Making a reference to Marissa Rothenberger, transgender pitcher on the team. Right. Just dick move. But what. It's. What it's. Simone Biles came back.

Oh, she was so good. Simone Biles was basically like, why are you attacking these communities? You need to raise them up. You should be doing something better, even if it's trying to find a solution to this problem. Blah, blah, blah, blah, blah. And of course, Gaines responded. And one of my favorite. My favorite tweets back was Simone Biles saying, why don't you pick on someone your own size? Which would probably be a man, ironically. And I'm sorry, but it made me.

You're straight up sore loser. You should be uplifting the trans community and perhaps finding a way to make sports inclusive or create a new avenue where trans feel safe in sports. Definitely came in fifth in a swim meet or something.

It was a fifth in a swim meet, and it was against the swimmer, Leah Thomas. I believe this all started with Leah Thomas, and it was talking about how Riley Gaines had a problem with Leah Thomas swimming because she said that Leah Thomas was taking records from, quote, unquote, female athletes. Even though Leah Thomas is a female athlete, she just happens to be a trans female athlete. So basically, this is how this started. She became a sweetheart to the right and Trump and all of these bigots, and she comes out talking about how all These trans women are taking records from CIS women, which in numbers, is not necessarily factual. Like, the way she's skewing this is really, really misleading. But Riley Gaines herself never was a number one swimmer. Never had the potential, in my opinion, to be a number one swimmer. And so she has found a platform that is so bigoted. And now that everyone on the right has just puffed her ego up, she will not stop. I think she's getting paid now to do it. A lot of talking spots. She's become their little, you know, their little poster child for this. And thank God, Simone Biles was like, I've had enough. I've had enough.

Yeah. And like, I am. I have zero fear of sharing a bathroom with a trans person. There is no record of a trans person attacking anyone in a restroom. What I'm afraid of is something that happened this past weekend that was pointed out, I think, on TikTok or Instagram, where somebody dressed up as an ICE agent, snatched somebody up off the street and attempted to rape her.

Yeah, me too. We've got a lot to get to today. A lot of stuff happened over the weekend, so we're going to start with some quick hits. All right, so for the latest on Abrego Garcia, you may have heard he's back on US soil after being charged. You check out the new Unjustified episode. We go over all of it. These charges are totally bogus. There are a bunch of huge inconsistencies in the government documents. That press conference by Pam Bondi was wildly prejudicial. You know, all the stuff people kind of wished Merrick Garland would do is going to be really bad for the Department of Justice, I think, in this case, because you can't get up there and say, we've arrested him. He was smuggling people. She was kind of mixing up smuggling with trafficking. Trafficking people. You're doing. You're taking people against their will. Smuggling. It's. It's bringing him in from Mexico. He wasn't right.

You also have lawyers admitting they made a mistake and that he fucked up. Why isn't that, like, the biggest thing that you would lead with?

That's what they're trying to circumvent here by bringing these charges. And there's inconsistencies in the paperwork. It's ridiculous. And again, we go over all of it. And also, by the way, I wrote up something. A lot of people kind of flew under the radar this weekend with everything that was going on. But Judge Sinise in the Abrego Garcia case unsealed a bunch of documents showing what the Trump administration was doing during the time of their investigation, quote, unquote, into Abrego Garcia. So you can check that out dot com. But that wildly prejudicial press conference where Pam Bondi was like, and you know, we're going to stop these smugglers from grooming children to become full fledged members of Ms. 13, none of that he did. He's not charged with anything like that. But to say it in the same breath in a press conference is going to come up in pre trial motions if she doesn't drop the charges. Charges first.

Like, like they had to drop against Ross Baraka, the mayor of Newark, and. And hopefully Abrego Garcia sues the out of Bam Bondi for this. But it was what you'll see emotion that's here. Here are a whole bunch of exhibits like Stephen Miller tweeting this criminal, terrorist, smuggler, trafficker, blah, blah, blah. When you have the chief of staff at DHS putting all that about you before you even gone to trial, you're tainting a jury pool. You are being prejudicial that it's really hard to get a vindictive or a malicious prosecution case and. And to have your charges thrown out. But if there was one, it's this one. So absolutely, we'll be keeping an eye on it. So check out the latest episode of Unjustified.

Okay, thanks, Allison. I don't know if you saw. I'm sure you did. San Antonio police apologized Thursday for a premature statement declaring there was no evidence of a hate crime in the death of Jonathan Joss. Now, the damage was done, but at least they walked back the statement. Remember, they said that the same day it happened that there was no evidence of a hate crime. But then there was a massive backlash and the police apologized and I quote, shouldn't have done it. It was way too soon before we had real information. And I will own that. That's. McManus, by the way, went on to say it was way too early in the process for any statement of that nature to be issued. We understand that many in the LGBTQ community are feeling anxious and concerned. A lot of it has to do with that pre premature statement that we released. And again, I own that. We shouldn't have done it. No, you shouldn't have done it.

