Hello and welcome to the Daily beans for Friday, May 24, 2024. Today, the Supreme Court rules that racially gerrymandered South Carolina maps are fine. Louisiana has passed a bill making the abortion pill a controlled substance. The Biden campaign is quietly meeting with Haley supporters after she endorsed Trump. Ohio Governor DeWine calls for the state legislature to pass a bill ensuring President Biden appears on the ballot. Governor Gavin Newsom signs a bill allowing Arizona doctors to perform abortions. In California, a political consultant has been indicted for those Joe Biden AI robocalls. Congressman Andy Ogles admits his claims to have loaned $320,000 to his campaign were not true. And a 12 year old could be the first person cured of sickle cell disease using gene therapy. I'm Alison Gill.
B
And I'm Dana Goldberg.
C
Happy Friday, my friend.
B
And to you. We made it through the week.
C
We did. And we have some follow up stories today where we're going to close the loop on some things that we were wondering about. And it's Friday, so that means it's fugal sang Friday. So we're going to talk to that guy. And also today, for the first time, daily cannabis users are more. They outnumber daily alcohol users. So happy 5, 23. I guess it's the 24th today, but
B
that was a reach. Yeah, ag. I'm real close to becoming one of those cannabis users. I actually don't know how people are not high during these times, to be honest with you.
C
Yeah, don't blame you anyone that's you're
B
sober though, out there. I mean, good on you for having the coping tools that most of us don't have to get through these times because, whew, it's a lot.
C
Yes, absolutely. That's why today at 5pm during our happy hour, we're gonna have cocktails and mocktails because everyone's welcome. So that's today at 5 Pacific for our patrons. Really looking forward to that. We haven't had a happy hour in a while because I've been traipsing all over the country, going to trials and shit. So really excited to be back. We're going to talk to John Fugelsang later, like I said. But we have a lot of news to get to. But first, some quick hits. And to make a long story short.
D
Too late.
C
Okay, I'm going to refresh your memory a little. Remember back in February when we reported that a magician was paid by a political consultant to create an AI recording of Joe Biden for some rope robocalls in New Hampshire? Well, this is from NBC News. And this is from a story a few months ago so I can refresh your memory.
B
This Back in February, I didn't know what I was doing.
C
The magician, Paul Carpenter, says he was hired by Steve Kramer, who has worked on ballot access for Democratic presidential candidate Dean Phillips, to use AI software to make the imitation of Joe Biden's voice during a New Hampshire Democrats telling them not to vote in the state's presidential primary. Remember, save your vote for November. Don't vote in the primary. Well, here's a brief update from WMUR9ABC. Ten indictments have been returned against Steve Kramer of Rockingham county for bribing, intimidating and suppression of impersonation of candidates. The indictments name five people who said they received the robocall. Kramer, a political consultant, claimed in an interview with News 9 that he only sent out the calls to drive home the need for more regulation of AI.
B
Oh, come on.
C
He said that if investigators wanted to come after him, they should bring it. Well, it's been brought. News 9 reached out to the New Hampshire Attorney General's office but was told it couldn't comment. And Kramer has not returned requests for comment either. I don't know if they've reached out to the magician, but I'd be interested
B
in hearing from him I'm sure there's some sort of disappearing act. All right, the good news is starting early. This one's from NBC 4 in Washington, D.C. a 12 year old boy who suffers debilitating pain because of sickle cell disease has become the first patient in the US to undergo a newly approved gene therapy. Kendrick Cromer is being treated at Children's national Hospital in D.C. by this time next year, he stands a chance of becoming the first person cured. Cured of sickle cell with gene therapy. His mother, Deb Kromer, has been by her son's side for every hospital stay and painful episode. She said she's more hopeful than ever, quote, to see the light at the end tunnel and know that our child is the first to experience it outside of research, to know that it's safe and doctors here believe in it. I would go to the end of the earth to make sure he was cured. There's nothing I wouldn't do for my son, but this makes me proud. That's what the mom said.
C
Awesome. Awesome. Yeah. That's another follow up from a story we did. We covered this sickle cell disease gene therapy a while back, and now this 12 year old could be the first person cured. That's amazing. Ohio Republican Governor Mike DeWine said Thursday he's calling a special session of the General assembly next week to pass legislation ensuring President Joe Biden is on the state's 2024 ballot. The Democratic National Convention, where Biden is to be formally nominated, falls after Ohio's ballot deadline of August 7th. Since Ohio changed its certification deadline from 60 days to 90 days ahead of its general election, state lawmakers have had to adjust this requirement twice, once in 2012 and once in 2020 to accommodate candidates of both parties. Each change was temporary, so hopefully they'll get this done.
B
Thanks, AG And Arizona, we talked about this before. Arizona doctors can temporarily come to California to perform abortions for their patients. Under a new law signed by Governor Gavin Newsom, licensed Arizona doctors would have to apply to the Medical Board of California or the Osteopathic Medical Board of California, one or the other. Now, the law requires California regulators to approve these requests within five days. This is fantastic.
C
Yes. And so he signed that today. That's why. Well, Thursday. That's why we. That's why the update came today. And really, the main change is that they have to. California has to approve this within five days. Making it super fast.
D
Yeah.
