Welcome. It is Verdict with Senator Ted Cruz. Ben Ferguson with you. Nice to have you with us today. We've got a lot to talk about, including some breaking news with Joe Biden and Hunter Biden. Plus an update on one of our shows that went viral dealing with Clarence Thomas and what's happening on Capitol Hill and finally the end of Title 42 and what's happening at the border. Senator, I want to get your initial response to the ex spy. And this is really big news. Behind the discredited Hunter Biden letter claiming that that la top was Russian disinformation. Said he wanted to provide the Biden campaign with a debate talking point, quote, unquote. Your reaction to that?

Well, we now have an email on October 19, 2020 where Michael Morell, former senior official in the FBI is emailing to John Brennan, who was Obama's head of the FBI. And the email says, john, can I add your name to this list? We'll be adding Leon Sue Gordon, Jeh Johnson, George Lisa Monaco and Mike Rogers today and working on adding Dan Coates, Mike Rogers and Tom Bosert and lists of other IC career folks trying to give the campaign, particularly during the debate on Thursday, a talking point to push back on Trump this issue. Thanks, Michael. And here's Brennan's entire response. Okay, Michael, add my name to the list. Good initiative. Thanks for asking me to sign on. This was politics. This was senior officials of the intelligence community lying for politics. Give Biden a debate talking point. Never mind that it's a lie. Falsely claim the true information in Hunter Biden's laptop is actually Russian disinformation because they know Biden will be all happy to lie about it. And by the way, who is John Brennan? John Brennan was Obama's CIA director who is such a radical that when he was a young man, 1980 election between Jimmy Carter and Ronald Reagan. Do you know who John Brennan voted for?

He said Jimmy Carter is not liberal enough. And so he voted for the communist nominee to be president of the United States. That's who Obama put in place. It was Gus hall was his name and he was the nominee of the Communist Party of the United States. He was the nominee in 1972, 1976, 1980 and 1984. And John Brennan said, nope, that Jimmy Carter guy, too much of a right winger. Give me the full fledged communist. And you know one of the things communists are happy to do? Lie. Lie. When it helps them politically. Actually, communists embrace lying as one of the tools they engage in. That is who Tony Blinken, who got rewarded with secretary of state. That's who Tony Blinken was rounding up. Give me the communist who ran the CIA. You know, it's sort of like, let's call Mikey, he'll eat anything. Let's call John. He'll say anything. And they got their talking point at the debate and Biden was more than happy to repeat it, even though it was an utter and complete lie.

There does seem to be a narrative change recently on this, there does seem to be now a White House that's willing to speak out and not just dodge things being forced, I would argue, to speak out on this. Do you feel that even in Washington, D.C. where there's so much numbness to scandals and even jadedness, that this does seem to be changing a little bit?

It does. And look, to show you how bad it is, let me just read you three headlines from the past week. Headline number one from CBS News, Grassley Comer alleged bribery scheme involving Biden and demand documents from FBI. That's one headline. Here's a second headline. This one is from Politico. Bracing for impact Biden world preps for Hunter Biden fallout Biden AIDS are more worried about the personal toll it will take on the president as a father. So that's headline number two. All right, let me just give you one more headline number three. Biden setting stage for pardoning Hunter as he frames potential DOJ charges as political witch hunt. Biden denied that a potential Hunter indictment would have any impact on his presidency. That's from FOX News. Again, just, just in the past couple of days, this is getting worse and worse and worse. And the amazing thing is this is all why while DOJ is desperately trying to cover up the connection to the big guy, to daddy, to they're trying to put it all on Hunter, the poor troubled soul and protect against any investigation into the real corruption that is the matter of public concern.

Justice Thomas rightly described the treatment he got from then Chairman Joe Biden and Senate Democrats is a high tech lynching. It is Sad to see 30 years later, this committee is again engaged in.

Senate Democrats and their lapdogs in the media are engaged in a twofold political campaign. Number one, to delegitimize the Supreme Court of the United States because they are angry that they are a majority of.