That's what I say when the damage is done. Now you've got all these people going, it's not a hate crime. The police said so. And then some of them just walk away and never are open to another opinion or a correction on that.

Yeah. And here's the thing to remember. In San Antonio, he won't be charged with a hate crime because they don't charge hate crimes in San Antonio.

They have hate crime enhancements to sentencing. So you won't see hate crime come up until there's a conviction and this person is sentenced and then they have a hate crime.

Enhancement. So if somebody in the right wing is like, look, no hate crime was charged, you dummy said, well, that's because they don't charge hate crimes. They do hate crime sentence enhancements. And I'm sure that that will be included in the sentencing recommendation. At least it should be anyway. Yeah, I'm that first impression. Right.

It's hard to come back. All right, next up, the Supreme Court docket was busy last week. Bad news and good news. We'll do bad news first. They're allowing DOGE to have access to our private Social Security data and they're letting them keep their records private under FOIA in that CREW lawsuit, which doesn't bode well for my lawsuit against Doge for foia. No, but we press on. At least maybe we know how to tailor our responses. All three liberal justices, by the way, disagreed with that.

I do have more good news, by the way, from the Supreme Court, which is surprising, is that they left in place a long standing gun restriction in the District of Columbia that bans magazines that hold more than 10 rounds of ammunition. And they rejected a Republican appeal and left in place a Pennsylvania court decision allowing people to cast provisional ballots when their mail in votes are rejected for not following technical procedures in state law. That is a win for, for Democrats.

Yes. And remember, Supreme Court didn't decide that. They just didn't take the appeal.

And by the way, I want to take that back. That's a win for voting rights, not just Democrats, because I'm sure some Republicans are actually getting screwed by this as well.

Absolutely. Especially if you're a mail in voter that's military, that's Republican and you cast a provisional ballot because you didn't put the date right or you didn't sign it right. And are you signed in the witness box instead of the voter box and then you can't vote? So. Yeah, very good point. Speaking of Doge, though, this is from the Washington post. Across the government, the Trump administration is scrambling to rehire many federal employees dismissed under Doge's staff slashing initiatives. After wiping out entire offices and in some cases imperiling key services such as weather forecasting and drug approval processes, Trump officials are trying to recover not only people who were fired, but thousands and thousands of experienced senior staffers who opted out taking that fork in the road exit. As the administration rolls out a second resignation offer, thousands more staff are returning in fits and starts as a conflicting patchwork of court decisions to overturn some of Trump's large scale firings go through. And that of course costs money and time and is wasteful. So when they call it the Department of Government Efficiency, it's the opposite.

Well said, by the way. Okay, everyone, this is from Reuters. Tesla's trying to prevent the city of Austin, Texas from releasing public records to Reuters involving the EV makers planned launch of self driving robo taxis in the city this month. Okay, these robocars that you're seeing a lot in a lot of places, that freaked me out a little, but I did ride in one of them now. The news agency in February requested communications between Tesla and Austin officials over the previous two years. The request followed CEO Elon Musk's announcement in January that Tesla would launch fare collecting robo taxis on Austin public streets. Tesla wrote the attorney general saying releasing the records would irreparably harm Tesla. That doesn't sound like the records are very fucking good.

All right everybody, welcome back. Let's hit the hot notes. Hot notes. First up from Chris Mirasola at Lawfare. And this is why I love the experts and that we should kind of wait to see what they have to say about it. But he's writing for Lawfare that Late yesterday, President Donald Trump signed a proclamation mobilizing 2,000 National Guard troops to respond to protests against ICE immigration raids in Los Angeles. This is not an invocation of the Insurrection Act. Instead, the President has relied on a far more limited, though also quite old, theory of inherent presidential authority known as the protective power. In tandem with this theory of constitutional authority, the President has also relied on an emergency statutory authority, title 10, US code section 12406, to mobilize national Guard personnel to undertake the duties authorized under the protective power. Now, the law Trump is using does not allow the National Guard to participate in law enforcement. It does not. So on the ground we have to hold them accountable for doing anything more than fetching water for ICE agents or doing paperwork. So that's me. Mirasola says in the days to come, the public must be laser focused on seeing the extent to which Secretary Hegseth adheres to these historically recognized limitations. Now, Governor Newsom and Mayor Bass have condemned the mobilization of the Guardian because these protests are peaceful. The only people being violent are the ICE officers. I would like to see Newsom maybe do more, but I'm not sure that he can. I'm not enough of an expert to know what else he can do. Can he sue? Maybe sign an executive order to stop this, at least temporarily, while it works its way up through the courts? He'd lose, probably. But, you know, do the thing. I don't know. I really don't know. But I want to see people get creative here, because allowing the National Guard is just going to foment violence from them. This is tyranny, like, plain and simple immigrants.

