You're welcome. Thank you. Janine Pirro is on the loose. She's indicted the 67 year old former Olympic canoeist Davey Hearn, and she gave an absolutely insane press conference about it today.

Watch Today is about accountability for damaging a national resource, a national treasure. And that is the reflecting pool that runs from the Washington Monument to the Lincoln Memorial, which is, of course, a symbol of DC's beauty and history. Now, it was recently renovated with significant funds and investments, and any tampering undermines that. And make no mistake, if anyone decides they want to damage that, whatever they think their reason is, or whether they think it's justified or whether they think it's not important, will be held to account. This is a priority not only for the President, but for myself as well. So today, a grand jury has returned a felony indictment against a defendant, David Hearn, for felony destruction of property, for which he faces 10 years in prison. The indictment is in response to an incident that occurred on June 19th of 2026, in which the defendant, Hearn, ripped a piece of recently installed sealant on the bottom of the reflecting pool at the Lincoln Memorial. The evidence shows, and we will prove beyond a reasonable doubt that Hearn willfully destroyed property at the Lincoln Memorial Reflecting Pool.

By Hearn's own admission, on June 19, he. He reached down into the pool. Our evidence further shows that the National Park Service employees observed Hearn actually forcefully and violently pulling up and removing the bottom liner with both hands. According to witnesses, Hearn damaged approximately 2 square feet of sealant from the bottom of the pool. A Parks employee actually told Hearn to stop. To stop his behavior and stop what he was doing. Hearn reacted by shouting at that Parks employee, saying that she cared too much about the reflecting pool. And why did she even care since it wasn't her pool?

Oh, my goodness. And incredibly. And I think that this is fantastic. Norm Eisen is. He's been on our show a few times. He's representing David Hearn. And I love this. And we went over this, like I said, on the audio podcast, but he put out a statement today that said, davey Hearn is innocent. These charges are outrageous and should be alarming to every American. This indictment reflects. Get it? Reflecting Pool, the administration's effort to shift blame for their own failures. The statement read, on the eve of our nation's Independence Day, Americans should be deeply concerned by the misuse of government power against an ordinary Citizen based on a concocted narrative. The justice system exists to determine facts, not to provide political cover. And I think that pivots perfectly into the second part of Beans Talk today because Nicole Wallace got an interview with Jack Smith, former special counsel who brought up the weaponization of the Department of Justice. And, and I know you're going to roll a clip here in a second, but I think one of my favorite things that he said was like, Nicole asked him about the weaponization and what's going on with like Janine Pirro and others other U.S. attorney's offices under the direction of Todd Blanch and Pam Bondi. He's like Jim Comey, Letitia James, Jero, I mean, come on, Seashells. Like he was, he was like, this is the most ridiculous and, you know, terrifying weaponization of the Justice Department that we've ever seen.

And the more I listen to him, the more I really like and respect Jack Smith, to be honest with you. I mean, it really takes us back to a time where there was still a semblance of sanity within the Justice Department. I mean, truly, he's just wonderful. He appeared on Deadline, as you talked about Deadline White House Today, and he, he had a lot to say, a lot to about Trump's weaponization of the Justice Department. So here's the first clip.

Well, you know, I was a career prosecutor. I worked in the Justice Department and other prosecutors offices for near on 30 years. And I don't know if your viewers know this, but I work in Republican and Democratic administrations over and over. I was the Acting U.S. attorney in the first Trump administration in Nashville, Tennessee. And that administration appointed me to a position running a war crimes tribunal for the State Department. So I have investigated cases focusing on the facts and law throughout my career. We did this case the same way, under the same standards. And the thing that's, I think, important for your viewers to know is those standards are not meant to change from one administration to the next. And in my experience until now, they haven't. And so I think we are facing an attack on the rule of law that is different in kind and scope to anything I've seen in my lifetime. And one of the reasons I wanted to be with you here today in advance of the Fourth of July, celebrating the birth of a country that we all love, is to celebrate the public servants who do this work, the people I spent my career working shoulder to shoulder with. I loved being a prosecutor, and part of it was I loved being around these sort of people. And it angers me to see Them victimized, to see them demonized for doing their jobs. I think it's really important that we stand up for them and let them know that there are a lot of people out there who back them and who are with them. And it's not just the people who've been targeted and fired for no reason for doing their jobs. It's also the people still in the Justice Department today. There are a lot of good career prosecutors who right now are working under incredibly difficult circumstances and they're still trying to do the right thing. And these are not self promoters. These are not people who are going to go out and, you know, crow about their achievements. We need to hold them up and celebrate them because they're part of what makes this country great.

And I love that. He's like, you know what? I've done this for more than one administration. Trump was appointed in his first administration for war crimes. Like, it just, if you turn on Trump, he sees it as a direct attack on him. If you're just doing your damn job, he's just doing his job.

And I wish he could have, you know, answered more about volume two of the report, which we found out today the DOJ hilariously accidentally emailed to the person they're prosecuting for emailing volume two

a woman named Carmen Leinberger, who's a former prosecutor. She's the one who emailed copies of volume two of Jack Smith's report to her Hotmail and Gmail disguised as cake recipes. Do you remember?

But, you know, Jack Smith went on to say a lot of stuff. I highly recommend you watch the entire interview. But this, this is another standout part of the interview to me. Here he is talking about some of the cases Trump has brought against his political enemies. The judge basically said that in the Kilmar Abrego Garcia case, said that he found that this was a, an instance where basically criminality was being reverse engineered all the way up to Todd Blanche. If a judge has found that, what do you think they're capable of with two more years?

Well, as I said earlier, I, from my perspective, I've seen a number of cases. James Comey, Letitia James, Jerome Powell. I mean, right. There's not criminality here. I mean, seashells. I mean, so the only reasonable explanation is the president has it out for these people and he has people who, his former personal lawyers who are going to do what he says regardless of the facts or law. I mean, you know, again, just to juxtapose it, I didn't have People on my team resigning because they refused to go along with a scheme to go after somebody. That was not what happened. You see that in all these cases. And just again, imagine if you would like, I was appointed from outside the government, no political allegiance to anybody, and they were comfortable with Jack. Wherever you think the facts and law dictate, that's what we'll do, and that's what will happen. Can you imagine that happening now? If there was an allegation of corruption in this administration, them saying, let's appoint an outside independent person to make a call on this, I think we know would never happen. And I think that's a real easy way to differentiate. Following process, following the facts, having independence.

And it's so obvious. It's retribution against the people he deems as his enemies. I mean, Jack is very clear on this.

indict, you know, a kayaker, an Olympic kayaker.

And not that Olympians can't commit crimes. This just isn't one of them.

Who's done absolutely nothing wrong and I'm sure will win his case and it'll be another embarrassment, but she'll bring all the crime she doesn't care about, not guilty verdicts. And that was something that Jack Smith was talking about in that first clip that you showed. He's like, there's a process you have to go through, and it's the facts that are important. You follow the facts in the law, and you can't go wrong. And there are still people left at the Department of Justice with some integrity. The problem is, is when you come across somebody who wants to assign you to one of the, like, a seashells case or whatever, right. Sandwich guy case, and you're like, I'm not doing that. And then you, you know, you got to leave your position because you're not going to go against the oath that you took. You're not going to go against the facts. And that's why there's such a huge brain drain at the Department of Justice. So it was a really fascinating interview. It was nice to see, and I know Andy McCabe and I are going to be talking about it quite a bit on this weekend's episode of the Unjustified podcast.
