So, yes, yes, gloves off. And I appreciate it. It's Friday here on the Daily Beans, which means we're going to talk to John Fugal saying later in the show, I'm excited about that. And we have a lot of legal news today, so we're going to break this up into a couple segments. So first, let's do some quick hits. All right, first up, the supreme court in a 5, 4 ruling, with Chief Justice John Roberts siding with the liberals, has allowed the Trump administration to continue blocking grants to the National Institutes of Health. But five have also signaled that the underlying Trump directives are unlawful. So that sends a fairly strong, if mixed message that Trump will lose these cases eventually, but only once they're brought in the Court of Federal Claims, which is that special circuit where they hear like tariff cases and trade stuff. So we're going to keep you posted. And thanks to Steve Vladic for the story.

Absolutely. And this one's from NBC. A federal judge on Thursday found that Acting U.S. attorney Alina Haba's appointment was unlawful and her actions since July as the top federal prosecutor in New Jersey, they may be declared void. And I quote, the executive branch has perpetrated Alina Haba's appointment to act as the United States Attorney for the District of New Jersey through a novel series of legal and personal moves. This is from U.S. district Judge Matthew Brann. He wrote that in a 77 page ruling. He went on to say, faced with the question of whether Ms. Haba is lawfully performing the functions and duties of the office of the United States Attorney for the District of New Jersey, I conclude that she is not. Because the former Trump lawyer is, quote, not currently qualified to exercise the functions and duties of the office in an acting capacity, she must be disqualified from participating in any ongoing cases. Again, this is from the judge. Brand went on to say that his order is on hold pending appellate proceedings, meaning it will not take immediate effect to allow Trump administration obviously, time to appeal the decision. And you know they're going to.

About California Republicans who are offended by Gavin Newsom saying fight fire with fire. They took the redistricting fight directly to the California Supreme Court saying that we didn't give a proper 30 day notice. Well, the California Supreme Court told them to pound sand. And from the Washington Post, California lawmakers on Thursday began passing a series of bills aimed at drawing new congressional maps as Democrats try to counter the Republican driven effort in Texas. Now, California Democrats in a Assembly Thursday morning changed the state's redistricting ballot measure legislation which basically now allows new congressional maps to go into effect no matter what other states do. So even if Texas backtracks or the courts strike Texas down, California will have new maps. The California assembly has passed the measure and the question will be on the ballot in a special election this November. Gavin Newsom is expected to sign the bills as we record this podcast.

And this one's from CNN and New York. I do not love this one, by the way. Cnn. A New York appeals court has thrown out the roughly half billion dollar judgment against Trump in the civil fraud case brought by the state's attorney general. Thursday's decision, which was not unanimous, leaves Trump still liable for fraud. So he's still guilty of the 34 counts. The judges upheld his liability and tossed the penalty so that the case could move forward to further appellate review. Obviously, New York Attorney General Tish James plans to appeal that ruling. In the prevailing opinion, the judges wrote, while the injunctive relief ordered by the court is well crafted to curb defendants business culture, the court's disgorgement order, which directs that defendant's pay nearly half a billion dollars in the state of New York is an excessive fine that violates the Eighth Amendment of the United States Constitution.

All right, next up from Politico, a federal appeals court has given the Trump administration the go ahead to end deportation protections and revoke work permits for more than 63,000 immigrants from Nicaragua, Honduras and Nepal, despite a lower court judge's conclusion that the administration's action was driven by racism. A 9th Circuit Court of Appeals panel voted 3 to 0 Wednesday to grant the Justice Department's request for an emergency order allowing it to proceed with the termination of TPS temporary protected status for citizens of three countries while the litigation over the issue continues. So it's not settled, but all these folks are going to be deported anyway.

Okay, this one's from the Independent, the judge in Texas denied on Wednesday. This one's a little bit of good news. Elon Musk, Musk's request to dismiss a class action lawsuit against him and his political action committee brought by a group of voters who participated in his $1 million a day giveaway leading up to the 2024 election. Over the last few months, lawyers for Musk and America PAC have sought to get rid of the lawsuit brought by the voters in battleground states who claimed they were defrauded when the tech mogul and his PAC misled them to believe that if they signed a petition and gave away personal information, they could randomly win a million dollars. In reality, Musk and his PAC had preselected people to win the million in exchange for a spokesperson contract, meaning those who signed the petition had no chance of winning. Musk and America PAC will now have to face the lawsuit filed in Texas from the group of voters.

It's time for the Hot notes. Hot notes. All right, first up, from Erin Reed, who I love at Erin in the Morning. That's her substack. Please subscribe. On Friday, the U.S. office of Personnel Management issued a memo announcing that beginning in 2026, all federal employees health plans will be barred from covering gender affirming care, including hormone therapy and gender affirming surgeries for both transgender youth and adults. The sweeping prohibition affects health benefits for more than 10 million federal workers and their members, marking one of the largest rollbacks of transgender health care across US in history. Even more disturbing, the memo mandates that insurers cover faith based counseling for transgender individuals, otherwise known as conversion therapy.