Immigrants are our neighbors. They're our friends. They work alongside us. They pay taxes, they commit crimes at lower rates than citizens. Sending in militarized thugs to arrest our community members who are guilty of nothing more than contributing to a vibrant and thriving society is prima fascia tyranny. And, you know, they're only doing this, Dana, to provoke the unwarranted need for military mobilization and the invocation of emergency powers against the people. So I will be out there this Saturday at the no Kings March, and I hope to see everyone there, too.

I have a feeling people will be. And I just want to make a little connection here. If you don't think this isn't connection to Newsom saying he's going to withhold his federal taxes because Trump was threatening him, you were sadly mistaken. Trump has been looking for an excuse to use this and California. He wants to have control of that state. He really wants control. So he was just waiting for a reason for all this. And I hope that they can stop it, because it's fucking scary. I'm in New York right now, thank God, but all my friends are in Los Angeles. So, please, if you are, be careful, be careful out there, but make sure you're paying attention to what they're doing and all the constitutional crises we have going on.

Honestly, I don't know if I could even feel that. I haven't really been out in the streets to see if there's any sort of protest going on. And I'm pretty close to Union Square, so normally they sort of walk down 14th, but I'll definitely let you know if I hear anything. Washington Square park is around the corner and usually they end up going down there.

So if anything happens, I thought Mamdani and Landers did a really good job. I know the United Auto Workers are kind of supporting him. AOC has endorsed Mamdani for mayor. They've got some really good candidates.

By the way, in a related story to the one we just talked about in Los Angeles. This is from CBS and something that kicked off one of the peaceful protests in la. Many undocumented immigrants who went to their Immigration and Customs Enforcement check in appointments at a federal building in Los Angeles this week. They were taken into custody and brought to the basement, held there some overnight. That's according to immigration lawyers and family members. Now, it was unclear how many people were affected, but the attorneys told CBS News hundreds of immigrants were detained, dozens in the basement in rooms that could fit up to 30 at a time. It's basically an underground prison. That's what that is. Now. One attorney, Lizbeth Mateo, said ICE officials slated several of her clients for check ins at the Edward R. Royball Federal Building in downtown la, but when they showed up on Tuesday, they were detained and immediately escorted to the BAS basement. Mateo said a couple and their two children, one of whom is a U S citizen, spent the night in a room with no beds and limited access to food and water. Mateo said the father had previously been issued a stay of removal barring him from deportation when he and his family were detained anyway. His wife was released Wednesday evening along with their children since she needed medical attention due to a high risk pregnancy. He was still being detained early Friday. By the way, and I quote, this is something I've never seen before, she said. Under the first Trump administration, I represented clients with very difficult cases, but never anything like this. Under any other circumstances, we would have been released. And a lot of this goes back to that. I don't know if it was a memo or a story, but there they have got a quota. 3000 arrests a day. 3000 arrests a day. That's what they're doing.

Yeah. So they're not rounding up criminals?

Nope. They're just trying to round up anyone that they think may not be a U.S. citizen. And a lot of People are getting caught.

They accidentally arrested a U.S. marshal in Phoenix this weekend. Like, just. I would be very interested to know what directives these officers have been given, what they've been told, what they've been threatened with if they don't meet their quotas. It's frightening. I would love to see that information.

And some of these, the videos. Man, these officers are taking way too much pleasure in hurting humans. Care if they think they are legal or not. The damage, the, the, the excitement, the joy that these people seem to have when they're close up with that camera. It's disgusting.

All right, from cnn. The Egyptian man accused of carrying out the anti Semitic attack in Boulder, Colorado, appeared in court Friday afternoon on a federal hate crime charge related to the attack that left several people injured. The court appearance comes a day after Mohammed Soliman, who's 45, was charged with 118 counts, including 28 counts of first degree attempted murder after he allegedly used a makeshift flamethrower and Molotov cocktails to set people on fire during a downtown event held to support Israeli hostages in Gaza. The firebombing attack occurred on the eve of Shavuot, which is a Jewish holiday. The attack, which happened less than two weeks after a separate anti Semitic attack in Washington, D.C. which we covered here, that's the one where the two Israeli embassy staff members were shot dead, has sparked widespread fear across the Jewish community. Now, he was remanded into custody, and he has a preliminary hearing set for June 18th.

