All right, so that bench trial in front of Judge Breyer for Gavin Newsom's lawsuit against the military being deployed in Los Angeles, it ended on Wednesday. Judge Breyer, by the way, laid into Trump's Justice Department during the final day of arguments, saying the government's, quote, new national police force is going to intimidate in order to bring about certain types of behavior, and that is what's violative of the Posse Comitatus Act. Hoo hoo. Doesn't sound good for the government.

The law is designed, quote, to get the federal government out of the states. Right. And all of that reporting, by the way, thanks. Is thanks to Adam Klassfeld at All Rise News and his coverage. Anna Bauer was also covering it blow by blow. But that does not sound good for the government. So we'll see how he rules.

Well, Judge Breyer went on to note that the sordid history of the law designed to basically stop the enforcement of Reconstruction era laws that former Confederate States feared after the Civil War. Now, as Breyer noted, those forces said, and I quote, out, out, out of our states. So the judge also asked the DOJ if there was an insurrection in Los Angeles, and there wasn't because the DOJ said no.

Yeah. Then he asked if there was a rebellion because that's what Trump's justification for sending in the troops was. And at that point, Judge Breyer sarcastically asked if they'd sent in troops if someone failed to pay taxes. She didn't pay her taxes. Send in. I'm really enjoying Judge Prior in this case, by the way.

I do, too. And I love that he asked about rebellion, and at one point he's like, can you tell me the difference between insurrection and rebellion? Because he said there was a rebellion, but you're saying there's no insurrection. And the reason he's asking is because that's the only thing that allows you to circumvent the Posse Comitatus Act. Right. And ghisaine Maxwell's lawyer, Mr. Marcus, took to Twitter and called my reporting on her sex offender waiver and security status and a rumor designed to rile people up. The Daily Beast reached out and asked me to provide a response, and I have. I said, quote, I stand by my reporting and my sources. Galaine Maxwell's electronic file clearly shows her public safety factor of sex offender has been waived, allowing her to be transferred to A minimum security camp, which by default includes work release. I have not reported that Ms. Maxwell has left the facility on work assignments. But if Mr. Marcus would like to go on the record and assure the residents of Bryan, Texas that she will not leave the facility, as the waiver apparently grants, I am certain that they and Maxwell's survivors who have been left out of this process at every step, would be relieved to hear it. I'd also like to ask Mr. Marcus who authorized the waiver.

So the Times is reporting that investigators have uncovered evidence that it was Russia.

It's at least partly responsible for a recent hack of the computer system that manages federal court documents. Shocking. Including highly sensitive records with information that could reveal sources and people charged with national security crimes. It's according to several people briefed on the breach. I'm telling you what, they're on our entire fucking grid now. It is not clear what entity is responsible, whether an arm of Russian intelligence might be behind the intrusion or if other countries were also involved, which some of the people familiar with the matter described as a years long effort to infiltrate the system. Some of the searches included mid level criminal cases in New York City area, New York City and several other jurisdictions with some cases involving people with Russian and Eastern European surnames.

Interesting, because in the previous reporting that you and I talked about, it was just the 8th Circuit, which wouldn't include New York, but now they're saying some mid level criminal cases in New York City. Oh my gosh. So maybe this is a, this is more scope and breadth than we originally thought. Anyway, we'll keep an eye on that for you. Thanks for that information, everybody. We have a lot of news to get to today. Let's hit the hot notes. Hot news notes. All right, first up from NBC. Trump told reporters at the Kennedy center that he's going to submit a crime bill to Congress and will ask lawmakers to approve an extension for his administration's federalization of the D.C. police to address crime. Quote, we're going to need a crime bill and we're going to be putting it in and it's going to pertain initially to D.C. he says we're going to be asking for an extension on that, long term extensions because you can't have 30 days. So it says Trump's emergency powers to take control of DC only lasts for 30 days and any extensions must be approved by Congress. You and I talked about this yesterday because in his Initial thing, he was like, until I say so. Until I determine there is no more crime.

Could be the worst day of your life. As your presidency ends, Dems retake Congress. America will be liberated. Liberation Day many are calling it. Thank you for your attention to this matter. Gavin Christopher Newsome. Now, his press office also issued this tweet on Tuesday night, again in all caps, final warning, Donald Trump. Maybe the most important warning in history. Stop cheating. Some cheating, or California will redraw the maps. And guess who will announce it this week? Gavin Newsom. Many say the most loved and handsome governor and a very powerful team. Don't make us do it. Thank you for your attention to this matter. Now, listen, I was a little worried about some of the things and ways we decided to run things in the last election. You know, I think there was blowback from calling him weird. I Think a lot of things. This is fucking funny. I mean, what, what? As long as he will back it up with actually doing something, I'm all for the trolling.