Yeah, yeah. Taken together. So your tax dollars are going to be paying for conversion therapy covered for federal workers. Taken together, the provisions appear designed not to just strip access to necessary medical care, but to coerce federal to detransitioning or leaving public service altogether. Quote for plan year 2026, chemical and surgical modification of an individual's sex traits through medical interventions to include gender transition services will no longer be covered under the FEHB or PSHB programs. This exclusion expands upon carrier letter 202501A and applies regardless of age. As an exception, counseling services for possible or diagnosed gender dysphoria must still be covered. Covered counseling services must be provided by a licensed mental health provider and may include those who provide faith based counseling. That's a quote from the memo directly. The move appears to directly contradict long standing interpretations of section 1557 of the Affordable Care act, which prohibits health care discrimination on the basis of sex. Under previous administrations, this provision has been used to mandate coverage of gender affirming care for transgender people both within the federal government and in several states with respect to Medicaid coverage. However, a recent Supreme Court decision known as US V. Scurmetti opened the door to medical discrimination against transgender people by ruling that the denial of such care does not violate equal protection rights. The administration, likely emboldened by that ruling, appears to believe it can now strip gender affirming care from employee health plans, including for adults, with impunity. If challenged, the administration may anticipate prevailing in a judicial system increasingly hostile to transgender people, setting the stage for yet another wave of legal battles that could shape access to care for years to come. Quote this discriminatory policy denying medical care to government employees and their dependents is not only cruel, it's illegal. That is Lambda Legal counsel and health care strategist Omar Gonzalez Pagan. He went on to say the federal government cannot simply strip away essential health coverage from transgender employees while providing comprehensive medical care to all other federal workers. Beyond the fundamental equal protection guarantees enshrined in the Constitution, which prohibit such animus laden actions, multiple federal laws also prohibit this type of discrimination. Title VII of the Civil Rights act prohibits employment discrimination, including denying equal benefits to LGBTQ employees. As confirmed by the Supreme Court's decision in Bostock, section 1557 of the Affordable Care act bars discrimination on the basis of sex in federally funded health programs. The federal government cannot simply ignore and violate these laws.

Thanks so much, Alison. This next story is from the Associated Press. The Trump administration said Thursday that it's reviewing more than 55 million people who have valid US visas for any violations that could lead to deportation, marking a growing crackdown on foreigners who are permitted to be in the United States. In a written answer to a question from the Associated Press, the State Department said all US Visa holders, which can include tourists from other countries, are subject to continuous vetting, with an eye toward any indication that they could be ineligible for permission to enter or stay in the United States. Should such information be found, the visa will be revoked, and if the visa holder is in the United States, he or she would be subject to deportation. Since Trump took office, his administration is focused on deporting migrants illegally in the United States as well as holders of the student and visitor exchange visas. The State Department's new language suggests that the continual vetting process, which officials acknowledge is very time consuming, is far more widespread, and could mean even those approved to be in the US could abruptly see those permissions revoked. The department said it was looking for indicators of ineligibility, including people staying past the authorized time frame outlined in the visa criminal activity, threats to public safety, engaging in any form of terrorist activity, or providing support to a terrorist organization. Officials say the reviews will include all visa holders, social media accounts, law enforcement, and immigration records in their home countries, along with any actionable violations of U.S. law committed while they were in the United States. The reviews are going to include new tools for data collection on past, present, and future visa applicants, including a complete scouring of social media sites made possible by new requirements introduced earlier this year. Those make it mandatory for privacy switches on cell phones and other electronic devices or apps to be turned off when an applicant appears for a visa interview. My God.

All right, Next up from NBC. President Trump has purchased at least $103 million worth. $103. $103 million worth of corporate and municipal bonds since he took office in January. That's according to new filings with the Office of Government Ethics, which I don't even know what they're even doing at the Office of Government Ethics these days. The documents, by the way, released late Tuesday, show Trump began the bond buying spree one day after he was sworn in January 20th and includes debt sold by companies, local governments, and entities that could be directly affected by his agenda. All told, Trump made about 690 purchases from January 21 through August 1. On January 21, Trump purchased a bond belonging to the New York Triborough Bridge and Tunnel Authority. A week later, he purchased another handful of bonds over consecutive days. Those bonds belong to various municipal hospital facilities, airports, regional development funds, and school districts from Florida to Alaska. The filings do not provide exact purchase amounts, but instead show a broad dollar range for each transaction. And the filings didn't show any sales by Donald Trump. Trump's buying continued at a steady clip for months, including bonds from Mega Banks Morgan Stanley, Wells Fargo and Citigroup worth at least $100,000 apiece. Now, Trump's direct ownership of bonds from three of the country's banking giants comes as he considers an eventual replacement of Federal Reserve Chair Jerome Powell. And weeks after he nominated one of his top aides, Steven Mirren, to a seat on the Fed's board, Trump purchases also include at least $500,000 worth of bonds apiece from chipmaker Qualcomm, mobile provider T Mobile, Home Depot, and UnitedHealth Group, that's the country's largest private health insurance company. I think it's because he's trying to privatize the VA and give that contract to United. That's just my insider feeling there.

