doing a dual role working for the Department of Defense and some right wing podcaster is out here trashing you while a government employ. I don't know. And so is it any wonder while Graham. Why Graham Allen is so in the tank trying to attack people like Candace Owens, even took a sideswipe at your humble host the other day. Is it any wonder? Well, this is funny. This was in our archives. We kind of thought of this while we were putting this together today. This is a call log that we got a hold of. This is interesting. Now, this is Arizona time. This is Arizona time. So 11:30 17 on the day Charlie Kirk was taken down. This was 11:23am that he was taking down Arizona time. 12:23, Utah time. Seven minutes later, Graham Allen is on an inbound call with tpusa that lasted 11 minutes. And it was finalizing the contract agreement between Graham Allen and tpusa. Was he still working for the DOD when he's finalizing his contract with the tpusa, in other words? And I don't know the answer to these questions, by the way. I'm just asking them, I'm just presenting them in the order I find them. I. But it looks to me anyway like TPUSA has a DoD special employee on their contributor staff. It's just the way it looks to me. Just the way it looks to me. And they, I, I think he thinks this is some kind of flex. I think he thinks this is some kind of flex because he, he took to his radio show the other day bragging about being a DoD employee and what is a DoD employee but a. That's the definition of a fed, you know. So when we say TPUSA is pushing Fed slop, this is what I'm talking about here. Graham Allen is this, this, this guy on the left. I don't know who this guy is in the gold Texas Rangers hat on the right, but watch here as he explains proudly from his hotel room that he is in fact a fed. And he thinks it's awesome. Yes, my official title was actually Senior Strategic Consultant to the Department of War. But, you know, whatever. You know, who cares? Whatever, whatever. But before that, everybody knows this. I left the show for six, seven months to go into the administration completely abandoned me. The Pentagon. All right, but what she leaves out is the important context of what my senior strategic consulting to the Department of War, the secretary actually is. You see, she just says the title she left out for digital media. You see, my role at the Pentagon was senior strategic consultant for digital media or comms or press for rapid response. That is my role, not. I, I'm not sure what point he's trying to make here, because it's actually worse the more he talks I actually would rather you be war gaming and not not be on the payroll to manipulate the public. That. That would actually be an improvement. Graham, the fact that you're bragging and you think it's some sort of a. A mitigation strategy to say, no, no, no, no, no, no. I wasn't planning the invasion of Iran. I was just planning on how to manipulate the masses to support the invasion of Iraq or whatever it is you were planning. Hired to support. I was. I was just doing things like digital media, communication, social media, running the rapid response account on X. This is not. This is not helping your case, sir. Your case is actually eroding by the second sand tabling and war planning. She makes it seem as though I'm in the rooms where, you know, we're deciding are we going to bomb Iran again or not. No, no, my. My side is, hey, so and so from the media is talking a bunch of crap and nonsense. How are we going to strategically calm out how we go about this and how we communicate with the American people? I'll translate. Candace is out there saying Tyler Robinson didn't solely plan and execute Charlie Kirk. How are we going to plan this out with the media? That's exactly what he's saying he did. 100%. He was paid by your federal government to do this exact thing. And now he's on the TPUSA payroll doing this exact same thing. I don't think you're making your case any better, sir. I'm. I'm confident you're not. Now, I'm very proud of that work and it's. Well, at least he's proud of it. Very proud of the manipulation I gave to the American public. I'm very proud that I was able to snow them under as often as I was. I'm pretty good at it. You give me a BS set of facts and I will create a golden turd and I will. I will flush it down people's throats. I will make them love the turd. This is. He just outlined precisely what he's doing every single day with Candace Owens. And apparently your humble host got a. Got a taste of it the other day as well. He did this for the federal government. He did this for the feds. He was a fed doing this exact same thing. You get a bad set of facts that someone in the media is dishing out, I. E. Your humble host, Candace Owens, Zach Costello, Coach Collin, Project Constitution, Real Bayes, Danks, Jesse on fire, Valhalla, whoever. You get this diligent denizen, you get this bad set of facts and you gotta go and get a professional like Graham Allen with a mohawk. You get a professional to tell you how to turn it, how to shovel fed slop on top of it. How are we going to snow under the public and make them believe us over them? That was his role. That's what he's describing. Anyway. I don't think I'm misstating that. It's a very important part. But that's also a very key piece of information to leave out when you make a statement like the Department of War murder murdered Charlie