I got to say the facts, these cases are all horrific but but I don't know that there's one that makes me more angry than this. This is a beautiful little girl. Let me read you from the coverage of the New York Post tonight. Here's the headline. Migrant charged with murder of 12 year old Jocelyn Nungari was released into the US just weeks ago. Now listen to the reporting. Police in Houston have arrested two migrants from Venezuela for the murder of 12 year old Jocelyn Nungari who was lured away from home then strangled and dumped in a bayou. One of the suspects crossed the border illegally less than a month before the shocking murder and was released into the US after claiming he feared for his life if he was sent back to his home country, sources told the Post. Johan Jose Rangel Martinez, 21, and Franklin Jose Pena Ramos, 26, were charged Thursday with capital murder, Department of Homeland Security sources said. Pena Ramos crossed into El Paso, Texas on May 28, less than a month ago. He was released soon after his interaction with border agents. He told authorities that he planned to live with his cousin in Houston until his court appearance in July. Sources said agents put a GPS tracker on Pena Ramos, which was only set to monitor his location for 21 days. It was unclear whether he was wearing the tracker when Jocelyn was murdered. Investigators identified the suspects from surveillance footage after they were seen following Jocelyn as she walked into a local convenience store. Her body was found in a swampy creek on Monday by a Houston resident who happened to be driving by. She told KTR KTV she thought the girl was a floating mannequin. At first I did a U turn and I stopped on the bridge, put my flashers on, look down and I realized it was someone. I parked right here and called 911 immediately, she said. The two migrants were arrested at a local apartment complex where they had been living as roommates, cops said. Homeland Security has invested opened an investigation into the suspect's immigration history. The victim's mother, Alexis Nungari, said her daughter sleep sneaked out of their apartment late Sunday. She told local outlet KHOU that she was taken advantage of by her killers. I'm like angry that they took advantage of her. She was so young. She was 12. You took my baby away. You took her away. Now I get to let her little brother know his older sister is never coming home, she said. She turned into a beautiful, beautiful young lady, alexis said. I was really looking forward to seeing how she was going to be and they took every opportunity away from me and my family. Houston Mayor John Whitner, Whitmire Democrat, said Thursday that Jocelyn's murder affected him personally as a grandfather to father. It doesn't get any worse. If there is any circumstance where you deny bail, this is it Ben. This is friggin horrific.

The part that is so frustrating to me is the fact that the police officials describe these two individuals and let's talk about who's coming across the border. You've got Martinez, who's 21. You've got Ramos, who's 26. They've been arrested. They've been charged now with capital murder by Houston police as you mentioned in connection with the strangulation death of this 12 year old girl. They apparently either followed her or walked with her to the 7 11. And you look at this and you realize that not only did they know what they were doing, but these two people are now being accused of strangling her to death, raping her, and then leaving her body in this creek at the bridge. The mother said she jumped in her car and pinged her daughter's cell phone which led her to the creek. When she arrived, police officers were canvassing the scene. Their mother was told about an hour later that police had found her body in that Creek. These are two military age men coming into this country killing a 12 year old. We don't know who these people are, we don't know their background, we don't know what crimes they may have committed before this in Venezuela. And yet the Biden administration says, no, no, no, you're good. We're going to track you for 12 days. We don't even know if the tracker was on. And the question I would ask is if the tracker was off, for example, is there any mechanism in place to then really start looking for the individuals before they go out and kill one.