If you're following the story, thanks so much, Allison. That one is a tough one to hear, but we are moving on from NBC, and the reckoning is here. But honestly, it's a little too late. Thirteen House Republicans who supported President Donald Trump's big, beautiful bill, they sent a letter urging Senate GOP leaders to scale back some of its clean energy cuts, sparking pushback from conservative hardliners. You already passed the fucking bill, you cowards. Not in Senate. In the House. The unusual criticism of their own bill indicates. Of their own bill. Yes, Indicates a modicum of regret by the GOP lawmakers whose votes were critical to pass the bill in the House by a narrow margin last month. By the way, and I quote, this is what they said. While we were proud to have worked to ensure that the bill did not include a full repeal of the clean energy tax credits, we remain deeply Concerned by several provisions. That's what Republicans in the letter, led by Rep. Jen Keegan said and Rep. Ken's a Republican in Virginia. They cited provisions that, quote, abruptly terminate Several credits just 60 days after enactment for projects that have not yet begun construction and restrictions to transferability. Yes, this approach jeopardizes ongoing development, discourages long term investment, and could significantly delay or cancel energy infrastructure projects across the country. This is what the group of House Republicans said when they criticize the legislation that they voted for and I guarantee didn't fucking read, while suggesting some changes to mitigate the harm it could cause. Now, Kiggins, like most of the signatories, represents a competitive district that Democrats are targeting in the 2026 election. Other politically vulnerable members include Reps. Brian Fitzpatrick, a Republican in Pennsylvania. Juan Kiskamani.

David Valadao is in California as well. Rob Bresnahan in Pennsylvania and Tom King is a Republican from New Jersey. The remaining three who hold comparably safer seats, Reps. Mark Amadei, he's a Republican. Nevada, Andrew Garbarino. Garbarino, he's a Republican in North. I'm laughing at myself, you all now because half of these, I feel like I'm just like sounding them out on air live, which is what's happening by the way. And Nick Lalota, he's a republic from New York. Now, Gabarino, missing the vote. He missed the vote completely. But he praised the bill and said he was about to vote yes and didn't make it in time. By the way, that bill, it passed 215 to 214 in an early morning vote and by early morning it was the dead of the night. You know what would have worked better? Not voting for the bill. Dude. All of you people, all of you, you should have read it. You should have known better.

These are all the same people, by the way, in these swing districts who are just scared shitless right now that voted against the Biden inflation reduction act, which is where a lot of these climate provisions come in, but then said, look what I did and took credit for the these infrastructure projects in their districts. And now they voted for the billionaire bailout bill to cancel these in their districts, this Biden era awesome projects. And now they're writing a letter to send the Senate saying, hey, I know we passed this, but could, could you not.

Amid a constantly changing reproductive landscape, one West Virginia prosecutor is warning West Virginians who have miscarriages in his state that they could get in trouble with the law. Raleigh county prosecuting attorney Tom Truman says that although he personally won't prosecute someone for a miscarriage, he made the suggestion out of an abundance of caution after hearing from other prosecutors who might. Truman even suggests that people might want to let local law enforcement know if they've had a miscarriage. Several reproductive law experts say people around the country have indeed faced charges related to miscarriages, but they still wouldn't recommend reaching out to law enforcement. Well, here at the Good trouble section of the Daily Beans, we do recommend you reach out to law enforcement. If you're in West Virginia and you have a period, give them a call, let them know that you've had your period, and you just want to put it on record to make sure that it's not a miscarriage. That's. Well, I'm so glad to have you here. And the reason that we. Because we had you, we talked about your book the last time.

When was I on? It was.

It was the day we found out that RFK Jr had a brain worm.

