ICE agents tackled and arrested an American citizen in Minnesota. You can get that wherever you get your podcasts. All right, we have a lot to get to, so let's hit the hot notes, hot notes. All right, everybody. First up, Jeanine Pirro has filed a really weird and very stupid motion for pretrial detention for the January 5th pipe bomber. And it's weird and stupid And I'm not arguing that he shouldn't be held in pretrial detention. I'm arguing the stuff about the stuff that's missing from this memo. You may recall I was very critical of the Department of Justice for having no information on the whereabouts of the pipe bomber in their arrest affidavit between December 13th and January 6th. Because if you have his whereabouts in those weeks leading up to the attack on the Capitol, including what the pipe bomber was doing after Donald Trump issued his December 19th will be wild tweet, you might be able to ascertain his political affiliation or his motives. So listen to this clip from the breakdown. That's my show over on the Midas Touch Network. Listen to this clip from three weeks ago this week, the FBI arrested 30 year old Brian Cole. This is the man who allegedly planted the pipe bombs at the RNC and DNC headquarters near the Capitol. Near is an operative word here, within a mile. And he did this the night before the January 6th insurrection. Now, in their arrest affidavit, the FBI said they used phone records to ping off cell towers to put him in the area. They used parts from the bombs that they traced to him purchasing. They used a license plate scanner that showed a car he drove registered to him or somebody he knew in the area and that he purchased that meal I told you about with a credit card a couple of weeks, three, three weeks before he planted the bombs. But there is a glaring gap of time in their affidavit. And this is something that was included in pretty much every single January 6th rioter affidavit issued by the Biden Justice Department. And it's a record of what this man was doing in the days and weeks leading up to January 6th. Marcy Wheeler pointed this out@EmptyWheel.net she said there's nothing in this affidavit between the time Trump called for everyone to come to D.C. will be wild. He did that on December 19th and the attack on the Capitol on January 6th. And I noticed that the affidavit says nothing about where he was on January 6th. Did he go? Did he go home? That would help you prove your case that he's some sort of lone wolf, whatever, and not associated with the January 6th attack on the Capitol. He was certainly being investigated with for a connection to January 6th, but they just left all of that out. And there's a reason why they want to create a vacuum of facts. MSNBC or Ms. Now learned that Brian Cole is a Trump supporter. He's MAGA and he's an election denier. He believes that the 2020 election was stolen from Donald Trump. He believed in the big lie that Trump actually won the 2020 election. But it wasn't the FBI or a government official that told this to Ms. Now, it was two sources familiar with the matter who spoke on a condition of anonymity. Now, this guy Cole spoke with the FBI for four hours. We also learned that from MSNBC and also confessed to planting the pipe bombs. Four hours of an interview and no facts. And then Pam Bondi says in her big fancy press conference that Brian Cole's politics are complicated. Really? No, they're not. You just don't want to say what his politics are for the same reason you left his personal communications and planning and whereabouts. Between the will be wild tweet and the insurrection, you are covering it up. Well, today Judge Box of Wine tried to explain away that 22 day gap in the pipe bomber's whereabouts that could reveal he's a Trump supporter, just like Ms. Now revealed that he was a Trump supporter. Sunday, she filed a memo for pretrial detention for Brian Cole. And in a footnote, she said, quote, the first factory reset or wipe event of Brian Cole's phone took place on December 15, 2020. The next such event did not occur until July 15, 2022. From that date, the factory reset or wipe events occurred at least once a week. On some days, the device appears to have been wiped multiple times in the same day. Now, she doesn't say why she mentions that. Is she trying to say that it was harder to investigate or we couldn't get the information about where he bought the pipe bomb material? Or is she trying to explain away that 22 day gap? If so, she's not doing a very good job. If the phone was wiped on July 15, 2022, wouldn't that wipe his whereabouts on January 5? Now, in this affidavit, in this memo, she makes no mention of where dude was January 6th. Which, as I said in the clip, would actually help them prove he wasn't a Trump supporter if he didn't go to the rally on January 6th. But they just conveniently left that out too. I mean, just, just like Judge Jeanine herself. This, this case is a big old mess. They're doing everything they can to hide this guy's political affiliations from the public. I'm not saying he didn't do it. I'm not saying he shouldn't be held in pretrial detention. I'm saying, wow, they're really