Well, if you tuned in to yesterday's episode, which I'm sure you did, this is part two. And when this, this horrific case, no matter what, there's no winners in this case, period. And, and allegations of child sexual abuse against a father. First it was a, you know, part of it was against a grandfather, et cetera. But I have side Aquila, the defense attorney for Mr. Mansell on the phone and we're going to be picking up where we left off yesterday, which is you heard everything that happened and how the police interviewed and all the different interviews and how the statements have changed and what, how the judges erred on the side of caution given the mother custody, et cetera. And now s back in court and the other half's not there. He files for you. Take it. Sigh.

So then it gets set for a hearing on April 29th.

April 29th. Mom does show up, has her new attorney. And instead of having a trial on the matter, we all go in the back and. And. And we have about an hour and a half powwow. Myself, her attorney, the judge, Dr. Alan Taylor.

So her attorney. Her attorney is a personal attorney. It's not, it's not a. It's not. It' attorney. That's. That's bringing forth the charges, y'.

Which in east west west FL would be Sam dequilla, but not. Not the same guy. Go ahead, S. So you having a pow wow. What happened?

We have the pow wow. And judge, Judge, I mean, Dr. Taylor basically lets her attorney know that this is the worst case of parental alienation that he's ever seen. He's recommending that my client have sole custody. He did. He did allow the mother to have visitation every other weekend from Friday afternoon at 6pm to Sunday afternoon at 6pm but that is the only contact she is to have with the children. This was to be a trial period for mom to one, accept responsibility for her past action or at least acknowledge them, and two, give her an opportunity going forward to try to fix it. He also put in place that the parties were to go see a parent and coordinator, which was ordered in the last in the first judgment back in 2022 that the parties went to that mom stop going to because she didn't like what the parenting coordinator had to say.

Same thing holds true for children's counselors.

Real quick because it's important side parenting coordinators. That's. Tell them, tell them about that.

The parenting coordinator is a mental health professional that works with the parents to resolve any conflict dealing with co parenting.

Yeah. Helps them help some with everything from doctor visits to school to extracurricular to everything dealing with. They help them learn how to co parent.

Right. And again, this is. This is. Well, this was ordered by the court.

Absolutely.

All right. And again, it's ordered by the court and book. You know why? Because these judges. No judge wants to see a baby get raped. But go ahead.

Yeah. So anyway, puts that back in place. Dr. Taylor recommended a counselor for the children to go to. Mom had changed the children's counselor two or three different times. Every time the children would get comfortable with the counselor. Mom would come up with this crazy idea that dad had an inside loop on them and she didn't trust them anymore. So she changed another counselor. Like she tried to change the parenting coordinator, but the court wouldn't let it. And then Dr. Taylor also recommended because he spoke to mom's counselor, and he said, mom's counselor does not have the backbone, nor does she know what she's doing to try to deal with mom going forward. So Dr. Taylor's giving them recommendations on the council that mom needs to go to.

Okay. We enter into a stipulation. That day in court, mom agreed to it. Dad is the sole custodian. She only gets every other weekend from those time periods. No further contact. She's got to work with the parent coordinator. Child's got to go see the child's counselor. Mom's got to go see a new counselor. Agreed to all that.

And that's. And again, that's. Y'. All, that's in the best interest of the children. Right. When there's questions, the court, it wants it to be in the best interest of children, not just her attorney or the doctor or, you know, or Cytoquila. It's the, you know, the court is like, okay, I. I'm getting down with this because it's the right thing today.

That is correct. So that's what people don't understand. We've got one, two. Two mental health professionals, Dr. Taylor and Renee McCarthy, the parenting coordinator, all saying that this is the worst case of parental alienation that they've ever seen. The courts ordered that the children go to these counselors, ordering that mom goes to a different counselor. So we've got a bunch of eyes on this, right? Everybody knows what's going on there. They all want to open up. Okay.

So we're set for trial on that on June 22nd. Now, whenever Judge Jones granted the ex parte custody application there when. When. When my client was arrested on the criminal charges, the judge had just put a condition of his bond obligation that he wouldn't have any contact with the victim. Well, that day in chambers, we contacted the other judge and let her know what was going on. After we talked to Dr. Taylor and said, look, well, I'm going to grant the export take custody to Mr. Mansell if you lift that bond obligation.

