Flow (16:39)
I got a couple things I want to say on that. This. It. It is. It is. It is. It is so crazy how they try to push these narratives and. And. And just say whatever. First of all, all of y' all in the. In the chat, we've been following this. We followed this Diddy case, and we've been following this Diddy story like a freaking bloodhound. Now, first point I want to make is, did they not send in the defense and the prosecution send in examples of the sentencing timelines? And I don't have the exact ones that the prosecution sent in, but they. I mean, time. The Time. The. The. Not the timeline. I'm sorry. The. The. The other cases of the man act where time was how much time was given. They did. The judge had them do this. This was a big thing, like they had time to do it. The judge went over it, the prosecution. So many examples of people getting a. A large amount of time or time similar to Diddy's or even a little more for the. So unless, like I said, they got somebody. The fixes in and. And. And. And Diddy them paid some back backstage money or something, how are you gonna argue with the. Exactly what they argued already in the court. They've already talked about the different time that people were given for the Man Act. They did this during the trial, during sentencing. The judge specifically asked the prosecution to send in examples, and they did so to say Diddy got more time than anybody from the Man Act. That's just not true. We went over this. Judge Aaron Subramanian, of all things, it was some things. I didn't like the way he handled it. I just thought maybe some ways he might have been a little soft on Diddy and soft in the courtroom. I thought maybe he maybe may have let Diddy, you know, stare down too many jurors. Without acting soon enough. But one thing I can say is he was very thorough in his approach. And when he made decisions, he gathered a lot of information from both sides. And like I said it, they made such a big deal about turning in examples of cases of how much time people got being being convicted of the man act that to come to the appeal and still raise the same exact argument that the defense tried to raise during sentencing when the prosecution showed many examples of people who got time similar to Diddy, some got more than Diddy, some got a little less. It was all over. It was a spread out, spread out situation. It was, it was different amounts of time. But they went over this. They went over this. So it's like this is an argument that was already talked about. I feel like they just taking Diddy's money. Thank you. Enoch brought up an example. The prosecutions, the prosecutor. Prosecutions brought the prosecutors. I'm sorry, you said prosecutions, but the prosecutor brought up a case where a guy got 10 years on the man that according to Enoch, I can't remember exactly, but I know Enoch has been following, following closely and I'm pretty sure she has the correct info. 10 years. So that's what I'm. So, so for Harvey, Mr. TMZ to push this narrative that people like that, that, that and act like it's some. It's justified to say that Diddy got more time than anybody for the man act is just flat out. Second of all, on top of that, his conviction carried a maximum of 10 years per charge that he was convicted. He was convicted of two charges of transportation or prostitution. That's 20 years. What the hell do we even have maximums if somebody can have be convicted of something that carries 20 years max. Now, of course, they don't give them max most of the time, but 20 years max. And we gonna argue that four years in two months is too much when the maximum was 20 years. So if that's the case, what the hell is the point of having maximums? If they don't mean to say that you could have got 20 years. Technically, Diddy could have got 20 years. TechnicallyS, we're just being. Technically, the maximum was 20 years. Now we gonna allow somebody to hold in a, a, an appeal and they technically could have got 20 years. They ended up getting four years. And part of the argument is they got too much time. In other words, the guidelines and the maximums don't mean a damn thing if that's the case. What he's supposed to have a maximum of 20 years. And get one year, two years time served from a 20 year, a technically 20 year conviction. Make it make sense. Like I said, if that's the case, the maximum, the max, that don't even mean nothing. Why even say it? Why even have it? Why not? Why not just let the judge just have convictions and let the judge just willy nilly it. If we gonna sit up here and say 20 years technically is what he could have got. And now we arguing that four years was too much, was way too much. I was following this appeal hearing just shaking my head, Shaking my head to the point where my neck start hurting because I'm like, this is. And people are running around acting like he's saying something. Do you know this guy? Diddy had spent a billion dollars on his legal team? They argued everything under the sun the entire time. You mean to tell me all of a sudden now they found something to, of how this should get appealed? Come on. Like, like, let's