Hello and welcome to the Daily beans for Thursday, Dec. 4, 2025. Today, the Pentagon knew there were survivors of the Sept. 2 boat strike. Ghislaine Maxwell is going to file a habeas petition challenging her incarceration, and she's worried that the release of the Epstein files will be damaging to her case. Nancy Mace is considering following Marjorie Taylor Greene's lead and resigning before the end of her term. In the House, the Department of Defense inspector general found that Pete Hegseth's Signal chat put troops in harm's way. Democrats swung 13 points with every county moving left in the special election for Tennessee's 7th congressional district, the government is inviting employees to voluntarily disclose their disabilities. The House Judiciary Republicans have refused Jack Smith's demand for public testimony and have issued a subpoena to hold questioning behind closed doors. Judge Beryl Howell has barred the Trump administration from making warrantless arrests of immigrants in D.C. unless they're deemed a flight risk. And the speaker of the Virginia State House said the legislature there is considering a one Republican Congressional Map. I'm your host, Alison Gill.

Hey everybody, Happy Thursday. Lots going on in the news. Dana's out today. She's traveling. So I'm here solo. First of all, Afton Ben did not win the special election in Tennessee 7th District, but she did claw back 13 points from Trump's victory in the district in November. And every single county in the district moved to the left. That's pretty incredible for a progressive Democrat in a deep red district who was ferociously outspent. So congrats to all the volunteers in the campaign of Afton Ben. Really well done. I wish we could have pulled it out, but just incredible pulling back those 13 points. And the speaker of the Virginia State House of Representatives said in an interview that the legislature there is considering redrawing their 6Dem 5 Republican map. It's 6 to 5 right now. They want to make it 10 to 1. They said that's not out of the realm of possibility and I think that that would be outstanding. So I hope they get that done. Also, the Department of Veterans affairs sent out an email to all its employees with a link inviting them to disclose their disabilities to the government. Specifically, Russ Vogt over at Office of Personnel Management. Now they're calling it the Biannual Self Identification of Disability Campaign, and they claim it's part of an effort to hire and advance people with disabilities. But that is complete bullshit. I worked at the VA for over a decade. As you know. We never had any biannual self Identification of Disability campaign. The VA knows the only way they can legally get their hands on your personal disability information is if you voluntarily give it to them. So don't. I wouldn't. There's no reason to. Also, Ghislaine Maxwell is worried that the Epstein files being released would really, really, really, really damage her reputation. So she had her lawyer, the lawyer I got in a Twitter spat with, David Marcus, write a letter to Judge Engelmeier saying, dear Judge Engelmeier, understanding that Trump has signed the Epstein Transparency act into law, Ms. Maxwell does not take a position regarding the government's request to unseal the grand jury transcripts and modify the protective order. At the same time, Ms. Maxwell respectfully notes that shortly she will be filing a habeas petition pro se. That means by herself, without lawyers. Releasing the grand jury materials from her case, which contain untested and unproven allegations, would create undue prejudice so severe that it would foreclose the possibility of a Fair retrial should Ms. Maxwell's habeas petition succeed. Respectfully submitted, David Marcus and Melissa Madrigal, two lawyers who aren't going to sign on to her habeas petition. I guess, I don't know that she. I guess she couldn't find a lawyer to do that. Obviously, that habeas petition is just a tool to try to keep the Epstein files from being released. She doesn't have a snowball's chance in hell. Her appeal is exhausted. The Supreme Court denied it. But she wants to keep it open. She really, really wants to make sure that all of her avenues aren't exhausted. Because if it's open, she may be able to, I don't know, finagle her way into not having some files released anyway. Also, Jim Jordan refused former special counsel Jack Smith's offer to testify publicly. Remember, Jim Jordan was like, come in behind closed doors. Jack Smith wrote a letter saying, nah, bro, I'm going to come in and testify in public so that you can't twist my words around. Right? Well, Jim Jordan says, no, you can't testify in public, and they've issued a subpoena for him to appear before the House Judiciary behind closed doors.