Of our kids every week? This is happening over and over and over again. No, the Biden administration doesn't care. No Democrat in Congress cares. And you may think that's harsh, but if they cared, they would do something about it. Every time we force a vote to stop this, every single Democrat, all of them votes no. And they do it over and over again. Look, I got to tell you, if you look at the picture of this 12 year old girl, I'm sorry, but this really upsets me. As you know, I have teenage daughters. Yeah, she's 12. Yeah, she has braces. She has braces. I'm looking at her thinking that these animals, these monsters, murdered this child. And I got to say, this case reminds me of, of the most significant case that, that I litigated when I was Solicitor General of Texas. It was a case that dealt with a criminal, a murderer named Jose Ernesto Medellin. Now, Medellin, like these two, was an illegal immigrant. He was an illegal immigrant from Mexico. And Jose Ernesto Medellin, in 1993, he was part of a gang that raped and murdered two teenage girls in Houston. They were 14 and 16 years old. Elizabeth Pena and Jennifer Ertman. It was a case that was horrific. Just like this case. They strangled the girls and in that case they violently raped them. We don't know. I pray that did not happen here. We don't know right now if that happened or not. But in the case of Medellin, he wrote a handwritten confession. It's four pages, handwritten. I've read it. I've held those pages, which is sickening. He bragged about what he did. He was proud of what he did. He bragged about how one of the little girls had a Mickey Mouse watch that he kept as a trophy of the night because he was so proud of. Of raping and murdering these teenage girls. This is sick. There is evil in this world. And I argued this case twice in the U.S. supreme Court. I prevailed twice. And ultimately Medellin was executed. He was executed for those horrific murders. But I gotta tell you, I've visited with their parents and I gotta tell you, look, you're a dad, Ben. How as a dad, how as a mom, do you live with knowing what your child's last minutes on earth were and knowing how horrific they were? I mean it. I stood on the Supreme Court steps with the parents of those girls and look, I gotta admit, I feel for the dads because I, like understand them. I feel for the moms obviously too. But as a dad, there's something. There's a feeling of helplessness and rage and like, how did they take my baby and what is wrong and what can I do about it? And that's what just happened again in Houston. From another illegal alien committing another horrific crime.

I also want to go back to something you said because I think people need to understand what you're saying is very accurate when you're saying this is happening every day. Let's move cities, let's go to New York City. New York City is not a border town. It's not a border city. It's not a border state. It's very far away from the border. An illegal immigrant from Ecuador who was arrested in connection with the sexual assault of a 13 year old new York City girl admitted that he filmed the attack as he became more comfortable during the attack. This was on the front page as well of the New York Post.

And this story broke just in the last couple of days. A 13 year old girl in New York being raped in a in a park. 25 year old illegal immigrant, Christian Giovanni Inga Landi was arrested on Tuesday, Tuesday of this week. Just a couple of days ago. He reportedly entered the United States in 2021. Last week, the 13 year old girl and a 13 year old boy were both held at knife point by Inga Landi with a machete style blade. He Tied the girl up and a group of good Samaritans located him, called him out as a rapist before smacking him around and tying him up with a belt. And God bless those New Yorkers, like there is a beautiful thing, this monster. They found him, they tied him up and he was captured. According to multiple reports, England confessed to the cops that he recorded the attack. And let me, let me read the quote from, from the Post. Quote, the chilling admission by Christian Giovanni Ingalandi, 25, broke the silence in an otherwise hushed court hearing in which he was arraigned on charges of rape, predatory sexual assault, kidnapping and raft about other felonies from the shocking June 13 attack in Kasena Park. Quote, I was nervous at first, then got comfortable and recorded it in Galandi admitted in a videotape statement prosecutors said in Queens criminal court. Drawing size from the audience, England he claimed that he saw the two 13 year olds having sexual relations. When he approached them, he used the knife to cut off her clothes. And after he committed the sexual assault, he stole both of the teens phones and fled. Quote, I went to buy drugs afterwards he reportedly said, this is happening. That was Tuesday. This is Thursday. Every day, every other day, every other week, this is happening. People are being murdered, children are being raped and not a s. What, what is Joe Biden doing? He's promising amnesty for a million illegal aliens. He's not mentioning this. Let me ask you, why isn't Joe.

Biden talking about this? Yeah, he's doubled down in fact. I mean he's just saying this is part of the carnage of my plan to remake America. This is the Democratic Party's carnage. They're saying this is acceptable and it's not just this. We keep talking about this, but I think we have to keep talking about. Senator, you hit pause on these stories because we have a couple more that I want to bring up. But we also have warnings now coming from the FBI and people in the FBI who are letting us know in border patrol letting us know we are at a major risk of a terrorist attack by the same military age men that are coming across the southern border that the same age, these murderers and rapists of these children who are coming into this country. We just arrested some of them directly connected to isis. K. The same people that had the horrific eight of them massacre in Russia. Yeah, eight of them. And yet they are just saying this is part of the ugly truth of remaking a country. You're going to get some bad in here when we're letting in some of the others that we need.

And so I think that's part of the problem, right, is that you have.