Oh, my God. Yeah, yeah. So we talked about simpler times.
Allison Gill
I know, the salad days, the brainworm days. But we talked about your book, Not Funny, you know, released with Simon and Schuster. A much needed book, it's been called, and I completely agree. But the reason we wanted to bring you back today, first of all, all of the stuff that's going on in California at Minneapolis, you know, with these ice raids out cities across the country, but you had tried to return to the United States and you were asked about your jokes. Talk a little bit about that.
C
So I was coming back from performing comedy at ted, which already sounds like a lie. I didn't know that the TED conferences have comedy. They do apparently have like one or two comedians every year when they do their big conferences. And so they had asked me to do comedy at ted and I have like a comedic TED Talk actually coming out July 18th. But I was in the Vancouver airport and I didn't know what TED was. It's like a week long conference. You're out every night. I was like having a nice time, not sleeping. So I was. This is all just a setup that I was like a little off my guard. And when I was in the Vancouver airport, I went past security and apparently US Border Patrol is stationed in the Vancouver airport, which I didn't realize. I thought that they. I would see them in la, but there's a section of the Vancouver airport that is actually like US soil. I mean, or it's not maybe US Soil, but it's like, it's like officially the United States or whatever. So all this to say when I encountered Border patrol, I just thought he was like airport security or something at first. And so I gave them my passport. They were like, what were you doing in Canada? I said, I was at ted and he asked, were you there for work? And I have had situations in the past where they want to make sure that I'm not violating a work visa if I'm getting paid in a foreign country. So I just said no. I was performing comedy unpaid. They don't pay the performers. That's a whole separate conversation. But then he was like, oh, you're a comedian? I said, yes. He goes, what do you joke about? And this was really embarrassing to admit, but I actually said everything other than airport security. I don't know why I like flirted with him or something. I just, again, I was not really sleeping and I was kind of just off my game.

Everything but bombs on an airplane, huh?

I know, know, I know. It was so dumb. And he didn't. I mean, I guess he didn't even know I was trying to be funny. He just looked at me confused, which I, I, I, like, don't read as a comedian, so I get that. And then he goes, what do you joke about? And I kind of checked out. I looked at a shirt and it said U.S. border Patrol. And I quickly realized that's who I was talking to. And I was trying to figure out what to say. And in my mind, I was like, do I. Do I say, Like, I can't say what I. I can't say that I'm a political comedian. Do I say that I, like, like sex? Come.
Allison Gill
I didn't know what to say before periods and menopause.

Well, now I know what to say. Now I know what to say next time. But I. I said nothing. And then he goes, do you make fun of politicians? And it's very important for me to get the exact wording right, because, you know, this is a story that happened, and I want to make sure that I'm not. That I'm, like, completely factual in every sense. But he said, do you make fun of politicians? And I posted about it. I didn't post my response at first because it was like, so I didn't. So I said, no. I've had friends kind of talk about it. After I posted it, my first instinct was to text two of my friends who don't look like Ann Romney. My one friend who is Muslim and Iranian and was coming back from ted, and I was like, FYI, don't tell them you're a comedian. And then I text another friend who's a political comic who's not white. And then I was like, I can't not post about this because this is crazy. But it's also really scary as like, a woman on the Internet to tell a story of something, because then ultimately you're just kind of exposing yourself and being vulnerable online, which is terrifying. And so I did post about it. I didn't say my response, which wasn't important to the larger point. But then now I've been talking about it a little bit more. Yeah, I said no, because why would you say yes? I mean, why would anyone? That's. I don't believe that's the time to take a stand, because it's literally your word against someone else's. There's no oversight, there's no accountability. They don't have cameras. They could just not like you and plant drugs on you or just say anything they want. You're Not. You have no control in that situation. The play, I think, which I did, which I didn't even think about at the time, is you just get through and then you talk about it when you're like, safe. But yeah, I have a toddler at home and I just was like, I gotta get home. And so I told him no, and he let me through right away. It wasn't, like, personal. He didn't recognize me. It just. He was like, literally only following orders. It seemed like, wow.
Allison Gill
Yeah. The co host of the Beans had a friend coming in from Canada, and when they were asked what they thought of Donald Trump, they said, well, not a fan. And now apparently they've been banned from entering into the United States.

So that's someone, you know.
Allison Gill
That was someone that our co host knows. Yeah, yeah. And so, yeah, that's either that or carry some Joe Biden jokes around in your pocket, you know, just to have on you.

Allison Gill
But I mean that. I totally agree. That is not the time to take a stand. The way to get the message out is to make it back and then, like you said, then tell everyone.

