You're listening to the 47 Morning Update with Ben Ferguson.
Ben Ferguson
Good Wednesday morning. Nice to have you with us on the 47 Morning Update. And we've got a very big story for you. A radical activist judge has now blocked the use of a federal database to check citizenship, meaning that illegal immigrants and others who shouldn't be voting in our elections are now being protected. So what happens next? And the second part of this story is Senator Cruz joins us to talk about this judge and how it could work its way through the court system. But will it have an impact on the midterm elections? Or could they stall until the presidential elections in 2028? But first, I want to tell you about our friends at patriot mobile. The stakes right now could not be higher. We finally have a president and an administration fighting hard for America first. But if conservatives lose focus now, the same people who created this mess we're already in waiting to resume their destructive progressive agendas. And protecting this momentum takes more than just votes. It takes everyday Americans like you staying in the fight for our rights and our freedoms. And that's why more and more people I know are switching to patriot mobile. America's only Christian conservative wireless provider. Patriot mobile offers premium priority nationwide service on all three major U. S networks, unlimited data plans, mobile hotspots, international roaming and 100 U. S based customer support. And you can switch in minutes while keeping your phone and your number. And I know it because when I made the switch, it literally took me minutes to accomplish that goal. And unlike other carriers, Patriot mobile puts your money towards causes defending faith, family and freedom. That's why I love them. They contribute literally millions each year to organizations on the front lines fighting for our God given rights. Patriot mobile isn't just talking about saving America. They're putting their business behind the Fight every single day. So don't wait. Join the movement and make a difference. Go to patriotmobile.com ben47 or call 972-RAPRIOT. If you use the promo code BEN47 you'll get a free month of service. That's patriot mobile.com BEN47 or 972-RAPRIOT and make that switch today. It's the 47 Morning Update and it starts right now.

Story number one, the judge, a judge
Ben Ferguson
I should say has shut down the Trump admin database used to remove non citizens from voter rolls. And this is now being celebrated by the left. Now this was as I mentioned, I think it was yesterday you had a Biden appointed federal judge that not only shut down the database used to remove citizens from voter rolls but now the left is saying that this is a massive victory. It's exactly what I predicted. They want lawlessness in our country and especially in our elections. Now our elections are supposed to be American cit citizens vote, not illegal immigrants. What's even more interesting is the 75 page opinion that was issued by Sparkle L. Suknan follows a civil action suit against the department of Homeland Security, the Social Security Administration and the state of Texas by parties including the League of Women voters. Now this was a very big opinion and the decision set aside a modified version of the systematic alien verification for entitlements known as the save system. And that was all created following the Trump signed executive order to verify the citizenship or immigration status of registered voters or individuals registered to vote. And this was all put in place by the department of Homeland Security and the Social Security administration. Sukh Nanan justified vacating the save system by citing quote two fundamental rights that protect Americans from government overreach namely that she said the right to privacy and the right to vote. Now she pointed to the 2025 modified version of the save system as the quote overreach as it included the records of natural born American citizens. Direct access, she says SSA so security administration records and allowed state users to conduct automated bulk searches rather than individual inquiries. Now this is an activist judge. When you dive into more of what she said you find out just how much more activist she actually is. She said the database shared among several federal agencies. So this is all federal agencies that have this information they're cross checking it basically contain private information on U. S citizens and thus violates protections put in place by Congress to prevent such centralized data banks including the computer matching and privacy protection act she says of 1988. All right, translation, I don't want you to be able to check in any way if someone is a citizen. So therefore I'm going to say that all the databases that we have and the SAVE database that we have, you can't use because I want illegal immigrants and dead people to be able to vote in our elections. Why would you want that to happen? Unless it's solely for one reason, and that is for to commit voter fraud. Now, the defendants argued that other more specific immigration