C
All right, we have more news to get to yet. Let's hit the hot notes. Hot notes. All right, first up from Sam Levine at the Guardian. South Carolina Republicans do not need to redraw their congressional map. This is a US Supreme Court ruling on Thursday saying the lower court had not properly evaluated the evidence when it ruled that the lawmakers had discriminated against black voters. In a 6, 3 decision shocker, the justices sent the case back to the lower court for further consideration. The decision in Alexander v. South Carolina Conference of the NAACP is a major win for Republicans, who hold a slim margin in the U.S. house with six of South Carolina's seven congressional seats. Six of seven. It also could give lawmakers more leeway to discriminate in redistricting and use partisanship as a proxy for race. That could be enormously powerful in the US south, where voting is often racially polarized. So basically, the Supreme Court ruled today, with Alito writing for the majority, that as long as you say it's political and not racist, you can pretty much do what you want.
B
Jesus Christ.
C
Quote, a party challenging a maps constitutionality must disentangle race and politics if it wishes to prove that the legislature was motivated by race as opposed to partisanship. But what if one of the political parties is fucking racist? Okay, second, in assessing a legislature's work, we start with a presumption that the legislature acted in good faith.
B
Well, there's wrong.
C
There's Samuel ALITO in opinion, Mr. Flag Flag Boy. That was joined by the court's five other conservative justices. Quote, the three judge district court paid only lip service to these propositions. That misguided approach infected the district court's findings of fact, which were clearly erroneous under the appropriate legal standard, unquote. The dispute centered on the way the Republicans, who control the state legislature redrew the state's first congressional district after the 2020 census. After Nancy Mace narrowly was elected in 2020, they shifted the district's boundaries to make it much friendlier to the Republicans. As part of that effort, they moved 30,000 Black voters from Mace's district to the 6th, currently represented by Jim Clyburn, a black Democrat. That's called crack and pack is what that process is called. A lower court had ruled that the lawmakers had impermissibly relied on race when they drew it after the 2020 census, saying they had to redraw the district. The case had dragged on for so long, however, that the lower court and the Supreme Court recently allowed South Carolina to use the district for this year's elections. Anyhow. Mac Deford, an attorney challenging Mace, observed oral arguments in person, and Deford said he Watched Chief Justice John Roberts wrestle with the connection between race and politics. Quote, from my viewpoint, there was some signaling that they were going to draw some sort of line between race and politics. And I think that they did this in this case. That's what Deford said, noting how in earlier decisions, Shelby v. Holder, Roberts had proposed the idea that southern legislators had long abandoned heavy handed racial discrimination in voting. They'd abandoned it. It was gone. Quote, this could be sort of setting the stage for a subsequent case, maybe next year that could be brought on the Voting Rights act that could further strip away the vote. Now, the challengers in this case, the South Carolina branch of the NAACP and a South Carolina voter argued that those actions violated the 14th Amendment's ban on sorting voters based on race. South Carolina Republicans argued that they were motivated by partisanship, not race. In 2019, the Supreme Court said there was nothing federal courts could do to stop gerrymandering based on partisanship. So this kind of falls into that now, sort of solidifying that sorting voters based on race still remains unlawful. This was the first case that came to the court since the 2019 decision, forcing the justices to clarify their standard when the two issues are intermingled. The lower court had relied on a trove of evidence and experts that challengers offered to conclude the South Carolina Republicans were sorting voters based on their race. One of those experts used an algorithm to draw 20,000 maps that didn't take race into account, but complied with traditional redistricting criteria. But Alito and the other conservative justices said that evidence was not good enough. Alito zeroed in on the fact that the challengers in the case had not offered an alternative map that achieved the partisan goals of Republican lawmakers, a safe Republican district, and that also had a higher black voting age population as the challenged district. Such a map, he wrote, was critical to proving South Carolina Republicans had considered race above other considerations. So Alito was like, if you can't draw a map that has black people in this thing and that Republicans would be like a win for Republicans, then it just doesn't count. That's basically what he's saying.
B
I don't understand how partisanship, by the way, can be involved anyway. Go ahead.
C
That's what they ruled in 2019 after they stripped out the pre, pre clearance thing in, in 2013. Now I'm, first of all, this is mind blowing that they, that they can't pull race out of politics, that they're saying, hey, as long as you do it for political reasons, it's not racist. That just blows my mind. Quote without an alternative map, it's difficult for plaintiffs to defeat our starting presumption that the legislature acted in good faith, he wrote. The rationale drew sharp rebuke from Elena Kagan, who accused the majority of getting the decision seriously wrong and inventing a new rule of evidence. Quote as of today, courts must draw an adverse inference against those plaintiffs when they do not submit a so called alternative map, no matter how much proof of a constitutional violation they otherwise present. That's what she wrote in an opinion. Her dissent Such micromanagement of a plaintiff's case is elsewhere unheard of in constitutional litigation. But as with its upside down application of clear error review, the majority is intent on changing the usual rules when it comes to addressing racial gerrymandering claims. I like how she used the word
B
upside down upside down. Me too.
C
When addressing Sam Alito. Kagan went on to outline how Thursday's decision would give states much more leeway to enact discriminatory maps and voting policies. In every way, the majority today stacks the deck against the challengers. They must lose, the majority says, because the state has a possible story to tell about not considering race, even if the opposite story was the more credible. That's what she wrote Kagan and she was joined by the court's two other liberal justices, Sotomayor and Jackson. Quote, when racial classifications in voting are at issue, the majority says every doubt must be resolved in favor of the state lest heaven forefend it be accused of offensive and demeaning conduct. Unquote. Now Leah Aiden, a lawyer at the NAACP who argued the case on behalf of the plaintiffs in October, last October said the decision usurps the authority of trial courts to make factual findings of racial discrimination, as the unanimous panel found occurred with South Carolina's design of Congressional District 1. Richard Hassan, an election law expert at the University of California, Los Angeles ucla, said Alito and the court majority had once again come up with a legal framework that makes it easier for Republican states to engage in redistricting to help white Republicans maximize their political power. He did so by reversing the burden of proof that should apply in these cases in two ways to favor these states, pushing a presumption of good faith and raising the evidentiary burdens for those challenging the maps. Clarence Thomas also wrote a lengthy separate concurring opinion in the case saying the federal court should not be involved in policing constitutional claims of racial discrimination in redistricting, a radical idea that would be a break with the court's long standing jurisprudence. Quote, it behooves us to abandon our misguided efforts and leave districting to politicians, he wrote. The concurrence was not joined by any of the other justices. Joe Biden also criticizes the decision in a statement Thursday, saying the Supreme Court's decision today undermines the basic principle that voting practices should not discriminate on account of race, and that is wrong. This decision threatens South Carolinians ability to have their voices heard at the ballot box and the districting plan the courts upheld as part of a dangerous pattern of racial gerrymandering efforts from Republican elected officials to dilute the will of Black voters.