The filings also show that Trump bought at least $250,000 of Meta bonds, which is, you know, Facebook CEO Mark Zuckerberg attended Trump's inauguration and donated a million bucks to that event. Likewise, Trump's ownership in hundreds of municipal bonds puts him in line to benefit when those municipal entities pay back that debt. And it comes when the administration has been tightly controlling the distribution of funds from the federal government to local and regional governments. So.

All right, this is from NBC, a longtime ally, advisor and fundraising for New York Mayor Eric Adams was suspended from his re election effort after she attempted to hand a local journalist a cash stuffed potato chip bag. That does sound like a mad lib. It's not. Winnie Greco was outed by a local news organization, the city, for trying to give cash surreptitiously tucked inside a hers sour cream and onion ripple potato chip bag to one of its city hall reporters after a campaign event Wednesday afternoon in Harlem. And a former chief advisor 2 Adams was indicted on new charges in an alleged bribery scheme on Thursday morning, less than a day after Greco that revelation and they just do not get it. According to the news outlet, the reporter Katie Honan initially refused the potato chips, which she believed to be a genuine snack offer. But Greco insisted upon discovering the wad of cash, which reportedly included at least $1 100 bill and several $20 bills. She immediately contacted the Adams confidant to return the unwanted gift.

Greco later called the money offer, quote, a mistake and apologize profusely when the city contacted her about why she tried to give a reporter who covers Adams administration a cash gift after an event meant to support his reelection. Greco, who is Chinese, said the act was a cultural thing, a position her attorney supported in a statement to the city. Okay, and I quote, I can see how this looks strange. That's what Greco's attorney, Steve Brill, told the city. But I assure you that Winnie's intent was purely innocent. In the Chinese culture, money is often given to others in a gesture of friendship and gratitude. Winnie is apologetic and embarrassed by any negative impression or confusion this may have caused. Now, I'm not saying she's guilty. You're a guy saying you're an official. And perhaps a different wrapping in the Chinese culture, a red envelope, something of that sort. Not a potato chip bag. May have made this look less sketchy as fuck.

Manhattan District attorney Alvin Bragg Jr. Announced charges against Ingrid Lewis Martin, who served as Adam Adams's chief advisor until she abruptly resigned in December. Lewis Martin is accused of accepting more than 75,000 in bribes. That's a lot of potato chip bags.

All right, everybody. The Department of Defense has authorized DoD civilian employees to apply to be detailed out to ICE and Customs and Border Patrol at the southern border. There's now an announcement on USAjobs.gov but the announcement includes an email address. Everyone one, it's FEMA. Volunteerforceema.dhs.gov we're going to have that in the show notes for you. This is from an Altgov account who wrote to me that says as an Altgov, I've worked with an Altgov FEMA person and the consensus is for the world to spam the fuck out of that address with accolades and thank yous to FEMA personnel. Sing FEMA's praises, thank them and maybe a fuck ice or two. And I have to tell you, I got that email. I know I got a bunch of stuff. I just wrote it up on muellershirerote.com that all these DoD civilian employees are being offered this ICE detail. But as a veteran, I got an email with a video in it, Dana, that is recruiting me to join ICE, saying I can get a $50,000 signing bonus, I can get $60,000 of federal student loan forgiveness, all kinds of great medical benefits. But here's the wild part. I went to a VA appointment just this at my primary care provider, at a VA health clinic. And first of all, first thing I noticed, Dana, all of the LGBTQ/PRIDE flags, trans flags, all gone. All the signage was just gone. Everything is beige. There's a big picture of Trump and Doug Collins and couch. And so that was obviously different. And normally in the VA waiting room, they'll play like Fox News.

