So I've always hated group photos, and now I have a reason for not engaging and for refusing them. That was Florida attorney John Morgan really calling the game before it even started correctly, no less. And I was going to introduce John as one of the most famous lawyers in the south. But then I went to LA a few weeks ago, and sure as shit, I'm driving from LAX to my Hotel. And what do I look out my goddamn window and see? A giant Morgan and Morgan billboard right in Los Angeles. And I'm like, holy shit, 3,000 miles away. I can't escape this guy.

John, there's been a lot of, we call it, but Monday morning quarterbacking, a lot of autopsying here, post mortem ing here on this election. But you were pretty well ahead of the curve. And you were also an insider. I mean, you are a very prominent Democratic fundraiser and donor. You had raised a lot of money for your friend Joe Biden at the time. And you kind of saw the writing on the wall, the way I looked at it at the time. And we didn't really talk about much about this publicly. Democrats, I'm now an npa. But you did talking about the fact that if we're gonna. The President of the United States, the anointed successor has to be what I'd call a napalm candidate. It's got to end the election right then and there. And when Kamala Harris became the presumptive nominee, it was still a tied score. And that did not bode well, obviously for the, you know, the incumbent administration. So, John, what did you see at that moment in time that troubled you and you in fact actually pulled out as being a donor to a Kamala Harris campaign?
John Morgan
That's right. I saw her. I saw her in the primaries when she ran for president. She got no delegates. She got 8% of the vote in her own state of California. She was beat badly. And while I like the idea of a woman president, you know, if you say if you were against her, it's like all of a sudden you're a misogynist because, you know, you're calling balls and strikes. Had nothing to do with that. I wanted. Listen, nobody fought harder for Hillary than me, but I thought two things. One, I did not think that she would resonate to break through what had to be broke through, which was the independents. That's who elects people now. I mean, 35% of the voters are Republicans, 32% are Democrats, 34% are independents. That's. That's the game. And most of those independents are really Republicans or Democrats and really like 6%. I saw that. Plus I didn't like the idea of running on this whole campaign of, you know, let's protect democracy when we don't have an election to pick our own candidate. It was hypocritical.

Right. Or a convention, A mini convention, something. You could have gone in and picked Meg Whitmer from Michigan and Josh Shapiro from Pennsylvania, and that would have been one hell of a ticket. That would have taken care of Michigan, that would have taken care of Pennsylvania, maybe. And if you save Wisconsin, you may be okay. But they didn't do that. Not only did they not do that, I believe she picked the guy from Minnesota because she didn't want to be challenged by somebody sharp like the guy from Pennsylvania. In business, a lot of times, businesses go down. A's hire B's because they're intimidated by A's, and then B's hire C's. You know, to build a great company, A's have to hire A's, hire people better than you, smarter than you, make you better. She got this high school assistant coach who didn't even carry his own district in Minnesota. I mean, look, I know my high school assistant coaches, and I don't see them as vice president.

Tim Walz, the governor of Minnesota, who was, of course, Kamala Harris's running mate. I want to get to the nitty gritty here. I mean, I feel that, in all honesty, Joe Biden probably would have won at least Pennsylvania. I'm thinking Joe Biden probably performs better than Kamala Harris performs if he made it to the finish line here. But, I mean, I just really thought that everybody talking about how, like, the vice president is next in line. How can we leapfrog a woman of color? And I'm like, first of all, the vice president is not next in line. Okay? Is not the presumptive nominee. And I'll tell you how I know. 2016 is how I know, because Joe Biden didn't run for president in 2016. And had he run for president in 2016, we probably wouldn't be having this conversation, because he would have won, okay, in 2016 against Donald Trump. And it strikes me, and I just. I feel like we have to have this conversation quite openly because, Brittany, let me just tell you, as a young woman in America, you can be anything you wanna be. Dream big, grow up, and you could do anything except be president. Let's be perfectly real about this, because it was 2016 all over again. But worse, they're like, we're not just gonna nominate Hillary Clinton. We're gonna nominate a woman of color in this country. I have to say it because we.

100%. Look, I think what happened is we know what happened. Pelosi thought there was going to be a convention. Obama did not endorse her for five days. Here's the dirty little secret. Obama didn't want her. Pelosi didn't want her. But Biden I believe. And look, I'm going to be at the White House tomorrow for a dinner. I think Biden was pissed that he was pushed out. And he said you. And when he said you, there's Harris. And Obama waited for five days, you know, and then all of a sudden everybody had to coalesce around it because they're running out of time. And with Harris, it looked like, here's how the election went. People who voted for Harris were voting against Trump. People who voted for Trump were voting for Trump. When they're not voting for you but against your opponent, that's a tough climb. And she couldn't make it. She didn't make the case. The other problem she had is she could never untether herself from Biden. It's Harris, Biden. It's the Harris, Biden, Biden, Harris economy. And she couldn't go out. And she wouldn't go out and say, look, I think Joe up. Let me tell you what I'd do different.