Kirk. Do you know what Graham Allen was doing before Charlie Kirk was murdered? Senior strategic consultant for the Department of War. And then she leaves it to the audience. You tell me what that means. I, I'll, I, I'll tell you. I'll tell you what it means. Means you're a fed. I just made you a fed. That's all it means. It made you a vet. I don't care what the rest of your title is. Your job was to dish out fed slop. You're still doing it, sir. You are the king of fed slob. So I'm a little, I'm a little, I'm a little intrigued by these people that, that TPUSA has on the staff. We'll talk about a few more of them. I got two or three more of them lined up. Let's go to the next fed slopper in chief who's just out there promoting the TPUSA position day in and day out. The judge's opinion, apparently the group who was supposed to do the Still Photography on July 6 did not file in time. They Were supposed to file it 14 days out. They only filed 13 days out. And Judge Graff, man, he's no nonsense. He's not spinning helicopters in the courtroom. Not Judge Graff. No, no, no, no, no. This guy is all business. He said 14 days before these guys filed 13 days before they're out. There was no one else that filed for that day. So I don't know that there'll be still photography that day. I don't know how he's going to settle that. But one of the things he ordered was that the defense and the prosecution must get together and decide, for your sake and my sake, which of these exhibits will be permitted to be shown to the public. Because there's a list of exhibits. We'll show you the ones we that are already public. I don't know why they would oppose those. I will show you some of them. I'm not going to show you every single one, but they will. They're going to show us a list of exhibits. And the prosecution of the defense has until July 6th to come to an agreement on which ones they both agree shall not be shown to the public. I'm assuming things like, you know, morbid pictures and stuff probably won't be, but things like the photo of the screwdriver, I don't think that's been public yet that I've seen. So will we see it? You know, so let's go over a few of these real quickly, and I will give you an idea of what it is they're talking about. First, I'll just give you an idea of what this exhibit list looks like. The defense has already lodged some objections. These are theirs on the right. Don't worry about this column on the right. We've seen this before. You've got drone images. You've got screwdriver. We've got three different photos of the alleged sniper perch. We've got a video of mom and kids in the crowd that probably will not be shown publicly since it has kids in it. We've got a written statement of somebody named AW. This is. Again, this is all going to be hearsay. Of hearsay, and the judge is letting it in. We've got a written statement from TP Whoever that is. Those are initials. We have a video of shooting from behind a questioner. I think we've all seen this one. This is the one where the guy in the red hat is on the right. And it's probably one of the more gory and graphic images. We got the video of the shooting from behind Charlie Kirk, I doubt they're going to take the screen grab from Candace Owens which means the court might actually see that original photograph. I mean that actual video footage. Got a written statement from tpusa, a video of the shooting from behind booth. I'm guessing that's the booth out to Charlie's, left to his 9:00'. Clock. A photo of the rifle in the bushes and then three other rifle photos. That's going to be what was recovered across the street from tpusa. The medical examiner's report. These are not the photographs. These are just the report, not the video. We have surveillance footage from UVU and doorbell surveillance footage. I doubt we're going to see a bunch of that. Probably only the stuff that's already been made public and we may not even see all of that. We got another written statement. Another written statement. This written statement should be interesting. I hope we get to see this because this is Mike Mitchell. This is the retired sheriff deputy who allegedly drove Tyler Robinson to the Washington County Sheriff's office. And it'll be interesting if he includes a time. Much has been made of the time that Tyler Robinson showed up. The family is now insisting it was early afternoon. Well I don't want to overstate that. A member of the family is insisting it was early afternoon. It'd be interesting if there's a time in this written statement from Mike Mitchell. We got the video at the Washington County Sheriff's Office. That would be definitive. That's it. That's what we're looking for. That, that to me solves the case. Is it either a multi agency cover up or not or at least it solves the. If it, if it, if the video is the wrong time. In other words if the video comes from earlier than they told us Tyler turned himself in then the it's over. This is not a Tyler Robinson deal. This is a multi agency cover up and it goes all the way to the top. Then we have this very controversial recorded statement of Lance Twigs. We've got text messages between Tyler and Lance. We have discord chats. That'll be interesting to see which ones they show. Is it after we believe Tyler turned himself in custody. Photo of the note. This will be interesting. I would love to see this. I don't know that we'll be allowed to. That would be