You know what? And I'll tell you something. It's a very important thing that James Dobson and I have in common. Neither one of us were ever ordained ministers. And we have to remember that this guy was just a propagandist fraud his entire life. I don't take delight in his death. I don't. I think more about all the people who've been victimized by Dobson and his ilk. Because when I was growing up, we had this news media that told me that guys like James Dobson were what Christians were about. The New York Times called him the nation's most influential evangelical leader. And he was a guy who argued for beating your kids. He was a guy who, when the American Psychological association removed homosexuality from their list of mental disorders in 1973, he resigned from the organization in protest. And he said AIDS was a direct consequence of gay behavior, that the disease was God punishing people. He promoted conversion therapy. And he never. He's the guy who said feminism was established to allow unattractive women easier access to the mainstream of society. He did this daddy daughter dating garbage where fathers and daughters had these creepy purity balls to promote female chastity. I mean, he never fought for any of the things that Jesus ever talked about. And that's why no one's gonna remember him. No one's gonna talk about all the things he did for the less fortunate. No one's gonna talk about how James Dobson came around and cared about the sick or the poor or the marginalized. No. He was a guy who made a lot of money telling Christian racists what they wanted to hear.

Yeah. And he's one of the guys who led to what we're seeing now with the Trump administration and the civil service. They are taking away the coverage for gender affirming care from federal civil servants and mandating coverage for conversion therapy.

For federal civil servants, yeah. It's because of people like Dobson.

And I mean, like, think about who's braver than transgender service members. I mean, people deployed in Afghanistan, Iraq, Syria, dodging bullets, dodging IEDs, dodging Taliban ambushes while Trump was dodging salad at his buffet. These are men and women who are brave enough to fight and die for a country that still treats them like second class citizens. And then Pete Hegseth, this boozed up rapist, this alcoholic abuser of women who comes in here. The Pentagon didn't ask for this policy. The generals didn't ask for this policy. The Air Force didn't want it. But Petey's trying to keep a job. Whispers in Trump beer, and suddenly all of these decorated soldiers just get tossed out like they're Happy Meal toys. And it is as disgraceful to the military as it is to their claims of Christianity.

We've got one of three resolutions that have now passed the California assembly in order to get Proposition 50 on the ballot. To get what? What is it? The consent of the voters in order to redraw our maps in order to push back against what's happening in Texas.

So, yeah, they have the three measures and this would establish the new districts, it would authorize the redrawn map to replace the existing one, and it would declare this November special election to undo the last special election that led to this policy. And it was very noble to have this policy. But again, this is self defense. Every one of these measures is going to require a 2/3 vote to pass. But California Democrats have super majorities. Right? They don't need any Republican votes to do this. And Gavin Newsom has to sign these by Friday to give the local officials enough time to prep for the special election. So again, this is not corrupt. This is countering corruption. If Kathy Hochul decided, screw these Republicans, I'm going to do it too. I would consider that corrupt. But all Gavin Newsom is doing is taking away the unfair advantage Texas Republicans gave by cheating. He's not cheating himself. He's evening the field again. So as long as other Democrats do it, I, I, to me, it's even. And, and honestly, talk about Newsom learning to read the room Allison.

Like, demanding fewer conversations about freedom. And I guess slavery just needed better PR. But I mean, like, like it's incredible. 400 years of slavery in apartheid, and Trump is like, why so negative? I finally broke out of high control religion in 2021 after many exhausting years of trying to change things from the inside as a woman in a rigged patriarchal system that tried to rebrand female submission as equal but different complementarianism. Wow. After a lot of hard work dismantling my belief system, I finally realized that religion has always been a barrier between me and my own humanity. I don't believe in hell anymore, but if there is one, I hope James Dobson is there looking up at both my middle fingers at the very moment. Today I'm serving on my local library advisory board, helping to ensure that my community's library stays a well funded, accessible place and that Bible belt fascist keeps their grubby bands off our books. As a career nonprofit professional, I started my own business, fruitful fundraising company in 2022 to help a small nonprofits create sustainable fundraising plans to power their important work. From the beginning, it was important to me that my services were accessible to even the smallest nonprofits. I specialize in working with survivors of sexual and domestic violence and for unfortunately obvious reasons, that population is really struggling right now. I frequently have clients bring up how difficult it is to feel informed about the news without feeling overwhelmed and triggered. I talk a lot about the importance of intentional versus reactive or habitual news consumption, and with clients who are comfortable with consuming information auditorily, I encourage them to consume news exclusively via audio like podcasts whenever possible, preferably while engaging in a physical activity, which could be anything from going for a walk to folding laundry. Receiving the news in a format that only engages one of the senses reduces the likelihood of emotional flooding in individuals with heightened sensory sensitivity, and engaging in physical activity helps with processing any nervous system activation in real time. Huh? I help clients identify what they're looking for in a news source, and things like accuracy of reporting, emphasis on social justice, and the inclusion of stories that inspire hope are all frequently mentioned. I'm happy to able I'm happy to be able to offer the Daily Beans as an option for them to consider, and I'm delighted to hear other therapists out there also helping clients find new sources that meet their needs. So much of this job is about holding space for unsolvable problems, and anytime I can empower clients to seek out resources that affirm and serve them, I feel a bit more empowered as well.