Thank you for their attention to this matter. Gcn so great. All right, let's get back to some news from some outlets here from NBC. President Trump's tax and spending law, what I call the billionaire bailout bill, will result in less income for the poorest Americans while sending money to the richest. That's according to the nonpartisan Congressional Budget Office or cbo, in a report on Monday. And this is exactly what we told everybody would happen. And this is what we knew was coming even before the election because it was in Project 2025. So this isn't a surprise. But the CBO, just to have the CBO's report come out, that's the news. They estimate that 10% of the poorest Americans will lose roughly $1,200 a year as they experience restrictions on government programs like Medicaid and food assistance, while the richest 10% of Americans will see their income increase by $13,600 per year. Overall, American households will see more income from the tax cuts in the legislation, including middle income households. But the largest benefit goes to the top 10% of earners. The CBO's report comes as lawmakers are away from Washington, many taking their messages about the bill to voters and many Republicans getting booed off stage. Republicans muscled through the legislation deemed the big beautiful bill by Trump through Congress in July. Democrats all vehemently opposed the legislation, warning that the tax cuts and spending priorities would come at the expense of vital government aid programs and it would balloon the national debt. Quote, this is a really big beautiful bill for billionaires, but for the poor and the working class in this country, you actually become poorer. That's Rep. Brendan Bole, top Democrat on the House Budget Committee. So as we suspected, this will, this will benefit the billionaires and it will cost $1300 a year to poor and working class is massive. Right. But that's a, you know, that's loose change to people like, you know, Elon Musk or whatever.

Those make me laugh. All right. This is a related story actually to what you were just talking about. Instrument Reuters. The U.S. government's budget deficit grew nearly 20% in July, 20% to 291 billion, despite a nearly 21 billion jump in customs duty collections, also probably ones we were paying from President Trump's tariffs. With outlays growing faster than receipts, the Treasury Department said on Tuesday. So that's the problem. It's upside down. The deficit for July was up 19% or 47 billion, from July of 2024. Receipts for the month, they grew 2% or 8 billion, to 338 billion, while outlays jumped 10% or 56 billion to 630 billion. That's a record high for the month. New customs receipts in July, those grew to about 27.7 billion from about 7.1 billion in the year earlier period due to a higher tariff rate imposed by Trump. This is from a Treasury official. These collections, they were largely in line with the increase in June customs receipts after steady growth since April. Now, Trump has touted the billions of dollars flowing into the US Coffers from his tariffs, but the duties are paid by companies importing the goods. Importing the goods with some costs often passed on to the consumers in form of higher prices. And that's exactly it. So you don't think that these companies, you know, I saw a whole thing on Arizona iced tea. This guy touts himself on being able to keep every single can at 99 cents. He is proud of it. But this aluminum tariff, for the first time in six presidencies, six different presidencies, wars never had to change the price. He may have to raise the price because of the tariff on aluminum. This is hurting and those are being passed on to us.

Yeah. So even with bringing in $20 billion in tariff revenue, which we pay for it, still increased the, still increased by 20% the debt. Wow. All right, thanks for that. Next up from the LA Times, this story. I'm going to give a content warning just because it's, it's so awful, but Los Angeles school district, police staff and community volunteers will form protective perimeters around at least 100 schools when classes begin Thursday to help ensure the safe passage of children. An announcement that came on a day that immigration agents reportedly handcuffed, detained and drew their guns on a student outside Arleta High School in a case of mistaken identity. Dana, a 15 year old boy, Jesus with disabilities, was at Arleta High School on Monday with family members. He attends a different district school, and that's when federal agents detained him. According to LA Unified School District officials, family members intervened, and after a few very tense moments, the agents released the boy. The school's principal also came out to assess the situation. Agents left behind some bullets on the sidewalk, apparently by mistake, which were collected by school police. Quote, such actions violently detaining a child outside a public school are absolutely reprehensible and should have no place in our country. That's school board member Kelly Gonz, who represents Arleta High School, in a social media post. Across Los Angeles, unified parents, teachers and staff have expressed deep fears about school safety amid immigration raids. Citywide leaders are concerned that children whose parents are living in the country without legal status will be kept home as families grapple with the climate of fear. Louisiana School Superintendent Alberto Carvalho spoke Monday at a news conference with Mayor Karen Bass near district headquarters. He said the district is doubling down on their efforts to protect students and families by creating and expanding what they call safe zones around campuses before and after school, that everyone must come together to protect the most vulnerable. For the first day, Carvalho will deploy central and regional office staff across the school system, an effort mirrored by organizers in the teachers union, who are gathering volunteers to patrol the streets around the schools. Safe passage zones have been expanded from about 40 at the start of the prior school year to up to more than 100. The school district, by the way, has close to 1,000 campuses. And we're going to have a link in the show notes if you'd like to volunteer with the teachers union to help patrol these safe passages in the streets around the schools. They cleared the way on Wednesday for the Trump administration to continue refusing to spend billions of dollars in foreign aid, finding that aid organizations that had sued to recover the money they lacked legal right to bring the challenge.

