C
And I'm Dana Goldberg.
B
Da na na na na. They say it's your birthday.
C
Wait, it is my birthday, too now.
B
Welcome. Welcome to your 50s.
C
Oh, my goodness. Thank you. We're recording this on the 12th. It is indeed my 50th birthday, and I got to tell you, AG, the universe sends little gifts. My partner took me out to dinner on Friday night, and we sat down at the restaurant. This very handsome man came to the table, and he said, hello. And my partner and I always ask our servers names because we like to do that so we can talk to them like they're human beings.
B
How weird of you.
C
I know. And so he said, his name is Avery. And then my partner introduced herself. And then I introduced myself as I am Dana. And he goes, goldberg. And I said, yeah. And I thought that was because of the reservation. And he said, I listen to you every single morning. The waiter at the dinner happened to be a Daily Beans fan. So, Avery, if you're listening, and I hope that you are, thank you for making my birthday extra special, my birthday weekend. And I just appreciate. It's just. It's just wild when the universe was like, here you go. Maybe you need this tonight.
B
That's Amazing. How cool. Hi, Avery.
C
Oh, we have our beans everywhere. Our beans listeners are indeed everywhere. It was an extraordinary weekend. I'm feeling beyond grateful and I'm ready for what's next to come. Like, bring it on. Let's go.
B
Going to be a great decade. Going to be a great year for you.
C
Yeah.
B
And, you know, maybe we have some beans listeners over in Hungary today, Viktor Orban is out.
C
Amazing. Amazing. This is such good news.
B
It really is. Peter Magyar has won in a decisive election. The Orban opposition Tisa party has won a super majority in the national assembly as well. It's a huge win, 138seats to 55. Now, Peter Magyar is a conservative. He is like anti immigration, but he's pro EU and pro Ukraine, anti Russia. But mostly he was put forth as the, as the candidate to oppose Orban because folks had the feeling that he would be and his party would be the best option or the best way
C
of beating him that would get the
B
most votes to beat Viktor Orban. 16 years of gerrymandering and removing and replacing people and authoritarianism.
C
Let this be a butterfly effect. Whose wings touched the United States in November?
B
I'm low key, jealous of Hungary right now. But for example, in his victory speech after Orban conceded, he, the guy, Peter was like, everybody, Supreme Court justices, everybody who works for the government, you're all fired. Just leave before you're fired. Everybody has to get out. We're replacing everybody. It was like a pretty. I was like, man, I'm jealous of a country that can fire their Supreme Court justices.
C
Right. I know we got some changes we need to do here. And this is going to come to no surprise to anyone who's listening to this. It's from the Wall Street Journal repeatedly promised his top administration officials that he's going to pardon Neil, pardon them before he leaves office. We knew this is going to happen. This is according to a lot of people who heard the actual comments, by the way. And his quote was, I'll pardon anyone and everyone who has come within 200ft of the oval. That's what Trump said in a recent meeting to laughs, according to people with knowledge of the comments. And I do believe he's going to do this. The thing is, is I wonder if he's going to do it before he dies, because I don't think he's going to make it through his term. So it'll be really interesting if he starts doing secret pardons that we don't know about until after he's gone. And they're like, no, here's my piece of paper. But what this also does is it gives everyone just carte blanche to do whatever the they want, all the crimes before he ends up leaving this earth. So it'll be. It'll be interesting to see what happens. But crimes are gonna be committed and
B
they already have in a lot of cases. Yeah. Yeah. I had to Google several months back, I had to google whether anyone's given bed pardons before. No one ever has.
C
Oh, it. It's going to start now.
B
Yeah. Unless it's like some sort of. When it happens, it's some sort of instantaneous thing. And then. Yeah. Everybody pulls out their piece of paper and they just have to fill in the date of. Yeah.
C
Or back. They'll back date it.
B
They're pardoned. Right. So, yeah. It's going to be interesting to see. I would also personally like to see an Attorney general or somebody run for president in 2028 who says they will appoint an Attorney General who isn't afraid to challenge some of these pardons.
C
Yeah.
B
I know that the Supreme Court is gonna say, nope. Sorry. Nopity. Nope. Nope. The pardon power is absolute, but it's worth a shot. Especially when these pardons are dangled as part of, you know, a fraud. But per the Supreme Court, the president enjoys immunity for official acts, and a pardon is an official act. So. Yep. But it'd be nice to give it a shot for at least somebody to put it down on paper to argue that these are corrupt. Mueller did it in his court in volume two when he talked about obstruction of justice and how Trump dangling pardons was part of that.