Right. I also think, though that you're talking about issues now. I don't think this election was about issues. It was not about competency or character.

This election was about this. And it began with defund the police. It began with transgender swimmers. This election was more about woke transgender swimmers and defund the police than it was about the inflation in the war in Ukraine.

But, yeah, but those culture wars are not Democratic culture wars. Those are Republican culture wars. Democrats don't really give a shit about them. They're just like, where are these people gonna go to the bathroom? Like, can we just have. Like, where are they gonna go? They gotta go somewhere. Republicans wanna run on those issues, but those issues and day one, mass deportations do not help the economy. In fact, quite the opposite. So that's why I'm saying this wasn't an election about issues. This is the wwe and that's what the Democrats keep missing. This isn't about competency or character or commitment to the Constitution. As far as I'm concerned, the Democrats should have nominated Tom Hanks and Mark Cuban or Oprah and Michelle Obama. Anybody who could win. It didn't matter who was competent, who was next in line. The bullshit petty politics of we can't leapfrog this person and the Vice President, that was a losing proposition.

But don't forget this. If they had leapfrog Harris, she would have thrown a shit fit. A shit fit. And she would have been saying the things that we know. She'd be saying.

Yeah, they had $200 million. But listen, you guys are in Florida. I'm in the Wall Street Journal today being quoted. They were running tons of ads in Florida. That was like, as I said in the Wall Street Journal this morning is like filling a wheelbarrow full of millions and millions of dollars and just catching it on fire. I mean, Trump was not going to lose Florida. He won by 13 effing points. But who was buying these ads? Who was running this campaign? There needs to be a colonoscopy on the waist.

But the most effective ad that Trump had was the transgender ad, and they never pushed back on that. I talked to Bill Clinton about that. He said, they've got to answer it. They never did. But to your point, about everybody internally and everybody around her really thinking that she was going to win the election, a friend of mine who works in politics and is a Democrat and was a big Harris supporter, I had asked her, I said, how are you feeling going into this election? And she was at a Harris waltz rally in D.C. the day before, and she said, my God, the energy was amazing there. And I was like, well, that's. Yeah, I would assume it is. Everybody who was there was a supporter of her and planning to vote for her. But that tonality and that vibe, if you will, is not necessarily reflective of everything else across the nation. And I did vote for her, obviously, but because it was choosing between the lesser of two evils. And even, I can tell you, the celebrity endorsements, the brat lingo, it was lost on me.

Is that to be fair, looking at the numbers, then Kamala Harris is going to have the third most popular votes of any presidential candidate in history. Biden is safe at number one. And as John said, perhaps those were people voting against her opponent rather than voting for her, which is problematic. But I wanna leave on this thought, John, because we are in Florida. And because of the grifting, because of Nikki Fried's big lie, Florida is in play. And I will tell you, all year long, every time I heard it, I played Whack a Mole with it. And I retweeted, I said, florida is not in play. We need to stop gaslighting ourselves and our donors and our voters. This is a rebuilding year. I'm a Dolphins fan. I know a lot about rebuilding years. That's all you do is rebuild. Absolutely. So what I'm saying is, what does Florida do when you got these grifters running the party who were. You can find her@pozogoldstein.com and Ada, I guess I should right off the bat is I imagine you've been getting telephone calls from concerned residents, clients, both naturalized and not naturalized. And what seems to be on the forefront of everyone's minds right now that you are hearing from, what are their fears, their concerns and what are you telling them?

Yeah, Billy, unfortunately my phone's been ringing off the hook and everybody is just panicked. And that's exactly what this administration wants. I mean, Tom Coleman has said it himself. Shocking off, that's what they want. They want to come in on day one, bring in massive police presence, even bring in the military, to just round up everybody who's here illegally and deport at least a million people in his first year. That's what he says he wants. So everybody's panicked. They want to know, is that going to be me? What are the priorities? Who are they going to try and deport first? But what if I have kids? Those are all the questions I'm getting on a daily basis. And it's very sad. It's people are here in South Florida. People in Florida are wondering if they should leave the state because we know very well that our governor is going to cooperate fully with whatever Trump would like him to do to help deport people. So it's just a mass panic right now is what I'm hearing from all my clients or potential clients that are calling me off.