B
Thanks, A.J. i'm sorry, I just Alito and Thomas, they make my blood boil. I mean, there's Gorsuch and obviously Kavanaugh as well, but these two Alito and Thomas, for some reason I just. I don't throw around the word hate, but it is real close.
C
Yeah, it's bad.
B
All right, A.G. thank you. This one's from Sarah Klein at the Associated Press. Two abortion inducing drugs could soon be reclassified as controlled and dangerous substances in Louisiana under a first of its kind bill that received final legislative passage Thursday and is expected to be signed into law by the governor. Supporters of the reclassification of mifeprestone and misoprestol, commonly known as abortion pills, say it would protect expectant mothers from coerced abortions. Numerous doctors, meanwhile, have said it will make it harder for them to prescribe the medicines that they use for other important reproductive health care needs and could delay treatment. Louisiana currently has a near total abortion ban in place, applying both to surgical and medical abortions. The GOP dominated legislature's push to reclassify mifeprestone and misopristol could possibly open the door for other Republican states with abortion bans that are seeking tighter restrictions on the drugs. Current Louisiana law already requires a prescription for both drugs, and it makes it a crime to use them to induce an abortion. In most cases, the bill would make it harder to obtain the pills by placing it on the list of Schedule 4 drugs under the state's Uniform Controlled Dangerous Substances Law. This is such bullshit. The classification would require doctors to have a specific license to prescribe the drugs, which would be stored in certain facilities. In some cases could end up being located far from rural clinics. Knowingly possessing the drugs without a valid prescription would carry a punishment, including hefty fines and jail time. Supporters say people would be prevented from unlawfully using the pills, though language in the bill appears to carve out protections for pregnant women who obtain the drug without a prescription for their own consumption. Okay. More than 200 doctors in the state signed a letter to lawmakers warning it this could produce a, quote, barrier to physicians, their ease of prescribing appropriate treatment and cause unnecessary fear and confusion among patients and doctors. The physicians warn that any delay to obtaining the drugs could lead to worsening outcomes in the state that has one of the highest maternal mortality rates in the country. In addition to inducing abortions, mifeprestone and misoprestal have other common uses, such as treating miscarriages, inducing labor, and stopping hemorrhaging. That's a huge one. Mifeprestone was approved by U.S. food and Drug Administration in 2000 after federal regulators deemed it safe and effective for ending early pregnancies. It's used in combination with misopressdol, which the FDA has separately approved to treat stomach ulcers. The drugs are not classified as controlled substances by the federal government because regulators do not view them as carrying a significant risk of misuse. The federal Controlled Substances act restricts the use and distribution of prescription medications such as opioids, amphetamines, sleeping aids, and other drugs that carry the risk of addiction and overdose. Abortion opponents and conservative Republicans both inside and outside the state have applauded this Louisiana bill. Conversely, the move has been strongly criticized by Democrats, including Vice President Kamala Harris, who in a social media post described it as, quote, absolutely unconscionable. The U.S. supreme Court heard arguments in March on behalf of doctors who oppose abortion and want to restrict access to mifepress. Tone. The justices did not appear ready to limit access to the drug. Yet. The Louisiana legislature now heads to the desk of conservative Republican governor Jeff Landry. The governor, who was backed by Donald Trump during last year's gubernatorial election, has indicated his support for the measure, remarking in a post on X otherwise known as Twitter, quote, you know you're doing something right when Kamala Harris criticizes you. Go fuck yourself, Jeff Landry. I can't. Yeah. Landry's office did not immediately respond to emailed requests for comment. And I will say this, and I know this is to be true. Mifepressone is safer than Advil in most cases. So it just. It's infuriating that this is even happening.
C
Yeah, well, it's. It's obvious why they're doing this, of
B
course, to control women. That's.
C
The contraception point is next.
B
Yep.