amazing to see. FBI released photographs. Then we have different rifle rounds from the rifle. Photos of them anyway. Photo of rifle round apparently that matches from the apartment. Photo of the Burton note from the apartment. Remember Tyler told Lance burn the note or get Rid of the note. Lance dutifully burned it, but not before he took a picture of it. And apparently he didn't spread the ashes, he left the ashes there. And it somehow is a, they were able to determine it was the note. We've got targets, presumably rifle targets in the, in the apartment. We have an ATF DNA report. This is DNA collected from the rifle and the cartridges. It'll be interesting to see how many different sets of DNA they've been able to gather. We've got DNA report from the Talon screwdriver. Again, is it just one set of DNA? ATF ballistics report. This is the much disputed ballistics report on whether they were determined a match between the rifle round and the gun, the purported rifle round in the gun. We've got an ATF DNA report, an ATF tool marks report. That'll be, that'll be interesting. So that's what they are going to have to get together and decide on. Which of these are they going to allow us to see. Well, some of these we already know. For example, we've already seen some of this. Like there's no reason to hide the drone footage. It's right there. Like we have it on our computer. So you don't have to hide the, the UVU police drone footage. We already have the drone footage. Do we have even more? Yeah, yeah, we have other drone footage. I think this was a news drone copter here, but this is other drone footage from the scene. You can see the LOSI center building here. You can see, this is the hall of flags running behind where the tent is. You can see the tent poking out there. It does not show the LOSI center, but it shows the walkway beneath the LOSI Center. So we have a lot of this drone footage. We even have drone video. I don't know if this is the drone video, but here's another picture from the scene. This is again drone footage from the scene. You can tell it's in an elevated position here. I want to say this was news because this, this cop here was not amused with this drone. At one point she waved it off and it went away. If you look at the video, but you can see even late into the evening, you got lights on down here on the left hand side under the hall of flag. So it's obviously late into the evening and, and there's still hats sitting out. So the scene has not been cleaned up. I think you can even see a camera right there. The, the speakers are still up. I mean this is, this is very much still a, a Live scene at this moment. So in other words, why would the defense or the prosecution object to showing drone footage is already public? That doesn't make sense to me. The screwdriver photo would be interesting. The radio scanner said nothing was found on the roof. If you listen to the original radio scanner, the guy gets up there and he's looking for rifle casings. He mentions nothing about a screwdriver. He doesn't mention anything about a screwdriver. Now, maybe he wasn't looking in the right spot. Maybe the screwdriver is located somewhere else. So it'll be interesting to see the screwdriver photo. I think that would have great public value. No, I don't want to play this. I don't want to play the audio. But it's. It. It's interesting to me that they have a. A photograph of this screwdriver. I'd be very curious where it was found, because if it was found near the actual perch near the ledge where the, where the. The shooter allegedly took the shot. I hate to use air quotes so much, but I don't buy any of the story. It'd be interesting to see the photo because if, if, if that's where it was, why did they not find it? When they went up there? They were up there looking for rifle casings. Why. Why did they not find the screwdriver? They say, oh, there's no rifle casings, but there's a screwdriver. It's right there. They didn't say that. They didn't say that. We have the pick of the rifle in a cardboard box that the New York Post has generously provided the public. I don't know why it's always the New York Post that gets these leaks, but there it is. This is interesting to me. The only reason I'd like to see this image is if they have a higher quality image. It's hard to tell with the shadowing and all this, where the scope, the outline of the scope is, and what type. More importantly, you see where my mouse is right here behind the bolt. See this large. Okay, everybody knows where the trigger guard is. See this circle down here in the trigger guard? Right above the trigger guard is the bolt to fire this weapon or to chamber around in this weapon. You have to lift the bolt up, pull the bolt back, and then shove the bolt back forward and push the bolt down. Now you're ready to fire. But right behind the bolt, right here, behind the bolt, is the safety of this gun. That's where the safety is. Now, historically, if you have an Original of this vintage model. The safety is very tall and it has to go all the way to the left in order to fire. It's all the way to the right. Right now I think you can see it, it looks like it to me. To fire a Mauser, that safety has to go back up into the top position and all the way to the left. It's a three part safety. On the left bolt can open, gun can fire. On the right on the top. If it's sitting straight up, you can open and