just be, let's just be honest. Let's use our, our common sense. All of a sudden, after millions and billions of dollars spent, they've argued everything you could think of, they've had a hearing for everything you could think of. Now all of a sudden they regurgitating the same and calling it appeal. Just taking Diddy's money. And you got people like Harvey Levin and some of these Diddyites, Didiots running around talking about, yeah, he got more time for the man act than you're supposed to get for the manic and the porn was he could, he made it for his own personal pleasure. That ain't what the, this whole case was about. But based on the narratives that's going around, let me break it down of, of real talk, what's going on and what's being said. So let me go, let me go, let me go. First of all, we don't have a, this, a timeline. I don't know when the decision is coming in. I don't know when the decision is coming in. They have no exact timeline of when we're gonna find out whether Diddy is gonna win his appeal or lose his appeal. But what we do know is what they broke down. So breaking down the chances of Diddy's appeal based on what's being said, this is what, this is what some people are saying, what the judges are signaling. They saying that they didn't shut him down. They saying that that is a good sign for Diddy. The judges engaged heavily with his lawyers. They asked serious questions about the sentencing, not just brushing it off Translation, this is not a dead on arrival appeal. He's still in the game. Now I think he's getting a real ear only because it's high profile and in the money and the, in the, and the money being spent and the lawyers that are, that are bringing it to the table. From my past experience, judges seem to listen a little more on, on high profile, big money attorneys when they're talking. If this was not Diddy and this was Paul down the street, these just, first of all, we wouldn't even be at an appeal. But if he did have an appeal, they would be shutting that down before he could take his first breath. Before the attorney could take their first breath. That appeal would be shut. The hell it was shut down. But I believe because these are high profile. Prof. A high profile case, high profile attorneys and big money being spent and big money watching it. These judge, our judges are paying attention and looking hella engaged. That's my opinion. Now the big issue here, acquitted conduct. This is where things get spicy. Diddy's team is arguing the judge punished him based on things the jury did not convict him of. That's called acquitted conduct. And even though it's technically allowed in some cases, a lot of judges hate how it feels. Now, key words right there, it is allowed. It is allowed. We can't be straddling the fence. Either it's allowed or it's not allowed. And in, in this case, it was allowed. And the fact that you can do something on a quitted, you can make decisions or sentence in a base on acquitted conduct, it is allowed. So let's continue. During the hearing, at least one judge seemed very uncomfortable with that concept. So they're saying that one of the judges that is hearing this appeal didn't like, didn't like the idea. Good morning, island girl. Didn't like the idea that Diddy was, that acquitted conduct was considered. So, so they pressed, they then pressed the government on how hard on government, on how hard on how that was fair. They went hard at the government about why they felt that was fair. Many people believe this was Diddy's strongest argument. If anything saves them, it could be the acquitted conduct. But the judges weren't fully sold. They weren't fully sold. Now here's the reality. Some judges pushed back on Diddy's team. They questioned whether the sentence was actually within legal guidelines. Anyway, they didn't clearly signal we're overturning this. Translation, this is not a slam dunk for Diddy, of course, but many people who are following this Harvey narrative Believe it's a legitimate fighter on, on hand. Now the First Amendment argument, which is the weakest part of the whole argument his team tried to argue parts of the case involve free speech and free expression. Now before I. That that's what I said. Like that part is just mumbo jumbo. I don't even understand you paying you paying these attorneys big money to try to convince. And part of their argument is that it was. This is freedom of speech and expression, this cornography. Judges basically didn't lean into this much at all. And they seem more focused on the sentencing issues. So overall, as I said earlier, and these ex quote unquote experts are saying the freedom of expression part, they could have kept that, that didn't even, that's, that doesn't even hold any weight. So at the end of the day, this is what they're saying. The real, real chance. This is the chances. What they, what the experts are saying is the honest breakdown of, of Diddy's chances. So they say as a full overturn conviction, meaning fully overturning and conviction wiped. They are saying it's very unlikely sentence being reduced or having a real, having a re sentencing. They feel like that's a real possibility. And it also, an appeal being denied completely is also a real possibility. So basically, if we were to put this in percentages, they looking at 50% appeal being denied and 35 to 40% sentence gets reduced or sent back 10 to 15%, he wins the appeal. Now 50 on a pill being denied. That seems very low. I think I forgot. I, I don't know the exact number, but I thought they said only as a matter of fact. Let me check this before I say it, but I'm thinking federal appeals. What is the percentage of, of victories or what are the percentage of appeals that are denied? I looked this up. I just want to, I don't want to get on here and say the wrong number, but appeals denied. 