C
Look forward to that. Just today, in this gerrymandering decision, Thomas attacked Brown v. Board of Education. So, I mean, nothing, nothing is safe. All right. This next story is from Phil Williams, who will be with me live in Nashville on July 28th at the City Winery. And get your tickets. He's, he's writing this for news Channel 5 investigates. Tennessee Congressman Andy Ogles, remember the George Santos of the south, filed 11amendments to his campaign finance reports Wednesday acknowledging that his claims for the last two years that he loaned himself $320,000, that, you know, he loaned it to his campaign, were not true. This comes less than six months after an exclusive news Channel 5 investigation that questioned whether Maury County Republicans campaign reports were accurate. This is he's the Maury county representative. Despite having reported making the $320,000 personal loan, ogles personal financial disclosures did not show any substantial investments, not even a savings account. Now, you'll recall going back to George Santos, Dana, he lied and said that he loaned himself like half a million dollars or something because if you reach a certain amount, you get all kinds of help from the National Republican Committee, right? And that's why right now one of the reasons George Santos is facing 23 felony counts because he lied on his financial disclosure forms. Ogles GOP opponent Metro Council member Courtney Johnston issued a statement Thursday condemning the actions, quote, andy Ogles lied to the federal government. Got caught. Normal folks get in big trouble for lying to the feds about money, but Andy's a politician who thinks he deserves a free pass and two more years of taxpayer salary. If Andy Ogles is willing to lie about his own money, what won't he lie about? We deserve a representative we can trust. That's what she said. Democratic candidate Miriam I'm going to say this wrong. Abel Fosley retweeted. I can't imagine the hubris one possesses to lie on these documents. You've got to be living in a different reality if you think you can say you have $300,000 and then come back later and and say you don't, she concluded. It reminds me of the new extremist GOP in general. Like dictators, they believe the law simply is only a tool to manipulate for their own personal gain. In January, nonpartisan watchdog group the Campaign Legal Center CLC filed a complaint with the Office of Congressional Ethics, citing news Channel 5's reporting and comparing Ogles conduct to disgraced New York Congressman George Santos. Quote, the expulsion of Representative George Santos for filing false financial disclosure statements and other ethics violations demonstrates why investigations of significant discrepancies in a candidate's financial reporting are warranted. That's what the CLC complaint said unexplained inconsistencies in Rep. Ogles's reported finances and allegations of him misrepresenting his background raise fundamental questions for voters about the transparency of their elected representative. It's not clear what, if any, action the Office of Congressional Ethics may have taken behind the scenes and whether that may have prompted Ogles amendments. The CLC complaint also cited news Channel 5's revelations that ogles misrepresented his educational and professional credentials, including his claims to be an economist, a trained law enforcement officer, and an expert in, quote, international sex crimes, unquote.
B
There's a red flag.
C
I know, right? Our investigation discovered that he had used the stillborn death of a child to raise $25,000 for a children's burial garden that was never built.
B
Oh my God.
C
Ogles has refused to provide evidence of what he did with the money. This is a developing story. Stay with News Channel 5. Follow Phil Williams for additional details. He gets to the bottom of shit and you don't want to miss us in Nashville. It's going to be so much fun.
B
It is going to be amazing show. Thank you, Ag. Last in this segment is from Jake Leahut and he's at the Daily Beast. A group of Nikki Haley supporters from Vermont to Arizona. They met with President Joe Biden's campaign on Wednesday night, almost immediately after she announced her plan to vote for Donald Trump. This is the Daily Beast has learned. In the previously UN reported meeting, a Biden campaign representative listened to the concerns of top Haley supporters from various states as part of Biden's world's outreach to win over Haley voters. Quote, the fact that they actually sent someone last night to speak to a small group, I think that's a good signal that they're aware there are huge numbers of Haley voters out there. This is from Robert Schwartz. He's founder of Haley Voters for Biden pac. He told that to the Daily Base. Swartz said the meeting was highly encouraging and likened it to other listening sessions the Biden campaign has done with the pro Palestinian uncommitted vote. The Biden campaign did not immediately return a quest for comment on the meeting. Ever since the GOP primary wrapped up, the Biden team has identified Haley voters as a key persuasion target for a unique set of key issues, particularly around Trump's attacks on democracy and the general notion of restoring decency to the office. The Biden campaign has continued trying to refine their definition of a persuadable Haley voter over the past few months, focusing on paid media, Haley's margins and key battleground precincts from the primary and simply listening to their concerns there is a fucking novel, right?
C
What an idea.
B
I know. Notably, Haley made sure to point out in her remarks about planning to vote for Trump that she still wants to see his campaign work to court her support supporters, something the Trump campaign has largely ignored since the end of the primary. Haley called Biden's team in office, quote, catastrophic, which was such bullshit. But Schwartz said he's still optimistic that Haley voters will ultimately shuffle over the Biden column. Quote, she has a very wide coalition of voters, including some from the center, left, the center and conservatives. And I think among strong conservatives, there are a lot of disagreements about Biden policy. This is again what Schwartz said. He said, while I respectfully disagree with her decision to support Trump, I would also respectfully disagree with her characterization of Biden being catastrophic. The continued outreach is most encouraging sign for Schwartz, who called the impromptu meeting, quote, a big deal. That's important development. He said the Biden campaign isn't only investing in digital ads in the traditional media to reach out to Haley voters, but now we've been asking them to actually come and talk to them, just like they've been talking to uncommitted voters to listen to what Haley voters are asking for and what their policy priorities are. Now, a zoom meeting may not be the most earth shattering development obviously in this campaign so far, but Schwartz said it's a crucial step for Biden's campaign to gain an edge with the key voting block, quote. It's critical that they make a serious, genuine effort to listen to them. And I could not agree more 100%
C
because, I mean, Trump told these voters to go themselves. You're not welcome. You're not in the MAGA club. Haley voters. You can't ever be. Don't vote for me. I don't want you. And now Haley has told the Haley voters to go fuck themselves. I mean, that is like the hugest betrayal that I can imagine. And so I think it's really, really awesome that, that this campaign is reaching out to them, these abandoned voters, and at least finding like, is there anything I can do? You know what? Tell me what your concerns are with a Biden administration and we'll see what we can do to work together. I think this is a really good strategy. Thank you for that story, my friend. We are going to be right back with Mr. Fugelsang for fugal saying Fridays and then we'll have the good news. Stick around, we'll be right back.
D
We'll be right back.

B
Hey, John.