I handled a lot of cases, a lot of criminal cases. I argued a lot of appeals in the Supreme Court in the fifth Circuit and the Texas Supreme Court. The ones that make me the angriest, that just fill me with rage are when evil bastards hurt children. I just, I think there is a special circle of hell that I just, I do not think there is anything worse than hurting children. And to listen to someone laughing at a 13 year old being raped and mocking, they say that's the fear mongering. You're reporting what's happening. No, actually reporting the news is not fear mongering. What you are doing is covering up the news. Because your political agenda matters more than the little girls who are being murdered and being raped.

And meanwhile, just to put in perspective, if you want to know what the law enforcement agencies around the country are really focused on, it's going after people that for example have done donuts and charging with hate crimes on gay pride paintings or sidewalks in the middle of the street. Just to put it in perspective, they say that those people that have done that, some of them kids being idiots and juvenile doing burnouts on the rainbow crossings in the middle of the street, are, are now, they should be labeled for the rest of their lives as, as people that are, are, are hate crimes that should not be trust in society. But these people who are actually out there raping children and murdering them and mothers of five, the media will completely overlook that story and move right on down the path. And they'll allow for people like you, like you mentioned a moment ago on msnbc, to actually mock and laugh the killing of a child. I don't know how they live with themselves, but I think they understand this. Senator, they can't talk about this and be honest about it right before this election. It's too big of a liability.

More than tracking down Al Qaeda, more than tracking down isis, more than tracking down the radical terrorists that the Joe Biden administration is releasing into this country. The Hamas and Hezbollah terrorists, the ISIS K terrorists, the Al Shabaab terrorists that are coming into this country and that are going to murder Americans. It is a matter of time. Tragically, I do not want this to happen, but it is becoming inevitable that we're going to see a major terrorist attack. They're not devoting the resources to. That they're not devoting the resources to. There's no one at the Department of Justice saying, you know what? There's some breaking news I mentioned a moment ago center and in a statement to Fox News, ICE has now confirmed that the illegal alien charged with rape and murder of Rachel Moran entered the US as a quote, got away on around February 13th of 2023. And that's where the beginning of his interaction with border agents and this country began. There's a lot more to that.

Yeah, no, that's exactly right. This case illustrates the revolving door of the Joe Biden open borders. Prior to that, this murderer was caught by the Border patrol not once, not two times, but three separate times in a matter of days. And he was expelled each time to Mexico via title 40 42. So once on January 19, 2023, when he tried to cross near Santa Teresa, New Mexico, he was apprehended. They sent him to Mexico a second time on January 31st. So just 12 days later, near El Paso, Texas, he, he crossed, they apprehended him, they sent him back to Mexico. And a third time on February 6, 2023, near Santa Teresa, Mexico. So, so six days later, seven days later, and then his fourth try, about a week later, he was able to slip into the US Near El Paso without apprehension. So understand this guy's from El Salvador. Did they send him back to El Salvador? Nope, not once. Basically what they kept doing is they'd catch him and they just drop him off right south of the border. And you know what, he'd come back again. They drop him off south of the border, he'd come back again. And it's like a game. They're just playing a game. And if they had send this guy back all the way to El Salvador, Rachel Marin would be alive. Four times in a matter of weeks, he crosses illegally, three times he gets caught and they let him go just south of the border. The fourth time he's a got away and he comes and rapes and murders her.

When you see that record. The question that I have for you now is we are about a week away from the first presidential debate. How does Donald Trump handle this issue? I mean one of the things that I would love for him to say to the President and I don't think this is really an I got you. I think it's a, could be a real moment for the President is just say, hey Joe, can you name any of the victims who've died recently at the hands of illegal immigrants? Do you know any of their names? Cuz I know them and I've called them. I think this President's so out of touch with reality, I'm not sure he knows the stories we're talking about.