Yeah. The other judge is Judge Sidney Walker.
Side Aquila (Defense Attorney)
Walker, that is correct. And she's definitely been in the trenches in family law. She definitely knows Dr. Allen Taylor. Judge Walker is the most experienced judge. Had probably had the most experience as being a family law practitioner before becoming a judge. So she knew what was up, so she lifted that. That order.

And I'm. I'm gonna go on the record and say she's one of the toughest but most fair, but definitely toughest that there is. But go ahead.

this after she agrees it to it in the courtroom there. Right?

Yeah. Well, when? From April 15th to April 29th. Yeah, she didn't. She didn't agree to it at that point. But then even after she agreed to it on April 29, even coming into today, she's still doing it.

Still doing it. So then. Then of course, the news media starts putting pressure on the district attorney. Like, what's going on? Oh, wait, let me back up. Probably one of the most important things in this case, on April 15, when my client goes and picks up those children, within hours of, like an hour or so of him having his oldest daughter back, she breaks down and cries, apologizes to dad for saying the things that were not true and asked dad to please forgive her.

That's heartbreaking. Yeah.

Okay, then ask dad to please forgive her. My wife also practices law, and she's. She's got a psychology degree. And we. I asked Jacob to bring the oldest child in. Did you just come in to talk to Heather? To feel, you know, so that way she can know, hey, look, you're not doing anything wrong. None of this is your fault. Blah, blah, blah.

So yeah, no dude, it is disheartening to see that that it, it could got to that point but it's gotten worse since then, right? Mom contacted media media's on the phone with district attorney saying district attorney, what's going on? District attorney says well I didn't know about any of this which is because I told him prior to he knew about it. But anyway and of course he's getting pressure, he's getting heat from the media. He doesn't want to be thrown under the bus in the media. So of course he's got to say well I'm going to do what's right. I'm going to do what's just blah blah blah. So he, he's Monday he filed a motion to reinstate the bond condition and tries to say all these other things that Sidney needs to do and whatever else.

Right. So let me and talk about this real quick. Let's go back to the media media personalities now. Karanchala, the ad I watched your, you know, your Facebook post. Etc. I've known her since she was a cub reporter. She and I actually have a very good working relationship and everything. But here's the deal. You're only she's only as good as the information that she's given now the, and so if they're going off of. I mean, you've, that's why there's such a show on social media about this, because they're only given what Karen and them have been giving them and.

No, no, I gave them the information.

The, the. Okay, but you, you gave them the information after they called Sam or.

Yeah, like, I. So April 15th, Corona sends me a text message asking me all these questions about how does my client get custody when he's got these charges pending and mom didn't know about the court date.

Yeah, well, I don't know about the mom knowing about the court, David, but I think the rest. That's what I'm saying. I think the rest of that is a legit question coming from her. But the part that she's saying mom didn't know about the court, they mean she's being lied to about certain things. But.

I sent her the pleadings that we'd filed in this thing. I sent her Dr. Taylor's report. I told her all the facts that went on behind it. I told her what Dr. Taylor said. I told her that everyone was on the up and up and extreme and very aware of all these situations. I told her my client passed the polygraph test. I told her that the minor child recanted her statement hours after dad had the child back in her custody, crying and apologizing and asking for forgiveness. She knows everything that I just told you guys, except for probably what was in that police report.

Right. And so she knows everything, but in, in her report that she came out, she didn't acknowledge any of that. I mean, I'm asking. I, I, I didn't.

No, she did not acknowledge that the, the, that the child recanted her statement. The only thing she acknowledged was what I told her was that Dr. Taylor wouldn't have recommended the children be in the custody. My parent of my client, if anything would happen to him, and, and Judge Jones wouldn't have done so.

Right. That's the only thing she did. And what, what aggravates me, Woody, is that the, and I know it doesn't make a good story.

Did they got a bash a judge, or they got to bash somebody to make it, to make people look at it. And I'm sick and tired of that. I see it go on too much in, in our legal community and especially with these two judges that we have, Judge Betsy Jones and Judge Sidney Piku Walker are Two of the best judges I've ever practiced in front of. Yeah, they're gonna shoot you straight and they gonna. They gonna apply the facts to the law and make a ruling that they can live with. And they're definitely not going to put a child in harm's way.