D
Oh, hey, Alison. It's great to see you. Thanks for having me back. It's a great week for racist murderers to be freed in Texas, so I'm really glad to be here to celebrate.
C
Oh, there's that. There's all kinds of really interesting things going on.
D
Let's get to some of those interesting things. Yeah.
C
Yeah. Let's talk about Nikki Haley, who said all kinds of things about Donald Trump, said that, you know, when he went after her husband, who's overseas, that he didn't even deserve to have a driver's license, let alone be the President of the United States. But she's going to vote for him, apparently giving him her endorsement. What are your thoughts on this?
D
The media really is shocked that Nikki Haley has done exactly what everybody said she would do all along. Look, there's a number of ways to look at this. Obviously, she's a fraud. She always has been. This is someone who it took, what, 11 years in a mass shooting by a white supremacist for her to finally agree to remove the white supremacist flag from the Capitol in her state. I mean, Nikki Haley doesn't believe in anything beyond the fact that Nikki Haley deserves more power in government. And that makes her the perfect Republican, the ideal Trumper. She thinks that Trump is unfit for office. We know she thinks this. She believes that he should never be back in the White House. We know she thinks this. And now she's endorsing him to come back into the White House. So on the one hand, this is a story about how Nikki Haley stands for nothing. On the other hand, this is also a story the media is missing about how Nikki Haley is really coming out against Nikki Haley supporters and giving a huge middle finger to everyone who believed her for the last year and a half of primary races that she was the alternative to Trump, that Trump's behavior was not acceptable. Turns out everyone who donated money to Nikki Haley was lied to because Donald Trump's second term was completely acceptable to her the entire time. But I think the real story here, Ms. Gill, is this is the end, I think, of the Republican Party. I mean, it's the Trump Party now. You know, that's it. Mitt Romney's just about wrapping things up and Nikki Haley was sort of the last bulwark of the old Republican establishment. But I think with Nikki Haley revealing that she was always Trump to the bone and never actually believed it, this is her second time capitulating to supporting Trump after saying she never would. She's done it twice now. So I think we can say this party of Lincoln is done. It's not even the party of Quail anymore. And any Republican expressing any kind of integrity or even telling the truth about our election in 2020 is going to get a one way ticket to Jeff Lake Island. I think the real story here is this is the end of the old Republican Party. It is purely the apparatus of Trump now.
C
Yeah. And whereas it might end in the political sphere, it doesn't seem to be ending and won't end anytime soon in the judicial sphere. And although that's me separating the judicial from politics, and I shouldn't, because at least two, probably six of our Supreme Court justices float in politics.
D
How quaint of you.
C
I mean, you know, I was just thinking this morning, you know, where is this immunity decision? It's May 23rd. The end of the term is the first week of July. They held the arguments on immunity the very last day. They could possibly hold them. April 25th.
D
Yes.
C
And they could come out anytime with a decision on the immunity case and get that case moving forward again. But they won't.
D
They won't. This is their decision. Their decision is election interference. Of course we know Donald Trump doesn't have presidential immunity. Joe Biden is not allowed to murder Donald Trump and then murder any senators. Who might vote to impeach him. We know what the answer to this ruling is. I'm a clown and I know how they're going to rule. But. But because they are there to serve him and they know they can't go that far, they're kicking the can down the road and stalling for time because they are committed to the American people not hearing evidence in the most important criminal case in the history of this country before election Day. It's very important to them that no witnesses give any testimony in the most important case in the history of this country before this November. And that's why we're waiting so long for the immunity, proving Donald Trump really does have immunity and no other president does.
C
Yeah. And that's not just an opinion. We aren't just guessing that the Supreme Court is delaying to help Donald Trump and push this trial past the election. Jack Smith went to the Supreme Court last December and said, don't. We can go right over the circuit court, the appeals court. We don't need to send this to the appeals court. Y' all can decide this now. And you're like, nope, nope, we're not gonna decide this now. We need to wait for what the appeals court said. Then the appeals court comes out with their opinion. Then they have the arguments, and they completely ignore everything that the appeals court said. In fact, they got it wrong on the face of what the appeals court said, because they said multiple times that the appeals court said that no presidents enjoy any immunity ever in history. When. When what really happened was that the circuit court decided on the facts of this case and that in this case with this indictment, Donald Trump does not have immunity. They completely glossed over that.
D
But that's not wrong. That's doing deliberately what they were hired to do. That's getting it right. I mean, we're in the time for them. Right? Right, exactly. I mean, we are witnessing for the first time in history a criminal defendant who has hired four of his own judges, including three on the highest court in the land. And we're still pretending this is all normal.
C
Yeah. And what are the Democrats in the Senate doing? They're writing strongly worded letters.
D
Yeah, Listen, the Democrats have a strategy. They just have to wait until they're no longer in power, and then they'll make it happen. Okay. They have just have to wait till after November when the Republicans retake the Senate for their grand plot to do absolutely nothing to happen. I mean, we need to have Democrats calling for the impeachment of Alito and Thomas right now. As part of the campaign. I'm thrilled. The first presidential debate, Ms. Gill, is going to start in June because we have to wake most Americans up. This poll this week reported in the Guardian that showed that 56% of Americans believe that we're in recession. Even though we're recovering from recession faster than all the other G7 nations, all of our capitalist allies are still dealing with inflation much worse than us. 49% of Americans believe the stock market's tanking when it just hit record highs. 49% of us believe that we're at 50 year high unemployment when we are at 50 year lows of unemployment. So the New York Times is going to call this disinformation. Reality calls it God damned lies. And they've taken root and complacency is out the window. We can't wait anymore. It's really great. They're going to have a presidential debate to start trying to wake people what we call the fuck up right now because people are not paying attention to objective reality. And I think that's exactly why Democrats in the Senate, while they still have it, should begin a very loud impeachment. Because all we're asking is to put Republicans on the defense, put them on defense for a change. That's all they do. They're not working to help the American people. They're working to put Democrats on defense all the time. And it doesn't help the country, but it does help shore up their base.