I don't think he does. You remember during the State of the Union, he did not plan to say anything about this and he got heckled from, from, from the crowd from a Republican House member who said Lake and Riley say her name. And remember Biden responded by saying Lincoln Riley got her name wrong. Lincoln Riley of course is a football coach, not the 22 year old woman murdered by an illegal alien Joe Biden had released. So he called her Lincoln Riley instead of Lakin. And his defense, he said, yes, she was killed by an illegal. And then his defense was, you know what? Legals kill people too. Which is the most asinine thing because we have murders in the United States. You shouldn't be mad that I keep letting in more and more and more murderers. Just, you know, I mean, what harm could more murderers do in this country? It is asinine. I think that's a very good point. Listen, I hope Trump next week of the debate is prepared to prosecute this and prepared to prosecute it systematically. What I hope is Trump doesn't go over the top. Now I'm worried he might, but I hope he very calmly lays out the facts and makes Joe Biden defend them because he can't. You're right, Biden can. He probably doesn't know anything about these cases. He doesn't care. It doesn't matter. And there is power. You know, there's an old line in a court of law which is if you have the facts, bang the facts. If you have the law, bang the law. If you have neither, bang the table. In this instance, the facts are so compelling. What I would encourage Trump to do is not get worked up at all, but just calmly explain them one after the other and ask him. I'd say, Mr. President, Joe, what do you say to the parents of Lake and Riley? What do you say to the parents of Rachel Marin? What do you say to the parents of the 13 year old girl raped in New York? What do you say to the parents of the 12 year old girl murdered in Houston? What do you say to the parents of Jeremy Casaris, the two year old boy murdered in Maryland? Joe Biden does not have a response to that. And actually the facts are so terrible that it has more force if Trump is calm, laying it out. I hope he does that.

One other thing that I just had to get your thoughts on is Mayorkas was on TV and he denied culpability in the rape and the murder of Rachel, for example. And not only that, but, but they referred to this murderer as a newcomer. Newcomer. How much more callous can you be when you refer to a person that just killed a mother of five as a being PC, as a newcomer?

[Senator Ted Cruz]

Look, Mayorkas does not care. No Democrat member of Congress cares. That sounds harsh. I mean, reasonable people want to give those who disagree with us the benefit of the doubt. That's a natural instinct. And they'll say no, no, I care, I care. If they cared, they would stop the conduct that causes it to happen again. If you cared about Lake and Riley, you would have acted in time to save Rachel Morin. If you cared about Jeremy Caceres, you would have acted in time to save the 12 year old girl murdered in Houston or the 13 year old girl raped in New York or the 15 year old girl raped in Boston. They are not changed. And by the way, they're not changing it today. All of these together have not convinced one single Democrat to say, enough is enough, we're not going to release him anymore. All of them have circled the wagons around Joe Biden and they're doing it again today. Today they release someone who's going to commit a crime in America. Tomorrow they're going to release someone who's going to commit a crime in America. The next day they're going to release someone who's going to commit a crime in America. And they're not willing to look in the eyes of the moms and dads who are crying because their babies are dead because they're the ones that release the bastards that killed them.

Yeah, it's a great point. And it's going to, like you said, if you're Donald Trump, you have to be careful how you talk about this, the American people, so you get a real conversation. They can see just how callous the President is. And I think Mayorka should be fair game for Joe Biden at this debate. I think he should have to answer for putting this man in charge. Do you agree?

Yes. But look, Mayorkas is a henchman. It is Joe Biden, it's Kamala Harris, and it's every Democrat in Congress. Mayorkas is following orders. He should be impeached. He should be ashamed, he should be embarrassed. He is complicit. But see, he's a henchman. He's not a decision maker. He just salutes and says, oh, okay, you want to have a criminal invasion of America, I'm glad to make that happen. He's following orders. It is the Democrats who are his puppet masters and they right now, not a one of them admits it. Not a one of them is willing to confront the horrors and the people who are suffering and dying because of their policies.

I want to move to something else and we get to cover this on this podcast. And I think it's so important, and that is your interaction specifically with Biden judicial nominees. Biden has nominated a judge with ties to communists. You had a chance to have a conversation with this nominee, Carla Campbell, for literally, she worked openly with a Marxist organization. Read us into this insanity.