having a hard time covering up the fact that this guy was a Trump supporter. All right, next up from Politico, Donald Trump expressed optimism about making progress on a deal to end the war in Ukraine as he welcomed President Volodymyr Zelensky to his Mar a Lago estate on Sunday. But just as he expressed his belief that Ukraine's revised 20 point peace plan offered the makings of a deal, he brushed off a question about whether he would sign a commitment to providing Ukraine specific post war security guarantees, signaling that there are still several hurdles to overcome. Yeah, like that the only real peace plan is for Russia to get the fuck out. Quote, no one knows what the security agreement will say. What a dumb question. That's what he shot back at reporters. Trump, who made initial comments as he welcomed Zelensky in the driveway of his Florida estate, said he didn't have a hard deadline for a deal, but asserted the talks are now in the final stages. We're going to see otherwise the war is going to go on for a long time. Either way, it'll end or it's going to go on for a long time and millions of additional people are going to be killed. Millions. Now he intended to call Russian President Vladimir Putin, who he spoke with before the meeting with Zelensky after sitting down with Zelensky. So he's going to bookend his meeting with Zelensky, the hero with two phone calls to Satan. Got it. I mean, is he looking for a pep talk? Is he looking to figure out if he's got it right, that he's telling Zelensky what Putin wants him to tell Zelensky? Just ridiculous. Next up from cnn, A day after part of a missile fired by the United States hit their village, landing just meters from its only medical facility, the people of Jabo in northwestern Nigeria are in a state of shock and confusion. Suleiman Kagara, that's a resident of a quiet, this particularly quiet and predominantly Muslim farming community and Tambo Wall, that's a district of Sokoto state, told CNN he heard a loud blast and saw flames as a projectile flew overhead around 10pm on Thursday. On Christmas, soon after it came crashing down, exploding on impact with the ground and sending the villagers fleeing in fear. Quote, we couldn't sleep last night, Kagara said. Never seen anything like this before. Kagara did not realize at the time that what he was witnessing was part of a US Strike that Trump would later refer to as a Christmas present for terrorists. Not long after the impact in Jabo, Trump declared on Thursday that the U.S. had carried out a powerful and deadly strike against ISIS militants in the region, who he accused of targeting and viciously killing primarily innocent Christians at levels not seen for many years and even centuries. According to US Africa Command, the operation neutralized multiple ISIS militants, but Trump's explanation has left Kagara and his fellow villagers scratching their heads. Villagers say Jabo is not known for any terrorist activity and that local Christians coexist peacefully with the Muslim majority. Bashar Isajabo, a lawmaker representing Tambu Wall in the state parliament, described the village to CNN as a peaceful community that has no known history of isis, Luca Rawa or any other terrorist groups operating in the area. He said the projectile struck a field about 500 meters from a primary health center in Jabo, that while there were no casualties, the incident caused fear and panic within the community. The operation in Nigeria follows repeated claims by Trump of a significant threat to Christians in the country, with the president ordering the Pentagon last month to prepare for possible military action. So this is just bigoted war, very dangerous. Next up here at home with NPR reporting. Federal immigration agents tackled and arrested a Somali American man in Minneapolis on Tuesday and detained him for about two hours for no apparent reason other than his ethnicity. The man who was arrested said the agents had trouble finding the Bishop Henry Whipple federal building at Fort Snelling while driving him there. The 20 year old was not suspected of any crime and described his ordeal during a Wednesday news conference alongside Minneapolis Mayor Jacob Frey and Police Chief Brian o', Hara, who each denounced the agent's actions. Moba Shear, who moved to the United States as a very small boy and became a naturalized American citizen, said that he stepped onto a sidewalk near Fourth street and Cedar Avenue during his lunch break when two masked men approached him. The Cedar Riverside neighborhood is the heart of the city's Somali American community. Sensing trouble, he ducked into a restaurant. They followed him inside, dragged him out and forcibly arrested him. The agents handcuffed Mubashir, took him across Fourth street and pushed him onto his knees in the snow. One put him in a chokehold. I have my id, he shouted repeatedly as heard on video of the incident, and the agents ignored him. Mubashir said the agents then put him in an unmarked SUV and asked to take his picture. Quote, I declined because how will a picture prove I'm a US Citizen? That's what Mubashir said. He went on to say, I told them I have my