Right. And I know I'm both y'. All. I personally know them both and I can vouch they're legit as legit gets. Almost you would say to a fault sometimes, oh, one err on the side of the caution and let the court system play it out now. The. The. But I was getting that sigh all the people that are blowing up immediately and. And automatically slamming the judges and you know, saying this and they must be getting paid off and he must be members of the family and da, da, da. That's what I call keyboard warriors. And I've been dealing with that the last eight years since I put myself in the public eye. And I don't even respond to it. I just let. Yeah.

It's ignorant. And they've got. They're sitting in the recliner. They have no skin in this game. They have no knowledge like you shared in the last two days, yesterday's episode and today's episode. They have no direct knowledge and they further that they have no knowledge of working these type cases before. Unfortunately, y'. All. This shit happens in the. And when. Even though I've done it on law enforcement side, I've done it on the criminal defense side. And I will tell you the. The When I do polygraphs. Probably 80% of all the polygraphs I've ever done have been child sex accusations. And probably 40, 30, 40 of those are false. And it's always a bad custody battle or, or, you know, the girls of a. Or the kids of an age now where they got to go spend the weekend with daddy, but daddy won't let the boyfriend come spend the night, but mama lets the boyfriend spend the night. It was always some type of shit show and they. They cry out. Doesn't make it right. And it always sucks. But you all people here, regular people side that have not been through it like you and I have. And these judges have the. They hear child molested by father or raped by father and they want blood. And then so they hit hide behind the keyboards and they're like, oh, this is. And this is a fix and this is this and this is that. And I'm telling you, never believe anything else. I tell you that these judges and. And I would stand up hindsight A thousand percent. Also they are trying to look out for the best interest of this kid. Now Sam coming out after the fact, him not knowing about it or whatever. Even if you say he did, he has got to to stand up and do his job too. The. And but the thing is the people don't know what they don't know. But let's. The as. As far as Karen goes. Karen, Karen, you want to come once sometime and and. And talk to me? I'd be more than happy to do that with you about this case. And you know, you certainly have my phone number. And what about the. The lady from Channel 2 WBRZ.

She interviewed the mother of the child. I mean what that if that's not so one sided. And, and. And the mother up there sobbing and the mother lied while she was on there. She said that the doctor that evaluated. Well for one the child never got evaluated by a doctor, M.D. Dr. And two that oh it's been happening since your child. Since she was 10 years old and it was her dad.

And she started out crying out against being the grandfather and later on changed over to dad. But I'm gonna tell you y' all this and this is the truth too. And I'm not saying. I'm certainly not saying this. This baby wasn't offended against by someone. But the. A lot of times on the law enforcement in when these children would do the cryouts and they would get him in for the CACs, et cetera if something had happened to him. But they would always name a person. Not always. A lot of times they would name a person that they knew was not going to harm them to be sitting in that room telling the truth. Right. Meaning they, they would name up like it was. It was my. You know because they were. They've been threatened this search secret if you tell anybody, you know, I'm a hurt your parents and what have you. These are real cases that I've worked and so the, I mean it's just. It's just some total crazy should show. But she didn't offer to interview you or your client but gets the mama one. Was there a video of that? Yeah, I, I'm not gonna lie to you. I hadn't watched it because I've been busy as. But the, the. So I will watch that and so so where, where we stand now with the. You tell me what you think this

is what I think. We're gonna have a hearing here pretty soon on. On the criminal aspect of it, and I'm following for a preliminary examination. We're going to have that heard on the same day that this motion that Sam just filed to reset the bond obligation and he don't have any contact with his children. We're gonna have a hearing that day.

And I don't have a crystal ball, Woody, but any judge with these set of facts would say there's no probable cause to hold this man under a bond obligation. None whatsoever. Had. Had. Judge Walker, had the entire police report that I just got two days ago or yesterday, whenever it was, had all of that been submitted to her, I doubt she would have signed the damn arrest one.

And that's what. That's, you know, that's just what aggravates me, that. That people don't do what they're supposed to do. If that's all you had say, look, this is. This is what I have, Judge. This is all of it.

You let the judge make the determination or whether or not there's probable cause to arrest that man. You don't just take bits and pieces and. And put it together and don't give them the whole story.

It's confirmation confirmational bias. Right. They taken the choice, selects for them, then maybe they did believe. Maybe the detectives who kept interviewing the child who shouldn't have been interviewing them, maybe they, you know, maybe they believed in them. They. Maybe they want the pieces to fit or whatever. But you don't ask the same question over and over again. I mean, it just doesn't happen. It's not supposed to, you know. And when is that? When is that court date?

