Police should be carrying edge weapons to slash that dude's throat while that fight's going on.

It's either a coffin or if this guy's approaching you and you aren't physically able to defend yourself in the doorway of your car, shut that door, put it in drive and move. Get the hell away from position, get out, separate yourself from the door. Attack.

He's a danger to everybody, as we saw. But that was ongoing. She knew he was running, which direction. Knew he was get. Knew she never even put her car in park. If you watch the car rolls forward and crashes into the mail truck. I mean, we've all been on. We've all been on perimeters. We don't sit on our car in a perimeter. Yeah, we get out of our car on the perimeter. We're prepared for looking around our music. Everything else is going on in the car. You get out of your car and you're looking. I have a problem with her sitting in the car during a foot.

And I say this all the time. Excuse me. We talk about this sometimes when I train SWAT teams. Sometimes I'll just. I'll say law enforcement now, but it could be anyone. They do things to. To try to be safe, but in actuality, it actually makes the situation more dangerous. And there is a prime example of her being halfway in her car, feeling like, hey, I'm in this safe spot. When you are not either be out of your car. And you would have known way before he got there that. That. That is. You're not. You cannot. You can't let safety play a role in your tactics. Good tactics are the safest thing.

The second he reached for that gun, she was justified to shoot him.

This is another great topic to hop back on that we've talked about before which is well, you have a. You have a staffing issue. Would you rather have more cops that at least are out there or less competent cops? And at the end of the day we always end up going back to I'd rather have less people that are more competent because fewer people I want vacation days. Fewer people on that scene would. Would have been better and. And she made the scene worse by being there. The numbers did not help them out. The numbers the weak links think made everything more dangerous for everyone.

That culture, race, regardless, that culture, right, is absolutely toxic. And they will look to you and you and you and all you guys did this job and say, how are you going to do your better to work around that? You shouldn't have to work around that. The problem has never really been law enforcement. You can jump down my throat all you want with that. The majority of the problem has not been law enforcement. The majority of the problem has been that culture. And show me anyone, any city leader that has stood up and said, hey, we need to fix this. They're not, they're not coming after us with because we don't have warrants. They're not coming after us because we're not running from. They don't come after us because we're not committing crimes. Let's just, let's just try this crazy, crazy experiment and let's just stop committing crimes. So I don't know for just a couple months and see what happens. But no, they sit there and they blame you for bad policing.

There's so much wild stuff that goes on to and that you don't realize. Like I remember going to calls where like seven year old grandmothers have like eight grandkids dumped at their house. And I'm like, where's the moms? They're like, we haven't seen the mom in like five days.

And they're like four different moms with like eight grandkids and one 80 year old lady trying to take care of.

And you're like, and there's like one year old kids running outside in diapers, the ones down the road. And you're like, what do you do for that? And then you go, make an arrest for, like, child ab. And then you're the dcf.

DCF looks at it and goes, there's food in the fridge.

I didn't understand this until, of all people, Drew made me think about this a little differently. I'm like, I thought for a second, like, grandparents raising kids might. Might be a good thing. Like, they have so much experience. They've already raised kids. They have 40, 50 years of experience under their belt. They usually have a little bit more money. Why is it such a problem? And. And Drew's like, as a youth pastor, had to deal with kids that had grandparents raising them. It's like. Like, because they didn't raise kids good the first time.

The water out of the washing machine, the water pipe, and it's like, she's like $2,000 in damage in this apartment. Our landlord's on our ass and all this stuff. And they're like. And I'm like, first off, I don't know what you guys want me to do about this. The kid is sitting here perfectly fine. He's obviously a psychopath because he's just I him. And I go, what do you have to say about yourself? And he looks over his shoulder, and he just kind of smiles and talks a little bit of talk. So he's a psycho at nine years old. But I'm like, he's not committing any crimes right here, guys. There's nothing I can do for you. And I can't turning him off and.

Was his negligence a factor into something happening? Why would you not check the pulse breathing of a person not moving underneath you for that length of time? So that is my. I won't debate you on whether or not he killed him. I will say that I think he.

Think it falls into that. Does it now? It looks horrible because of what he was actually doing. Do I think he choked him with his knee? Absolutely not. Do I think, did he contribute or negligence contribute to George Floyd's death from him? I think it did. And that could be as simple as not performing life saving measures on a non moving, non breathing person for multiple minutes.

Should he be in jail? No, because what's jail for maybe rehabilitation.

But then he didn't for about nine minutes. That's my only problem.

I don't think he killed him. I don't think he committed murder by any means, but I think he was negligent.

[Justin]

Let's, let's walk down this road then helping him and I think you just kind of touched on it. But then does he deserve jail time over negligence that turns into a homicide?

[Derek]

No, that's where I kind of walk because, because what jail is for is rehabilitation. Okay. And he's, I don't think he's going to go do that again. Whereas a drug dealer or a murderer, a real murderer needs to be really rehabilitated from that behavior. I don't know. They needed to go to jail.