laws overrode the general restrictions of the 1988 Act. Specifically, they pointed to the Illegal Immigration Reform and Immigration Responsibility act of 96, which actually mandates that the federal government respond to state inquiries to verify the citizenship status of any individual. By the way, Democrats hate that the judge declared the argument not a winner, quote, unquote. Like, that's her actual words, not a winner. I mean, one hell of a legal brief when you just say quote, unquote, not a winner. The judge also blocked the Federal Trade Commission's antitrust probe into Media Matters, by the way, just for point of clarity here, and barred the executive branch from deporting unaccompanied migrant minors and reuniting them with their families abroad. So you can't even do that. Now, this is the same crazy judge. Now, this ruling comes as both Republicans and Democrats are preparing for the upcoming midterm elections. That's why this is has like, it's a big deal and it has big ramifications. Republican Utah Senator Mike Lee again is attempting to advance the Save America act in the Senate. But you have a problem there because you have basically four scumbag Republicans in the Senate that hate Donald Trump and don't look at the 80 plus percent of Americans that want the SAVE act to pass. And so they want to stick it to Donald Trump. And so they're like, here's our middle finger. Like, that's just the truth of this. What is the SAVE act if you don't know? It's real simple. It requires a government issued ID to vote. What a novel idea, Lee. Senator Lee said this on Sunday on Fox News, quote, the American people overwhelmingly support this, regardless of political party. Want to make it easy to vote, hard to cheat. Let's say that again. Want to make it easy to vote, but hard to cheat. That's what the House passed and that's what the SAVE act actually does. Couldn't, by the way, agree more with Lee on that one. So when you look at the SAVE act and you look at this, what Democrats are now publicly saying and celebrating is lawlessness, is actually making sure that lawlessness continues now, the SAVE act is also something else that's, by the way, not controversial. More than 80% of American voters, Republican Democrats alike, want it. The voter ID bill is now becoming even bigger issue heading into the midterms and these Republicans are stopping it. Well, they suck. Now what we're being told is President Trump is now gearing up and going to be attending a closed door Senate GOP lunch with John Thune while pushing for the SAVE Act. Bret Baier, Fox News Channel reporting this just a few minutes ago tonight as he pushes Senate Republicans to pass the Save America Act. But that is creating another political problem.
Narrator/Host
Chief Congressional correspondent Chad Pergrim shows us from Capitol Hill.
Ben Ferguson
President Trump fixated on a singular goal.
Commercial Announcer
We have to pass the Save America act, which is voter id, which is proof of citizenship.
Ben Ferguson
But he's not getting his way. There's no doubt the President is very
Commercial Announcer
frustrated with the speed of the Senate, as am I.
Ben Ferguson
The President is exasperated at the Senate struggling to approve the bill. I suspect we'll get a talking to, but at the same time we'll be able to convey back to him the GOP numbers don't work. Talking is good.
Commercial Announcer
Sabak's a waste of time.
Ben Ferguson
Some Senate Republicans are irritated that President Trump incinerated GOP plans to renew the anti terrorism program, FISA section 702 and stymied rapid confirmation of national intelligence director nominee Jay Clayton. We have very candid conversations. I am very direct with the President.
Commercial Announcer
I shoot straight with him and vice versa.
Ben Ferguson
And you know, we at times have differences of opinion. GOP Florida Senator Rick Scott bypassed Thune, inviting the President to Capitol Hill to pitch the Save America Act.
Commercial Announcer
My experience in business is that we
Ben Ferguson
sit down with people and find out what their needs are and try to solve it. The President is pressuring Thune.
Commercial Announcer
John's a leader. That's what Bing is, a leader. Pat John is a leader and hopefully he can get the votes.
Ben Ferguson
Democrats anticipate intra party GOP fighting.
Narrator/Host
Trump only will talk to Senate Republicans behind closed doors. And from what it looks like, that ain't going to be pretty.
Ben Ferguson
Now, the president clearly is trying to get this done. The SAVE act isn't even controversial. American citizens should only be the ones that vote in our elections. That is not controversial. Congressman Wesley Hunt, African American talking about this issue and it's an important one because Democrats say the SAVE act is going to actually disenfranchise African American voters. And you want to talk about racism. Their actual argument is you can't expect black people, minorities to have a form of government ID. Now, if that's not racism 101, I don't know what is. Wesley Hunt saying this in Congress. Take a listen.