80 to 90% of all federal appeals are denied. Now they are saying diddy has a 50% chance of being denied when it's normally 80 to 90%. Even that right there gives me cause to pause. They went through this case with a fine tooth comb. He didn't get rico. He wasn't charged with rico. It was hella evidence. He done blew up people cars just show you how money worked in fame. Anybody with common sense with half a brain knows he blew up Kid Cudi's car. He ran around with pistols. I totally believe the story that Capricorn Clark told because not only did I Know what she said. But I know family member, a family member who told me the stories before the trial of what happened to Capricorn Clark. And it was a lot of back and forth between. There were a lot of gang because Capricorn Clark had a lot of gang cousins. Like cousins and family member who were in gang. And they pressed Diddy. That's why Diddy end up paying Capricorn Clark out that money after he put hands on her and did all that kidnapping. So I, I strongly, from the information I have, I strongly believe Capricorn Clark, all of this wild. And he get a measly four years. And now he's looking at a 50%, basically. 50, 50. If you listen to the experts or the narrative that's being projected, we are looking at a 50, 50 chance on Diddy either getting denied or getting some type of sentence reduction or something to do with re sentencing. Now they are saying it's only about a 10 chance that he gets the whole thing. Re. Re gets the whole thing overturned. But to even sit up here and look at the fact that Diddy, after all of this has a 50 chance, only a 50 chance to be denied when normally it's 80 to 90%. Is ridiculous. What say y'? All? And let me put the. And also y', all, I'm, I'm gonna announce whatever, whatever donations come in, I will announce those at the end of the show to let y' all know if we will be back here on Monday. I'm gonna put the link for the Buy me a coffee one more time in the chat. Times is hard. But hey, look, we're gonna do what we got to do to keep this, keep this live show going. Now when I say the live show, I want to be confused. The podcast is going strong. The audio version. So that has nothing to do with the audio version. Right now we are trying to save the live version. So I just want to be clear on that. So people don't. The podcast, the audio version is going strong. I got good, good amount of subscribers. And like I said, the audio version is very supported. And I appreciate everybody on Apple and Spotify. I will, I will definitely. I appreciate all my Apple and Spotify people responding to a community member right now. I appreciate all my Apple, Spotify and all my other platforms who for support. And so I just don't, I just don't want nobody to get confused to think that we're talking about the actual audio podcast on Apple and Spotify. Y' all are have nothing to do with this. This is Only concerning the live me, the live that I do at 8:30 Monday through Friday. I didn't want to get it all into it, but it's about a two to three hour commitment daily. And I do want to make sure I'm using my time wisely so that I can continue to grow and continue to grow into my content creating and my podcasts and everything like that. So I set a, a minimum goal, 250 a week, which is not a lot. Y', all, y' all got, hey, look anybody out there that's working a job or just working period, know the work that I put in and amount that I sacrifice to be here daily at 8:30, 250 is very minimum. So I definitely like, I understand the economy so I'm not trying to gouge anybody. But also like I said, I got bills to pay, I got miles to feed, I got all type of to do. So I can't, I have to be mindful of my time and what I'm spending it doing versus what it is, what amount of food is able to put on the table. But back to this Diddy stuff. So. Oh shoot. I didn't even. And let me, let me put the, let me put the chat the, the Buy me a coffee up here. So this is the link. If you want to keep going, if you want to keep this, the live show going, please donate to the Buy me a coffee link. Even if you're not watching this live, you can still donate to the show and keep this thing going. I love it and I'm sure many shout out to Tinko. Enoch, let me do a quick world call. What's up lady? Lazy Baby. Lazy Baby says she appreciate. We appreciate you for. I appreciate y' all too. I look forward to the mornings. Puff puff