I mean, it's been like a good creative muse. I wrote a New Yorker piece of making fun of customs. I have a bit in my show. The opening of my show is all about that. So, like, it's given me material and I. People are like, I'm sorry that happened to you. And it didn't affect me at all. Like, it was jarring. It felt like it was a scene from the Handmaid's Tale, like a flashback I was watching. But it's so not about me. It's just. Oh. Also. So when I got back, I reached out to a friend who works for Adam Schiff, and he sent me apparently. So this happened April 11, and on April 10, I posted a me a meme online that I can show it to you. They actually took it down. I don't know when they took it down, but it was. It seems so fake that I actually, like, I'm so neurotic anyway, but just, like, paranoid about, like, not being believed or, like, posting misinformation because there's so much misinformation everywhere that when someone sends me something, it's, like, hard, you know, I have to just, like, make sure that it's legit before I disseminate it. But the. They posted a meme that was like, if it crosses the border illegally, it's our responsibility to stop it. And it was like, drugs, weapons, something else. And then ideas and Politico actually reported on that ice, had posted it and then they took it down. But in the context of what I experienced, it made total sense that if you're seeing that meme, yes, stop ideas at the border. Stop anti American ideas at the border. Which would be like, I guess, I mean, I think making fun of politicians is like the most American thing you can do. But if you're just an employee of, you know, the US Customs and Border Patrol, that's, you know, that he, it didn't seem, I think it's important as I rant, sorry to say that this guy, it was not personal. He was not just fucking with me. He wasn't white, for what it's worth, like, he wasn't like a white Trump guy. He just was an employee following orders. And yeah, that to me is actually scarier. I want to see if I can find it and send it to you.

That's really weird. Yeah, I know we talked about that post that was taken down.

On the show Gotcha when it happened. But I mean it was what, two, three months ago? Yeah, but yeah, that, that's scary. Like is he does, does this guy, this border patrol agent, did he have to ask you that and that's why he did it? Can he decide not to ask people that? Like, that's what's, you know, I think is interesting. Are they monitoring what these guys ask people when they come back in? Do they have to fill out a report?

You know, like, oh, that's interesting. I mean, in my case, I offered up that I was a comedian because I again, like, that's why I said I had my guard down because I normally don't do that. It was just kind of, I thought that, I thought he was Canadian and I thought he was just trying to make sure I wasn't violating a work visa. So I was just like, here's everything. But normally I wouldn't over share with Border Patrol. So I think he just was like, oh, you're a comedian. I'm going to do a little due diligence. It didn't feel mean spirited or threatening. I mean, it just felt like it felt scarier. Like if he was trying to fuck with me, it almost would have felt less scary.

Yeah. Or maybe he's trying to meet a quota.

You know, where a lot of these folks are under pressure to meet these quotas. I know Stephen Miller and Tom Homan have been very, very angry about the fact that they aren't actually finding 3,000 people a day to arrest and that's why they're going into restaurants and places where people work and then also parking themselves outside of immigration courts where people are going through the legal process and checking in and having their cases dismissed and then. And then snatched up is because they're not making this hugely unrealistic and gigantically expensive and tyrannical quota. You know, this edict issued by, like, Stephen Miller.

Yeah, it's so. It's also awful. I mean, like, to be, like, an American with an American passport, like a blonde white woman, and to have that line of questioning and you just, like, realize, like, I mean, I'm so lucky and privileged, and I just can't imagine how hard it must be for anyone who's not, who doesn't, you know, look like a Republican's wife right now to just be navigating. I. I mean, I was like, if they can do this to me or, like, if they can, like. And then the other thing about it is, like, the free speech thing has been such a Republican thing and such, like, a BRO podcast thing. So it's like, I do feel like that it's an opportunity to reach across the aisle and be like, look like erosion of civil liberties. Be they, like, you know, like, if they're, like, going into your house to arrest you or just asking you what you joke about, it's all the same thing. And it's weirdly made me more patriotic in terms of, like, you know, like, what America stands for, what we should be. What we should be is, like, protecting people. I mean, give me your tire, your poor, your huddled masses yearning to breathe free. The Statue of Liberty. I mean, so. And I also think for the past, like, I don't know, decade, the left has kind of shunned the American flag and patriotism and ceded that to the right. But I think in a weird way, we need to be doubling down on patriotism, Taking. Taking back the American flag, reminding people what it stands for, like, all of the amendments that ice, like the ISIS violating the Constitution at every turn and just trying to remind people of that, because the only way out of this is, like, with the courts and people just actually. And maybe I don't know what I'm saying right now, I'm again, Sunday, and I've been with my toddler since 6am but just. I mean, I don't know if I hope that's not, like, a Pollyanna ish thing to say, but, like, we're a nation of immigrants. We're all immigrants, right?
Allison Gill
We have to defend what it means to be a Patriot. And yeah, I think that that's a really good point too. When you, when you land on the free speech issue to be like, hey, it shouldn't matter what the speech is, it should be free.

And even like, for like the constitutionalists or like whatever they call themselves.
Allison Gill
I mean, like contextualists.

Yeah, yeah.

Or textualists, I always say. Contextualist. Textualists.

Yes. Forget all context and nuance. No.