But number two, very directly, this is a political campaign designed to smear Justice Clarence Thomas. And the reason is simple. The left despises Clarence Thomas and they do not despise him because he's a conservative. The left despises Clarence Thomas because he is a conservative African American. Here's what Clarence Thomas said at that confirmation hearing. He said, if you are a free thinking African American, quote, you will be lynched, destroyed and caricatured by a committee of the U.S. senate. Well, in three decades that hasn't changed and it's Gotten worse. And to be clear, here's the left's view. I point to one article just three weeks ago. The Democrats need to destroy Clarence Thomas reputation. They'll never successfully impeach him, but so what? Make him a metaphor for every insidious thing the far right has done to this country. That's what the left is trying to do. And I will tell you if you look at the next poster board, the left has repeatedly attacked Clarence Thomas with a racism. This is a magazine cover that showed Justice Scalia every bit as conservative as Clarence Thomas, but he's portrayed as the master. And Clarence Thomas, in a bigoted attack, is portrayed as shining his shoes. I'll show you another one. To give you a sense of the racist vitriol from the left, here's a racist caricature of Clarence Thomas. Lawn jockey for the far right. This is the bigoted contempt the left has. I'll show you another. Another magazine cover. Offensively, this is how the left views Clarence Thomas. Now, it's important for people at home to understand this is not about judicial ethics.

This is not about judicial ethics. This is not about rules that should apply to judges across the board. We could have a reasonable discussion about that. This is about applying a double standard to Clarence Thomas and only Clarence Thomas. The attack that my Democrat colleagues breathlessly repeat is that Clarence Thomas stayed at the vacation home of a very close friend of his, a successful Texas businessman, flew on his plane and went on his yacht. Well, if that's the standard going and traveling and being paid for by others, then guess what? Just about every Supreme Court justice has done so and done so in much greater numbers. Justice Thomas was appointed in 1991. In the time since then, he's taken 109 reported trips, five international trips. Justice Ruth Bader Ginsburg was appointed in 1993. Two years later, and the time she was on the court, she took 157 trips, including 28 international trips. Mr. Payne, yes or no? Do you think Ruth Bader Ginsburg was corrupt?

Nor do I. Ruth Bader Ginsburg was not alone. Justice Stephen Breyer, appointed the year later in 1994, took 233 reported trips, including 63 international trips. Again, yes or no, Mr. Payne, do you think Stephen Breyer was corrupt?

Nor do I. I would point out Justice Kagan has done the same thing. Justice Sotomayor has done the same thing. And yet none of my Democrat colleagues care because this is a political attack directed at a Justice they hate. And by the way, let's spend a moment focusing on Justice Stephen Breyer, a delightful human being, someone I know personally, someone who served decades on the court. Justice Stephen Breyer repeatedly traveled on the penny of a prominent Democratic billionaire, the Pritzker family. Now, J.B. pritzker is the Democrat governor of the State of Illinois, from which our chairman hails. I would be shocked if the chairman of this committee has not had multiple meals with the Pritzker family. Justice Breyer was a longtime member of the board that awarded the Pritzker Architecture Prize.

Now, what did that mean?

That meant Justice Breyer traveled on the dime of these Democrat billionaires. In 2019, Justice Breyer traveled to New York City, to Vancouver and Paris. In 2018, Justice Breyer traveled to Ireland and Spain. In 2016, he traveled to New York, Spain and France. In 2013, he traveled to Norway, Sweden, Denmark. In 2012, he traveled to Beijing and to London. All of this paid for by the Pritzker Foundation. Now, none of my Democrat colleagues are mad about this. And let me be clear. I'm not suggesting Justice Breyer is corrupt. What I'm suggesting is this committee is corrupt because this is a kangaroo circus. And I will Note, we had 15 Senate Democrats, including six members of this committee, send a letter to the Appropriations Committee threatening to cut off the funding for security at the Supreme Court. The left is willing to threaten the lives of the justices. Justice Samuel Alito this weekend in the Wall Street Journal said that the attacks directed at the justices are making them targets of assassination. This is disgraceful. Every senator who signed this letter should be embarrassed. Mr. Chairman, I ask unanimous consent that this letter be admitted into the record and also that the interview with Justice Alito from this weekend be entered into the record. Democrats can have disagreements based on law, but this attempt to delegitimize the court, this attempt to personally smear Clarence Thomas, is dishonest. And everyone in the media echoing it is participating in a shameful reprise of 1991's High Tech Lynching.

Senator. Unbelievable, by the way. The way that you laid it out for everybody, and I'm glad that you were able to do that. But the media hasn't stopped since then. They're still coming after Clarence Thomas and his family members.

Well, that's exactly right. So what you just played was from the Judiciary Committee hearing last week. It was the hearing on, quote, judicial ethics. And it was the reason we released the pod a day early last week. We normally do Monday, Wednesday and Friday. Last week we did Monday, Tuesday and Friday because we wanted last Tuesday's pod to be out before the hearing in Judiciary. That pod provided in great detail some of the background on Clarence Thomas as to why the charges weren't accurate. And I gotta say, it really was striking because the hearing did not go the way the Democrats wanted. And by the end of it, the Democrat senators had fled the room. They realized their hypocrisy had come out and they wanted it to be just a slugfest, beating up on Justice Thomas. And it didn't play out that way because they have no defense, they have no response. It's not like they can say, oh, well, Justice Breyer flying on lavish trips to Europe paid for by Democrat billionaires.