C
Yeah. And their retention of power. Now Alito, Mr.
D
Flag Waving Insurrectionist, Mr.
C
Personality Flag Waving thing, wrote a majority opinion today out of the Supreme Court where saying basically the racist maps in South Carolina are fine as long as you just say it's for political reasons, wink wink, it's totally cool. Justice Thomas agreed in his concurrence. We don't need to worry about racism and racist based gerrymandered maps anymore in our country. We've solved it. It's all fine and good. Believe me when I say now what I really liked was in one of the dissents, I believe it was Kagan said that conservative justices have it upside down. And I thought that that was a real nice intentional or not kick to the flag that Alito was waving at one house while meanwhile putting up the pine tree flag at a different house, which is Nazis and white supremacists on January 6th. So this is very bad news. They've already kind of gutted the Voting Rights act and they're just, they keep chipping away at it and this is going to lead to I believe multiple where there are currently still gerrymandering battles going on in different states. This is going to lead to a lot of unfairly drawn maps based on race, which is going to negatively impact what happens in 2024, making our jobs that much harder as voters.
D
This is how it's always been, this is how it always will be. There's nothing new here. Yeah, it's a disappointing ruling, but it doesn't change the fact that everybody, every American of every background needs to make sure that they are registered to vote. Just because you voted last time doesn't mean your registration is still valid, especially in certain of our favorite charming states. So yeah, you know, they use the same rationale. When they gutted the Voting Rights act back in the summer of 2013, they, they, they said, well, there's a black president, so clearly racism is a thing of the past. Right? That's the modern racism is the denial of the existence of racism. There's a black president, Bill Cosby, it's not a problem anymore. I can hail a cab. Can you? So, you know, I want to remind everyone too, they gutted the Voting Rights act the same week Sci fi channel greenlit Sharknado 2. This is when our society began to fracture. Summer of 2013. So they use that rationale, right to gut the Voting Rights act where we had these pre clearance rules that certain states that historically had a problem letting African American taxpaying citizens vote had a few extra regulations to make sure they couldn't fuck with citizens that way. Now the smart choice would have been, hey, let's not single out the Confederate states, let's make all 50 states have these preclearance rules. We didn't do that. We got rid of the preclearance rules for the states that historically have a very difficult time granting ballot access to certain people. So we really shouldn't be surprised now 11 years later to see all over the map. They are trying what they do all the time to make it as hard as possible for citizens to vote. They know, our Republican friends, that they won't win on the issues. They know the majority of American citizens don't want to put women in jail for abortion. The majority of American citizens don't think millionaires need another tax cut. All they have is umbrage, a false reading of the Bible and enough power to know that white people are going to be a minority in 2045. And they are going to rig our institutions as deeply as they can to guarantee that white people will control this society for many years. After we become a minority.
C
Yeah. And here's a product of that. Today, Louisiana legislature voted to classify abortion pills as controlled substances. Right up there with heroin, lsd. I mean.
D
Yeah, right.
C
You know, making it basically illegal to possess these things as if, though, as though you're, you know, you're getting high off your mifepressone.
D
And they're also, you know, obviously they're hoping it'll go to the Supreme Court one day and that they'll use this case to ban mifepristone rather than the ridiculous Amaryllis Texas case where saying that the FDA never should have approved it. Mifepristone's been approved for 25 years. It is safer than childbirth. It is safer than pregnancy. There's no way.
C
It's safer than aspirin.
D
Yeah. There's no way this law can stand. And they know that. They're doing this law for the same reason they do all of these anti woman laws. They want to get it to the Supreme Court. And again, they're not Christian. The Bible is not anti abortion. No part of the Bible prescribes any punishment for terminating pregnancies at all whatsoever. The Bible's not anti birth control either. Jesus was anti death penalty. They don't give a rat's ass what's in the Bible. And I'm sorry to always be talking tabernacles on your wonderful show, Ms. Gill, but I have to bring it up all the time because we have to understand these Bible thumpers and their pro life ways. It's not grounded in anything in the actual Bible. They don't follow the teachings of Jesus. They use the word Christian as camouflage for their own selfish ends.
C
Yeah, agreed, my friend.
D
Hate to always say that, but we have to bring it up that, you know, their, their whole reason d' etre for their anti abortion movement is spiritual fraud, much like Alito's Catholicism. Nice flags, but can you imagine if Ketanji Brown Jackson flew a, a Black Lives Matter flag on her lawn? What the response from Hannity would be by that day? I mean, she'd be impeached.
C
Yeah. At least they would start the proceedings.
D
Yeah.
C
Which reminds me, you know, you can google Dick Durbin and give him a phone call and let him know that strongly worded letters aren't the way they're much more.
D
Thoughts and prayers are the way Republicans do thoughts and prayers. Democrats do strongly worded letters. Both achieve the same response.