C
Yeah.
B
But no charges were filed. Okay. We have a lot of news to get to. We. We're gonna start holding these accountable. Going back to the Civil War. We haven't done this. Right.
C
I know.
B
And we need to do it. We need to start doing it.
C
I think it's way longer than that. I.
B
There.
C
Can we do retroactive, like all the way back to the, you know, or slavery.
B
1600s.
C
Yeah. Seriously.
B
For reals.
C
I should say our slavery years. Like they. I. I'm not, I'm not that naive. Everybody. Just so you know.
B
Right. Exactly. Okay. We have a ton of news to get to. Let's hit the hot notes. Hot notes. All right. Pretty devastating news for supporters of Eric Swalwell, the Manhattan District Attorney's office. That's Alvin Bragg. That's the same district Attorney who got the 34 felony count conviction against Donald Trump. Said on Saturday it's investigating an allegation of sexual assault against Eric Swalwell a day after CNN reported that a former staffer from the California Democrat, a former staffer for the California Democrat, accused him of having sex with her when she was unable to consent. We call that rape.
C
Yes, we do.
B
Cnn, quote, we urge survivors and anyone with knowledge of these allegations to contact our Special Victims Division. And the phone number is 212-335-9373. That's what the DA's office said in a statement. They went on to say, our specially trained prosecutors, investigators and counselors are well equipped to help you in a trauma informed, sur centered manner. Now, CNN has reached out to Swalwell's attorney for comment. The former staffer told CNN she was heavily intoxicated after a night of drinking with Swalwell in New York City in April of 2024 when she woke up to him having sex with her in his hotel bed. So I'm going to give a content warning here for sa. The survivor said, I was pushing him off me saying no. That's what the woman told CNN of the incident, which she said happened after she had stopped working in Swalwell's office. But he didn't stop. Now, she was one of four women who described to CNN allegations of misconduct by Swalwell, who's running for California governor. Others alleged that Swalwell sent them unsolicited nude photos or explicit messages. Swalwell has denied the allegations. In a statement to CNN and in a video he posted on social media Friday evening, the San Francisco Bay Area congressman said in his statement that these allegations are false and they come on the eve of an election against the front runner for governor. I don't know if I would call seven weeks from now the eve, but yeah, okay. Quote, for nearly 20 years, I've served the public as a prosecutor and a congressman and I've always protected women. I will defend myself with the facts where necessary and bring legal action. He said something CNN is leaving out that he also said is he said, in my past, I'm no saint, but that's between me and my wife. So.
C
Right.
B
I think what he's getting at here is that it was consensual sexual. Right.
C
And that he obviously cheated on his wife with people that were in, in again, you know, consenting, like you said.
B
Right. And I am of the belief that a intoxicated subordinate is unable to.
C
Cannot consent. Yeah. Thank you.
B
Meanwhile, the Alameda County District Attorney's office told CNN in a statement that it's evaluating whether any alleged criminal conduct occurred within the Bay Area county where some of the women accused Swalwell of a separate act of sexual misconduct she said took place in 19. I think the statute of limitations might have passed on that, but I do not know if, if it's a forever statute of limitations for certain kinds of crimes, I'll have to look that up. Quote, we will review and assess all available information to determine what further action can be taken. That's what the office said. Swalwell worked as a deputy district attorney in the county before he was elected to Congress. The allegations have upended Swalwell's gubernatorial campaign. He shut down his Act Blue accounts. Swalwell is a former prosecutor who also ran for president in 2020. Briefly, prominent Democrats across California and the country on Friday called for Swalwell to reconsider his campaign or drop out entirely. He's not yet announced his next steps. And Dana, this is just breaking right now from CNN. A letter signed by more than 50 former staffers of Eric Swalwell described recent allegations of sexual assault and misconduct against him as serious and credible while demanding he resign from Congress and drop his bid for governor.
C
Wow.
B
Here's a quote from the letter. What has been described is not a political attack. It is the account of a young woman who trusted her employer, who was targeted and exploited by someone in a position of power over her and who has carried this burden for years. The corroboration reported by both outlets, including medical records and multiple witnesses, makes clear that this cannot be dismissed or deflected. As I said, the state's all primary election. And I wish we didn't have an all party primary election.
C
I know.