[Justin]

You're talking about it more from like a, like from a, a morality. I don't know if morality is the word I want to use. I'm talking from a legal standpoint. I don't know if that changes like the question or how you answered it.

[Derek]

I think legally. Do you think he should have got a different trial? I think the, I think the murder charge to have been completely gone because I don't think he intentionally caused the act. He should have been tried for manslaughter and those factors of what manslaughter is.

[Justin]

Okay.

[Derek]

And those instructions should have been brought separate from a murder charge.

[Justin]

So. So, yes. All right, so to, to dig down and be a little more clear. An innocent man is in jail because they overreached on a murder charge and should have never gotten to a murder charge. It should have, it should have gotten innocent of murder.

[Derek]

Correct.

[Justin]

And he should be free. Had they, had they tried something more like that and whatever the punishment was, it'd take a little of manslaughter.

[Derek]

He's probably served enough time at this point that for a third degree, whatever that charge is for negligence. He's done his time.

[Justin]

He got shanked in prison, too.

[Brent]

Good. He applied for the grant. They're in the process of getting that pushed through and they're going to start providing support and a place to donate as soon as I get that link and where you can donate to help Sal, I will post it. But I spoke to Eddie today and they are in the process of helping that family. For those that don't know, he was indicted up in Jersey for what is absolutely a clean shoot. And Eddie Gallagher and Andrea are great and they're helping out.

I know we got a few. Just, just Reader's Digest. Explain to people what happened.

[Derek]

Just real quick. So he gets a call with no cat notes and no other information that a two armed subjects are breaking in a house house and doing a burglary. They get to the scene. No information on the homeowner's description, no description on the suspect. As they pull up, his first partner pulls up, is confronted with a man with a gun, speeds off and yells, he's got a gun. Sal jumps out of his car. You can see in body cam the guy is raising the gun. All the information he has is two guys are breaking into a house armed. He fires and shoots and kills him. It ends up being the homeowner, which is very unfortunate. But he had talked about suicide by cop. He was inebriated on methamphetamine and alcohol and he had talked about killing himself. It got to the point that the. The victim's girlfriend actually testified for the police and said he. He was in this condition, wanted to die.

[Brent]

Did she change her?

[Derek]

He worked 20 months. Cleared, promoted officer of the year. He is driving along.

[Justin]

That's where the story really gets crazy.

[Derek]

A call that says you have two hours to turn yourself in to the jail. You've been indicted for murder. Had it. Got married, had a kid living Any. And that's a mental health issue. That call is never going to get by you. That you killed a homeowner.

[Justin]

That shouldn't be any more by the book. We've. We've done two videos now of homeowners showing up to the door with a gun.

[Derek]

Yes.

[Justin]

Which we talk about that. That's got to be a cop's worst nightmare. I mean, it's, it's, it's legal. It's a horrible idea. But you're talking about a guy who's outside in his yard blatantly walking up to police officers and raising his own body cam.

[Derek]

He brings the gun up.

[Justin]

Right. What other option do you expect that cop to do?

[Derek]

He did everything he was trained to do. He saved other people. He saved his fellow officers. He is a good dude. He has a great family. Dad is a 36 year SWAT operator out of the city of Philadelphia. Law enforcement family. And he did nothing wrong. And a Trump. Anti Trump Cory Booker supporting attorney general came in and just started rolodexing all the cop shootings and he gets indicted 20 months later. It is the worst one I've seen yet.

[Brent]

Yeah.

[Mike]

That's crazy. He didn't even know that that was coming down the pipe.

[Derek]

No idea.

[Mike]

Yeah.

[Derek]

He's driving along one day, minding his business. Back to work, living and, you know.

[Justin]

Doing what he's doing.

[Derek]

And you know, he gets into some of the stuff me and Tyler talk about is the thin blue line. You don't hear from anybody. Nobody calls him.

[Brent]

Yeah.

[Derek]

You know, nobody checks his friends.

[Brent]

His peers got told they couldn't contact him. You. You can't tell me a brother.

[Justin]

That's right.

[Brent]

You cannot tell me.

[Derek]

You can kiss my ass.

[Brent]

Yeah, maybe not talk about the case. Okay.

[Derek]

Yeah.

[Brent]

Because I don't want to get him.

[Derek]

I'm gonna come sit at your table. We're gonna break bread. We're gonna have a beer. We're gonna see how you're doing. I don't care. I don't care. I'd quit my job before I wouldn't go see him. And that's for sure. It's unfortunate.

They just can't pay him because of the statute that it's a murder charge. They're not allowed to pay him. But they brought him back. They agree it's not a bad shoot. But if he gets.

If he gets cleared for with this, will they have to back pay him?

The other good news is that the governor election is in November and they're hoping that the Democrat is out and the Republican takes over and comes in with some sense.