So Tom Homan is the President elect's incoming border czar. He served as the acting head of Immigration and Customs Enforcement ICE during the first Trump administration. And he's been making the rounds on News 60 Minutes talking about, as you said, the shock and awe on day one. And that really, I guess, is the question, right? What is the criteria going to be? I have a lot of immigrant friends and neighbors. I guess it's not my problem. I can say as a white man born in America, whose parents were born in America. America, whose their parents were born in America, their grandparents were born in America. I don't know how far back they're going to go to denaturalize here. But is that the question? What is the criteria going to be? Where are they gonna start first? What do we know? I think we do know that they have said they're going to target so called criminals or people whether they are naturalized or not, people who had been convicted of crimes. Right.

The easy one to say is criminals. I think everybody agrees if you've been convicted of violence Violent crimes that you should be put in deportation proceedings. So that's the easy one. But the other thing that President Elect Trump is saying they're going to prioritize is people that have final orders of deportation. Most people with final orders of deportation in this country are not criminals. There are a lot of people that didn't go to court, so they ended up with an order of deportation and absentia. There are a lot of people that maybe lost an asylum claim, but have been here for many, many years and are working, paying taxes and have no crimes. So it's not just people that are criminals that are going to be deported. It's going to be the lowest hanging fruit, because we know he wants the most massive ginormous deportation that this country has ever seen. And it's going to be the easiest people to deport, which are people with final orders of deportation and yes, also people with serious criminal convictions.

Now you see violent crimes. But, you know, down here in South Florida in particular, we have a lot of people have been convicted of Medicare fraud. A lot of people have been convicted of drugs, drug related crimes that may be considered nonviolent but are pretty serious felonies in the face of defrauding the taxpayers and the federal government in terms of poisoning the streets with drugs from Latin America into this country. And some of those folks are naturalized. That's the thing too, is that people hear a lot about illegal immigration, but they're talking about. And Stephen Miller, who is going to be beyond the border czar, he really is Trump's guru of immigration, has said quite openly that denaturalization is on the table, which means that people who have become citizens. Right. Might not be citizens anymore and then might be deported.

I mean, we saw this in a smaller scale during Trump's first administration. It was Operation Second look where they went back into the naturalization applications of people and see if there was any kind of fraud that was committed and they tried to denaturalize people. Didn't get very far, but they've promised that this time it's going to be Operation Second Look. Turbocharged is the term that they use, that they're really going to go after people to try and see if, for example, when on that citizenship application, when people apply to naturalize it, ask if you've ever committed a crime for which you have not been arrested. People answer no. A couple years later, they maybe get convicted of a crime and it turns out that they were involved in that scheme before they naturalized. That would be grounds to denaturalize someone. But the whole process is in a federal court. This isn't something Trump can come in and say, you, you, you, you're denaturalized. There is a process in federal court and this process, though, has no right to counsel. So if you get put in a denaturalization process and you can't afford an attorney, good luck, you're going to have to represent yourself against the United States government trying to take away your citizenship.

Is, it appears like as if he's just going to do whatever he can to meet this quota of deporting 1 million Americans or 1 million self quota.

I think if you look at day one of the previous Trump administration with the Muslim ban, it was like chaos. So, I mean, there's no telling. He's already said that he's going to use the military to enforce this policy, whatever this policy may ultimately be. So, I mean, we very well could see soldiers on the streets of American towns rounding up immigrants. We have, the state of Texas has volunteered, I think, what, thousands of acres of property to build deportation camps, you know, a place for people to go and think and really concentrate at these camps, if you think, even concentration camps, you know, if you think about it. And so, Ada, where do we keep talking about? Where do we begin? But like they've already said that TPS is also, this is a. TBS is a policy that Congress created back In, I think 1990 for temporary protective status. It's a humanitarian effort for people whose countries are in tumult of which there are countless Haiti among them. And so people are not going to be protected anymore by these laws. And I'm kind of wondering, though, about the Cuban Adjustment Act. A lot of my Cuban friends feel that they are safe from these policies. And I have to wonder. We talked about Stephen Miller, who of course is like, has been an authority on immigration policy for Donald Trump through all these years. Katie Miller, of course, is his wife. She's a Florida woman. She was a communications director for the vice president. And I'll never forget what she said back during the first administration when people were concerned about the family separation policy. Listen to this. Katie Miller, she was spokesperson at DHS during the family separation crisis. A vocal, unwavering defender of what we were doing, taking these kids away from their parents. Katie Miller told Jacob, sober off, quote, my family and colleagues told me that when I have kids, I'll think about the separations differently. But I don't think so. Homeland Security sent me to the border to see the separations for myself, to try to make me more compassionate.

End quote. Sounds like Jacob responds, quote, it didn't work. I will never forgot what I saw. Seriously, are you a white nationalist? He asked, exasperated. No, she said, but I believe if you come to America, you should assimilate.