Narrator/Host
If the United States is a country worth preserving, then I think we must protect the integrity of our elections and do everything in our power to do just that. I am shocked at the SAVE act, which has already passed the House is even controversial. And safeguarding our elections is the bedrock of our democracy is something that both sides sides should easily support. They say that non citizens voting in an election is not a real issue. Or if some non citizens are registered to vote, it's not a significant amount to make a difference. Well, in my home state of Texas, we just removed thousands of non citizens from voter rolls. And at some of these recently hotly contested elections, that amount could even be enough to swing an entire election. Undermining the integrity of elections is not an oversight. It's a threat to democracy. I think it's time that we as a body acknowledge that threat. Now, I'm sitting here right now and I gotta tell y', all, I'm. I'm black and I'm a veteran. I have six forms of government id. Six. I've been black for my whole life. I've been a veteran since. Since 2000 when I was at West Point. The insinuation that black and brown people cannot get an ID to vote like every other citizen, regardless of your race, religion, color or creed, is insulting. I actually refer to this as the soft bigotry of low expectations. We, as all Americans, should want free and fair elections. We aren't making it more difficult for people to get an ID to vote. Every last black person that I know in my life has a government id. We as a country have got to clean up our rules to ensure that we have free and fair elections, regardless of your race, religion, color or creed. And that's why I reject the assertion that we, no matter what color you are, cannot reach that very low bar of having a government ID to figure out how to vote for the leadership and the future of this country.
Ben Ferguson
Could not agree more with what was said there by Wesley Hunt.
Narrator/Host
Next story number two.
Ben Ferguson
Explain this, this, this judge, what she has done here in a simplistic way, what they were trying to do is make sure that people that were not American citizens and those are not eligible vote would not be able to eligible to vote. That doesn't seem controversial. The majority of Americans are in favor of the SAVE Act. It's 75, 80%, depending on what poll you look at. And this judge said, hey, you guys can't cross check in different groups, like Social Security, can't work with others. And you guys know we're not going to allow this to happen. That was shocking.
Commercial Announcer
Yeah. So I'm going to read from the Associated Press. A federal judge on Monday ruled that a recently revamped version of a federal tool central to the Trump administration's effort to nationalize elections can no longer be used. U.S. district Court Judge Sparkle L. Sukdan I want you to stop and think There's a friggin judge in America named Sparkle L. Sukhda. None. By the way, she was a clerk for Sonia Sotomayor. She's a radical leftist. I voted against her confirmation, but she is a district judge in Washington, D.C. and Judge Sparkle sided with the advocacy groups that argue that the recent upgrades to the program called the Systematic Alien Verification for Entitlements or Save aggregated Americans sensitive personal data in a way that could result in voters being wrongly purged from voter rules. Quote, all in all, the federal government has knowingly trampled on the privacy rights of American citizens in a manner that threatens the sacred right to vote. Sucaden said in an order explaining the decision. This court cannot stand idly by while that happens. She says Congress had expressly prohibited the government from centralizing Americans personal identifying information and the federal agencies that created the Save program, quote, knew that the database violates these statutory protections. Now, this is a liberal activist decision. It is also a decision that doesn't make sense under the statute, the statutes that she was looking at. Number one, the statute is the Social Security act. And the Social Security act requires, quote, Social Security account numbers of record that are obtained or maintained by persons pursuant to any provision of law shall be confidential and no authorized person shall disclose any such Social Security account number or related record. Well, you know what? Trump administration didn't disclose anyone's Social Security number that, that exactly. If they released, you know, your Social Security number, that would be a violation of the Social Security Act. They didn't do that. Social Security act doesn't say the federal government can't look at Social Security numbers. Like the government is one entity. And it is a bizarre system that says you have records that show if people are illegal aliens or not. You, the federal government are not allowed to look at those records because a law says you can't publicly disclose them to others. They didn't. There's another, there's another law called the Privacy Act. And the Privacy act, they claim it violated this as well. But Again, the Privacy act does not prohibit the federal government from looking at its own records. I mean, understand this is a ruling from a radical judge who's saying even though the federal government and initially the SAVE database was set up to stop the federal government from giving government benefits giving welfare to illegal aliens, now mind you, it is illegal to give government benefits to give welfare to illegal aliens. Congress has passed that law over and over and over again. And Democrats, when they're being completely split personality on this, they will say repeatedly, well, we don't give welfare benefits to illegal aliens. They'll say that over and over again. They'll simultaneously say, dear God, we've got to give welfare benefits to illegal aliens. What a monster would deny them. So they say them both. Remember when every Democrat running for President in 2020 was asked, should we give free health care to every illegal in America? And they all raised their hand. Yup, yup, yup. Every one of them. Right down the line. But, but at the end of the day, Congress has passed repeated laws saying do not give welfare benefits to illegal aliens. And Judge Sparkle. And look, by the way, I think it is really impressive that My Little Pony is now a federal judge, but I just wish My Little Pony was not a Marxist. You would think that Judge Sparkle would recognize something beautiful like the Constitution or federal law. It is insane to say that the same Congress that says you cannot give government benefits or welfare to illegal aliens somehow said, but you're not allowed to look to see if anyone's an illegal alien. Nope, the government is blindfolded from looking at your own databases. I'm gonna make another prediction in this show.