Muskets. You know what I mean? Like, anyway. But I mean, every single amendment, the one I forget, was it the fifth Amendment and the sixth. The one where, like, you can't go into people's homes, like, all the, like, due process, all of these things we have in the Constitution for a reason. And, and it's just, they're being violated and it's, it's awful. And it's so, it's so sad.

Yeah. These warrantless raids, they are unlawful. And also it's really sad to see people in leadership kind of backing away from the idea of protesting immigration.

Oh, are you watching the Gavin Newsom thing or that?
Allison Gill
Or I think Amy Klobuchar like, switched directions when asked about immigration because we were all like, the whole, the whole message, like, leading up to the election was we had this immigration bill that we worked out with Republicans and Donald Trump killed it. Right. And kind of changing the zeitgeist from why don't we welcome immigrants to we should only welcome legal immigrants. But even they're smashing through that now.

Documenting people like on tps. And I know a lot of veterans are really upset about what they're doing to the Afghans who helped us during the war now being shipped out. So we, I feel like in some ways a lot of folks have painted themselves into a corner to be like, super pro secure borders. So it's, it's harder now for them to say, we welcome our neighbors. And, you know, I'm in San Diego. This is a border town. I'm 20 minutes from the border. And yeah, we have absolutely no problem with anyone who wants to come and work here. It's great for our economy. It's great. It's going to cost so much money and not just in lost tax revenue, but in small businesses having to shut down. And you notice that they're not really doing this in Republican states. I saw that they're doing it more in the blue cities.

It has nothing to do with border security or even immigration. They're just with blue cities. Yeah, they're just with us.

Try to rile people up to have to be forced to send in the National Guard or whatever so they can get their, yeah. Propaganda clips.

Yeah, it's true. I don't, I don't know, I don't know what to do. I mean, like, it, not like any of us do, but I mean, I, I, I do think, you know, I, I see both sides of like, you know, don't flood the streets, but don't, don't give them their clips and give them an excuse to incarcerate more people by protesting. But I also know that peaceful protest is like, really important. And I mean, maybe there's just a way to creatively stop them in their tracks. I don't want to, I don't know what to suggest on the pod, but like, you know, just finding ways to disrupt like boycotting a velo Airlines, you know, like doing the economic boycotts. Finding creative ways like to shut down the ICE detention centers or I, I don't, I don't exactly know. But yeah, I, I don't know. Also, it's like when your actual family is being broken apart, when you're like grandparents who have been here for 50 years are being sent back to like a country that they haven't lived in forever. Like, I don't, I don't know what that does to people and how to protect people in this time.

Yeah, well, I'm all for peacefully putting your body between the bad guys and the good guys. We're going to be doing a big march to everybody around the country this Saturday. The no Kings march.

And you know, I've seen, I've seen a lot of people about, you know, know your rights, don't talk to the police, always ask for a lawyer.

But here's the thing, because I, in theory, I fully agree with you, but we don't know our rights right now.

Right.

Like, if I were to know my rights when I was crossing the border, my right to free speech would have, you know the answer. I could have said, is it illegal to joke about Trump? Why are you asking me that? What's your name? Like, but at the border you have no rights. And so, and if you're, if you are not, if you're not a US citizen right now, you have no rights. Even if you're a. Naturally, even naturalized citizens are big. Being harassed. Green card holders are being harassed. So, and detained. So I Don't I, don't I. Not to. You know, I hate this term, devil's advocate, but it's like, what are our rights? And like, how do we keep people safe in our communities? I, I want to go out there and protest and tell everyone to protest, but are they just trying to get crowds of people to like, antagonize us to, to get footage that said, like, are they provoking protesters to the point where they're justifying? That was Gavin Newsom's thing where he was like, didn't he say like, don't. Did he say don't go out on the street or something? Or like, don't. The news is so fast. It's very, it's honestly hard for me to keep up, but.

No, it is. But I'm, you know, I have always long feared that the Trump administration would plant violent protesters among peaceful protesters. They did it in the George Floyd protests with people from the three.

I agree with you, though. I'm not saying don't protest. I think there's just like, in these times that it's like, I think we have to be like really creative about disruption.
Allison Gill
Yeah. Well, what, what, what's being suggested is if, if some kind of violence happens that the protest is, the protesters aren't, you know, starting. They say everyone immediately sit on the ground in silence, put your signs down.

And get it on film. And you know, that I think that just kind of. And when I say know your rights, not like, know the rights that they're trying to take away from you. Yes, there's that. But like, know your rights. You don't have to speak to a police officer without a lawyer.

You don't have to open the door. If, if anyone, you never have to open your door. They still, like, I guess they can't storm into your house even if they try to. But just don't open your door for them.