They have no, they, they literally just ignore the point. What's happened since then? Well, what's happened since then is the drip, drip, drip of attacks. And we talked about this before in last Tuesday's pod. This is an organized political attack. This is just like if you're running a campaign for governor or senator or president, the other side has an oppo research department, they're putting out a daily attack and they are running a campaign against Clarence Thomas. And to be clear, let's be very clear what their objective is. Their objective is to destroy Justice Thomas. Let me read you a little bit from an opinion column May 4 in the Washington Post by Ruth Marcus, the associate editor. The title is Clarence Thomas should get out his checkbook and reimburse Harlan Crow. The opening line of it is the Clarence Thomas story has now entered the Abe Fortas danger zone. Now who is Abe Fortas? Abe Fortas is a Supreme Court justice who resigned in disgrace because of corruption. That's what the left wants. And that's the analogy we're hearing. Lots and lots of people tell the story of Abe Fortis. Why the left has convinced themselves if they can relentlessly drag Justice Thomas through the mud, at some point he'll surrender and go away. And they can replace one of the greatest constitutionalists ever with a left wing activist who will undermine the Constitution and implement and force the left's radical agenda on the American people. That's what they're trying to do. By the way, you know, it's very interesting. The Post says Clarence Thomas should reimburse Harlan Crow. You know what they didn't say? They didn't say Stephen Breyer should reimburse the Pritzkers. They didn't say Ruth Bader Ginsburg should reimburse everyone who paid for her trips. They didn't say. So Sonia Sotomayor should reimburse everyone who paid for her trips. They didn't say Elena Kagan should reimburse everyone who paid for her trips. This is designed to be a very deliberate attack going directly at, at Clarence Thomas. And so now they've launched yet another attack. And the latest attack, which they saved until after the hearing so that there would not be a forum to provide the response to it, is that this same Texan, Harlan Crow, also paid thousands of dollars of tuition payments. And then this is now what has the left clutching their pearls. Now let's talk about the facts. So Clarence Thomas and his wife Jenny spent 12 years helping not their son, not their brother, but rather their great nephew, an individual named Mark Martin, who was in trouble. He was in real need. And Clarence Thomas and Ginny Thomas step forward heroically to raise their great nephew and to raise him and to take care of him. And this is what, what the left is targeting is that for a period of time, Harlan Crow paid tuition payments to the schools where the Thomas's great nephew was attending. Now I want to go back Tuesday's podcast. We interviewed Mark Paoletta, who has been doing just such an incredible job defending Justice Thomas and putting the facts out. And I want to do a little bit of an in depth examination of the statement Mark Paoletta put out on this attack on the tuition payments because it's important to understand. So I'm reading from the statement of Mark Paoletta, friend of Justice Thomas. Quote, the Thomases have rarely spoken publicly about the remarkably generous efforts of to help a child in need. They have always respected the privacy of this young man and his family. It is disappointing and painful, but unsurprising that some journalists and critics cannot do the same. The Thomases quietly and honorably devoted 12 years of their lives to helping a beloved child in desperate need of love, support and guidance. In 1997, Justice Thomas and his wife brought their great nephew to live with them. They agreed to take in this young child, much as Justice Thomas grandparents had done for him and his brother. In 1955, Justice Thomas grandparents changed the trajectory of his life. And the Thomases hoped to do the same for a child in need. Justice Thomas and his wife made immeasurable personal financial sacrifices and poured every ounce of their lives and hearts into giving their great nephew a chance to succeed. In the summer of 2006, the Thomases were struggling to find a school where they could send their great nephew. In discussing these challenges with their dear friends, Harlan and Kathy Grow, Harlan recommended that the Thomases consider one more option. Sending their Great nephew to Randolph Macon Academy. Harlan had attended Randolph Macon and he thought the school would be a good fit. Harlan had financially supported Randolph macon since the 1980s and had funded scholarships for students from disadvantaged backgrounds. Harland offered to pay the first year of Justice Thomas great nephew's tuition in 2006, and that payment went directly to the school. Harlan Crow's office confirmed that he did not pay the great nephew's tuition for any other year at Randolph Macon. After some time, Randolph Macon recommended the great nephew attend a boarding school in Georgia for one year. Harlan offered to pay the first year of tuition for their great nephew at the Georgia school. And again those tuition payments went directly to the school by the next year. By the next school year 2009, the Thomases great nephew returned to Randolph Macon. He moved back to Savannah in December 2009 after he turned 18. The Thomases love their great nephew. It is despicable that the press has dragged him into their effort to smear Justice Thomas. This story is another attempt to manufacture a scandal about Justice Thomas. But let's be clear about what is supposedly scandalous now. Justice Thomas and his wife devoted 12 years of their life to taking in and caring for a beloved child who was not their own. Justice Justice Thomas grandparents had done for him. They made many personal and financial sacrifices to do this. And along the way, their friends joined them in doing everything possible to give this child a future. Harlan Crow's tuition payments made directly to these schools on behalf of of Justice Thomas's great nephew did not constitute a reportable gift. Now this is where it's getting into the specific legal charge because the left is claiming, aha, you did not report this. So listen to the clear legal analysis. Justice Thomas was not required to disclose the tuition payments made directly to Randolph Macon and the Georgia school on behalf of his great nephew. Because the definition of a dependent child under the Ethics and Government act, which is 5 USC 13101 Section 2, does not include a great nephew. It is limited to a son, daughter, stepson or stepdaughter. Justice Thomas never asked Harlan Crow to pay for his great nephew's tuition. Neither Harlan Crow nor his company had any business before the Supreme Court. This malicious story shows nothing except for the fact that the Thomases and the Crows are kind, generous and loving people who tried to help this young man. Now there are two really important things in there, Ben. One is the personal story. A story of generosity, a story of caring for a child in need. A child who was not their responsibility was not their child. But they stepped forward for a dozen years to help their great nephew. But secondly, the whole legal hook is they say, well, gosh, Justice Thomas should have reported this on his financial disclosure. The law is clear. You have to disclose a payment made for a dependent child. And the statute. I want, I want to read, read this again. The statute defines a dependent child as the term dependent child when used with respect to any reporting individual, any individual who is a son, daughter, stepson or stepdaughter. By the way, that same definition doesn't just apply to judges. It applies a lot of other places, including to Congress. Do you know right now that if you, Ben Ferguson, decided you wanted to give a million dollars to the great nephew of Chuck Schumer, Chuck Schumer would not have to report that because the reporting requirements do not extend to great nephews. Now, I don't know if Schumer has a great nephew, and I wouldn't advise giving him a million bucks if he does.