Ben Ferguson
I was gonna say what's gonna happen.
Commercial Announcer
This decision will be reversed.
Ben Ferguson
It will be when and how quickly.
Commercial Announcer
I don't know how quickly it might be reversed by the DC Circuit. If it's not reversed by the DC Circuit, I think it will be reversed by the US Supreme Court. What I don't know is if it gets reversed in time for the election. Part of the strategy of the litigants is delay. And generally speaking, these decisions can take a lot of time. Now the Department of Justice likely will seek emergency relief from the D.C. circuit. Now it will depend on what panel of judges you get. You get three random judges on the D.C. circuit and then if the D.C. circuit the probably the biggest danger is they seek emergency relief in the D.C. circuit and they get a bad draw of left wing judges on the D.C. circuit. And what I predict they would do then is just try to delay it till after the election. So they just slow walk it and it's really hard.
Ben Ferguson
And that's how they can make sure that they don't have any that's implemented for election day. So you can have more people that can vote illegally.
Commercial Announcer
Yes. And so if you get a good panel on the D.C. circuit, I am quite confident this will be reversed. And by the way, if the D.C. circuit upholds this decision, I think the Supreme Court would take the case and reverse it. But in the normal course of things, that would take a couple of years. So that would not impact the 26 election. It would probably be in time for the 28 election. My hope is they take an emergency appeal and the D.C. circuit overturns it quickly. Or even if the D.C. circuit rejects the appeal, I want them to make a decision fast because then they could appeal that to the Supremes. I think the Supremes would act quickly. The danger is the DC Circuit slow walks it for another six months.

Focus: Judge Sooknanan’s ruling against a federal database for election citizenship verification, political fallout, and the broader debate over election integrity.
In this episode, Ben Ferguson discusses the dramatic legal decision by Judge Sparkle L. Sooknanan, who blocked the use of the federal SAVE (Systematic Alien Verification for Entitlements) database in verifying voter citizenship. Ferguson dissects the judge’s rationale, potential impacts on upcoming elections, political responses—particularly from Republicans like Senator Ted Cruz and Congressman Wesley Hunt—and the partisan divide over election integrity measures such as the SAVE Act.
(05:49 – 13:24)
Block on Election Verification:
Judge Sparkle L. Sooknanan, appointed by President Biden, issued a 75-page opinion halting the use of the federal SAVE database for checking voter citizenship.
“A judge, I should say, has shut down the Trump admin database used to remove non-citizens from voter rolls. And this is now being celebrated by the left.”
— Ben Ferguson (05:49)
Case Background:
The case was a civil action against DHS, Social Security Administration, and Texas by plaintiffs including the League of Women Voters.
The modified version of SAVE (post-Trump executive order) was meant to verify citizenship for voter registrations.
Judge's Justification:
She cited protection of two fundamental rights: privacy and the right to vote.
She particularly objected to the inclusion of natural-born citizens' data and the automated, bulk-search capability allowed by the system.
“Sukh Nanan justified vacating the save system by citing ‘two fundamental rights that protect Americans from government overreach... the right to privacy and the right to vote.’”