Yeah. And they haven't read all the reports. They don't know all the times the stories change and all the different things and the rules on who should ask questions and who shouldn't ask questions. But I really, really. I mean, the whole thing kind of pissed me off, but when they start talking about Judge Jones and Judge Walker, I was like, oh. And they're not like, They're. Pardon, my friends, my listeners know I curse, but the. They know I. I would not believe that either one of them would ever take to any type of social media to defend themselves. Right. Because they're judges, and I get that, especially in an ongoing litigation case. But to be ripped to pieces and shreds like that. Come on, man. They do. What do you think? What do you think? Do the judges wake up in the morning, they're taking a payoff to. To, you know, let the kids go to one house and not the other, and then, I mean, get the fuck out of here. Right? Yeah, right? There you go. Yeah, the old outlaw. But. And. And I'm like, man, you know what? They can't defend themselves, so I'm gonna defend it for them.

For you. I practice in front of these judges all the time, and they are the fairest judges that anyone could ever ask.

Yeah. Yeah. And you know what? Every judge gets something wrong at some point in time or whatever, but it's not. It's not exactly what I said. Time. That's why you have appeals like Murdol or this dude, this idiot. I mean, I always knew he was guilty and everything else. And you know what? He gets a new trial because that did whatever outside the quorum. Great. Let him have a new trial. They still going to come back and find him guilty. Yeah. And that's what you have the appellate courts for. But these two ladies, come on, man. They. I mean, I've known my entire life. And look, I'm. I'll go on record say my daddy's daddy was the judge on the same bench those two ladies sit on now. And my mother's daddy was the DA in the same two courtrooms, I think for like 30 years that, you know, they're in front of now. These people are not evil. Let the system play out. Let it work.

Yeah. And. And at the end of the day, you know, whatever the system says is what it says. But I'll tell you this. And I think you did this already. I, I think. I'm pretty sure I read it. No way in hell if I was ever accused of molesting my kids or any kid, that. And I could have a judge trial, not a jury trial. That's the other thing people would be like, oh, well, they want. They just want a judge trial. Fuck you. You put 12 regular people in the jury box who go to church on Sundays, got kids and grandkids and da, da, da, da, da. And then you put a kid on the stand whether they're telling the truth or not. Y', all those people want blood, right? And. And the. So a judge is supposed to be fair and impartial, which I do. I totally believe that Judge Walker and Judge Jones are and what have you.

So all I gotta say is this, judge or jury, my client will be found not guilty.

And the reason why we opted for a bench trial is because we could get it a hell of a lot quicker than we can. And my poor client is suffering from all of this. That it's. It hurts my heart to see this man have to go through that. And he's a good man.

Well. And you know, the thing is, it's. He's. It's never. It's like standing inside of a hurricane with a feather pillow, cutting it open 100ft, 40 mile an hour winds, letting all the feathers out, trying to get him back. He's going to suffer this for the rest of his life on one level or the other. So the. Anyway, the power to you. And if the other people want to say whatever, they can say it at the. I mean, I'll. I'll talk to them. I don't care. But. And they say their peace. I certainly don't have any direct knowledge of. Of if anything actually did or didn't happen. Meaning I wasn't there. Right. And, but I believe in the justice system and, and people can't stand defense attorney side when, when they're, when they, when they were like, why would he defend someone or not just you, anybody. Why would he defend a murderer? Why would they offend this? Well, you know what, what do you say about that? I already know what you're gonna say, but what do you say about that?