Yeah, look, we had this morning a judicial confirmation hearing with actually two Court of Appeals nominees. One to the First Circuit Court of Appeals, one to the Sixth Circuit Court of Appeals. They're both terrible nominees. The One of the first Circuit Court of Appeals is a judge in Maine who repeatedly has given incredibly soft and lenient sentences to vicious criminals. There was one guy who was a child molester who molested two little girls. One five years old, one nine years old. This judge sentenced him to just six years and described from the bench, he said, I can see so much good in you. You're such a good person. This is to the child molester repeatedly molesting a five year old, nine year old girl. There was another woman, a mom whose one year old baby died of fentanyl poisoning. Now she was a drug dealer. She had drug dealing all throughout her apartment. This one year old child massively overdosed of fentanyl. When he was found, his pajamas were coated in fentanyl. The sheets that he was lying on were coated in fentanyl. They had fentanyl everywhere. He had enough fentanyl in his system to kill four adults. One year old. She could have sentenced this mother to 30 years in jail for murdering her child with fentanyl. She sentenced the child to four years. This is a terrible nominee. But you know what? Most of the hearing she got very few questions. You know why? Because the other nominee was even worse. The other nominee has been actively supporting radicals and literally communists. She has been a volunteer supporting a communist group that is openly calling for a workers revolution to overthrow capitalism. She's done that for years. She also supported a radical left wing candidate for Congress. Just give a listen. Because. Because I questioned her vigorously and she would not answer a damn thing about her own record.

Ms. Campbell, I will say I have seen some astonishing nominees from this administration. But I have to admit your record takes the cake. A judge should not be a political activist. Your record demonstrates to me a long history of being a political activist. But not just an activist. An activist who affiliates with extreme and radical organization. Now when Senator Grassley asked you about the workers dignity organization, you gave I think deliberately misleading answer. You said you did not represent them. And that convinced Senator Grassley not to continue on that line of questioning. You have been a legal advisor to that organization since 2013. That is what you have publicly printed on your avoid biography. It is what has been described in the Tennessee Bar association when you were nominated that explicitly says she served as a legal advisor for local workers rights non profit workers dignity. Now why is it you're distancing yourself from them? The reason is because they are utterly radical. If you look at this group that you've served as the legal advisor for, for over a decade, this is an openly Marxist organization. This is a communist organization. Now that those words are not said lightly according to their own characterization of their views, this group says there's no election outcome that improves conditions for workers. The laws of this country have never worked for our people. And now that the system is crumbling, we will continue to stand in community and solidarity with each other. The only way we win in a world we deserve is by building a multiracial working class revolution that can push out white nationalism, violent state racism and the capitalist class that is desperately clutching to hold control and profits as the people rise up. Why have you spent a decade as a legal advisor to an openly communist and Marxist organization?

If I could briefly clarify. More than a decade ago, probably for the course of two or three years, I served on an advisory board that helped. This at the time was supposed to be a non profit workers rights organization. Get set up and get started.

At that time? None. They. They did not express these kinds of views. It was a organization.

You're aware that your current profile that you have up, your legal bio says you are right now an advisor to them.

As your testimony under oath. And that's all right. The facts will come out. But your testimony, I want to. I want to make it explicit. Your testimony under oath is that you have done absolutely nothing and had zero contact with them. For how long?

I have not served on their advisory boards.

If you look at other statements from this organization because they are radical, they are radicals. If you look also, this is the same group in 2020. They called for abolishing ICE, abolishing prisons and detention centers and abolishing the police. Why did you volunteer for a communist organization that calls for abolishing ICE and abolishing the police?

Senator, I have never seen these comments before.

You didn't know who you were volunteering for?

I was not a volunteer for them at that.

Well, it's Amazing, because a minute ago you also told Senator Graham that the Tennessee Immigrant and Refugee Rights Coalition that has a manifesto calling for abolishing ice.

With it, which is fairly astonishing because on page three of their manifesto, they thank you by name for what they say. We would like to thank the following individuals and organizations for their thoughtful feedback and input. This platform would not have been possible without their expertise. Are they lying?

Are they lying? Did you provide any assistance. Did you give feedback and input, which is what they say on the. On the COVID page?

Senator, I didn't even know that existed. And so, no, I did not provide. Provide input on it.

And why. You know, when Senator Graham asked why you gave money to this radical candidate who has said 52 senators are Jim Crow senators and said multiple of us are siding with the devil, you laughed and thought that was funny. But Senator Graham asked you a question. Look, that candidate was as radical as I've ever seen. And when Senator Graham asked why you gave money to that candidate, you just smiled and didn't answer. So why did you give money to a radical candidate who believes multiple members of the Senate are siding with the devil?

Actually, Senator Whitehouse, you weren't here before an exchange with the chairman where Senator Kennedy asked for longer periods because you have two circuit justices, and the chairman said he was going to give additional time. So the comment they want to be gaveled as part of the show is not accurate. And Senator Welch said he was going to give additional time. In fact, he said at the beginning was going to give six minutes. So my question. You did not answer.