B
But our all party primary election takes place, like I said, June 2nd, a little more than seven weeks from now.
C
Thank you so much, Allison. All right. This is from Arizona Mirror. Three Democratic members of Congress said that they were horrified that immigrants were being stuffed into holding cells like sardines at a Mesa Immigration and Customs Enforcement holding facility. They showed up to without warning on Thursday night. And that is the way to do it. Now, the visit came in the wake of the Arizona Mirrors reporting on Thursday detailing how the Arizona Removal Operations Coordination Cent center that's located at Mesa Gateway Airport has been operating far over its 157 person capacity for most of this year. The mayor's analysis, in fact, found that one of the few times ICE was detaining fewer people than was when two of those same Democrats toured the facility during a scheduled oversight visit in February. Okay. Oh, yeah.
B
So that there's only one time they had fewer people there. And that's. Whoa. Surprisingly, one other people came for an inspection. Yeah.
C
When Democratic U.S. reps. Greg Stanton and Yasmin Ansari told ICE that would be conducting that oversight visit, ICE policy requires they give seven days notice before arriving, the number of detainees began to decrease to some of the lowest numbers the facility had seen all year. I have to wonder what they did with them now. Almost immediately after the inspection, those numbers began to climb again.
B
Huh.
C
The mayor's reporting prompted ansari, Stanton and U.S. rep. Adelita Grijalda to conduct a surprise oversight visit on Thursday night. When they arrived at the facility at around 9:30pm they saw firsthand just how overcrowded it was and the harm it was doing to the people being detained. And I quote, what we saw tonight inside the facility was shocking. This is from Stanton. That's what he told reporters outside the MESA facility after the brief tour. Calling the conditions inside significantly overcrowded, he described concrete rooms with no bedding or blankets packed with people, mostly laying on the floor. When the lawmakers entered the facility, many of those individuals also scrambled to the doors of the holding cells, asking them for help. Ansari was visibly shaken by what she saw. She said, shameful. Absolutely shameful that the United States government, funded by our taxpayer dollars, is allowing this to happen. Ansari said that each of the rooms holding immigrant detainees lists its maximum capacity. The majority had a capacity of 21, while two others were 24. Ansari, Stanton and Grijalva all said that counted more than 40 people in each of the six rooms and estimated around 250 people. And told her what inside the facility. So over 100 people passed the max of this facility. Said, I've never experienced anything like this in my entire life. This is Grahalva. And she said she was fighting back tears. The Tucson Democrat described the way people were laying down inside as like sardines. It's frightening in here, she went on to say. It's disgusting. When lawmakers arrived at the AROCC facility, they were also greeted by another site, aircraft used to shuttle around detainees to either other facilities or deportations. Could be how that number went down when there was a scheduled inspection. The facility, first exclusively reported on by the Mirror, takes up about 25,000 square feet in a building located at the Mesa Gateway Airport Airport, where it shares space with the U.S. forest Service and Phoenix Interagency Fire Center. Now, the three Democrats said that an additional bus full of migrants observed by the Mirror as well contained upwards of 80 more people. But ICE staff could not tell them if they were coming or going to the facility. Many of their questions went unanswered. Of course they did.
B
They were put on a bus. They were probably in that building. There was probably 300 plus people.
C
Yeah.
B
In that facility. And you know, there are flight trackers who, who pay attention to this kind of stuff, who have seen planes and buses leaving detention facilities as lawmakers go for oversight. Yeah. And then those detainees come back after they're done. All right, next up from Reuters, U.S. representative Jamie Raskin of Maryland told fellow House Democrats Friday he's going to introduce legislation to create a commission to facilitate the removal of any president deemed unable to carry out their duties. And that's according to a House Judiciary Committee spokeswoman. I wonder who that's for a, quote, commission on presidential capacity to discharge the powers and duties of the office. Bill was first introduced by Raskin, now senior Democrat on the committee in 2020, when Donald Trump was in his first presidential term. In recent days, Democrats in Congress have begun talking about pushing for the impeachment of Trump, now in his second term, or trying to trigger the 25th Amendment to the US Constitution, which provides the bare bones process for taking away a president's power in a procedure separate from impeachment. Trump earlier this week caused widespread alarm and anger after he said a whole civilization will die in Iran unless its government agreed to allow ships to freely pass through the Strait of Hormuz. Shipping there has been interrupted, as we know, following Trump's decision to launch, along with Israel, a military attack on Iran that began on February 28th. The Raskin legislation is unlikely to advance in the Republican controlled House where Speaker Mike Johnson is a strong defender of Trump. As we know and probably hasn't seen that tweet, Republicans in the House and Senate have blocked Democrats moves to pass a separate resolution to end the Iran war that was never authorized by Congress. The Raskin bill would create a 17 member bipartisan commission if it is determined that the president cannot perform the duties of the office because of physical disability or mental deficiency or because of drug or alcohol use or other conditions. Trump was subjected to two impeachment proceedings during his first term, each of which ended up with acquittal by the Republican controlled Senate. Since then, most Democrats have shied away from talking about impeachment. But Trump's latest military foray in Iran and his failure to lay out clear objectives have emboldened many Democrats to begin talking about removing Trump from power, a strategy that is not necessarily embraced by all in the party caucus. And I'M not sure why. And I also am not sure why they would go with the 25th Amendment because that has to end with a 2/3 vote in the House and a 2/3 vote in the Senate, which is more votes than you need to impeach somebody and remove them. But this is what Raskin wants to do and I think it's a good move.