I had no idea it was gonna be two episodes. It's tough. It's tough. It just doesn't work. The. It's horrible. The. I'm certainly not saying this baby wasn't offended against it. Could have been anyone. That's been my experience in the past. But also, you know, I've got more people doing life in Angola for messing with kids probably than all the other cops you ever met. Right? So I believe in the justice system, but you know what? Damn it, let it work. And, and what you don't know, and the haters are going to blow me up on this and I don't give a. What you don't know is what you don't know. And meaning, you know, the cops are not supposed to interview and all the times stories change and what the doctor had said and everything else. So, I mean, it is what it is and that's the way that it's going to be. Right? But I do want to talk about this amendment. I think this is crazy as fuck. Listen to this. So in the state of Louisiana, if you're a judge, you know, local judge, you got to retire at 70. You know what? I'm 56 years old, closer 57 than 56. And if I was a judge, I wouldn't even probably become judge until this age. But at 70 years old, the. I mean, how, how do you. I mean, I get it, people get Alzheimer's and Parkinson S or they get poor health and stuff like that, but I think it is ludicrous. Now, I'm not talking about like the Supreme Court justices. You see that, you know, nodding off during the. The president or whoever's talking or whatever. Certainly they have a bunch of underlings underneath them. But this Saturday there's actually a vote, okay. As constitutional amendment number five. And it would raise the required retirement age for judges from 70 to 75. Okay, I'm down with that. That's five more years of experience on the bench. It could be Judge Walker, it could be Judge Jones, it could be Judge whomever. Right? Judge Judy, if she practice here. So Constitutional Amendment 5 would raise the required requirement age for judges from 70s to 75, allowing our most experienced and effective judges to keep doing the work they are still capable of handling. 70 ain't what it used to be. The election day is May 16th of 2026. They already had early voting on May 2nd night. I'm gonna tell you right now, I'm voting for it. But let me tell you a little bit more. What is constitutional amendment number five? It raises the mandatory retirement ages from judges from 70 to 75. It lets the voters decide who stays on the job. Job preserves the meaning, like just because you're on there. I mean, you have to have an election, right? Somebody wants to run against you and they beat you on merit. Hell, that's the American way. But unless the voters decide who stays on the job, Preserves the wisdom and experience of competent judges. That's invalid. Y' all just absolutely invaluable. And because they've seen all sides and then there's no added cost to the state retirement system. Well, judges get retirements too, but they're not. It doesn't cost any more than it would does right now. If you give them the extra five years and the Supreme Court oversight remains. You just heard what Si said and what I said about Murdoch. You still got your appellate process, right? So if they error and no judge wants to be found in error, but they error, people are going to appeal it anyway. That's why if you're on death row, it takes 45 effing years to get you executed. Right. And I'm not against that. Let them run out all the pills and then you get what you were sentenced to. And if you get found innocent, let them walk. So why vote yes? People are working longer and living healthier lives. I totally get that. Everybody does it nowadays. And it's just the way that it is. Life expectancy is at an all time high. True. Also, this eliminates age and gender bias. And guess what? There's 19 states in the United States, they have no retirement age, including a lot of states that are in the South. And now let's go to federal judges. Like I told you, a federal judge serves for life. Federal Judge James Brady. My the graduated with my mother and daddy from law school. He served until he passed. And the retired judges over 70 already served in Louisiana by appointment of the Supreme Court. I mean, if it's not billed, you know, Supreme Court can appoint them. They're say they're still fit, they're good to go. And the women are growing part of the bench. So we've been talking about Judge Jones and Judge Walker today. And I'm pretty sure not throwing shade on y' all ladies because I'm, I'm certainly a lot older myself. I'm pretty sure they're in that age range. Right. But many women delay their careers to raise families and live longer. So you start out as a lawyer, as a female, and yeah, you're having babies, right. And then you're going to hang your shingle, as my mom and daddy used to say, and practice law. And you get all these years of experience and you heard Si say about Sidney Piku Walker, the judge here, that he said that lady has more experience dealing with family laws all over all her years of practice and probably than any other attorney I've ever met. But I feel really very, very, very strongly about this. I also feel very, very strongly about these baby rape cases. Y' all know that I hate them, but, you know, not all of them are the way they. That they are portrayed to be. I really can't stand when keyboard. Keyboard warriors who have no clue, they read a headline automatically. Ooh, with the judge is taking money. This is happening in this. No, motherfuckers. They're not. Okay? They're just not. And I understand everybody's pissed off this baby has made allegations, and I get that. And I am not saying she wasn't offended against. I'm not saying that the mom unfairly coerced or if what size saying is true in those police reports. I can tell you from being old detective supervisor and detective work these cases myself, that child should have never been questioned by law enforcement directly. That doesn't happen now unless you are a certified CAC trainer. And if you are the CAC trained, and if you are, why in the hell would you send her to 3 or 4 cacs when you could have just done it yourself? Because there's reasons for that, y'. All. There's reasons for that. And. And it is what it is. I guess that proof's gonna come out in the pudding. And I'm gonna keep them all. I'll keep you all updated. And you know, I. I still.