cycle the action, but you cannot pull the trigger. It disables the trigger. I wouldn't stand in front of it. I mean, not that confident that it disables it, but it disables it. In theory, it disables it. And when it's all the way to the right, you can't do either. You can't open the bolt and you can't fire the trigger. You can't engage the round. Well, if that safety is all the way to the right in this condition and the scope prevents it from going all the way back to the left, how did he fire the round? And so I think this is very interesting. This is a blurry, grainy image that New York Post has given us. We have asked them or not. We, Daisy, Daisy's asked them every which way she can and asked everybody, I think who works at the New York Post, can we get a clearer image? And all of them have ignored her. But a clearer image might tell us whether or not this rifle even could be fired in that condition. Now to be fair to the Fed slobbers, you can take off that original very tall safety and they make a very short safety. And that short safety allows a low profile scope, which is what that appears to be. And it still allows you to turn the safety into the three positions. But you can't tell from that grainy image what it is. So that, that's, that's an image I hope they release to the public because I think that's a matter of great public importance. Could this rifle even be fired? And it's not gory. You guys are claiming it's a rifle. So I don't know why you wouldn't be able to show us the rifle picture. Why would anybody oppose that? I mean, we on our side of the aisle who. Or at least I don't speak for all of you. I don't believe Charlie Kirk was shot with a 30. Got six. I just don't, I don't, I don't think it's possible, however, I Would love to see a rifle that could at least make the shot, that could at least fire around if it wanted to. That would at least allow me to inter keep entertaining the possibility perhaps he was shot with a 30 out six that acted in an unbelievable manner in his neck and did not go through. I would at least have that possibility floating around. But if you show me a high quality image, and that's a high pro, that's a long, the original safety and it can't even go past the scope. Well, we got a problem on our hands, ladies and gentlemen, so that'll be interesting. I think that would be one that, that I would really like to see for sheer news value. And I only display that for news value. I mean that's why, that's why it's there. Messages between Tyler Robinson and Lance Twigs. We already have them, so why wouldn't you show them to us? We have. Well, we have a bunch of them. I don't know that we have everyone that's ever been sent, but we have a bunch. Look, all these are text messages between them. So why wouldn't you just show us the text message? Why is that a, a closely guarded state secret? You already gave us all these. The only thing that you could possibly give us are additional texts that are unrelated. Okay, redact them. But what we might be able to tell from looking at the images of the text messages timeline. What time were these texts sent? Then we can begin to build out a timeline that's a little more accurate for the day of. We can guess when a lot of these were sent, but guessing isn't very helpful. Guessing isn't very helpful. They have the ATF DNA report. The ATF DNA report. Well, we have pleadings that quote extensively from the ATF DNA report. We even have correspondence back and forth that includes, That includes ATF data. So, so why wouldn't you tell us that? Because I do remember everyone was shocked last time. I'm not going to scroll through that and show it, but I, I do remember everyone was shocked when in open court the defense lawyer was questioning one of the. I think it was a police officer. And the state had the police officer say that there, that Tyler Robinson's DNA allegedly was on the, the rifle. And then the defense lawyer gets up and says yeah, but five other people's were too. Right? And he said I can't comment on that. He said, oh, you can comment when it's only Tyler's, but you can't comment that the. About the other five people that were found. Well, that Was a huge bombshell into this case. Whose DNA was that? Have we been able to track down those people? Is it people like Lance Twigs? Is it unknown how many people are handling this rifle? Is it. Are they related to Tyler Robinson? That would be helpful. Like if we, you know, maybe granddad's DNA's on there. Well, we could probably rule him out as a suspect for setting up his own grandson, but what about these other people? Who are these other people's DNA? They mentioned there were two videos that they were going to show of the shooter on the roof. Well, we've seen one. We. I think we've seen them both. I'll show you the first one here. This was from inside the hall of flags. Immediately afterwards, you guys remember this video? I'm not gonna stop it and all that? We're right there. That's one of the two videos we have of the shooter on the roof that we know of. I hope I played that. Did I pull a Baron? I don't think I did. I think I played that. We have yet another video of the shooter on the roof. If I can get this one pulled up and shared appropriately. This one is actually probably the most interesting one to me of all three can ride up. Yeah. You think he'd already be in place. You would think that. So there's somebody on the