past. Elise. What's going on, Elise? What's going on, Elise? I don't know why my, my comment section is getting stuck. My comment section is getting stuck. It's maybe so many comments coming in right now, but yeah, so let's continue. Man. So they are doing this. Diddy. Let's, let's, let's go over what some people are saying. Got a couple people coming through just to let y' all know. A couple people coming through with the donations. A couple people coming through with the donations. Definitely. I appreciate it, but we, we about to get C. Tuck. He just text me. I didn't see Tuck in the, in the chat. Well, good morning, Michelle. I didn't see C. Tuck in the chat. Let me see Tuck. Where you at? Let Me put the thing out here, Put the link in there. We got to get ctech thoughts on this whole diddy thing. Put a 1 in the chat if you want. Want to hear what C. Tuck gotta say on this. On this Diddy appeal, the narrative being created, whether he think it has any merit, and just. The whole thing, y', all, like, we got to see what C. Tuck got to say. I just put the. I just put the link in there for C Tech to get on here. But I gotta figure out something, y'. All. I gotta figure out how to use this. My, how I can use my. I don't know why my microphone won't allow me to use the microphone with seats. Oh. Oh, y', all, never mind. See, tucking. Can't get on. Okay, I just, I, I just saw a text from him, so I didn't know if he was texting me to get on because I couldn't read it. But I ain't see him in the chat, but he on the road, y'. All. Let's, let's, let's say pray for C. Tuck to have a safe trip back back to the land. Everybody shout out, see Tuck. He's on the road. Let me go back and put the, the link in there. So, yeah, we, we see you. See, Tuck, I thought you were texting me because you couldn't get on, but everybody, let's pray that C. Tuck has a safe, a safe trip back and hopefully you enjoy this trip. It's been a. It's been a wild week, y'. All. What a what a week. I don't know about y', all, but this is one of those weeks where I'm, I, I. Now I understand the saying. Thank God it's Friday. I needed this Friday. You know, sometimes you work hard during the week and you just look up and say, thank God it's the damn weekend I can chill, relax, and get my mind right. Monica, what's going on? I see you. Tracy says, be safe. Safe travel. See Tuck. Michelle says, safe travels. Safe travels. Safe travels. Let's see who else we got in there. C. Tech said thank you to everybody impression. We'll still do the we hope C Tech make it home. We don't. We don't. We, we don't wanna, we don't want to have be trying to figure out what happened to C Tech on the road. Keep your eyes on the road. See, Tuck, you texting. And. Let's see. Traveling. Grace Lazy Baby says gas prices. Oh, yeah. Thank you for bringing that up, Tracy. Gas prices. She says they have went down in. In North Carolina by what, two cents? I don't know. I don't know if it's down in Cleveland. Yeah, we got to keep up with them damn gas prices. Y' all definitely got to keep up with the gas prices. Oh, something I just want to bring up. This is like a side note. This is like a little side quest, little personal podcast take that's really getting on my nerves. I don't know how many of y' all have been following. I don't know how many of y' all been following this Pooh Shiesty, Gucci Mane situation, but there's a bigger issue going on with this that I just want to speak on. So I don't know if y' all. Kush II is a rapper who was signed by Gucci Mane. I'm sure a lot of y' all at least have heard of Gucci man. If you haven't heard of Pooh Shiesty. But Gucci man signed Pooh Shiesty, took him off the streets, bottom cars, all type of stuff. Just show them love. From what I know, I'm not in the inner circle, so I don't know everything that went on. But long story short, Gucci Mane had Pooh Shiesty under contract, which all label owners. This is what they do. And. Recently, Pooh Shiesty was in. Is was indicted and push ic's father and his people in his crew were all indicted for kidnapping and putting a gun to Gucci Man's head and forcing him to sign a release to let Pooh Shiesty out of his contract. And they got hella, hella evidence. Some people saying they got video recordings, some saying they don't, but they got hella evidence. They got hella evidence. Even Gucci Man's cameraman was beat up and choked unconscious during this whole thing. So Gucci Mane, they are saying. Gucci man, they are saying that Gucci man, quote, unquote, snitched or he gave a statement and identified Pooh Shiesty and the crew and, you know, told them what happened to him. First of all, when you got. When you get your jury took and all type of stuff for insurance purposes, if you want to get your insurance money back and get your money back for your jury that you were robbed of, you need. You have to make a statement anyway. But second of all, do y' all know that some on the Internet and including Bootsy, I'm gonna have to just call him out by name. I. Some like. I like Bootsy as far as Entertainment wise, I think he's funny. I think he has some good quality about him. But