Why? Please answer that question. Time is expired. Would you please ask the witness to answer the question? She's refusing to answer it. It's indefensible. But answer. Was there any reason or you just give fifteen hundred dollars to anyone? Senator, your. Your time is expired. I would like her to answer the question. And you said she could answer the question. She has refused to do so multiple times. Please answer the question. Answer the question. No, she did not. She said she didn't know. Those comments. That's not why she gave the money. Senator, can I ask you why she gave the money? No, you don't know because she hasn't answered. Are you going to answer? Ms. Campbell, does committee not deserve to know why you gave money? It's amazing. By the way, they said she answered the question. They'll just flat out lie, won't they?

They will. And it was really striking. I've never seen. So this particular judicial nominee, she presents as a sort of very mousy, shy woman, which is really weird because she volunteers for communists. Like I've never seen that. And she had. So. So Lindsay. So Chuck Grassley asked her, hey, you. You volunteered for this communist group. You said, I've never represented them. And he was like, oh, well, okay. I guess my staff got that wrong. Sorry. So that happened first. And then Lindsey Graham asked, and he asked her, why'd you give money to this? I mean, this was a radical candidate who literally said, all 52 Republicans who voted against Katanji Brown Jackson or all 52 Republicans, not. Not who voted against Tanja Brown Jackson. But 52 Republicans were Jim Crow Republicans, including, by the way, Tim Scott. She called Tim Scott a white supremacist. He's African American. But she called Tim Scott a white supremacist. This was this judicial candidate's single largest donation. She gave $1,500 more than she'd ever given to any political candidate. And Lindsey asked her, said, why did you give the money? And she just stared at him silently. And Lindsey moved on. So I went and asked her, why'd you give the money? And she tried that. She had the weirdest. I've never seen a candidate do this, where you have a question and she just looks at you silently. And then what happened is a bunch of Democrat senators rush in. So Peter Welch was chairing the hearing. He's trying to gavel down saying, no, no, no, no, I don't want to answer this question. Then Cory Booker came in. So Sheldon Whitehouse chimed in. None of them were there for most of the hearing. And Sheldon Whitehouse came in and said, oh, just gavel them down. They want that. So he was trying to do that. And then Cory Booker was just trying to stop the bleeding. But you know what? It's amazing. Do you know how many Democrat senators on Judiciary Committee asked her, hey, why'd you represent a communist organization?

I'm gonna go with probably zero.

That would be zero. None of them care, do you know? None of them. It is a bizarre thing. There is no independent, free thinking thinking among the Democrats. There's none. Listen, when Donald Trump was president, he nominated some terrific judges. We confirmed the vast majority of his judges. He had some judicial nominees that were mistakes, that were bad nominees. And you know what we did as Republicans? We rejected them. We said, nope, take this one back. This one's not there. That's actually under the Constitution, the job of the Senate. It's called advise and consent. The Democrats never, ever do that. They're just a rubber stamp. And they're willing. This is a woman who's volunteering for multiple organizations that are calling for abolishing ICE and abolishing the police. And the Democrats will all be like the politburo and vote da. That sounds like a federal appellate judge to us.

It's incredible. At the end of the day, the question everybody's asking right now is, is she going to get confirmed? And the answer is yes, correct?

[Senator Ted Cruz]

No. I think we'll probably beat this judge. And I actually think the reason they paired them so typically a Judiciary committee, they'll do one court of appeals judge at a time. It's unusual to do two. And I think the reason they did this is I think they knew this woman's record was pretty radical and she was gonna have a really rough time. I think they really want the left wing judge from Maine on the first Circuit. And they know that her record is terrible too. She keeps letting violent criminals go with really, really short prison sentences. But they knew. So, you know, look, I spent, I don't know, 45 seconds laying out the terrible record about this judge letting violent criminals go early. But you had a communist next to her. I don't know if she's a communist. She just volunteers for the Communists. So you decide what that is. But I think it was a strategy. They know the 6th Circuit judge will go down, that she's not going to get the votes, but they're trying to ram the other judge through. And the other judge from Maine got a bumpy ride, but a much better ride than if she'd been solo and people had actually been able to really dive into her record.