roof over there. Just saying. He just ran from over. Where's my finger from? Over there. Ran in. Now he's right there. Just saying. Just that's. That's interesting to me because it gives you an idea of how long that guy was actually on the roof in that prone position because he sees him run, he sees him lie down. He has to get out his phone, open his camera, get it up there. And that's a 20 second long video right there. And there was no bang in that video. So that's at least 20 seconds. We know the guy was lying down prone in that position. If. If that's. If that's an authenticated video or authenticatable video, assuming you can figure out who that is. I believe Candace has talked to that guy who took that video, and he was some sort of a firearms expert. And he actually sent her a note that she showed on her screen. We got a screen grab of it here. He actually sent her a note of his opinion, his expert opinion. I will call him an expert. Watching the video of the impact, hearing the sharp crack instead of a big hunting rifle's boom and seeing what looked like a shorter rifle platform, albeit with the absence of a shape of a standard 30 round magazine. The assassin may have used a 10 or 20 round magazine, only expecting to shoot once or twice. I would guess that he was shot with a Hornady VMAX or similar lightweight.223 bullet designed for a very rapid expansion. Of course, I don't have access to any autopsy reports like you might, but if they found a small sh. If they found small shards of copper rather than one large copper coated lead slug, that's the gun and bullet I would expect was used. So this is a firearms expert saying that did not look like a Mauser 98 and it didn't sound like a.30 06. Sounded different. That's consistent with a lot of other witnesses at the scene who said it did not sound like a big boom, sound like a firecracker. One guy said it sounded like a cherry bomb, another person said it sounded like fireworks. All very consistent. Now, there is that one other video and I'm not even gonna play it because it, it's so lousy. You can't say anything of the guy running across the roof from the part from the, across the parking lot. And they zoom in and they follow him down. That's the one where he scales off the roof like Spider Man. Those are the only three videos in existence that we're aware of that show a shooter on a roof. Can you say beyond a reasonable doubt that any of those three were Tyler Robinson? Can you say that? Maybe I will show it if I can find it quickly. No, I can't. Yeah, there it is. Now, if, if you were in court and someone said, I need you to put this guy to death, this is the evidence. Can you state with certainty this is Tyler Robinson? This is the evidence. You're. You've got a guy who's now missing. Here he comes, pops out the other side. That's him there. Can you state beyond a reasonable doubt, that's Tyler Robinson? Is there anybody on earth who would look at that and say, yep? There's not a single reasonable person. There's not a single reasonable shred of doubt that that's Tyler Robinson? I am 100% convinced that that is Tyler Robinson. What about that hall of Flags video I showed you where they, they panning across the crowd and you see a little figure in the background, he's about that big, running across, scampering across for about half a second. Anybody on earth who would look at that and say, yep, fry him, strap him in the chair? No. What about that guy who had the video of him lying? I said, is that somebody on the Roof. He didn't know there's a person. Is that somebody on the roof? It looked like somebody ran over here and laid down right there. Is that. Is that a guy on the roof? So when you talk about. Hey, hey, hey, hey, hey. You guys are being totally unfair. It's. It's open and shut case, like Brandon Tatum said three hours ago. Open and shut case. What is. What's an open and shut case? What's the open and shut part of this case? How is it open and shut? That. That is Tyler Robinson. Well, Baron, they found a shoe imprint up there, okay? A shoe that nearly everyone owns. I own a pair of Chuck Taylor's. I'd like to see the shoe imprint that they claim is so clearly Chuck Taylor. Now, maybe they have additional evidence. I don't know, but you don't either. And that's the point. That's the point. I don't know what other evidence they have. Maybe there's a video camera right on the roof, and Tyler walks up to it and goes, hi, Mom. Maybe, maybe. Maybe there's a. A. A, you know, right on the ledge. Tyler put all 10 fingers and just, like, carefully touched the ledge and then, like, carefully lifted up, said, ooh, I bet those fingerprints are perfect if you've ever been fingerprinted. And I have been fingerprinted. When I became a lawyer, I had to go get fingerprinted to get a courthouse pass. I don't know why, but yet I did. For whatever reason, I had to go in, and I think I had to get fingerprinted for the bar, too, but I know I had to for the courthouse pass. And I had to go in there, and they, you know, they roll your fingers out one at a time, and then you get this black smudge all over, and they do your other hand, they roll them out one at a time, and that's. That's the fingerprint. Maybe Tyler's up there rolling his finger out one at a time on the ledge, and it's just indisputable that nobody. All ten match. All ten fingerprints match. All ten of Tyler's fingers. Maybe. But I don't know