— Ben Ferguson (06:31)
Activist Framing:
Ferguson frames Judge Sooknanan as a “radical activist judge” and repeatedly suggests the goal is to enable illegal voting, alleging:
“…I want illegal immigrants and dead people to be able to vote in our elections... Unless it’s solely for one reason, and that is for to commit voter fraud.”
— Ben Ferguson (07:39)
Defendants’ Arguments:
The federal government cited the 1996 Illegal Immigration Reform and Immigration Responsibility Act, which mandates verifying citizenship, but Judge Sooknanan dismissed these arguments as “not a winner.”
(13:24 – 22:14)
Ramifications for Upcoming Elections:
The ruling is seen as especially consequential with both midterms and presidential elections approaching. Ferguson warns of the potential for further “lawlessness” in elections.
The SAVE Act in the Senate:
Senator Mike Lee and other Republicans are pushing the SAVE Act, requiring government-issued photo ID for voting, but face alleged intra-GOP opposition from “four scumbag Republicans in the Senate that hate Donald Trump."
“Here’s our middle finger. Like, that’s just the truth of this.”
— Ben Ferguson (10:02)
President Trump’s Engagement:
Trump is pressuring Republican senators, particularly John Thune, to pass the SAVE Act but faces resistance due to party divisions and competing priorities such as FISA renewal.
“The President is exasperated at the Senate struggling to approve the bill. I suspect we'll get a talking to... but the GOP numbers don’t work.”
— Ben Ferguson (11:35)
Democratic Counterargument and GOP Response:
Democrats argue the SAVE Act could disenfranchise minorities; Congressman Wesley Hunt (Texas) rebuffs this on the House floor, calling such arguments racist:
“The insinuation that black and brown people cannot get an ID to vote like every other citizen...is insulting. I actually refer to this as the soft bigotry of low expectations.”
— Rep. Wesley Hunt, as quoted by Ferguson (14:53)
(15:15 – 22:14)
Ferguson’s Analysis:
Ferguson reads directly from the Associated Press and the judge’s order, emphasizing the judge’s arguments about privacy rights and the alleged threat to voters’ rights.
He asserts that the relevant statutes (Social Security Act, Privacy Act) do not prohibit federal cross-checking within government databases.
Mockery and Tone:
Ferguson mocks Judge Sooknanan’s name and background, calling her a “radical leftist” and referencing her former clerkship with Justice Sotomayor.
“I think it is really impressive that My Little Pony is now a federal judge, but I just wish My Little Pony was not a Marxist.”
— Ben Ferguson (18:45)
Core Legal Point:
Ferguson argues the ruling contradicts Congressional intent, which both mandates denial of benefits to illegal immigrants and, logically, the verification thereof.
(20:25 – 22:14)
Legal Outlook:
Ferguson predicts the decision will be reversed, but timing is critical. Appeals to the DC Circuit or Supreme Court could be slow-walked, delaying any reversal until after the 2026 midterms—potentially even the 2028 presidential election.
“If you get a good panel on the D.C. circuit, I am quite confident this will be reversed… But the danger is the DC Circuit slow walks it for another six months.”
— Ben Ferguson & guest (22:00)
Political Strategy Allegation:
He alleges delay is intentional, as prolonged litigation would allow more dubious votes in the next election cycle.
On the core issue:
“Our elections are supposed to be American citizens vote, not illegal immigrants.”
— Ben Ferguson (06:09)
On the judge’s rationale:
“She said the database shared among several federal agencies... contain private information on U.S. citizens and thus violates protections put in place by Congress to prevent such centralized data banks.”
— Ben Ferguson (06:45)
On the Save America Act:
“Want to make it easy to vote, hard to cheat. Let's say that again. Want to make it easy to vote, but hard to cheat.”
— Senator Mike Lee, quoted by Ferguson (09:37)
On racial arguments in the ID debate:
“I have six forms of government id. Six... The insinuation that black and brown people cannot get an ID to vote... is insulting.”
— Rep. Wesley Hunt (14:44)
On Judge Sooknanan:
“There's a friggin judge in America named Sparkle L. Sukhda. None. By the way, she was a clerk for Sonia Sotomayor. She's a radical leftist.”
— Ben Ferguson (15:49)