Yeah. And they have to have a very specific kind of warrant and they haven't been. So I, you know, I'll be out marching and doing my best to, to stay safe and keep those around me safe. But yeah, I like all of the little good trouble things. Like we were able to single handedly neutralize the ICE tip line one day by creating a seven hour hold time so nobody could actually perfect.

And I know Jess Piper was like. Because in West Virginia, the, one of the lawmakers is saying, hey, be careful. If you have a miscarriage, you could be charged criminally unless you, unless you report your miscarriage to the police and she's like, well, everybody call 911 every time you have a period. And you know, come up the don't.

Call 911 because then you're flooding 91 1. But definitely like send your miscarriages to the police station.

Something if they want to make sure.

It'S not, you know, just flood the zone. Yeah.

Call the non emergency police line.

And yeah, not even the police because they actually maybe just the politicians who are legislating it. I really do think we should be sending all of our periods. And because miscarriages, you sometimes don't know if it's a period or a miscarriage. So just send those. Send them all to the Republican politicians in your district.

That's not kind of good trouble that, that I.

That it's not a biohazard. It's. You're actually. It's your civic responsibility. Send your dirty tampons. And anything that you just sending. Just send it to 10. Send it to politicians, Republican politicians.

I think what you meant is per se harassment. But given her lawyering skills, describing what she does as pro se also fits nicely. Pro se describes a person who litigates his case without an attorney, so it certainly describes the actions of Alina Haba. Yeah, you're right. But pro se does work because only a fool represents herself, especially if she's a parking lot lawyer.

I'm a podcast junkie, and even though I listen to Jack religiously, I only added the beans to my library about six months ago when the yam was elected. I have to say, my new favorite sound is Dana's laugh. One of the best. Thank you for that. I'm writing to you from Machias. Machias, like the Tias. Yes, I got that right. It's the. Okay, this one's going to be harder. Passamaquoddy. Passamaquoddy. Maybe I think Passamaquoddy word for bad little falls, and that's in Maine. It's a town of 2,000 people, and depending on the year, it's the county seat of the poorest or second poorest county in Maine. Historically solid red. Nonetheless, a small group of dedicated resisters has been peacefully protesting every Saturday since April 5, despite the fact that it has rained every single Saturday since April 5th. I'm sorry to say that at 63, I'm often the youngest person there. Don't be sorry. Oh, my God. But I do wish there were more young people, but as Mainers do, we stand in the rain and we take on black flies, the relentless defenders of the wilderness whose sole mission is to make our eyes swell shut after a bite. Our numbers range from 20 to 70 plus and I'm hoping to see larger numbers next week. At the no Kings rally yesterday, we had the most positive responses from passersby than we ever have. So it seems even a down east main the tide is turning, but I'm not sure this is really good news as much as just is happening all over the country. People doing the right thing and standing up, speaking up. What I really want to submit is more of a shit my kids say or misheard lyrics category. Maybe you want to save it for a particularly bad news day. I think that's every day. By the way, Years ago when my children lived under my roof, we had a whiteboard in the kitchen to note when we needed something at the grocery store. Last of the toilet paper, milk, etc. Now one day I was scrubbing some pots and pans and my hands were full of soap and I used the last Brillo pad. I asked my ever obedient and agreeable 8 year old son to put Brillo on the grocery list. It wasn't until long after I was finished that I noted that he had written gorilla on the whiteboard and I planned to use the story in my speech at the wedding someday. He unquestioningly thought he needed a gorilla and dutifully wrote it down without wondering why would we need one? Where would we put it? How would we even get it home? Or if it's stocked gorillas at the grocery store? Surely he had been there with me in the past and knew they didn't sell gorillas. Don't worry, this once oblivious little boy is now a capable young man with good critical thinking skills. For my tax I'm including a picture of said child at the day as oh at one day old and photos of my two chucklehead dogs, Bodhi, after Bodhi Miller and Mookie, named after Mookie Betts. Ah. I would go baseball. Who had the best name in baseball?

He's just a loving, tender and devoted mutt who has FOMO when there's a deer outside, who also believes the floor is lava and needs help coming into the bedroom at night. Mahouti's breed is pretty obvious. I think he's enormous. And he thinks he ought to sleep in the queen size bed with two adults. For a poodle, he's not the brightest. And neither of these dogs are helpful when it comes to cleaning up spilled food on the floor. You literally have to call them over, bend down, point at any spilled morsels. So they are not earning their keep, but we'll keep them anyway. Oh my God, look at the sun.

Like, they are fighting all of this, but a lot of these Lawyers are working pro bono, so it's my job to raise money so that they have funds to actually finance their lawsuits.