C
Yeah, I'm just glad people are doing something. I'm glad they're doing something. Yes, exactly. This one's from NPR. A federal judge in St. Paul on Thursday gave the Justice Department and the Department of homeland security until May 1st to provide the court with evidence related to January 7th killing of Renee Good. The decision does not make the material public, by the way. Now the order from US District Judge Jeffrey Bryan stems from the case of Robert Munoz, Guatemala, an undocumented immigrant whom a jury convicted of using his vehicle to drag and injure ICE agent Jonathan Ross in Bloomington. Okay, then June of 17th of 2025. That's not the same situation, by the way. And people are understanding that this is not the same situation. They're saying that, that that whole situation is what made him all fucking trigger happy, by the way. That's what they're saying. Now immigration authorities has sought to Deport Munoz, Guatemala, 40, happens to be 40 years old after he pleaded guilty in 2023 to repeatedly sexually assaulting his 16 year old stepdaughter. In a criminal complaint affidavit, federal prosecutors said that local authorities did not honor an immigration detainer request for Munoz, Guatemala. Now prosecutors said that he dragged the agent about 100 yards in the course of about 12 seconds. Ross suffered a substantial wound on his right arm that required dozens of stitches. Nearly seven months later, that's when he killed protester Renee Good in Minneapolis. Trump administration officials have claimed that Ross fired in self defense, but the video clearly shows that Good turning her wheel in the vehicle as she drives away from him, trying not to hit him. Over prosecutors objections, U.S. district Judge Jeffrey Bryan ordered the government to turn over unredacted investigative materials from the Good shooting as well as Ross's personnel file to a magistrate judge. The magistrate judge is expected to review the evidence to determine if Munoz, Guatemala can use any of it for his defense at sentencing or to request a new trial. Now Munoz, Guatemala is being held in the Sherburne. I hope that's correct. Sherburne County Jail. In a February motion to request the evidence, defense attorney Eric Newmark writes that any interview that investigators may have conducted with Ross after the Good killing and I quote, could have bearing on Ross's motive or intent when he approached Muno Guatemala's vehicle and escalated the situation using force and could potentially form the basis for a new trial. In his order, O' Brien notes that the U.S. sentencing Commission guidelines provide that if a victim's wrongful conduct contributed significantly to provoking the offensive behavior, a defendant could be eligible for a reduced sentence. In March, Hennepin County Attorney Mary Moriarty and Minnesota Attorney General Keith Ellison, they sued the federal government in an effort to force the Trump administration to share evidence with state investigators related to killings of Good and Alex Preddy and the non fatal shooting of Julio Sosa Selles.