passport. It's in my phone. Can I open it and show you? They declined. I told him, I give you my name and my date of birth. They declined. Mubashir said the agents detained him in their vehicle for about an hour after he refused to consent to the photo. Mubashir said they also tried to take his finger fingerprints, but their digital reader didn't work. So they drove toward Fort Snelling, where ICE has a detention facility. But they appeared unfamiliar with the area. Quote, while they were driving me all the way there, they were wasting time. They kept going back on the same highway. I told them, are you guys lost? They said, this is our first time taking someone in. They had their maps out and everything, and they were trying to intimidate me. Mubashir said when they finally arrived at the Whipple Federal Building, the agents took him out of the vehicle and made him stand in the cold unless he consented to a face scan. So he eventually did. He said that the face scanner appeared not to work either, so they took him inside the federal building. Mubashir said they refused his request for water and to warm his hands. Once inside, a staff member finally allowed him to turn on his phone and show his ID before they released him. His parents picked him up. Jacob Frey, the mayor, who's an attorney, said that the agent's actions were blatantly unconstitutional. We call this a Kavanaugh stop, right? Quote, what we saw by these ICE agents that clearly did not know what they were doing was violence and unwillingness to hear the simple truth, which he was repeating again and again, which is, I am an American citizen. Brian o', Hara, the police chief, called it embarrassing to the law enforcement profession that agents were wearing vests. That said police, quote, random efforts, including individuals who are American citizens, are being stopped because they appear to be Latino or because they appear to be Somali is wrong. That's what o' Hara said. That's the police chief. NPR News, contacted ICE by email Wednesday to ask about the reason for Mubashir's arrest and the agent's treatment of him. And on Friday morning, NPR News received the following statement from an ICE spokesperson. Quote, On December 9th, ICE officers were investigating criminal immigration violations in Minneapolis near a location that has a high level of criminal activity. The officers were having a consensual conversation with a suspected illegal alien. At that time, a second male individual walked out of a nearby restaurant, turned around and fled from law enforcement. Having reasonable suspicion as protected under the Constitution. Officers gave chase and caught up with the individual, who violently resisted officers and refused to answer questions. A large crowd of agitators descended and began threatening the officers for their safety. They temporarily detained the individual to safely finish asking their questions. Once officers finished their questioning, he was promptly released. Allegations that DHS law enforcement officers engage in racial profiling are disgusting, reckless, and categorically false. What makes someone a target for immigration enforcement is if they're illegally in the U.S. not their skin color, race or ethnicity. Under the Fourth Amendment of the Constitution, DHS law enforcement uses reasonable suspicion. Oh, he turned around and walked away. That's your reasonable suspicion? We use reasonable suspicion to make arrests. If and when we do encounter individuals subject to arrest, our law enforcement is trained to ask a series of well determined questions to determine status and removability. They ignored him when he said he had his ID and drove them around acting like they were lost. All right, let's get to some better news. Judge Kohler Cotelli has denied the government's request to once again sift through Daniel Richmond's stuff to find classified materials, but granted the government's request to give him a little more time to comply with her previous court order about returning all of his stuff to him. Richman, as you know, is Comey's friend and lawyer that successfully sought a restraining order against the government to prevent the feds from accessing the materials seized back in 2017 and returned them to because the government violated his Fourth Amendment rights when they failed to get a search warrant to go through his stuff again this year when they were trying to indict Jim Comey, the judge said in her Saturday ruling. It's hereby ordered that no later than January 5, the Attorney General or her designee shall certify to this court with specificity that the government has complied with the Court's order dated December 12, as clarified and modified by any subsequent order of this court. That's the one where they have to give the stuff back. It's further ordered that the government and its agents shall not access Richmond's covered materials except for the limited purpose of deleting the purportedly classified memorandum identified in the record or share, disseminate, disclose or transfer those materials to any person without first seeking or obtaining leave of this court. It's also ordered that the government