this street that he talks amongst other things. Do you know people have a problem and acting like Gucci man is wrong for identifying the. Who put guns to his head and robbed him over a business transaction. This is not the streets. I am sick of that narrative, man. What Gucci is supposed to. Now if Gucci kill him, then we'd be all mad at Gucci and his family be crying and they'd be having T shirts with Pooh Shiesty on it. But Gucci does the right. He's not in the streets. He's damn near what, 50 years old. what point does that street mentality is. At what point are we done with that? That is the most ignorant I've heard in a long time. And I've heard some ignorant. We've been covering a Diddy case, so I've been hearing ignorant left and right. But you mean to tell me you got who are mad or acting like Gucci is wrong for making a statement. Like. So he's supposed to. Gucci Mane is supposed to get robbed at gunpoint, kidnapped, locked in a studio to sign this release. And because he's supposed to honor some up street code that I don't even know what this has to do with regular business, but he's supposed to just sit back and let that happen. So then what is supposed to do? Not make a statement and then go back and set up Pooh shy scene, put a gun in his head and make him sign back onto the label. And then this thing just keeps going back and forth. Grow up, man. Starting to not even like rap no more. And I'm really sounding like an old man. And, and. And not just the art form of rap, but these. It's some of this rapper street mentality. It gotta go, man. Gucci man made it out the streets, served his time, got his life on in order. Mary handling real business. And he gotta sit back and. And get robbed and. And guns pointed his head. And then because he is questioned and identified who did it to him. You got people like Lil Boosie and other people in the. In, in online talking about they mad at Gu. We gotta. We gotta start calling that out, y'. All. We gotta start like saying, like, shut up, Boosie. What the f. What is wrong with y'? All? So somebody put a gun in my head, make me sign some stuff, take my jewelry, take my money, and then y' all ain't mad at him or them. Y' all mad at Me because I say what they that that they just did this to me. But y' all not mad at the people who putting guns to people head and kidnapping them and and and and and and and and robbing them. They work Gucci worked hard and got his jewelry legally. You illegally rob them at gunpoint take it from them. But you got some that's more mad at Gucci and not even thinking about the people who did this. I just had to speak on that y' all because it's, it's some toxic. This is horrible. I don't even like it frustrates me even watching this when people saying it like are you that what? Grow up. And we've got young 20, 19, 18, 17, 16 year olds looking up at us and people my age and older like Boosie and all these other people are saying this. Excuse me for saying retarded, no shout out to mentally whatever. I didn't mean to even say it like that but I'm. It just pisses me off. Grow up. Do y' all know how stupid that sound? So now without further ado, I got, I got some news for y'. All. Thanks to the support squad. Thanks to Island Girl Michelle. Lazy Baby Stephanie. Color me Kareem Black Roses. Elise Tracy, Creepy little Beach Barbie Shawna. And I'm gonna say the best for last. The the the the the the the one that came through Allison. Thanks to all the support squad. We hit our goal. So the first week of making this thing make sense, I'm proud to say that the flow. And we hit our goal, we'd be back here see Tuck, hopefully see Tuck make it for the road. We'll be back here Monday live 8:30am but let's, let's give a special I'm give everybody who donated today their flowers and their shout outs. So first before I get to the last but not least one of the biggest supporters of this show, I'm gonna give her her flowers last. But today y' all can thank Island Girl Island 23. She donated $25 to keep this thing going. Keep the lights on. Everybody shout out Island Girl in the comments for the 25 donation. Next. Michelle Renice. I'm sorry if I. Michelle, you know who you are. Michelle. Michelle. Thank you for the ten dollar donation today. Lazy Baby. Thank you for the ten dollar donation today. All of y' all contributed to getting us to this goal. I'm happy. I'm looking forward to Monday. I love I told y' all I, I want to build the live stream revenue up because I want to go live two hours a day. I want to do, I want to take time away from my content creating and creating videos for social media. I would love to just stay on live and we all want a two hour show. So I am going to making a point to build the revenue up on this live so I can be on live more. I got C. Tuck, one of the, the best co hosts I could ever ask for who is down and committed. Love doing the show with him. It actually helps take a little load off of me to have another perspective and another person talking. So I'm looking forward to building this thing. And I told you I put a lot of accountability on me because a lot of the YouTubers and