The decision, which centered on President Trump's authority to withhold funding already appropriated by Congress, handed the White House a significant legal victory. Since taking office, Trump and his advisors have consistently claimed expansive authority to freeze federal dollars allocated for projects they have endeavored to snuff out. An action known as impoundment that legal scholars and aid groups had considered to be strictly limited under federal law. But by a 2 to 1 vote, the appeals court panel ruled that under the Impoundment control Act of 1974, only the government Accountability Office, which serves as Congress's independent watchdog, could challenge the president's efforts to withhold foreign aid funding. That panel found that groups that receive government funding, in this instance a number of global health nonprofits, did not have cause to challenge his funding cuts. The decision lifted a lower court's order that had required the administration to continue processing foreign aid payments with funds Congress had already budgeted. So we're going to keep you posted on the appeal and see what happens.

Okay, this one's from Anonymous. Pronoun she and her Dear Beans Queens, I found your podcast about a year ago and it's a lifesaver. Thank you. Mostly for your good mostly for your good news. Mostly is only mostly dead. I love your whole show but sometimes the real news it's a little too much and I just fast forward to the good stuff for my mental health. I love that because the majority probably do the opposite. I feel a bond with Allison. I went to Northern University of Arizona in late 80s. Then on to the real stuff. My husband and I are 28 year plus VA healthcare providers. Oh my God stretch to the max doing patient care. Every day is a little harder and more dangerous. I would leave but there would be nobody to take care of my veterans because they are all they are not replacing vacant positions. Before my good news, I need to share my heartbreak that the VA is actively helping ICE recruit veterans to join their terror squad. There's going to be a link to that story if anyone needs that. The U.S. department of Veterans Affairs. There's a Facebook page. My good news is that my extended family members are starting to wake up to what's going on in our country. They've always voted red and we agree on very little. Politically, no amount of my warnings were successful, but now they are noticing that maybe things are not what they really wanted. You know I'll take those small steps and try to continue to have patience and grace with them. But so hard for my podpet tariff I'm sharing a picture of my recent past fur baby Toby aka Mr. Orange. He was the third kid in our family. He had a long life. 15 plus years and we'll never forget his unique spirit and constant mischief. Standard schnauzers are working dogs and he proved that in every way. He was so smart we had to baby proof the whole house yet still managed to find trouble. He was the most loving companion to us and our boys who are now men. He especially loved time in the pool. Thank God because we lived in Arizona. It's been three months since he passed but my heart is still aching every day. Thank you for letting me share him. Keep up all your great work. You are the best.

The F word describes so much. The good news you ask. My ex husband of 30 years, a lifelong Republican, although not a Trump lover, whispered to me a few weeks ago that he was becoming more and more liberal. Me, I just left it right there. No words needed. Our kids got him to stop watching Faux News a year or so ago. I wouldn't call him woke by any stretch of the means, but he's starting to see praise be. Turns out he doesn't want his daughter and granddaughters to die from maga. Christian horrific ideals. I have been an angry liberal since I was 25 and woke up after the birth of my second son and yelled someone sold me a bill of goods. LGBTQ are wonderful people. POC are wonderful people. I was raised Catholic in a tight bubble until the age of 16 in a small farming town. When we moved to the city, I noticed immediately the racism and bigotry. I divorced at 33 and started college at 37, all the way to my master's degree. Congrats, Em. I couldn't have done it without heating assistance and food stamps. However, I noticed I was a white woman. I was treated differently in the system. Now 64, after much therapy, study and voracious reading about everything, I've dedicated my life to helping lift up all with love. Except maga. I spit on them figuratively, not literally, because that's assault and they rarely if ever show up in therapy. Makes perfect sense, right? My practice is open to all, even maga. I love being a therapist and the satisfaction of teaching healthy and strong thinking and behaviors. I especially love my women who are stuck in in abusive relationships. And I love trying to teach men to wake up and grow. I'm a fucking badass. Accomplished, successful feminist to the core. Loud and angry. I'm not sure why more men do not understand they are on notice. You are on notice, guys. Women will no longer hold your dirty, abusive secrets. This backlash against us infuriates me. I boycott, I march and unabashedly share the dangers we are in. In closing, fuck the patriarchy. Fuck Trump and his administration. Fuck women who support this toxic patriarchy and betray themselves and the rest of the women every. I'm afraid I'm not much of a funny person, but a serious person. Although I have my moments. All right, this is from Laura, the hospice chaplain, pronoun she and her. In this time of rising white Christian nationalism, I want to give a shout out to my Alabama church, Weatherly Heights Baptist, which is part of the Cooperative Baptist Fellowship. We are the only Baptist church that is fully welcoming and affirming of LGBTQ community in northern Alabama. That's north of Birmingham and called our first female pastor a year ago. Who is amazing. We participated in our first Pride festival this summer. We have a long standing ESL program and because the CBF joined a suit with the Quakers and the Sikhs, we have an injunction against ice coming on our property. We also pack backpack size bags before each fall break and spring break for local elementary school whose kids all qualify for free breakfast and lunch so they have something to eat over the school breaks. A group in the church spends time helping to rehab houses in one of the poorest neighborhoods in the city as well. It feels good to be a part of a community pushing back against the bigotry in the name of religion that is so prevalent today. For my pod pet tags, I have a couple of photos of our 4 year old rescue dog Ferris, who is is about 60 pounds of bounce and aggressive snuggler. We do not know what kind of ancestors he has.