shall not review Richmond's materials for any additional classified material beyond that single classified memoir from Mr. Comey that was originally contained in the petitioner's personal computer hard drive without first obtaining a valid search warrant. The government wanted to go through, look through all of his shit again because they said there might be classified stuff in there. They could only prove that there is probably one classified memo in there. So she's like, no, you can't you can go get that one and that's it. And then you gotta tell me by January 5th that you've done everything that I told you to do. Also, in some better news, nobody likes Trump. Still, NBC reports the head of the Kennedy center sent a scathing letter this week to a musician who canceled a Christmas Eve concert at the performing arts venue after Trump's name was added to the building's exterior. Rick Grinnell, special envoy during Trump's first term, blasted Chuck Red, who has presided over the annual jazz jam since 2006, for citing the name change as his reason for canceling the event. In the letter, Grinnell said the Kennedy center will seek $1 million in damages for what he called a political stunt. Putting the Trump name on the front of the fucking Kennedy center is a political stunt, sir. Quote, your decision to withdraw at the last moment, explicitly in response to the center's recent renaming, which honors Trump's extraordinary efforts to save this national treasure, is classic intolerance and very costly to a non profit arts institution. Trump's name was added to the facade a day after the board voted to change its name. He already had it ready to go. That addition could be one of many changes to the building. On Friday, the president posted images of potential marble armrests for the seats. That sounds comfortable. Democratic Rep. Joyce Beatty of Ohio Monday sued the Trump administration over the name change, calling it a flagrant violation of the rule of law. Beatty, who's a member of the board, said she was prevented from participating virtually in the board meeting. When they voted to rename the center, they muted her. They muted a black woman. And in a related story, the Daily Beast reports Trump's Kennedy Center Honors hosting debut on Tuesday flopped badly. Preliminary ratings data show CBS's broadcast of the awards show attracted its smallest audience ever. Ever. The 48th Kennedy Center Honors averaged about 2.65 million viewers on Tuesday. That's a 35% decline from the 4.1 million who tuned in for 2024. Trump, the first president to host the awards, had boasted before the show that the center's board and just about everybody else in America wanted him to serve as emcee for the evening. CBS didn't even want him to. They aired the prerecorded ceremony without indulging Trump's rebrand and trimmed his opening remarks by 12 minutes. Well, from 12, it was 12 minutes. They cut it down to two minutes. They cut out some of his freewheeling asides, including his crack at the laughing crowd as horrible people. If there's one thread that connects all these amazing artists. It's the word persistence. I know many of you. You are persistent. Many of you are miserable, horrible people. But you're persistent. You never give up. Sometimes I wish you'd give up, but you don't. They cut that out. They cut all that shit out. Is he going to sue him for editing his speech? 2.65 million viewers. That is fewer than have viewed the spiked 60 minutes inside Seacoat Prison segment that we had to bootleg from Canada. We're bootlegging our news from Canada because of Barry Weiss and CBS. This is our neurospicy kiddo, who's faced language processing disorder, severe social anxiety, odd ocd, adhd, and everyday struggles like holding a pencil or a conversation. He's always been wise beyond his years, but the basics took work with amazing public school teachers, therapy, and little League. The boy who spent recess with the lunch lady became the first student body president at his new high school. He's been the go to escort at four quinceaneras. Being an openly gay young man who can dance and speak fluent Spanish has its perks, is nearly fluent in Korean, and he maintained a 4.58 GPA from grades 10 to 12. Holy cannoli, Nick. We're waiting on 13 more schools this spring, but he feels like this is a great sign. His dream PhD in history teaching at the university level. We're incredibly proud, though every frustration and setback. Through every frustration and setback, he never gave up. Beyond academics, he's conquered most of his social anxiety, become an amazing friend, loving brother, and incredible son. The doctor looked it up right away and announced excitedly that it was woman owned. The office is mostly women and they were all excited to hear that my pup went to live with chosen family. When I was hospitalized last March, she was doing her own version of PT with her new brother and guardian, Pomeranian Punkin, while I was doing the same thing, first in the hospital, then in a rehab facility. We're both doing much better now, and with four adults in the house, two of them retired, she's always got someone to fuss over her.