a lot of they actually do continuously stressed the, the importance of the donations and the shout outs. I am just so much about the stories. I don't do that enough. But as you can see, this week went the way we needed it to go. And I'm grateful and I'm sure everybody who wakes up in the morning knowing that we got a place that we can come to and talk, we want to keep that going and not only keep it going, but we want to make it more. That's. I don't want to do an hour. Only reason I'll do an hour because that hour takes me two or three hours between prepping and uploading it and all that. And so the more I can't, I can't afford to do two hours right now. I have to do my other content and my other coaching and all of that. But if we can build this thing up, y', all, like I said this, I would love for this to be a two hour show. Two and a half hours. I see Nightcap goes two and a half hours. So I, I want to build it up to like Shannon Sharp and Ocho's show. They do two to two and a half hours on that show every day or whenever they come on. I want to be like that. So with the help of y' all and we're going to slowly build this thing up, tell your friends about it, get your friends and family members involved, whatever, we gonna build this thing up so we can get on this thing and talk for two and a hours, maybe three hours. I don't give a damn. I like doing it and I love the community that I built. Like it's a great community. But I say all that to say, Let me give a special special shout out. Oh, let me see Grandma Kathy. I mean, I want to see. I see Grandma Kathy said thank you Grandma Kathy says, thank God. I was about to get a new credit card. Hey, but. Hey, we. Hey, Grandma Kathy, we. We get that car for next week. We gonna. We gonna keep it going. But Michelle says she loved his community. Lazy baby says all the donors are amazing. I agree. Enoch said Flowing fam is best. But let me get this special. Let me give a special one. We was 90 short at the beginning of the show, and halfway through the check the show, I checked my. My Apple, my Apple Pay. And I want everybody to give a special special shout out to. To our. Our girl Allison from Philly, because Allison came in with $90 herself. And Allison, I don't know if. I don't. I don't never. I don't see her much in the comments, but she does send the apple pays. Allison is always a big supporter. $90, she said. Tally it, Flow, she says, good morning, Flow. And family, I've always been around. I love you guys. And this is Allison from Philly. She said I can't donate to the link, so I sent it to Apple Pay. And everybody, Allison. Give Allison her flowers and let her know that we appreciate it and just flood the comments with everybody. Let everybody know how much we love and appreciate this community. Like I said, I. I was hoping, just like everybody else was hoping. I want to meet our goal because I wanna. I wanna continue popping in on live when we end the show on Friday. I'm already looking forward to Monday's 8:30am show. So I am happy that y' all came through. Shout out to everybody. And like I said, some. Some weeks, somebody gonna have to pick up the slack. Some weeks, some people might not have it. Some weeks, others have it. Whatever we got to do. This is why we're a community. We're gonna come together and who got it. Whoever got it, we gonna give it. And if you don't got it, don't worry. We just. We're gonna pick each other up and do what we got to do to keep this thing going. So they said, salute, Allison. Tracy said, yes, girl. Allison. Michelle said yes, Allison. Gerald says, salute Allison. Tinko, you good? Huh? Hold on. What's going on with Tinker? What's wrong, Tinkle? Music is killing me. Like. Oh, she. I think she don't like. I don't think she likes what's going on in the music business. Grandma Cassie says, allison, thank you. Yeah, I think she. I think Tracy confused what you were saying, Tinker. But look, everybody, it's a celebration. We made our first week go. As a matter of fact, I think we actually did. We actually surpassed our goal. And if I'm looking at this correctly, we did 300. Our goal was 250. We did 300. We continue to do that. Like I said, we're gonna. We're gonna extend this show. We. If we get a cons, we get to get the revenue up. We're gonna definitely extend this show and make it longer. But anyway, we gotta celebrate, y'. All. We. We started off Monday with a goal, and as a community, we hit our goal Friday. And I think I set the goal at a. At a fair amount for you guys and me at the same time trying to keep it. I. I actually think I put it at the right amount because, like I said, I didn't want to. Can't have it. You know, I didn't want to have it too high where it's stressing people, and I didn't want to have it too low where it don't make sense for me. I think I put it at the right amount. I think that's a good amount. Anyway, so let's celebrate, get y' all behinds up. It's Friday. We about to put on our favorite theme song and dance our way up out of here. I will see y' all Monday at 8:30am thanks to the Flow support squad. Let me turn this damn mic also. Here we go. Swan.