C
Yep. Yep, exactly. Shit in. What is it shit in one hand Anyway, my friend, it's been wonderful to talk to you, as always, you're here every Friday for Fugal Sang Fridays on the Daily Beans. And if you're if you want more John Fugalsang, like I always do in my life, you can find him on Sirius XM progress channel 127 weeknights at 9pm Eastern, 6 Pacific for the Tell Me Everything show and the John Fugalsang Podcast. Yeah, we're going to Seattle at the Moore Theater, which we haven't played in like a dozen years. But we are returning to Seattle on Saturday, June 1st. That's where Nirvana shot the video for Smells Like Teen Spirit. Really excited to be going back there. And then we'll be hitting Denver June 22, Boston, Atlanta, and we will be in New York City. And we will be in Chicago the week of the convention for my show and for the Sexy Liberal tour as well. So it's going to be a very busy summer, Alison, and I'm so glad you're here to talk me off a ledge.
C
Thank you, my friend. We will see you next Friday on Fetal Sang Fridays, everybody. Stick around. We'll be right back with the good news. History is messy. It's weird, wild and anything but boring. And of course your you came up with what's the model of your axolotl which I still love so much. Any animal photo you want to send to us to pay your pod pet tax, do that. We'll try to guess something about it. If you want to make a game out of it and if you don't have pod pet tax to send, you can send an adoptable pet in your and we'll see if we can help find him a home. Also, if you have any shout outs, whether it's to a small business in your area that could use some support, some sort of community event that's going on, your local librarian, if you love them, let me let us know about it because that's amazing. I love librarians. A self shout out. Those are incredible. Spouse, kids, whoever you want to give a shout out to, send that to us as well. And then of course any government program that you have benefited from or that anybody you know has, whether it's wic, snap CHIPS Act, PACT Act. We've had a million veterans get care under the PACT Act. If you've got a great story about care at the va, I want to hear it. Medicare, Medicaid, Social Security, Affordable Care act, and especially student debt forgiveness, we've got Learned Today another 160,000 people that was yesterday actually are going to be receiving student debt forgiveness. So send that to us. And you can send it all to us by going to DailyBeansPod.com and clicking on Contact. All right, let's see what do we have. First up from Barbara Pronouns she and her hello, Beans, Queens and company. Thanks for your fabulous podcasts. I often play them while I'm out and about running errands. It's like having the company of smart and snarky friends while I'm alone. Fuck yeah, Barbara. A brief, somewhat law nerdy correction to Thursday's Beans cast. Eugene Carroll and Crystal McKinney did not sue under the same law. Okay, okay. Eugene Carroll sued Trump under the Adult Survivors Act. That's right.
B
That's right.
C
Which was signed into law May 24, 2022. Before 2019, a three year statute of limitations applied to civil suits for sexual misconduct. In 2019, that statute of limitations was extended to 20 years, but the extension was not retroactive. The ASA provided victims of sexual misconduct in New York state with a one year look back window which ran from November 24, 2022 until that same day in 2023, giving them an opportunity to raise claims that would otherwise be barred by the statute of limitations. Crystal McKinney sued for a violation of the New York Victims of Gender Motivated Violence Protection Law, a New York City, not New York State law that provides legal pathways for victims to pursue damages from their abusers and responsible entities. Due to a 2022amendment of that law, survivors of sexual abuse that occurred in New York City have a two year window to file claims over gender motivated assaults that occurred at any time in the past. The window opened March 1, 2023 and closes March 1, 2025. That amendment also extended the statute of limitations to bring claims within seven to nine years from the date of the gender motivated violent act when it occurred. Amazing. Thank you for sorting that out because I was a little confused by that. This is a New York City law two year window going back forever versus the E gene Adult Survivors Act, New York State. One year window to go back 20 years. Thank you for setting me straight on that. For podpet tax, I submit photos of the late great best dog ever, Shayna Medell Cohen and my dad. Feel free to guess her two breeds. Dachshund and Dalmatians.
B
I see Dalmatian. I think that's bigger. I'm gonna go with like a hound dog.
C
Hound dog. All right, let's see what we got here. Basset hound, Dalmatian. You got it.
B
There we go. Although dachshund Dalmatian would be a really cute puppy. I mean, let's be honest, right? Okay, this one's from Data. Okay, Are we team Data or Data?
C
I believe she goes by Data Diva.
B
All right, this is from Data Diva. Pronoun she and her hello. Look. Torres de la Hora, news announcers of the hour. All right. I wanted to let you know that the organization I co founded, Generation Data, recently wrapped up our third session of Indoctronucion. Introduction to Data Tools. It's a Spanish language class to teach people to do data staff for progressive organizations. Both it and I were nominated for powerful Idea Awards. Idea Awards. And we would appreciate votes from the gumanati. Oh my God. Data Diva, you're about to get some votes. And we would appreciate those votes. This year I just put the links on my own website, which is data diva.net easy enough. Instead of you trying to read the link there, you can also find my 3D printed queer dinosaurs. Trans eggs with a trans.
C
Hold on.
B
Transisaurus. I love that RPG in a box. And my latest design, a combination crochet, hook and bubble wand that says Hookers and Blow. Instead of pets. I offer a baby picture of myself at 10 months and a recreation of that same photo 40 years later. I'm also sharing my pics of my work. Tuckers and Blow. Look at these dinosaur eggs. These trans dinosaur eggs. These are amazing.
C
Bus. That's incredible.
B
Okay, this is also adorable. You as a baby and then 40 years later. Well done.
C
Love that 70 sepia tone picture.
B
Right? It looks like Mrs. Claus, who could be her mother, but behind her.