Yeah, but the principle is very clear and the rule is very clear.

The rule, it is defined fined by statute. And in this instance, you've got Harlan Crow with Randolph Macon, has supported the school for years, has paid for scholarships for years. He knew of a child in need who could benefit from the school, and he's being painted as a villain for caring for a child in need.

And this was obviously a pre planned, orchestrated smear campaign. And they're going after Clarence Thomas. I also think there are significant racial undertones here. They've been doing this. You mentioned this and what you said and what we played earlier, but the racial side of this, they hate Clarence Thomas, I think, honestly, because he's an African American man who has not gone to the woke left and therefore he's such a big threat, they want to be done with him for that reason as well.

It is a qualitatively different and double standard. Antonin Scalia was incredibly conservative, and yet the left didn't loathe him. William Rehnquist, my former boss, was incredibly conservative, and yet the left didn't loathe him. The same way that there is a unique vitriol that gets piled on Clarence Thomas. In the left's view, he is not a black man. He doesn't qualify as a black man. By the way, in the left's view, I'm not Hispanic. If you're not a leftist, you don't get to be Hispanic. Look, we did an earlier podcast where Don Lemon, before he got fired for saying idiotic things like this, described how Nikki Haley was Pastor prime and he Gave nasty misogynistic statements about a woman is in her prime, in her 20s or 30s, which is idiotic. But in a certain leftist logic it made sense because to the hard left, Nikki Haley is not a woman. You don't count in whatever category you are, whether it's African American or Hispanic or woman. The left's view is they own you. If you're in any one of those categories and if you dare disagree from their ideology, you have lost any right to fall within that category. And so you know my dad, who came as a penniless immigrant from Cuba, not speaking English. Nope, not Hispanic, doesn't count. That's their view. And Clarence Thomas, I don't know that there is an individual more despised by the left than Clarence Thomas. Donald Trump is close and it's a different sort of hatred, but they might well be running neck and neck.

Yeah. Lastly on this, do you believe they're gonna finally at least hit the pause button and put this to bed or do you expect there to be more attacks in the, in the coming weeks?