B
All right, interesting. We'll see what comes up. Obviously, like you said, it's not going to be made public, but we might hear something through sentencing of Munoz Guatemala or, or perhaps, yeah, maybe future charges from Hennepin county or Minnesota against Ross for the killing of Renee Goode. All right, everybody, we have a bunch of good news we have to get to. And I'm really excited about getting to the good news today because it was a tough weekend. Um, yeah, it's a tough weekend here in California. And so please send all your good news to us dailybeanspod.com, click on Contact. We'll be right back with it. Stick around after these messages. It's not only annoying, but it can actually have really like, really bad consequences as well. When your address and your phone number and your family members names are out there, it makes you more vulnerable than most people realize. And that is especially true now when more and more bad actors are willing to use that information to target political rivals, civil servants, journalists, and just ordinary people who speak their minds. Online. Doxing is not some abstract Internet problem. It can affect real safety, real peace of mind, and real lives. That is one reason I take my privacy very seriously. And I also keep hearing about data breaches in the news. Hackers getting names, addresses, phone numbers, last four digits of Social Security numbers, and even masked bank account numbers. All right, this next one's from Kat Pronouns she and her Greetings Beans Queens listeners. Since Muller she wrote, quote, I'm the principal of a Sweet little elementary school in the middle of California. Last year we were nominated for the DOE's National Blue Ribbon like the Academy Awards for Education because our student achievement scores were in the top 15% of the nation and because our demographics represent our surrounding area, our families speak 31 different home languages. Anyway, when we were nominated last April and asked to write 20 essays about our school, I told our writing team will either be the last National Ribbon National Blue Ribbon or we'll have the front row seat to history as they demolish the doe. Sure enough, the week before the Blue Ribbon schools were to be announced In September, the 43 year program was discontinued. Here's the cool part. The California Department of Education picks us up and will honor our school in two weeks at the banquet at the Disneyland Hotel. I love my home state. Fifth generation California Podpet tariff. Yeah, flipping off cyber trucks is fun.
C
Yeah, it really is.
B
Yeah, I like it.

Dumpsters. All right. This is Mo from Michigan. Pronouns she and her hey Beans Queens. Love love your daily news podcast. I'll be visiting my grown kids this weekend on the other side of the state, Grand Rapids. I love to bring gifts But I am a terrible shopper. Thank you, Dana, for a great gift idea from your Instagram. I'm going to pick up a couple bottles of good champagne for them to have for that special occasion we all hopes in our near future. If you're not sure what Mo's talking about, I put up a video just asking people what they were going to drink when it happens, and hopefully it happens soon. For my pod pet Tax is my daughter's baby, Tig. Do not be fooled by her good looks. She is a terrorist. My oldest son rescued her from the streets, and his sister has given her a great home and loves her.
B
Oh, look at this sweet little Tig.
C
Oh, gosh. So sweet.
B
That's very cool, Mo. I love Grand Rapids too. It's. It's a pretty town. Been to a couple shows there with some friends. I. I really like that city and I really like the idea of getting bottles of champagne for your friends for when it happens. And if you guys want to follow Dana on Instagram, it's DG comedy. That's. That's you everywhere, right? DG comedy.
C
Yeah, everywhere. Blue Sky, Instagram, Facebook. Yeah, I think I have. Have a. I know I have a TikTok, but I'm not great at TikTok.
B
Yeah, yeah, my TikTok got hijacked and now they sell weird products from, oh, overseas. So if you see Mueller, she wrote on TikTok, it's not me. It's not me selling those teddy bears or whatever. Next up from Twin Cities, gym pronouns, he and him. I think along with Taco Tuesday. We need to call this Sunday twats. Trump's whiny ass truth socials. That's. That's what happens on Sunday. Trump's weirdly apoplectic truth socials. Trump's wildly asinine truth socials.
C
There you go.
B
Take your pick. Twats. But they seem to be coming out with regularity these days. The Sunday Twats followed by a Taco Tuesday. Yeah, I always like, I think Angry staffer had posted his latest rant over on Blue sky, and I replied with that meme that said, I'm not reading all that. Sorry that happened or I'm happy for you.
C
Yeah,
B
happy for you, or sorry that happened. Something like that. For my tax, not tariff. I hate everything being about as fucking tariffs. I've attached one of the more original signs at the St. Paul, Minnesota, no Kings rally. What an event. Springsteen, Joan Baez, Jane Fonda, Tom Morello. So many great speakers. Just what the Twin Cities needed. Yeah, and the sign says, if you support ice, your mom's a hoe.
C
Oh, my God, that's so funny. You know how many people probably took a picture of that sign? A lot.
B
That's a good one. Nothing like a good Gen X. Your mom's a hoe joke. That's right, man. Oh, fantastic. Yeah. What an incredible flagship event. I think more than 200,000 people were at that at that particular march in Minneapolis. So thanks for that and thanks everybody for your good news. Please overwhelm us with your good news. We want to hear from you. Just takes a couple of minutes. Go to DailyBeansPod.com and click on contact and send it in. Dana, do you have any final thoughts before you get out of here for your birthday?