that, and you don't know that. And so if you come and you say, oh, I'm confident he did it. How? What do you have? His DNA was there. It was his gun. Of course his DNA was there. His DNA is all over the rifle. Yes, that's correct. That's correct. Just like if you grab my water bottle and take it to the scene of the crime and leave it there, my DNA will be all over it. My fingerprints are all over it. My DNA is from where I'm drinking out of it. It's all over. It. Doesn't mean that I drink water at the scene. Doesn't mean I was even at the scene. And so what we're talking about here is reasonable doubt. Reasonable doubt. Right now, there is a mountain of reasonable doubt that Tyler Robinson solely planned and executed Charlie Kirk with granddad's 30 out 6 from the Losi Center. A mountain of reasonable doubt. Maybe those holes will get filled in as time goes by. Great. But if you're frustrated that we keep saying that, why are you guys saying. Why are you so confident he did it? The evidence doesn't seem to suggest that yet. If you're, if you're frustrated by that, sit back and shut up. Wait, wait, Daisy. I may hold off on section five here for tomorrow. All this, I don't think I can do this quickly. And we're already an hour and a half. It'll be interesting to see what happens next week. Be interesting to see what happens next week. Keep in mind, this is not a situation where it's a public trial and you have to bring in actual witnesses and you have to cross examine them the way that you would at trial. The judge's responsibility is not to weigh the evidence at all. It's just to merely say, is this, did the prosecution produce anything? Did any have to fit the rules of evidence? Did they produce anything that I can hold this guy against his will and, and declare that he has to go to trial? That burden is so low. So low. I'm intrigued by the fact that Erica Kirk is going. I assumed she might. I think I made that assumption a week or two ago. I assumed she might go, but I'm very intrigued now that she is going. Because it's a five day hearing scheduled for five days. I don't know that it'll last all five days. But is she planning to be there for all five days? Is she going to stay at the, the Quality Quality Inn in, in, in Provo? I mean, you know, it seems a little bit either. We'll see. I don't know if she's just gonna pop in, make an appearance, or leave. We'll find out. I would suggest, if I was her attorney, I would suggest that she should stay for all five days. I did find one thing very interesting. So the crowd is being told not to take phones into the courthouse. I think that's fair. Most courthouses have that rule. You can't take. You can't take your phone in the courthouse. Most courthouses have that rule. As an attorney, I've always been able to take a phone into the courthouse. You just tell them you're an attorney at the thing, and you maybe show them a bar card or something, and then, okay, sorry. And they let you in with the phone. I have been in hearings where even as an attorney, I was not allowed to have a phone. There was a trial 15 or 16 years ago in the federal courthouse in Alabama. It was a big gambling case, lots of national implications, huge claims both ways. And I tried to take my phone in, and they were like, you can't take your phone. I was like, I'm a lawyer, and I'm digging out my bar card. He said, I don't care. He said, are you working on the case? I said, no, just here to observe. He goes, no, you can't take your phone in. I was like, really? Even as a lawyer? He's like, no. So I had to walk it back out to the car and, you know, put it in the. Put it in the glove box. I noticed that Erica Kirk's lawyer, not Tyler Robinson's lawyer, not the state's lawyer, but the one of the four lawyers she has representing her in this case, specifically asked the judge if he could have a telephone. And I couldn't figure out why. And then I started thinking, wait a minute. This is perhaps the most awkward grieving widow of all time. This is going to be a televised event. They're going to have live video footage going pretty much the whole time. It's almost assured that at some point the camera will swing over and show her. And I'm assuming they want feedback. That's the only thing I can come up with. Why he would have to have a phone is so that somebody could say, get her under control. Get her. Get her. Get her to brush her hair. Tell her to take her, you know, 75 rings off her head. I don't know what they're going to tell, but. But I could see them wanting instant feedback of how she looks on camera to make sure she doesn't look like a total psychopath, because it would hurt the case. It would definitely hurt the state's case if she. If she came in there and looked ridiculous. Hopefully she doesn't show up dressed like the Italian server that she showed up with the black ball cap and the black suit and the black pants and, like, scowling at the camera, hoping that's not how she shows up. If they pay me the 15 million that I've all that. It's gonna cost more than that. We're up to 25. Give me the 25 million and I will help her pick out an adequate outfit for the occasion. I will talk to her about what is and is not appropriate in court. But I'm not doing it for free, so I'm not going to give you my advice here. And so you, you, you have to find some sort of non compromised person with, with the jurisdictional ability to get him immunity.