More, more, more. It is drip, drip, drip. It is funded. I don't know who's funding it, but someone is putting serious dollars behind this attack. This is a political campaign. It's, listen, you gotta stand up and defend Justice Thomas because he can't. Justices have no ability. They don't know how to fight PR fights. They don't have a press secretary, they don't have staff to do it. They're literally just sitting there like a pinata getting whacked. And the people whacking the pinata are the Democrats, are the media and all of their cheerleaders. And so it's gotta be the rest of us providing the truth and the facts to counterbalance this very coordinated and very well funded attack.

Some of the latest statistics that have come out have been brutal for this administration when it comes to Title 42. Almost 55,000 Border Patrol apprehensions, 18,600 plus known gotaways in a single single week at the border. There are some of the highest weekly totals that we've ever seen. And Title 42 hasn't even dropped yet. These are stunning numbers, especially that how many gotaways there were in just a single week. You had agents that were assaulted. You had 54,951 apprehensions, 20,000 basically got aways $714,000 seized 101 pounds of cocaine, 1,050 pounds of marijuana, 2,721 pounds of meth, 138 pounds of fentanyl, 16 firearms, 6 sex offenders in the group that we did catch in one week, seven gang members. And that's what happened at the border in one week. And yet this administration continues to tell the lie that the border is secure. It's not.

You're exactly right. And the stunning thing is it's fixing to get worse. We have the worst illegal immigration in the history of our nation. Six and a half million people have crossed illegally under Joe Biden. All of that is A direct political decision Joe Biden and Kamala Harris made. And it is about to get worse. On Thursday of this week, May 11, the administration is going to lose the authority to deport people under Title 42. Title 42 was essentially the only legal basis under which they were deporting anyone. So now it is truly going to be. Katie, Bar the door. Anyone who crosses. Guess what? Joe Biden is your travel agent. Pick a city and come on in. And. And you know what? It is so bad that even the corrupt corporate media is forced to acknowledge it. It's the front lines of a humanitarian crisis in South Texas. The Department of Homeland Security says they've encountered an influx of migrants ahead of Title 42's end, driven by an uptick in Venezuelan nationals. Still others wait in Mexico camped along the Rio Grande River. New Biden administration guidelines that kick in after May 11th promise more consequences like a one way ticket. On Ice Air, we watched as 133 migrants, hands and feet shackled, boarded a plane back to Guatemala Friday.

Back at home in Venezuela, she says there is nothing. The mayor of Laredo has declared a citywide emergency.

And I got to say, look, they aired that on the Sunday show on Face the Nation. The images you see, people just homeless, just gathered in the streets. It is a crisis in South Texas it is a crisis that is overwhelming. It's overwhelming the hospitals, it's overwhelming the jails, it's overwhelming the schools, it's overwhelming the communities.

And they're deliberately making decisions to make it worse.

That's just not true. We know that he was lying then, we know he's lying now. More than 6.3 now, probably 6.4 million illegal immigrants have crossed the border since Biden took office. We gave those stats a moment ago. What happened in just one week?

Well, within the Biden administration, there are zero consequences for lying. Mayorkas lies on a daily basis. Karine Jean Pierre said that illegal immigration had dropped 90% under Joe Biden. That's such a wild, bald faced lie. I actually wonder if the reporters sitting in the press briefing room moved because they were afraid lightning was going to strike her as she was talking. And she does that on a daily basis. And here's what we've learned. Number one, there are no penalties for lying in the Biden administration. But number two, you get rewarded. The only reasonable inference is it is their job to lie. Like Baghdad Bob, Saddam Hussein's lying press spokesperson Mayorkas and Karine Jean Pierre are sent out every day with the instructions go lie because Joe Biden wants you to lie, because the Democrats in Congress want you to lie. And they're counting on the dishonest corporate media not to call them on their lies. Now, there are moments where there are cracks in the facade and you get things like Face the Nation actually admitting there's a humanitarian crisis these guys have caused. Now, mind you, although CBS acknowledged that they didn't point out that every word that comes out of the White House spokespeople's mouths is a lie, that there's still no consequences, you ask will be the consequences to pay. Two groups will determine that. Number one, the House of Representatives. As you know, I believe we should impeach Alejandro Mayorkas. I hope they do exactly that. Number two, the American people, I think the real accountability is going to be in November of next year. And I hope the American people say enough is enough and throw the bums out. Throw Joe Biden out of the White House and throw Democrats out of the Senate and the House and give us Republican majorities in both. If we have a Republican president and a Republican Senate and a Republican House, we can solve this problem. We can do it fast and we know we can do that because we did it before. In 2020, the last year of the Trump presidency, we had the lowest rate of illegal immigration in 45 years. We can do it again. And if the American people want this insanity stopped, the way to get there is a big, big win next November.