C
I know. So rad. So rad. Thank you so much. Data Diva for this. Everybody again, go and vote for Dada Diva for her Powerful Idea awards. It's@dadadeva.net thank you for that, Sherry Pronouns she and her When I don't hear you each morning, my day doesn't start right. Anyway, when we first moved to Topeka, the blue dot of Kansas five years ago, our front porch became a cat refuge for the ferals living around us. One of them, who I named Mamo, had kittens by our fence, which my dog Zeus discovered. Zeus loves kittens and would go every day to lie by the fence and watch Mamo and her babies. I started feeding her while promising my husband that I would not add any more cats to our household, which at that point had five cats and two dogs. Of course, within a few weeks, Mamo presented her kittens to my husband with a definite air of here, you take them. And the big old softy did. We later built winter shelters out on a porch for the cats. Oh, that's Mamo sharing her shelters with the local possum. As happens with ferals, Mamo eventually succumbed to injury and illness. She was not amenable to being touched, so I couldn't do anything. But her two kittens rule our house, sleep on our dogs, and generally live well. The possums visit the front porch regularly. I watch them through the doorbell camera to eat the cat food I put out for my porch kitties. And they eat ticks too, so I am pro possum. I love the news, the swearing, the experiments, and pronunciation and the humor.
B
Thank you. Thank you so much. I like that Sheri said experiments in pronunciation.
C
I think that that's a really good way to look at it. Yep, I approve that. I approve of that message. And again, like, why would we bother to Google when we have this vast, incredible community of extremely intelligent people who get to tell us and teach us these things in ways that Google cannot. So that's I agree.
B
And speaking of corrections, here we go. This is from well pronounced he and him. Hi ladies. There was an exchange on Wednesday show about the pronunciation of the last name Melon. I work in financial services in Hong Kong. In that context, there is a Bank of New York, Melon or bnym, which is named partly after Thomas Mellon. There's also Carnegie Mellon in Pittsburgh. In both cases, I'd pronounce Melon as melon, not melon. Understood. Thanks for doing what you do given time zones. I listen to you all as I leave work every day instead of you being the first thing I hear in the morning after A stressful day. I've always I'm always ready for a bit of news with swearing I don't have a pet, so here's a picture of a baby hedgehog I met in a hedgehog cafe in Osaka a few years ago. Note to self, I need to go to Osaka and this fucking hedgehog cafe immediately.
C
Uh huh. Yes, I definitely look at the so their little hands kill me.
B
Oh God, they're so cute. And they have the cutest toe beans too.
C
They really do. I love them so much. Thank you for that. Next up, Hannah Pronoun. She and her hello Queens of the Beans. I've written before about the birds and critters that visit our yard, and I'm excited to share some possum facts that I recently learned from a friend who lives in Australia. Possums are protected by law there. According to the Nature conservation Act of 2014, if a possum gets in your house, it's illegal to harm or otherwise interfere with it.
B
You have to like let it live.
C
It's like on your couch eating food and get out. Nope, you can't touch me. Only licensed professionals who are trained to minimize stress and harm can relocate them. Another option is to install a possum box and hope that the possum moves in there rather than continuing to damage your home. As another listener explained, the common brush tailed possum is native to Australia but invasive in New Zealand. What we call opossum in the US is the Virginia opossum, the only marsupial found in North America. For pod pet tacks, I'm sharing my friend's photo with a brush tail possum peeking out of a possum box. I find them infinitely cuter than the US Version, which we sometimes see on our outdoor cameras at night, but my husband thinks they're cute too. Thanks to the beans crew for all you do.
B
Look okay, I am struggling because as cute as this thing is, it borders on terrifying the teeth.
C
Right?
B
It's like a rodent of unusual size. It's like an R O U S from the Princess Bride and it looks
C
like it's got bushy white eyebrows.
B
Oh my God. It really is kind of cute. And he's just picking out the box. Oh my God. Thank you for that. All right, this is from Cindy Pronouns. She and her hello my Queens. My good news is that after 41 years, I'm retiring from USPS as a letter carrier. I will miss awesome customers and their pups. Giving treats to the dogs goes a long way to making friends with them. It's it's against company rules, but well that I'm a total bird nerd. Awesome to hear that you are interested now too. A helpful app is Merlin. It identifies bird songs and calls. So when you're sitting on your porch or walking in the woods, just turn it on and we'll give you a continuous list of all of the birds it's hearing. For podpet tags, I give you my senior rescue Anna D. Banana and a picture I took of yellow crowned night heron. Thanks for all you do.
C
Yep, I've got Merlin right here already on my she's showing it.
B
Sure does.
C
And I have so far recorded all kinds of really amazing birds just in my backyard. Thank you so much Cindy. If you guys get the Merlin app, it's rad.
B
Alison Gil I just scroll down to the bottom of this last story and my ovaries exploded. I don't even have any eggs left in them, but they tried to find one.
C
I'm still looking at the cat from Cindy.
B
I'm like, oh, you look at the cat. Get down to these baby pictures.

They provide resources and community for parents experiencing loss. Without them, my world would still be upside down. My family and I are doing better. I try to focus on gratitude and staying present. Dana, your comment about surviving our hardest day was so meaningful. Thank you Ag. One activity that helps me is birding. See, Maybe we can have a birding beans club. Here's a picture of my rainbow baby when he was a little fresh pea out of the pod. He's a little over one now. Also as pod pet tax the piete cats who adopted my parents. I don't know if I'm saying that right. Herbert the Orange and Suzette. Much love and appreciation. Look at this baby.

And just so everybody knows, a Rainbow Baby is a term for a baby that's born after the parents have a pregnancy loss. The name draws on the symbol of the rainbow, representing beauty after a dark time. Thank you so much, Anonymous for sending that in. What amazing photos. And anybody, if you have any good news that you want to send us, please send it to us@dailybeanspod.com and click on contact. Dana, do you have any final thoughts?