Why do we need to have, like, Little Havana? Because our neighborhoods are segregated down here. Well, that's true, but, you know, it makes me wonder, you know, we had talked about this on the last show about the English only ordinance that was passed overwhelmingly on a referendum in Miami dade County in 1980. This after the county Commission had acknowledged that we are already by the late 70s, a bilingual community. And we are, in fact today, now, 40 years later, we are a minority majority community. And it makes me concerned about the culture of and future of this community. Otto, what do you make of that? Is anybody safe? If TPS doesn't protect anybody, does the Cuban Adjustment act of 1966 protect any?

Well, the Cuban Adjustment act is not really going to help a lot of people anymore because we don't have wet foot, dry foot. So ever since wetfoot, dry foot got taken off, then when a Cuban tries to enter the United States, they're not given any kind of admission, they're not given a parole document, which is what used to happen when they would come in under wet foot, dry foot. So now when Cubans come in, they're never technically admitted into the United States. They're placed in court proceedings without being admitted. And the Cuban Adjustment act requires that the Cuban national have been admitted a year and a day ago in order to qualify for residence. So we've seen a watering down of the Cuban Adjustment act since wet foot dry foot has been taken away. The only Cubans that really benefit nowadays from the Cuban Adjustment act are the ones that are managed to come over here on a parole, which we know the humanitarian parole is going to be gone now under Trump. The ones that come in with that parole, or Cuban nationals that happen to have another citizenship, for example, that also have citizenship from Spain, and they enter the United States on an asta, a visa waiver, then they're able to apply for residence under the Cuban Adjustment act, but those are really the only Cubans that can use it. Now. It's been watered down a lot, and I suspect that it's going to be watered down more when now we're not even going to have the option of the humanitarian parole for Cuba.

But that is. That is forward facing, though. I'm talking about backward facing. Meaning you have naturalized Cuban immigrants, but is it possible to see some of them denaturalized and deported?
Kat
Well, they would have to. The United States Supreme Court did find that in a unanimous decision that in order to denaturalize someone, there has to have been a material fraud that was committed. So it's not just. So the Cuban Adjustment act is no longer here. We're gonna take away your residence? No, it has to be that. They have to prove that that Cuban national, or any other national for that matter, in denaturalization proceedings, committed a material fraud, lied about something on their application that had they told the truth, they would have likely been denied. That's what the government is going to have to prove to denaturalize anyone who has already become a United States citizen in this country. Now, is it going to become harder to become a U.S. citizen? I believe so. That. Absolutely, it's going to become a lot harder.

So obviously, in your line of work, you had mentioned up top that naturally you're experiencing a lot of panic from clients or potential clients and paranoia. And then I'm curious about the other side of that perspective, which we run into often in Miami, which is Cuban Americans or Cuban people idolizing Trump blindly and idolizing this administration. So what's the ratio between people that are legitimately concerned for themselves and their family versus people that think that they are invincible? Quite like. Like President Elect Donald Trump. Like, are you seeing a lot of a lack thereof of rightful paranoia and people thinking, oh, it won't happen to me, because that, to me has always been the most disheartening and confusing sentiment is. So many individuals fight so hard to get to come into this country. And they speak like, as if they're proud of their culture, and they speak like, as if they're proud of their nationality. And then the second that they are able to achieve some level of citizenship, they turn to their very brothers and sisters of Cuban descent and they say, okay, none.

Like a Miami nightclub list is full. Nobody else can come in. You know, so I'm wondering, you know, obviously you're seeing the panic, but are you seeing the dulu, for lack of a better term?

I think I saw a lot more the DULU before the elections. I think now that plans are becoming clearer. It's. People are starting to go, oh, wait a minute, we messed around and now we're going to find out. I mean, I've had people sitting in my office before a couple where the husband is a United States citizen, the wife is undocumented, and I tell them, look, we have to, you know, it's, things are probably going to change with the election, so you might want to file now in their league election. If Trump doesn't win, I'm leaving. I'm like, well, no, I don't mean that they're going to change and make it easier for your undocumented wife. Oh, well, no, no, no. She's married to me, so everything's going to be fine. There still is a lot of that level of. But I think that the more and more we start seeing the video of the military or law enforcement, ICE agents and people getting picked up and families getting separated, I think that that's going to go away pretty quickly.

And like, as I always say, the Miami of today is the America of tomorrow. So all of these red flags and all of these indicators and, like, you know, you were saying red flags, red flags.

And now what we're seeing is the very people who are supposed to be holding these folks accountable in law enforcement, in the state attorney's offices, they're just, like, up and sort of acknowledging that they're.
